Invitation to Submit Technical Information for Evaluation
The 409th Contracting Support Brigade (CSB), Theater Contracting Center (TCC), Kaiserslautern, Germany is interested in establishing a Multiple Award BPA IAW FAR 13.303 for self-compacting, solar powered solid waste bins, which will be used as a pest control measure to reduce vermin and potential aircraft bird strikes for strategic use at strategic locations throughout the European Theater. This BPA is NOT a binding contract it is just an agreement between the U.S. Government and vendors to provide supplies at a fair and reasonable price. This agreement may be terminated by either party with a 30-day notification. For Multiple Award BPAs, the total agreement shall not exceed 60 months/5 years. The proposed BPA ordering period shall be as follows:
Ordering Period I: From date of BPA issuance through 365 days thereafter Ordering Period II: From the end of Ordering Period I through 365 days thereafter Ordering Period III: From the end of Ordering Period II through 365 days thereafter Ordering Period IV: From the end of Ordering Period III through 365 days thereafter Ordering Period V: From the end of Ordering Period IV through 365 days thereafter
Instructions to Industry
1. The Government intends to enter into multiple agreements based on the result of this invitation. Vendors who are interested in entering into an agreement under this BPA are asked to review the information contained in this invitation to ensure each interested vendor is given fair consideration for an agreement.
2. Multiple Vendors: If the Government receives interest from more than one vendor then pricing will not be required or evaluated at the time the agreement is established. The Government will place each order over $10K using fair opportunity procedures to provide for maximum competition amongst each BPA agreement holder using a lowest price technically acceptable basis for award. Vendors shall provide technical information that will be used to evaluate if the vendors offered Self-compacting / Solar Powered Solid Waste Bins and licenses will meet the minimum technical requirements as described in attachment 3 “Salient Characteristics”. An agreement will be established with each vendor whose information demonstrates that it can meet the Government’s minimum requirement.
3. Pricing: Price will not be evaluated at the time the agreement is established but will be evaluated when each call is placed by providing fair opportunity for each agreement holder to submit a quote using Attachment 2. All vendors are encouraged to provide their best competitive pricing as each call order will be evaluated on a lowest price technically acceptable basis.
4. Single Vendor: If the Government only receives interest from a single vendor, then the Government reserves the right to communicate directly with that vendor and ask that they submit pricing using Attachment 2. The pricing will be evaluated to determine reasonableness with fair markets prices and if determined reasonable will be the established prices for a period of 12 months. The established pricing will be a “not to exceed” amount and each caller will be encouraged to ask for discounts. Pricing will be reevaluated on an annual basis to allow the vendor and opportunity to revise pricing based on market conditions that will be established for the subsequent 12 months.
5. Obsolescence: Agreement holders shall notify the Government of model changes that result in obsolescence of
Self-compacting / Solar Powered Solid Waste Bins and licenses during the period the agreement is active. The agreement holder shall provide the technical information to the Government for evaluation to ensure the replacement model meets the minimum salient characteristics. If the model is evaluated to meet the minimum salient characteristics the agreement will be modified to reflect the new model. If the replacement model does not meet the salient characteristics, then the agreement may be canceled by the Government.
6. Annual Evaluation: The BPA, and all agreements entered in to shall be evaluated on an annual (12 months) basis.
Each agreement holder should provide updated technical information for evaluation to ensure that any obsolete models are removed, and new models of Self-compacting / Solar Powered Solid Waste Bins and licenses can be evaluated by the technical evaluator.
7. On Ramp/Off Ramp: The Government reserves the right to enter into agreements with additional vendors at any point during the period of performance of this BPA. The Government also reserves the right to cancel agreements with an agreement holder if the vendor is determined to have poor performance in meeting the Government’s requirement.
8. Technical information shall be submitted no later than 1600 hours (4:00 PM Central European Time) on 21
August 2023. Offerors shall submit any questions via email to Ms. Deserae D. Long, Contracting Specialist, deserae.d.long.civ@army.mil, and Mr. Cory L. Moore, Contracting Officer, cory.l.moore7.civ@army.mil, no later than 3 days prior to the solicitation close date. Questions shall annotate a reference to the specific solicitation element to which they pertain.
9. Contract Clauses and Provisions: All vendors are required to submit with their technical information the following filled in clauses and provisions:
a. Offerors shall complete FAR 52.212-3, Offeror Representations and if the offeror has not completed the annual representations certifications electronically in SAM.
b. FAR 52.204-24, Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment

h. DFARS 252.229-7001, or Alt. I, Tax Relief. This is based on the place of manufacture for the supply so please read the clauses and fill in the appropriate version.

ATTACHMENT NO. 1 – TERMS AND CONDITIONS
1. Description of Agreement: This agreement is offered for the purchase of Self-compacting / Solar powered
Solid Waste Bins provided in the approved delivery schedule located within this BPA, when and called for by the Contracting Officer (KO) or designated representative, during the specified BPA ordering period.
The Government has the right to add additional BPA holders for this requirement.
This agreement may be cancelled or modified in its entirety by either party upon thirty (30) days written notice to the other party. No deletion, modification, addition to, or cancellation of this agreement shall affect any contracts entered between the parties in which this agreement or portion of has been incorporated by reference.
This agreement shall be reviewed, at a minimum, annually before the anniversary of its effective date, and revised to conform to all requirements of the Federal Acquisition Regulation (FAR). This revision shall be evidenced by an agreement modifying this BPA or by issuance of a superseding BPA.
All calls are subject to the Terms and Conditions of this BPA. No work shall be performed, and no payment will be made except as authorized by a call. The BPA holder shall not proceed with any work pursuant to this section until a written call is issued by the appropriate KO.
2. Extent of Obligation: The Government is obligated only to the extent of authorized purchases made under the BPA.
3. Purchase Limitation: No individual purchase order shall exceed the equivalent of $100,000.00
4. Individuals Authorized to Purchase under the BPA: Authorized callers, or callers who are authorized GPC holders.
5. Invoicing: All invoices shall be submitted through wide are workflow (WAWF) IAW with DFARs Clause
252.232-7006 which will be specified in each call order.
6. Delivery Tickets: Each delivery of Self-compacting / Solar Powered Solid Waste Bins and licenses shall be accompanied by a delivery ticket that includes the following information:
(i) Name of supplier
(ii) BPA number
(iii) Date of purchase
(iv) Purchase number
(v) Itemized list of supplies or services furnished
(vi) Quantity, unit price, and extension of each item, less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information).
(vii) Date of delivery or shipment.
7. Effective Period: The total agreement shall not exceed 60 months/5 years. From date of BPA issuance through 60 months / 5 years.
8. Final Inspection and Acceptance: Final inspection and acceptance of services delivered under this agreement shall be at the specified destination of delivery.
9. Ordering Instructions: The U.S. Government reserves the right to compete the call amongst all BPA holders to obtain the most competitive price. Accordingly, Firm Fixed Price (FFP) calls will be placed throughout the ordering period on a competitive basis for orders over $10K.
A request for quote (RFQ) indicating the quantity of Self-compacting / Solar Powered Solid Waste Bins and licenses using attachment 2 will be sent to the agreement holder. The agreement holder shall fill in the unit and total price and submit it as their quote to the Government prior to the closing date of the RFQ for evaluation on a LPTA basis for award. Once an awarded has been determined the Government will issues a purchase order.

Notes on pricing:
• The prices submitted must be free of any Country Value Added Tax (VAT) or any other Taxes and Duties that the Government of the United States and the government of any country in which services are provided have agreed shall not be applicable to expenditures in such country by or on behalf of the United States.
• Prices may be submitted in either US Dollars or EURO. If quotes are received in both USD and EURO the EURO quotes will be converted to USD IAW 52.225-17.
ATTACHMENT NO. 3 SALIENT CHARACTERISTICS
for
SOLAR-POWERED SELF-COMPACTING BINS PURCHASE REQUEST
IMCOM Europe G4-Environmental is seeking to purchase Solar-Powered/Self- Compacting Solid Waste Bins for use at strategic locations throughout the European Theater for use as a pest control measure to reduce vermin and potential for aircraft bird strikes.
Minimum Requirements:
(Delivery location to be determined when a call order is placed) Purchase shall include either delivery to a central location in Europe or delivery to multiple military base locations throughout Europe. Requiring Activity shall be responsible for each unit’s placement at strategic locations throughout the community and removal of conventional trash bins.
Delivery of “ready for service” units shall occur within 90 days of order placement and have minimal operational set up requirements with no additional initial set up charges. Upon delivery, each unit shall be equipped with the following items:
• SIM cards and any necessary software to be operational ready for use upon placement and start up.
• Two-year warranty from date of delivery
• Weatherproof bin chassis constructed of stainless steel or other highly durable material with drainage seep holes.
• Include SIM cards and necessary software licensing fees for initial two years (Annual licensing fees to be paid outside purchase contract after initial 2 years)
• Ability to receive bin fill level status via email addresses ending in “.mil” and via text messages to cell phones in country of use to include Romania, Bulgaria, Germany, Italy, The Netherlands, and Belgium etc.). Bins shall not require connection to Government LAN computer.
• Equipped with removable standard 120-Liter plastic bins that require no special disposable bags.
• Solar powered compactors (efficiency rating>14%) capable of compacting waste greater than 5X original volume
• Foot pedal bin flap opening activation and soft close bin flap sealing after each use.
• Waterproof domed topped bins to keep solar panels clean and reduce snow buildup and prevent precipitation from entering interior of bin.
• Offer choice of bin color with placement of optional DPW logo on bins (JPEG file to be provided)
• Permanent mounting plate and hardware
• Battery with a 7-year average life span
• Self-draining chassis should water enter.
• Internal or external ashtrays with mounting hardware and any necessary tools to install.
• Non-pinch soft close flap of adequate size to accept typical community generated trash.
• Include one-time brief training session on unit technical and software operation.
• Offer on-going technical support and parts for purchase, if needed
• Maintenance (if needed) shall be readily available within 14 days of request.
• Include 20 bags per bin capable of withstanding load (6 mil or thicker)
• Base contract shall include purchase and delivery of solar bins.
• Quoted costs shall include licensing fee per unit. No routine maintenance or servicing is required after purchase.
• Supplier shall assist with initial activation of each bin.
