FOR
Replace Robinson House HVAC

I. GENERAL
A. DESCRIPTION OF WORK/SCOPE: The contractor shall furnish all personnel, equipment, tools, materials, supervision, and other items and services necessary to decommission, dispose of and replace two
(2) existing furnaces, two (2) condensing units, and (2) evaporator coils. All work required by the project documents shall be accomplished by the contractor even though minor items required may not be specifically mentioned. The system shall be designed to maintain temperature and relative humidity conditions within the building.
BACKGROUND
This project is located at the Henson Robinson House within Lincoln Home National Historic Site, Springfield Illinois. The project is to remove and replace two (2) outdated HVAC split system. The current units were installed in 2007 and have had numerous repairs; the expected life span is 10-15 years after installation. Replacing current units at the maximum end of the expected service life will reduce repair costs and provide for a more efficient operation and uninterrupted service. New HVAC units and components are to be installed in existing footprints.

OBJECTIVE/TASKS:
SITE VISIT: Site visit is highly recommended to ensure proper sizing and type of all equipment being replaced.
• Task 1: Evacuation of refrigerant (4-10A) from system will be done by the National Park Service prior to demolition. Remove Two (2) natural gas fired furnaces, two (2) condensing coils, two (2) evaporator coils, and two (2) line sets. These systems support the HVAC in the Dubois House. The existing humidifiers will remain and be used with the new systems. (See Attachment #2 for photos)
• Task 2: Install Two (2) new high efficiency natural gas fired furnaces, two (2) new condensing units, two (2) new evaporator coils, and two (2) line sets. Furnaces shall be 96% AFUE or higher. Condensing units shall have a minimum SEER of 20. Each system (furnace, condensing unit and coil) shall qualify as an Energy Star Environmental Protection Agencies (EPA Energy Star Program) rated system. Contractor shall verify the new system fits in the existing space/location and is responsible for any ductwork modification required to install the new system. Line set shall be installed in the same locations/penetrations as existing line set. Connect new furnaces to the existing flue and combustion air piping. The modification of a system with lower energy star rating with supplementary and/or ancillary
140P6221Q0022 Attachment 3 Page 2 of 19 components to achieve a higher system energy rating will not be permitted. New system shall use R410A refrigerant.
• Task 3: Test and balance the new system to design standards according to AABC (Associated Air
Balance Council) procedural standards.
• Task 4: Controls will be terminated by Alpha Controls and Services LLC prior to test and balance at the Park Services expense.
CONTRACTOR TO PROVIDE:
The current system in the Henson Robinson House will be replaced with the following components. NOTE: All new units to match existing Supply and Return duct work connection dimensions. References in specifications to any brand name equipment or materials shall be regarded as establishing a standard of quality and shall not be construed as limiting competition.
The Contractor may submit proposed equal equipment and/or materials for government consideration during the submittal process of the contract.
• System 1 (Bases of Design):
1. Furnace: Rheem Prestige Series R96TA1152524MSA, 96% AFUE or approved equal with the same 96% AFUE. Furnace shall be multi-position configuration with two stage heat, ECM motor, configured for both side return, 120 V/1 Phase/60 HZ, High heat 112.0 MBH input/109.0 MBH out, Low Heat 78.4 MBH input/ 75.3 MBH output, 1750 cfm, 120V/1 Phase/60HZ, 15 Amp MOP. The new system shall have a 10-year commercial warranty for the Furnace, compressor, and all parts.
Labor shall be covered for 1 year after installation date.
System and install shall include:
The refrigeration system consisting of a high efficiency compressor, pressure safety switches, filter drier, refrigerant sight glass, moisture indicator, charging connections, and R410A refrigerant.
Auto restart feature to automatically restart the system after a power failure.
Utilize a short cycle control to prevent compressor short-cycling and compressor wear.
Internal Thermal Overload Protection.
Configuration settings shall be factory-set based on the factory defined component operation.
Run-tested at the factory prior to shipment and shipped with a charge. Comply with
ASHRAE 15.
Comply with minimum COP/efficiency levels according to ASHRAE/IESNA 90.1.
Comply with NFPA 70.

NOTE: Cooling Performance is rated at 80° F entering dry bulb, 66° F entering wet bulb. Gross capacity does not include the effect of fan motor heat. AHRI capacity is net and includes the effect of fan motor heat.
Units to be certified in accordance with the AHRI-certified program. EER and/or SEER are rated at AHRI conditions and in accordance with DOE test procedures.
Contractor to verify dimensions of current supply, return and drain lines and ensure they are compatible with new units.
ENERGY STAR means products meet strict energy efficiency guidelines set by the US Environmental Protection Agency. Modification of units with lower designed energy ratings with supplementary/ancillary components to achieve a higher “system” rating equivalent to the Energy Star value will not be permitted.
INSTALLATION PERIOD:
• Period of performance: Work shall be completed within approximately 120 calendar days after notice to proceed issuance. 30 days for shop drawings, material delivery as verified with manufacturer material suppliers, and 60 days on site for active installation of the new system to substantial completion (POP is inclusive of 3 weather days), 7 days for final completion. Work on site shall not commence until critical equipment and materials required to complete the work are in the Contractor’s possession in order to minimize period of inactivity to the project’s progress once commencing. The Contractor shall obtain the CO’s written approval to proceed with active removals and construction within the Henson Robinson House upon confirmation that critical equipment and materials have been physically received.
a. The Contractor is expected to commence and remain actively progressing with the project work once issued the Notice to Proceed. The Period of Performance 120 calendar days are
140P6221Q0022 Attachment 3 Page 4 of 19 http://www.rheem.com/product/rcf-rcfn-hm6024ac729/ http://www.rheem.com/product/rcf-rcfn-hm6024ac729/ intended to account for extended equipment and material lead times to delivery and Contractor monitoring the seasonal winter weather forecasting to attempt to minimize periods of severe cold during active installation when the HVAC system is disconnected and temporary heating and protecting infrastructure is required (see Part 3.8 B of this document for temporary climate control requirements.) These two occurrences are recognized to be largely outside the control of the Contractor or NPS and therefore incorporated into the extended duration of the Period of Performance noted. The Contractor shall provide all reasonable efforts to commence and complete the project in the most efficient timeframe possible to the duration of disruption of HVAC service to the Henson Robinson House facility.
• The removal and installation of HVAC unit and components must be accomplished by an HVAC firm who has been in the profession long enough to be able to provide at least 3 to 5 commercial examples within the last 5 years (work on historic buildings is preferable) with the same manufacturer. Proof of establishment must be provided.
• The removal and installation of HVAC unit and components must be accomplished by an NATE certified technician(s) who has been in the trade and demonstrates good working knowledge and workmanship. The examples provided should be work done by the individual doing the work or overseeing the work being performed. They are also required to be manufacturer certified to install the product being provided. Proof of manufacturer installer and certification must be provided.
• The electrical work shall be performed by competent craftsmen skilled in the trade involved and shall be done in a manner consistent with normal industry standards. All work shall conform to the currently adopted edition of the National Electric Code (NEC) and all other applicable state and local codes or standards.
• All work will be completed in a professional manner. Unless otherwise specified, all materials and equipment shall be new, unused and undamaged. Materials and equipment shall be the current and standard designs of manufacturers regularly engaged in their production.
• All work will follow applicable codes and regulations.
• New equipment will need to fit into existing locations.
• Contractor is responsible for all work including electrical, gas, and plumbing to assure that the new unit functions as designed
• Coordinate all electrical installation with electrical contractor. Reconnect all wiring and install all environmental control units in accordance with manufacturer’s installation instructions. Current service disconnects to remain.
A. Coordinate features of controllers and accessory devices with pilot devices and control circuits to which they connect.
B. Coordinate features, accessories, and functions of each motor controller with the ratings and characteristics of the supply circuit, the motor, the required control sequence, and the duty cycle of the motor and load.
• Comply with the manufacturer’s instructions for rigging and handling equipment.

• Install all units plumb and level, firmly anchored in locations of previous footprint, and maintain manufacturer’s recommended clearances.
• New HVAC unit shall match existing supply and return air duct dimensions.
• The contractor will remove and dispose existing HVAC system. All refrigerant will be reclaimed by the National Park Service prior to demolition.
• The contractor will be responsible for testing units to ensure no leakage. The Contractor to ensure all functions, set point adjustments, alarm notifications, temperature sensing devices, air balancing devices, air balancing measurements, factory settings, for each unit work accordingly as designed.
• Verify that balancing devices, such as test ports, gage cocks, thermometer wells, flow-control devices, balancing valves and fittings, and manual volume dampers, are required by the Contract Documents. Verify that quantities and locations of these balancing devices are accessible and appropriate for effective balancing and for efficient system and equipment operation.
A. Examine systems for functional deficiencies that cannot be corrected by adjusting and balancing.
B. Examine HVAC equipment to ensure that clean filters have been installed, bearings are greased, belts are aligned and tight, and equipment with functioning controls is ready for operation.
C. Examine heat-transfer coils for correct piping connections and for clean and straight fins.
D. Examine equipment for installation and for properly operating safety interlocks and controls.
E. Measure terminal outlets and inlets on each unit without making adjustments.
F. Measure terminal outlets using a direct-reading hood or outlet manufacturer’s written instructions and calculating factors.
G. Adjust terminal outlets and inlets for each space to indicated airflows within specified tolerances of indicated values. Make adjustments using volume dampers rather than extractors and the dampers at air terminals.
H. Adjust each outlet in same room or space to within specified tolerances of indicated quantities without generating noise levels above the limitations prescribed by the Contract Documents.
I. Adjust patterns of adjustable outlets for proper distribution without drafts.
J. Adjust each makeup air outlet to indicated airflows.
LOCATION: Lincoln Home National Historic Site, 413 S. 8th Street Springfield IL. Some locations to this project will require contractor to use hoists, lifts and other means to transport tools, and new equipment.
Contractor to review all locations of existing units, noting limited access points and conditions for replacement and installation of new units and components.
STANDARD WORKDAY/WEEK: Work shall normally be accomplished during the standard 8-hour day, 5-day week, Monday through Friday, between the hours of 7:00 A.M. and 3:30 P.M. local time, excluding Federal Legal holidays and non-work days resulting from holidays occurring on weekends. If desiring to work other than the standard 8-hr day, submit written request at least three work days prior to the proposed performance of work to the Contracting Officer (CO). State the proposed performance of work, day/days, time/amount of work, and reason why permission should be granted to perform work during non-standard hours.

PARK AND SAFETY REGULATIONS: Comply with all applicable OSHA and National Park Service DO-50 regulations and directives (available online) pertaining to security, safety, occupational health, fire, traffic, and personnel clearances while at Lincoln Home National Historic Site.
SAFETY BRIEFING: Primary contractors will brief subcontractors on safety, occupational health, and fire prevention regulations, emphasizing the requirement to obtain a welding permit, when welding, cutting and brazing operations are required, and obtain authorization from the Contracting Officer Representative (COR) when open burning is intended. Maintain documentation that all subcontractors have been briefed.
FORCE PROTECTION/ANIT-TERRORISM STANDARDS: Contractor to adhere to all park policies and procedures regarding Force Protection/Anti-Terrorism Standards. This includes, but not limited to securing vehicles, tools and materials as well as access to facilities with keys, door codes, etc. Under no circumstances will contractors be allowed to escort unauthorized personnel without written notification from park Contracting Officer Representative (COR). The Project Manager will provide list of names of all contractors/sub-contractors to COR who will be on the job site.
II. SUBMITTAL REQUIREMENTS
A. SCHEDULE OF MATERIAL SUBMITTALS: For the majority of projects a material submittal schedule will not be provided by the Government. If the requirement for a material submittal schedule is absent from the solicitation documents, the following guidelines apply. After award, the contractor shall complete and submit a material submittal schedule for approval by the Contracting Officer. The contractor shall identify all planned submittals dates on the schedule. Submit the schedule to the CO within 10 calendar days after contract award or within another agreed to timeframe as directed by the
CO.
B. SUBMITTALS: The Contracting Officer may request submittals in addition to those required when deemed necessary to adequately describe the work. Each submittal shall include Material Approval Submittal, and two (2) copies of supporting documentation. When available, the Government may request electronic copies of submittals via email, in lieu of hard copies. The availability and practicality of submitting electronically versus hardcopy will be discussed and agreed to during the initial pre-construction conference after task order award. In general, submittals shall be provided a minimum of 14 calendar days in advance of scheduled purchase to allow satisfactory time for government review.
Additionally, unless stated otherwise, submissions on test results and other submissions of that nature shall be made within 14 days, after the work or test is performed. Each submittal shall be complete and in sufficient detail for ready determination of compliance with the contract requirements. Submittals shall include such items as Contractor’s or manufacturer’s shop drawings, descriptive literature, catalog cuts, diagrams, operation charts or curves, samples, certifications, test reports, test cylinders, operating manuals, installation procedures and recommendations, templates, and other descriptive literature.
Catalog cuts and other descriptive data which may have more than one model or type shall be clearly marked to show the model, type, size, and all optional accessory equipment the Contractor proposes to install. Submittals on component items forming a system or interrelated items shall be submitted at one time as a single submittal in order to demonstrate that the items have been properly coordinated and will function as a unit. Submittal items that are disapproved will be promptly corrected and resubmitted within 10 calendar days by the Contractor. No materials shall be installed until submittals are approved by the Contracting Officer. The approved submittals shall always be available at the job site for inspection by the Contracting Officer .

E: REAL PROPERTY RECORDS: At the completion of construction and before final payment, the following information will be provided by the contractor to the Contracting Officer (CO) via email for park record purposes.
The following must be provided: a.
Manufacturer.
b. Model Number.
c. Serial Number.
d. Electrical rating, full nameplate data.
e. Energy Efficiency Ratio (EER)
f. Seasonal Energy Efficiency Ratio (SEER)
g. Cooling Capacity BTU/HR and Sensible Cooling Capacity BTU/HR
h. Other pertinent information (Warranty/guarantee information-start date, stop date)
i. Cost of each item (Equipment Cost Only)
III. WORK COORDINATION:
A. GENERAL: The project work dates will be negotiable and will be set and agreed to by the contractor and park service when delivery dates for all equipment is known. The contractor shall coordinate all work schedules with the Contracting Officer (CO) and the Contracting Officers Representative (COR)/Inspector prior to the start of the work. Notify the CO or the COR five days prior to moving onto the work-site to commence work. You must provide notification the day you move back to the work-site after an interruption of work of two or more work days. Before initiating any work, the contractor shall meet with the CO and COR and agree on: a sequence of procedures; a means of access to premises and buildings; placement of dumpsters and haul routes; delivery of materials and use of approaches; use of corridors, stairways, elevators, and similar means of egress; communications; the location of partitions and barriers; eating spaces, and restroom for contractor’s employees; any other incidentals to the project.
Interruption of Work: When work begins this project will be the priority of the contractor. Delays due to other project schedules will not acceptable. If it becomes necessary to interrupt work activities in buildings and/or areas for construction purposes (excluding those otherwise described/agreed), the Contractor shall request permission, in writing, from the Contracting Officer (CO), or designated representative(s), at least ten (10) working days in advance. The Contractor shall submit written requests for any approved street closings ten (10) working days prior to closing of the street.
Temporary construction: Any contractor installed temporary construction intended to prevent interruption of normal work activity or loss of utility services is subject to approval of the Contracting Officer (CO) and or the Contracting Officer Representative (COR).
B. INSPECTION: Obtain the Contracting Officer (CO) and the Contracting Officer Representative (COR) approval prior to accomplishing tasks such as closing walls or performing tests. The request for such approval shall be given with sufficient advance notice to permit an inspection of the area before the work or test is accomplished.

C. WATER UTILITY WORK: Contractors shall coordinate with park when conducting any work pertaining to the water utility lines.
D. PROJECT SUPERVISOR: Contractor to employ a full-time supervisor who has been in the trade and is certified by the manufacturer of the products being provided to install and perform warranty work on those units. The supervisor’s duties shall include the overall management of the project, coordination of the sub-contractor’s work, and liaison with the Contracting Officer (CO) and the Contracting Officer Representative/Inspector. No work shall be performed without the presence of the supervisor or a competent representative on the job-site. A competent representative is as defined by the Occupational Safety and Health Administration (OSHA) Standards.
E. 24-HOUR POINT OF CONTACT: Provide the Contracting Officer (CO) with a 24-hour number or numbers where his authorized representative can be contacted at any time day or night. This number should be provided at the notice of contract award, but not later than the first day of contract work at the site.
F. CONTRACTOR’S OFFICE SPACE: N/A
G. CONTRACTOR’S STORAGE AREA: No onsite storage will be permitted
H. SITE AND STORAGE AREA MAINTENANCE: The construction site is situated within Lincoln
Home National Historic Site. Contractor will be responsible for general maintenance of construction site and storage area(s) daily. This includes, but not limited to, cleaning, safety checks and disposal of trash and debris.
I. DUST CONTROL/ NOISY OPERATIONS: Contractors shall be responsible to pick up, clear and/or sweep away any mud or debris from roadways or sidewalks left by foot traffic or trucks.
Contractors shall use whatever means necessary to ensure equipment and trucks do not leave mud and debris on the roadways, to the satisfaction of the Contracting Officer Representative (COR). Noisy operations such as those involving use of air hammers, etc., in demolition, or cutting of openings shall be scheduled with the Contracting Officer (CO).
J. OCCUPANCY: The park staff/public will continue to occupy the building and carry on normal activity. Each Contractor shall protect the occupied areas from dust, smoke, etc., by a method reviewed by the Contracting Officer.
K. PATCHING AND REPAIRING: After the work has been completed, any contractor caused damages to Government-owned structures, facilities, streets, curbs, walks, lawns, etc., shall be properly patched, repaired, or replaced to the complete satisfaction of the Contracting Officer (CO) or the Contracting Officer Representative (COR). Any holes, cuts, breakages, and damages made in finished surfaces of the area in which work has been accomplished, shall be properly repaired and the disfigured areas then painted over or otherwise repaired and resurfaced to match the existing finishes to the complete satisfaction of the CO/COR.
L. DISPOSITION OF REMOVED GOVERNMENT PROPERTY: All materials and equipment to be removed by the contractor and not reinstalled or recycled under this contract, including debris generated by this project, shall be removed at regular intervals from the site and disposed of off-site by the contractor. Recycling of debris is encouraged. Disposal of materials shall be in conformance with applicable Federal, state, and local pollution regulations at the contractor’s expense.

M. EXCAVATIONS & LANDSCAPING: For all disturbances to grounds, the contractor shall complete final grading and seeding within one week of the disturbance/backfilling.
N. FINAL CLEANUP: Upon completion of the project, all equipment and debris will be removed from the site(s) and left in an acceptable condition approved by the Contracting Officer Representative
(COR).
O. TEMPORARY CLIMATE CONTROL
1. The Contractor shall be responsible for providing any necessary temporary heating equipment and protection of Henson Robinson House infrastructure (including but not limited domestic water piping and fire suppression piping) by methods approved by the CO. This may include electric space heaters, insulative covers and sleeves, or methods as proposed by the Contractor and approved by the CO.
2. The Contractor shall be allowed to utilize NPS electricity for temporary heading measures at no cost to the Contractor. The Contractor shall verify with the CO/COR that their proposed methods are within the electrical capacities of the Henson Robinson House facility to avoid a disruption or damage to existing utility and retain daily Henson Robinson House operations. The Contractor shall be required to implement measures that do not create a fire hazard, overload the facility’s electrical system, or employ methods that subject equipment to function outside of its intended use as per the manufacturer. Equipment employed for providing temporary climate control (heating) shall be in proper working order. The CO/COR reserves the right to reject and require removal of any equipment that is not in proper functioning order. The CO/COR retains the right to require the Contractor to adjust their means and methods of providing temporary heating equipment and insulative measures should measures employed demonstrate insufficiency to providing protection, climate control, and utility infrastructure operation.

The Contractor shall be responsible for monitoring the long range weather forecast, with severe low temperatures specifically monitored and make decisions regarding removal and replacement of HVAC system based on minimizing risk to freezing impacts to the facility infrastructure. The Contractor shall maintain clear communication with the CO/COR as to forecast monitoring and intended scheduling of work progress.
IV. PERMITS:
A. GENERAL: Contractor is required to investigate, submit for any permits necessary for the design and construction of this project. All permit applications shall be submitted to the Contracting Officer Representative (COR). The Contractor shall pay all permit fees. The following sections contain information on some of the various permits the Contractor may be required to obtain for task orders. This is not meant to be a complete list of all required permits. It is still the responsibility of the contractor to obtain all required permits for any construction, whether included in this document or not.
B: SPECIAL PERMITS INCLUDE:
BURN PERMITS: Requires the contractor to obtain a Welding, Cutting, and Brazing Permit prior to conducting any operation that will create a spark or flame. Contact: If an open burn permit is required, the permit request shall be routed through PRIOR to actual open burn efforts. The Owner shall be notified before starting welding or cutting. Fire extinguishers shall be immediately accessible when welding or cutting with an open flame or arc. Welding or cutting with an open flame or arc shall be stopped not less than one hour before leaving the premises.

V. UTILITIES AND SERVICES:
A. COMMERCIAL UTILITIES: Contractor will be permitted the use of the utility services such as electric, gas, sewer, and water. Temporary connections such as portable sanitary facilities are at the contractor’s expense and are subject to approval by the Contracting Officer (CO). Contractor will be responsible for any relocation of existing and/or new construction of commercial utilities to include but not limited to cable, gas, telephone, electrical, etc.
B. TEMPORARY WATER SERVICE CONNECTIONS: Notify the Contracting Officer Representative (COR) in advance of temporary water service requirements. All temporary water connections shall be performed by the contractor at the expense of the contractor. Where appropriate, backflow devices will be used. Disconnection of temporary service lines installed and used by the contactor and any subcontractors will require complete removal of the service line at contractor’s expense.
C. UTILITY SERVICE INTERRUPTIONS: The contractor shall submit written notification not less than 14 work days in advance for each planned interruption of a utility service. No single interruption shall exceed eight hours. Utility service interruptions shall not be permitted unless approved by the Contracting Officer (CO). Service interruptions shall be accomplished at other than normal work hours if feasible.
D. ENABLING/DISABLING FIRE ALARMS PANELS: The contractor shall bear all costs associated with enabling/disabling fire alarm panels. All fire alarm panels shall be properly operating prior to the contractor securing at the end of each workday. To have a fire alarm panel enabled/disabled the contractor may contact: the Contracting Officer Representative (COR).
E. FIRE HYDRANT CONNECTION: Not Applicable
VI. MAINTENANCE INFORMATION:
A. OPERATIONS AND MAINTENANCE MANUALS: The Contractor shall provide the Contracting
Officers Representative (COR) the specified number of copies of operation and maintenance instruction manuals. Manuals shall contain complete instructions on operating and maintaining the equipment, including piping and wiring diagrams. The manual shall be assembled in book form having a cover indicating the contents by equipment or system name and project title. Manuals shall be submitted a minimum of three work days before the Contractor conducts the on-site operation and maintenance instruction. Also included with the manual is to be 1 copy electronically in PDF format.
B. SPARE PARTS LIST: Where required by the other parts of the specifications, the Contractor shall provide the Contracting Officers Representative (COR) the specified number of copies of spare parts lists. The lists shall provide the supply source, item description and price of all parts and shall be cross referenced to equipment diagrams or pictures. Spare parts lists shall be assembled in book form and may be separate from or integral with the operation and maintenance instruction manuals. Spare parts lists shall be submitted with the related instruction manuals.

C. ON-SITE INSTRUCTION: Prior to final inspection, the contractor shall provide the services of a factory certified personal where required by other parts of the specification, to instruct government personnel in the proper operation and maintenance of newly installed systems and equipment. The instruction shall be in accordance with the procedures and methods recommended by the equipment manufacturer. The Contractor shall schedule the on-site instruction with the Contracting Officers Representative (COR), but such instruction shall not occur until ten days after the receipt of operation and maintenance instruction manuals.
D. WARRANTY ITEMS:
1. In addition to any other warranties in this contract, the Contractor warrants, that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.
2. The installation shall be warranted for a period of 1 year from the date of final acceptance of the work. If the Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession.
3. The Contractor shall remedy at the Contractor’s expense any failure to conform, or any defect. In addition, the Contractor shall remedy at the Contractor’s expense any damage to Government-owned or controlled real or personal property, when that damage is the result of:
(a) The Contractor’s failure to conform to contract requirements; or
(b) Any defect of equipment, material, workmanship, or design furnished.
4. The Contractor shall restore any work damaged in fulfilling the terms and conditions of this clause.
The Contractor’s warranty with respect to work repaired or replaced will run for 1 year from the date of repair or replacement.
5. The Contracting Officer (CO) shall notify the Contractor, in writing, within a reasonable time after the discovery of any failure, defect, or damage. There shall be a maximum 24-hour response time by the Contractor on all warranty items installed under this contract and identified as either malfunctioning or inoperative after acceptance of the item. The Contractor shall notify both the CO or their designated representative and the Inspector of the date, place, and time that the contractor will be on location to determine the cause of the problem. Response time shall be defined as the time from when the CO contacts the Contractor until the time the Contractor is present at the location of the equipment with the appropriate personnel to determine the problem and what is necessary to correct the problem. Warranty items shall be defined as all equipment, components, appurtenances, and wiring installed and the labor and materials necessary to install said items.
6. If the Contractor fails to remedy any failure, defect, or damage within five working days after receipt of notice, the Government shall have the right to replace, repair, or otherwise remedy the failure, defect, or damage at the Contractor’s expense.
7. With respect to all warranties, express or implied, from subcontractors, manufacturers, or suppliers for work performed and materials furnished under this contract, the Contractor shall:
(a) Obtain all warranties that would be given in normal commercial practice;
(b) Require all warranties to be executed, in writing, for the benefit of the Government, if directed by the Contracting Officer; and
(c) Enforce all warranties for the benefit of the Government, if directed by the Contracting Officer.
8. In the event the Contractor’s warranty under paragraph (b) of this clause has expired, the Government may bring suit at its expense to enforce a subcontractor’s, manufacturers, or supplier’s warranty.

9. Unless a defect is caused by the negligence of the Contractor or subcontractor or supplier at any tier, the Contractor shall not be liable for the repair of any defects of material or design furnished neither by the Government nor for the repair of any damage that result from any defect in Government-furnished material or design.
10. This warranty shall not limit the Government’s rights under the Inspection and Acceptance clause of this contract with respect to latent defects, gross mistakes, or fraud.
E. SHORING AND SAFETY: All safety practices must be followed under OSHA requirements.
F. SUBSTITUTION OF MATERIALS AND EQUIPMENT: The Contractor shall submit plans and informational data and component equivalent information if the Contractor proposes a piece of equipment and/or accessories on other than that specified. Drawings shall show all piping, electrical connections, sizes of equipment, location of piping, and electrical penetrations, and all other associated equipment and materials. The Contracting Officer (CO) reserves the right to reject or accept any or all of the proposed changes based on completeness, clarity, and other requirements of the plans and specifications. When the Contractor requests approval of substitute materials and/or equipment, it shall be understood and agreed that such substitution, if approved, will be made without cost to the government, regardless of changes in connections, spacing, electrical service, and all other appurtenances.
G. BRAND NAMES: References in specifications to any brand name equipment or materials shall be regarded as establishing a standard of quality and shall not be construed as limiting competition. The Contractor may submit proposed equal equipment and/or materials for government consideration during the submittal process of the contract after award.
H. ENVIRONMENTAL WORK: All safety practices must be followed under OSHA requirements.
H.1 – This covers the requirements for management of non-hazardous waste produced as a result of this work.
a. Contractor shall practice efficient waste management when sizing, cutting and installing products
b. Contractor shall use all reasonable means to divert waste from landfills and incinerators and facilitate their recycling
c. Contractor shall be responsible for implementation of any special programs involving rebates or similar incentives related to recycling and any revenues or savings obtained from salvage or recycling shall accrue to the Contractor.
d. Contractor shall ensure that facilities used for recycling, reuse and disposal shall be permitted for the intended use to the extent required by federal, state and local regulations.
H-2. Plan
a. Conduct a site assessment to estimate the types of materials that will be generated by demolition at the site.
The Whole Building Design Guide website (http://www.wbdg.org) has a Construction Waste Management Database that contains information on companies that haul, collect, and process recyclable debris.
b. Develop and implement procedures to reuse and recycle materials to the greatest extent feasible based upon the contract debris estimated quantities of materials, and the availability of recycling facilities.
c. Prepare and submit to the COR a written demolition debris management plan. The plan shall include, but not be limited to, the following information:
• Contractor and project identification information;
• Procedures to be used for debris management;
• A listing of the materials to be reused, recycled, or taken to the landfill.

• The names and locations of reuse and recycling facilities or sites.
H-3 Collection
a. Provide necessary containers, bins and storage areas to facilitate effective waste management.
b. Clearly identify so that recyclable materials are separated from trash and can be transported to respective recycling facility for processing.
H-4 Disposal
a. Contractor shall be responsible for transporting and disposing of materials that cannot be delivered to a source-separated or mixed materials recycling facility to a transfer station or disposal facility that can accept the materials in accordance with state law.
b. Building or demolition materials with no practical use or that cannot be recycled shall be disposed of at a landfill or incinerator.
H-5 Report With each application for payment, the contractor shall submit a summary of debris diversion and disposal, quantifying all materials generated at the work site and disposed of or diverted from disposal through recycling.
I. PRODUCTS NOT ALLOWED: Materials containing asbestos and the use of lead based materials as well as any other known hazards are prohibited.
J. OZONE DEPLETING CHEMICALS: Ozone Depleting Chemicals, Class I and II listed at http://www.epa.gov/ozone/science/ods/ are to be recovered by the Contractor and disposed of according to regulatory requirements. Any Freon in current systems must be re-claimed/captured for recycling or re-use by the contractor. Disconnection of existing piping to allow Freon to escape into the atmosphere will not be permitted. Ozone Depleting Chemicals may not be sold or given away to private industry unless otherwise specified by the government.
K. RECYCLE: The existing equipment and all debris must be removed from the job site and recycled or properly disposed. Recycle all ferrous and non-ferrous metals from the project. The Contractor shall also recycle general administrative refuse associated with this project. This refuse includes cardboard, plastic bottles, plastic soda bottles, aluminum cans, and mixed paper.
