JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION

for SIMPLIFIED ACQUISITIONS OVER THE MICROPURCHASE THRESHOLD (See FAR Part 2) UP TO SAT (See FAR 13.106-1)

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

The requirement is for 100 new Dupont MEMCOR L10N Membrane Filtration Modules. These micro-filtration filter modules used in three Lake Mead water treatment plants. The current modules are aging and need to be replaced. These filters have a set life cycle and must be replaced before they deteriorate to a point where proper treatment of drinking water is not possible.

The micro filtration modules are fragile and require constant monitoring to ensure that no breaches have occurred. As the filters get older, failures become more common and eventually the filters get to a point of being unrepairable.

2. Sole Source Justification rationale (Check one and explain below):

Explain: The current system utilizes Dupont Memcor L10N Membrane Filtration Module. In order to maintain system integrity, the same filters need to be utilized. This product can be procured by multiple vendors and a brand name justification will allow competition. Filters must be Memcor L10N, any other brand filters from other sources will be imitations and not compatible with our Memcor housings. They will not carry the same flow ratings or warranty. Any other brand filter will not be compatible with existing service contracts in place with Dupont/Memcor. Other brands such as Aquaboon, GE, Pureplus, Expresswater, etc are copies of the Dupont design. Use of these filters would not be in the best interest of the Government as they are not guaranteed to work in Dupont housings that we currently have installed.

There would be no warranty as they would not be used as they are designed. Fit, sealing and filter performance could not be guaranteed. Changing housings is not an option as it would cost prohibitive and fiscal waste to replace all of the NPS existing systems.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:

Dupont has several authorized resellers who can provide this product. Vendor will be to provide a bill of lading from Dupont to verify authenticity of the product.

4. If this is a determination for sole source, the Contracting Officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist. NOT

APPLICABLE

b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part13.106-3(a). PRICE FAIR AND REASONABLE

WILL BE DETERMINED THROUGH COMPETITION.
