SECTION C

STATEMENT OF WORK

TO

BATHROOM FLOOR DRAIN REPLACEMENTS

AT

NATIONAL EAGLE AND WILDLIFE PROPERTY REPOSITORY

I. GENERAL CONDITIONS

A. Work includes removing and replacing the two floor drains in the men’s and women’s bathrooms on the north end of the National Eagle and Wildlife Property Repository (NEWPR) located in Rocky Mountain Arsenal NWR, Commerce City, CO.

B. The work shall include disposal of all materials removed under this contract.

C. The Contractor shall have all certificates and licenses required by law for the execution of the work, and shall comply with all Federal, State, and local laws, ordinances, rules, regulations, and codes relating to performance of the work.

D. The building is considered a nonsmoking building. Smoking is not permitted within 25 feet of entrances, windows, or air intakes.

E. Safety

1. The Contractor shall assume full responsibility and liability for compliance with all applicable Federal, State, and local regulations pertaining to the protection of workers, visitors to the site, and persons occupying areas adjacent to the site, including the provisions of 29CFR1910 and 29CFR1926 of the Code of Federal Regulations. The Contractor shall hold harmless the Government for failure to comply with any applicable safety or health regulations on the part the Contractor, the contractor’s employees, and all subcontractors.

2. Every Contractor employee shall be responsible for complying with applicable safety requirements, wearing prescribed safety equipment, and preventing avoidable accidents and property damage.

3. The Contractor shall provide and maintain a basic first aid kit for use of the workers.

The kit shall contain first aid supplies in type and quantity commensurate with type and size of project and the work force, with items necessary for first aid treatment of all injuries. The Contractor shall advise all workers of the location of first aid supplies.

4. The Contractor shall post the telephone numbers of nearest hospital, ambulance service, and fire station in a conspicuous location. The Contractor shall advise all workers of the location of telephone numbers. Communication devices shall be made available and be ready at the work site to alert others in case of emergencies.

5. The Contractor shall provide at least one nonfreezing type fire extinguisher in each field office, workshop, work site, and storage shed at the work site.

These fire extinguishers shall be placed in locations readily accessible by workers.

II. WORK SITE CONDITIONS

A. The site of the work is on the Rocky Mountain Arsenal National Wildlife Refuge, in Commerce City, Colorado. The NEWPR building’s address is 6550 Gateway Road, Bldg. 128 Commerce City, CO 80022.

B. Prospective bidders are urged to visit the site, become familiar with existing conditions, and ascertain the conditions which affect the work. Failure of the successful bidder to visit the site prior to submitting a bid or proposal on this work will not relieve the successful bidder from completing the project at the bid price.

Prospective bidders must make site inspection arrangements with the Station Contact identified in this contract.

C. Existing Conditions

1. The existing floor drains have been calcified shut with buildup from years of use.

The women’s bathroom is completely shut and cannot be used or scoped. The men’s bathroom floor drain is barely functioning and needs to be replaced.

2. See the attached Eagle Repository Building As-Builts for additional details on the existing conditions. See Sheets P1 through P4 (PDF sheets 15-18) for the plumbing sheets. Sheet P3, Details Partial Pluming Floor Plan and Riser Diagram show a detailed layout of the plumbing in the bathrooms. Sheet P4, Trap Primer Detail shows the trap primer layout.

3. The floor drain is under an approximately 5” concrete slab reinforced with 6x6 – W2.1xW2.1 Welded Wire Fabric with tile flooring.

4. Tile Flooring is 2”x2” dark gray speckled ceramic or porcelain tile with dark gray grout. The wall tile is a 4”x4” light gray ceramic or porcelain tile with an accent row of dark blue at the top of the tile section. See attachment photos for visuals.

5. The existing floor drains are Zurn FD2290-P floor drain with trap primer connection, 2” cast iron lines connecting to 4” cast iron lines. Approximate length is 4’.

6. The trap primer is a 1/2” copper line.

A. Protection Environmental

1. Pollution Control

a. The Contractor shall abate and control all environmental pollution arising from construction activities by complying with all applicable Federal, State, and local laws and regulations concerning environmental pollution control and abatement, as well as the specified requirements in this contract. The Station Contact, or their designee, will inspect the site regularly for compliance.

b. Compliance with this requirement by any and all subcontractors shall be the responsibility of the Contractor.

1. Prevention of Water Pollution

a. During construction the Contractor shall comply with all applicable Federal, State, and local laws and regulations concerning the control and abatement of water pollution.

b. The Contractor's construction activities shall be performed by methods that will prevent entrance or accidental spillage of solid and/or liquid matter, contaminants, debris, and other objectionable pollutants and wastes into streams, flowing or dry watercourses, lakes, ponds, and underground water sources. Such pollutants and wastes include, but are not limited to, refuse, garbage, cement, concrete, sanitary waste, industrial waste, radioactive substances, oil and other petroleum products, aggregate processing tailings, mineral salts, and thermal pollution.

c. At the completion of construction, the Contractor shall remove and dispose of all pollutants, wastes, and objectionable material at a site located off the Government property.

d. The Contractor is responsible for the proper disposal of such materials in accordance with applicable local, State, and Federal regulations.

2. Abatement of air pollution

a. The Contractor shall comply with applicable Federal, State, and local laws and regulations concerning the prevention and control of air pollution.

b. Construction activities shall be performed in such a manner that air pollution is held to a minimum.

c. Burning of materials, trees and brush, combustible construction materials, and rubbish will not be permitted.

d. Construction debris shall be removed to an approved landfill.

3. Solid Waste

a. The Contractor shall dispose all waste in an EPA approved landfill.

b. The Contractor shall remove any dust, dirt, and debris caused during the construction process.

4. Noise Pollution

a. The Contractor shall comply with all applicable Federal, State, and local laws, temporary use permit, orders, and regulations concerning the prevention, control, and abatement of excessive noise.

5. Environmental Litigation

a. Time lost due to work stoppage because of failure of the Contractor to comply with these requirements may not be the subject of a claim for extension of time or for costs or damages.

6. Fossils and Cultural Materials:

a. Should the Contractor discover any fossils or cultural materials during construction operations, such objects shall become the property of the Government. The Contractor shall cease construction operations in the area of the "find," and immediately notify the Station Contact and CO of such discovery. Construction operations may proceed in other areas not affected by this clause as approved by the CO. Do not excavate, remove, damage, alter, or deface archeological or paleontological remains or specimens. Control the actions of employees and subcontractors on the project to ensure that protected sites are not disturbed or damaged.

b. Failure to comply with this requirement may be considered a violation of the Archeological Resources Protection Act of 1979 as amended. Destruction of historic and prehistoric sites and/or unauthorized collection of cultural materials can result in criminal and/or civil penalties. Penalties can include fines, prison sentences, and/or confiscation of equipment.

III. TEMPORARY FACILITIES AND CONTROLS

A. Temporary Utilities

1. Electric power is available at the job site.

2. Although a Government telephone is available in the NEWPR Building for

23-023: BATHROOM FLOOR DRAIN REPLACEMENTS Page 5 of 43 emergency use only, the Contractor and their personnel are strongly encouraged to use their cellular telephones exclusively.

3. Sanitary Facilities: The Contractor may use toilet facilities at the NEWPR Building during open hours. Use of Government toilet facilities will NOT be permitted after hours.

4. The Contractor shall supply potable water for their crew. Non-potable water is available at the NEWPR Building during open hours.

5. The Contractor shall be responsible for the daily removal and disposal of all debris from construction activities.

B. Site access and equipment storage areas

1. All Contractor operations (including storage of materials) upon Government premises shall be confined to areas authorized or approved by the CO, Station Contact, or their designee.

2. The Contractor shall restore all work and storage areas and areas disturbed by construction to their original condition, or as approved by the CO and the Station Contact, or their designee, upon completion of the work.

3. The Contractor shall observe all laws and regulations of the local, county, and State authorities in the use of all public roads and highways for the transportation of materials and equipment in connection with work on the project.

C. Protection and Restoration:

1. The Contractor shall protect all structures and vegetation during the progress of the work and remove all debris and unused materials from the site.

2. Upon completion of the work, the Contractor shall restore, at their expense, all vegetation to its original condition, including the replacement of any facility or landscaping which has been damaged.

D. Partial Occupancy: Government will occupy the premises during the entire construction period, with the exception of areas under construction. Cooperate with the Station Contact during construction operations to minimize conflicts and facilitate usage. Perform the Work so as not to interfere with Government operations. Maintain existing exits unless otherwise indicated. Provide not less than 48 hours' notice to Government of activities that will affect Government's operations.

IV. MEANS AND METHODS

A. Means and methods of construction shall be such as the Contractor or subcontractors may choose; subject, however, to the Contracting Officer's right to reject means and methods proposed which:

1. Constitute a hazard to the work, persons, or property.

2. Will not produce finished work according to the terms of the contract.

3. Are contrary to specified means or methods included in the contract.

B. The right to reject means and methods of the Contractor or subcontractor shall not be construed or interpreted as acceptance of control of means and methods by the Contracting Officer.

C. The Contracting Officer's approval of means and methods or failure to exercise right to reject means and methods shall not relieve the Contractor of the obligation to complete the work required by the contract.

D. Total responsibility for control of all means and methods lies with the Contractor for all work.

E. Final Inspection

1. The Contractor shall request a final inspection in writing at least 5 days prior to the anticipated date of completion. If, as the anticipated date of completion approaches and it becomes apparent that the date will not be met, the contractor shall inform the Contracting Officer Representative within 3 days of the anticipated completion date.

2. Work will not be considered ready for final inspection until all the work has been completed and the Contractor has certified that all items are properly operating and in strict compliance with all contract terms and conditions. Provide this certification to the CO.

3. The Contractor and/or their project supervisor shall be at the job site during the final inspection.

F. Final Cleanup: The Contractor shall clean the site and remove all construction debris from the site.

G. Final Payment: The Contractor shall submit the following prior to final payment:

evidence of completion, guarantees, warranties, certificates, and as-builts.

V. CONTRACTOR QUALIFICATIONS

A. The Contractor shall have all Federal, State, and local licenses, and/or certifications, etc., necessary to perform work in Adams County, Colorado. All licenses and/or certificates must be current from start to finish of the project.

VI. SUBMITTALS

A. The Contractor shall submit electronic submittals of all items listed in Section VIII to the Contracting Officer Representative for approval prior to start of work.

B. The Contractor shall provide copies of all required permits, if any, obtained to perform this work to the Contracting Officer Representative.

C. The Contractor shall submit manufacturer's warranties, guarantees, and certificates for all installed equipment to the Contracting Officer Representative.

D. Timing of Submittals/Unapproved Work: As specified above, the Contractor shall submit copies of all required permits and all product data sheets to the Contracting Officer Representative for review. These submittals must be approved prior to the installation of any purchased or fabricated components. The purchase and/or installation of any unapproved components shall be at the contractor’s risk. Contract performance time shall not be extended due to delays caused either directly or indirectly by the purchase and/or installation of unapproved components.

E. The Contractor shall submit a construction schedule prior to starting construction.

VII. PERFORMANCE

A. The NEWPR has access for employees and visitors. The Contractor shall plan all Construction activities so that employees’ work is not impeded, and the public is kept safe.

B. All materials and all related components shall be installed according to the manufacturer’s instructions.

C. The Contractor shall coordinate the construction start date with the Contracting Officer. The project shall be completed and available for use within 30 calendar days from the date the Notice to Proceed (NTP) is issued. Additional time will be allowed, if needed, to obtain long lead time materials. Construction will not be allowed on Saturdays, Sundays, or Federal Government holidays or observed holidays without prior permission of the Contracting Officer.

D. During the performance period of the Contract, the Contractor shall be available for conference calls with the Contracting Officer, the Contracting Officer’s Representative, the Station Contact and the Government On-Site Inspector, as needed, to discuss project progress and/or problems.

E. The Contractor shall obtain all permits and licenses, pay all fees and taxes, and give the

F. The Contractor shall be liable for damages to roads, utilities, structures, and property, due to any act, omission, neglect, or misconduct during the period of performance of the services of this contract.

G. Typical work hours are from 900 MT to 1500 MT. Hours of work are negotiable during the pre-construction meeting.

H. Progress Meetings: The project will have a weekly coordination call to ensure project communication open. The day and time will be selected during the pre-construction meeting.

I. In the event there is work being performed under a separate contract the Contractor shall cooperate fully with separate contractors so work on those contracts may be carried out smoothly, without interfering with or delaying work under this Contract or other contracts. Coordinate the Work of this Contract with work performed under separate contracts.

VIII. PROJECT REQUIREMENTS

A. The items covered by this specification are intended to represent a complete functioning drain system in both bathrooms. All measurements shall be confirmed by the Contractor prior to ordering materials. All materials shall be installed according to the manufacturer’s recommendations and applicable codes.

B. Dispose of debris, unsuitable material, and excess material. Recycle or dispose of material legally off the project.

C. Provide all materials needed to complete the work to a complete, finished, and functioning condition.

1. Removals

a. This work consists of removing the clogged 2” floor drains in the northern men’s and women’s bathrooms (two floor drains total). Remove approximately 4 feet of the clogged drain line up to the 4” cast iron main in each bathroom. Remove the length necessary to remove the clogs and join back into the existing 4” line.

b. Remove the minimal amount of tile and concrete floor necessary to complete the work.

c. Concrete removal in repair areas: Saw cut at least 2 inch deep along boundaries of repair areas. Do not damage concrete and tile designated to

d. Contain any debris within the immediate work area. When necessary, construct adequate debris shields to contain debris within the work areas.

e. If necessary, remove and reset the bathroom stall walls and door.

f. The Contractor shall dispose of legally offsite any dust, dirt, and debris generated during the construction process.

2. Installation

a. The contractor shall couple the new drain lines to the 4” main in a method that meets current IPC and local codes and removes the clogged portions of the drains.

b. Install new floor drain inlets in both bathrooms with drains of equivalent size and meets IPC codes. Reconnect the trap primer to the new floor drains.

c. Backfill and repour the concrete slabs. Compact the backfill material prior to repouring the concrete slabs. The new concrete slabs shall be at least 5” thick.

d. Replace the tile and grout with materials equivalent to the existing tile and grout. The new tile shall match the existing tile, as best as available on the open market. The new tile shall match the same size and material.

The tile shall, to the best available, match the color, pattern, and texture.

The current tile is similar to Daltile’s Desert Gray Speckle Keystone tile.

The new grout shall match the color and type of the existing grout. Seal the grout if recommended by the manufacture.

e. Install or replace all other materials needed to bring the work sites to a complete. Finished, and functioning condition.

f. Test the floor drain systems to ensure all systems are functioning properly.

D. Regulations: Comply with all Federal, State, and local laws, ordinances, rules, regulations, and codes relating to performance of the work, including the following:

1. International Building Code (IBC), most recent version

2. International Plumbing Code (IPC), most recent version

3. International and National Electrical Code, most recent version

5. Architectural Barriers Act

6. Federal, state, and local rules and regulations

7. Occupational Safety & Health Act (OSHA)

IX. PERIOD OF PERFORMANCE

A. The CO will issue a Notice to Proceed before commencement of any work. The period of performance is 30 days from the Notice to Proceed date.

X. WARRANTIES

A. The Contractor shall guarantee that all materials and labor installed are new and of first quality and that any material or labor found defective shall be replaced without cost to the Owner within one (1) year after substantial completion of the Contract.

The guarantee shall list the date of the beginning of the one (1) year period, which shall be the date that the Substantial Completion Certificate is issued.

B. Any damage to the building, caused by defective work or material of the Contractor within the above-mentioned period, shall be satisfactorily repaired without cost to the Owner within 30 days.

XI. CLOSEOUT PROCEDURES

A. The following items need to be submitted prior to the final payment:

1. Release of claims

2. Certified payrolls of Contractor and all subcontractors

3. Guarantees, warranties, and certificates

4. As-Builts

XII. PAYMENTS

A. Progress Payments can be submitted for major accomplishments. The payment shall be broken down to the most logical detail to ensure review is able to be completed.

The invoice shall have all design and construction accomplishments on the same invoice.

B. The process shall include an invoice to the COR and CO. The COR will review and the CO will approve the payment. Once approved, the payment may be submitted in IPP.gov.

C. Only monthly or less frequency are allowed for progress payments.

D. Retainage will not be implemented, unless the CO determines that progress and/or quality are not satisfactory.
