(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

(ii) The solicitation number BEP-RFQ-16-0824 is and is issued as a Request for Quotation

(RFQ).

(iii) This solicitation document incorporates provisions and clauses in effect through most current Federal Acquisition Circular FAC 2005-88-1 effective 15 June 2016.

(iv) The associated North American Industrial Classification System (NAICS) code for this procurement is 334514. This requirement is 100% Total Small Business.

(v) This solicitation lists the following contract line item numbers, items, and quantities:

(vii) Period of Performance: Ft. Worth, TX (WCF): The period of performance is a base period of twelve months plus four (4) 12-month option years for service and maintenance. The anticipated award period is 24 August 2016 – 23 August 2021. Contractor shall deliver all equipment within 90 days of contract award.

Washington, DC (DCF): Contractor shall deliver one (1) unit within 90 days of contract award.

If any item is deemed insufficient or damaged, the Contracting Officer Representative (COR) will notify the contractor.

(viii) Provision at FAR 52.212-1, Instructions to Offerors-Commercial (OCT 2015), applies to this acquisition

Offeror’s response must clearly indicate the capability to meet all specifications and requirements. Offeror shall not simply rephrase or restate the Government's requirements, but shall provide its rationale explaining how the Offeror’s approach will meet this RFQ requirement. Responses that do not meet the specifications and requirements specified in this RFQ will be determined non-responsive and will not be evaluated further.

Volume I: Price – Offerors shall submit pricing for all contract line items (including options) identified in Section v above.

Volume II: Technical – Offerors shall provide technical description of the items being proposed. Description shall include full specifications and capabilities of the product proposed.

Equipment specifications must address all required specifications in the SOW. Offerors shall also provide warranty information for all equipment.

Volume III: Corporate Experience (no page limitations): Offerors shall identify at least three

(3) Federal, State, Local, or Foreign contracts that demonstrate recent and relevant experience.

Recent is defined as within the last three (3) years. Relevant is defined as work similar in size, scope, and complexity to the work identified in the SOW. Offerors shall provide the following information:

Project Title Description of the Project Contract Number Contract Amount Point of Contact’s name, address, phone number and email address Contracting Officer’s name, address, telephone number and email address Current status, e.g. completed and/or in progress, start and estimated completion dates A brief narrative of why your firm believes this reference is relevant to the proposed tasks BEP may contact those references during the evaluation process to verify relevant experience and the level of performance. The BEP may, at its discretion, may obtain and evaluate information from sources other than those provided by the Offeror.

(ix) FAR 52.212-2, Evaluation—Commercial Items (OCT 2014)

(a) The Government will award one contract resulting from this solicitation to the responsible offeror(s) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Volume I: Price - The Government will evaluate price to determine fair and reasonableness.

The Government will evaluate offers for award purposes by adding the total price for proposed contract line items.

Volume II: Technical – The Government will evaluate technical for acceptability. Proposed equipment must meet or exceed the specifications stated in the statement of work.

Volume III: Corporate Experience –The Government will assess the Offeror’s capability to perform under this contract by evaluating the Offeror’s experience on previous same or similar contracts. BEP may contact those references during the evaluation process to verify recent and relevant experience and the level of performance. The BEP may, at its discretion, obtain and evaluate information from sources other than those provided by the Offeror.

The lack of Offeror’s Corporate Experience similar in scope, size, and complexity will deem the proposal unacceptable

Basis for Award: Lowest Price Technically Acceptable

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. Should any reference to such equipment or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government shall consider institution of all remedies available under applicable law, including 31 U.S.C. 333, and this contract.
