1.4 VARIATIONS

Variations from contract requirements require Government approval and will be considered where advantageous to Government.

Discussion with Contracting Officer prior to submission, after consulting with the Project Manager, will help ensure functional and quality requirements are met and minimize rejections and re-submittals. When contemplating a variation which results in lower cost, consider submission of the variation as a Value Engineering Change Proposal (VECP).

Specifically point out variations from contract requirements in transmittal letters. Failure to point out deviations may result in the

Government requiring rejection and removal of such work at no additional cost to the Government.

1.4.2 Proposing Variations

When proposing variation, deliver written request to the Contracting

Officer, with documentation of the nature and features of the variation and why the variation is desirable and beneficial to Government, including the Project Manager’s written analysis and approval. Clearly mark the proposed variation in all documentation.

1.4.3 Warranting That Variations Are Compatible

a. Coordinate scheduling, sequencing, preparing and processing of submittals with performance of work so that work will not be delayed by submittal processing. Allow for potential resubmittal of requirements.

b. Submittals called for by the contract documents will be listed on the register. If a submittal is called for but does not pertain to the contract work, the Contractor is to include the submittal in the register and annotate it "N/A" with a brief explanation. Approval by the Contracting Officer does not relieve the Contractor of supplying submittals required by the contract documents but which have been omitted from the register or marked "N/A."

c. Carefully control procurement operations to ensure that each individual submittal is made on or before the Contractor scheduled submittal date shown on the approved "Submittal Register."

d. Except as specified otherwise, allow review period, beginning with receipt by approving authority, which includes at least 21 days for submittals for Contracting Officer approval. Failure to point out deviations may result in the Government requiring rejection and removal of such work at the Contractor's expense.

If changes are necessary to submittals, the Contractor shall make such revisions and submission of the submittals in accordance with the procedures above. No item of work requiring a submittal change is to be accomplished until the changed submittals are approved.

1.8 APPROVED SUBMITTALS

The Contracting Officer's approval or acceptance of submittals is not to be construed as a complete check and indicates only that the general method of construction, materials, detailing and other information are satisfactory.

Approval or acceptance will not relieve the Contractor of the responsibility for any error which may exist, as the Contractor is responsible for dimensions, the design of adequate connections and details, and the satisfactory construction of all work design, dimensions, all design extensions, such as the design of adequate connections and details, compliance with the drawings, specifications and amendments etc., and the satisfactory construction of all work.

Government reserves the right to disapprove any material or equipment which previously has proved unsatisfactory in service.

Samples of various materials or equipment delivered on the site or in place may be taken by the Contracting Officer for testing. Oceanic and Atmospheric Administration (NOAA) is provided below. It establishes what will be considered to be normal weather for the purposes of this contract. The table shows the average number of adverse weather delays and average low and high temperatures for each month.

1.2 CONTRACT TIME LIMIT

The contractor shall allow for the impact of normal weather in his planned contract performance, as indicated in the weather data below.

1.3 TIME EXTENSIONS

A. Time extensions for weather may be granted for weather in excess of normal that impacts ongoing activities on the site that have successive following activities that must be completed in a required sequences in order to meet the specified performance period in the Statement of

Work. These would generally be labeled as Critical Path Activities when that type of schedule is used.

B. Any request for a time extension for weather must include:

a. Weather data from Military Installation or National Weather Services.

b. Written description of the impact of the weather occurrence to the scheduled activity(s) and successor activity(s). For example, if it rained on one day, but the impact to one activity affected the sequence of other activities that resulted in more than a one day delay, contractor shall explain the logic between the activities and justify the re-sequencing of successor activities that resulted in additional days beyond the normal time allotted.

Contractor shall also prove that weather delay impacted activities on the critical path or that the weather delay created a new longer critical path.
