SUBMISSION REQUIREMENTS

The Government will award a firm-fixed-price (FFP) contract to the responsible offeror whose offer conforms to the requirements as stated in this request for quotation (RFQ). The award will be made using the Lowest Price Technically Acceptable (LPTA) method based on the following three (3) evaluation factors: Technical, Past Performance, and Price.

The Government intends to evaluate quotes and make award without questions to offerors.

Therefore, the Offeror's initial quote should contain the Offeror's best terms from a Technical and Cost standpoint. Unclear quotes may not result in questions for clarifications. Offers with an omission or unclear quote may be judged to mean the contractor does not fully understand the requirements or understand what it takes to meet the requirements, regardless of the proposed cost/price, and will be rated unacceptable. In that case, the Offeror may be found unacceptable, and ineligible for award. The Government reserves the right to ask questions of offerors if the Contracting Officer determines them to be necessary.

Site Visit (Pre-Bid tour) –

Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost or contract performance, to the extent that the information is reasonably obtainable.

In no event shall failure to inspect the site constitute grounds for a claim after contract award.

The scheduled site visit will be performed on 28 August, 2020 at 1:00 AM EST.

Evaluation Criteria Factors/Ratings:

I. TECHNICAL:

A. Technical Requirements: This information consists of the offeror’s intended approach to executing the contract. The submission for this section shall not exceed 5 pages in length, excluding resumes.

1. Equipment plan: The proposed equipment list should only include the equipment which will be used on this contract. Include size, make, model, and ownership (owned or rented) of equipment.

2. Staffing plan: The proposed staffing plan shall include both numbers of personnel proposed and position titles. Resumes for proposed key personnel, consisting of experience and other pertinent information, inclusive of superintendents, quality control inspectors, and foremen must also be submitted.

3. Capabilities plan: The proposed capabilities should include adequate documentation to illustrate the Offeror’s capabilities to successful complete the work identified within the solicitation.

B. Evaluation Criteria: The Government will check Offeror’s equipment, staffing and capabilities plans for each project for completeness and reasonableness. A complete and reasonable equipment, staffing and capabilities plan will receive an Acceptable rating. Incomplete or unreasonable plans will receive a rating of Unacceptable.

Government will evaluate the clarity and strength of the overall organization and how well it is organized and structured to execute the entire scope of work. The Government will evaluate the capability of the firm to execute the project. The Government will evaluate the Contractor’s resources to determine if it has the capability to self-perform the required amount of the project, in accordance with public policy to assure adequate interest in and supervision of all work.

II. PAST PERFORMANCE:

A. Technical Requirements: The offeror shall demonstrate recent, relevant experience on similar projects. If the offeror is a joint venture, each firm shall demonstrate experience. Submit at least 3 detailed examples of relevant work that are currently well underway or performed within the past 10 years. Work experience shall be demonstrated for at least 10 years. The Installing Contractor shall be certified by the manufacturer of the roof system to be installed.

B. Evaluation Criteria: The Government will evaluate how well the Offeror demonstrated their recent (within three years of the issue date of the RFQ), relevant experience with similar projects. If the Offeror is a joint venture, each entity must demonstrate qualifying experience comparable to its role on the project. The Government reserves the right to verify the experience record of cited projects or other recent projects or to interview owners or references. The Government reserves the right to check any or all cited references to verify supplied information. A rating of Unacceptable will be given to an Offeror who cannot demonstrate a history of recent, relevant experience. The Government will consider extent of recent experience, degree of relevance of such experience to this project, demonstrated familiarity with similar sites and local conditions. Some examples of relevancy to this project may include, but not be limited to: (1) Number, size, type work, location; (2) Dates (completion within last 10 years);

and (3) Firm's role and extent of work self-performed (subcontracting out all work is an examples of less relevant experience).

III. Price: Price will be evaluated by utilization of price analysis. Offerors shall complete the

Bidding Schedule by filling out the pricing data blanks in the solicitation. This submission item is not rated. Award will be made for the lowest-price, technically acceptable offer.

The lowest-price will be evaluated for the sum of the contract.

SLOPE PROTECTION

STATEMENT OF WORK

Statement of Work: The US Army Corps of Engineers at Curwensville Lake in Curwensville, Pennsylvania requires placement of new slope protection on the downstream slope of the dam embankment in a vegetated area that is too steep to mow safely. The Contractor shall provide all labor, supervision, materials, equipment, and supplies to complete the following:

1. Turf Removal and Excavation: Remove the existing turf and excavate 6” of soil below the existing grade in Areas 1 and 2 identified on Attachment 1. Area 1 is the 2 on 1 slope embankment downhill of Ramp B. Area 2 is the steeper section of embankment around the manhole vaults opposite the service bridge. Excavated soil may be disposed of on site at a location designated by the COR. Excavation shall not extend further than the near side of the guardrail posts (side away from the road).

2. Stone Placement: Place a 6” layer of bedding stone in the excavated area. Bedding stone shall be placed up to the road side of the guardrail posts. Place a 12” minimum thickness layer of riprap on the bedding stone.

3. Grading and Seeding: Place a strip of soil at the base of the riprap to anchor it. Soil excavated in Item 1 may be reused for this purpose. The slope of the anchor soil shall be even and gradual for future mowing. The soil strip and all disturbed turf areas shall be graded for mowing, seeded, and mulched. Ruts and other slope damage will be repaired prior to

4. Bedding Stone: Bedding stone will comply with PennDOT No. 2A aggregate (type B or better).

5. Riprap: Riprap shall be PennDOT type R-4 and furnished in blocky and angular shapes, with its greatest dimension not greater than three times its least dimension. The maximum dimension of a stone shall be defined as the maximum distance that can be obtained between two parallel planes by placing and rotating, in all directions, the stone between the planes while having the stone "touch" both planes. The minimum dimension of a stone shall be defined as the minimum distance that can be obtained by the procedures specified above.

Flat stones, slabs, boulders and parts of boulders will be rejected. Not more than 5 percent by weight of clean spalls resulting from loading and shipment will be allowed in any one load.

Stone shall consist of fresh, sound, hard, dense, durable rock which shall be separated from bedrock by quarrying. No schistose stone or any highly foliated stone will be acceptable.

Sedimentary or metamorphic stone containing carbonaceous, coal, or clay seams/lenses or stone containing stylolite or similar deleterious features will likewise not be acceptable.

6. Seeding and Mulching: Grass seed applied shall be appropriate for the location and climate of the work. Seed shall be applied at a rate appropriate for the establishment of grass. Mulch shall be sufficient to hold the seed in place until grass is established.

7. Quantities: The area of work is approximately 5,900 square yards in Area 1 and 400 square yards in Area 2 (Option 1).

DELIVERABLES

1. Pre-Work Submittals - A paper or digital copy of the following shall be submitted within 20 days of award to the COR:

A. Accident Prevention Plan B. Bedding Stone Material Selection C. Riprap Material Selection

2. Post-Work Submittals: Two paper or digital copies of the following shall be submitted within 15 days of work completion to the COR:

A. Daily Quality Control Reports B. Bedding Stone and Riprap Tickets including material, gradation, and quantity

SPECIAL CONDITIONS

1. Period of Performance: Work shall not commence until after the issuance of a notice to proceed issued by the Contracting Officer. Work shall commence no later than 30 days after the issuance of the notice to proceed and be completed within 90 days of notice to proceed.

The start date shall be coordinated with the COR, Mr. Jeff Meadows, and Head Dam Operator, Mr. Tim Smay.

2. Performance of Work: The Contractor shall perform work only during normal Corps of Engineers duty hours (7:00 a.m. to 3:30 p.m., Monday through Friday, excluding national holidays). Exceptions to this condition must be coordinated with and approved in advance by the Operations Manager, Susquehanna River Project.

3. Accident Prevention: In performing this contract the Contractor shall comply with all current Federal, State, and Local safety regulations, including Corps of Engineers Safety and Health Requirement Manual EM 385-1-1 and shall comply with any subsequent changes.

x. Prior to commencement of work under this contract the Contractor shall furnish to the Government an Accident Prevention Plan in accordance with Section I, Article 01.A.12 of the EM 385-1-1, dated 30 November 2014.

4. Accident Reporting: In the event of an accident or injury involving contractor personnel or equipment in performance of work, the Contractor shall immediately notify the Government representative by the most expedient means feasible. The Contractor shall complete forms furnished and/or provide a written description of the incident within 24 hours of notification to do so.

5. Access and General Protection/Security Policy and Procedures: All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

6. Government Escort: All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

7. Pre-screen candidates using E-Verify Program: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

8. Operations and Storage Areas: The Contractor shall confine all operations (including storage of materials) to areas authorized or approved by the Construction Control Representative.

The Contractor shall hold and save the Government, its officers, and agents free and harmless from liability of any nature occasioned by the Contractor’s performance.

9. Housekeeping: The Contractor shall keep the work area, including storage areas, free from accumulations of waste materials. Before completing the work, the Contractor shall remove from the work site and premises, any rubbish, tools, equipment, and materials that are not property of the Government. Upon completing the work the Contractor shall restore the work area to the original condition, to be approved by the Contracting Officer.

10. Environmental Protection: The Contractor is required to comply with all Federal, State, and

Local environmental regulations.

11. Permits and Licenses: The Contractor shall, at his/her own expense, obtain any license or permits required to perform the contract. The Contractor shall comply with all Federal, State, and Local laws and regulations and shall comply with any subsequent changes.

12. Records and Reports: In addition to the administrative requirements dictated elsewhere in this contract, the Contractor shall complete a Daily Construction Quality Control Report form to maintain record of contract performance, accident/injury incidence, and observance of project deficiencies. Forms will be distributed at pre-work conference.

13. Superintendent: The Contractor shall act as or provide a Superintendent and quality control manager whenever the work specified herein is being performed. The Superintendent shall conduct overall management coordination and be the central point of contact with the Government for performance of all work under this contract. The Superintendent and any individual designated to act for him/her shall have full authority to contractually commit the Contractor for prompt action on matters pertaining to the work performed under this contract. Such authorization shall be submitted in writing to the Government representative.

The Superintendent shall deal directly with the Government representative for normal day-to-day administration of the contract provisions. The Superintendent shall attend pre-work conference(s) prior to commencing work under this contract.

14. Project Operation: Curwensville Lake is a flood control project and the Contractor’s access to the work area and the execution of the requirements specified herein shall not interfere with the daily operations of the projects or employees. It is the responsibility of the Contractor to coordinate all work with Head Dam Operator and COR.

INVOICES AND PAYMENT

1. Invoices: The Contractor shall submit itemized invoices no sooner than 5 days from the completion of the contract activity and no later than 15 days from the completion of the total contract activity. The invoice shall accurately reflect work completed. Each invoice at a minimum shall contain the following information:

2. Corrections: Incorrect invoices will be returned to the Contractor for correction before processing payment. Corrected invoices shall be re-dated to reflect the new submission date.

3. Remittance: Invoices shall be submitted via post-mail and/or electronic mail to the following addresses for payment. Should changes occur to the mailing addresses, the Contractor shall be notified of the correct recipient.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUN 2020)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

“Veteran-owned small business concern” means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern--

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; or

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
