TECHNICAL SPECIFICATIONS
LUCKY PEAK DAM & LAKE
TAILERABLE WORKBOAT
1.0 Intent
1.1 These specifications cover the manufacture, outfitting, and delivery of one new aluminum, single gas powered engine, jet or propeller driven trailerable workboat ready for freshwater operation and with suitable trailer. The contractor shall provide all labor, material, equipment, and engineering necessary to build and deliver a boat meeting the specifications below.
2.0 SCOPE
2.1 The vessel shall comply with all current U.S. Coast Guard Regulations, U.S. Army Corps of Engineers
Safety Manual EM 385-1-1 Section 19, and Federal and State environmental requirements with respect to a vessel’s function, construction and equipment outfitting.
2.2 The vessel shall be newly manufactured and shall be built entirely of aluminum by a proven manufacturer regularly engaged in the manufacture of trailerable welded aluminum boats. A custom built boat is not necessary and modifications to a stock model design is acceptable.
2.3 The vessel is to be used as a workboat in a fresh water environment and shall reflect that type of construction inside and out. The vessel's hull shall be properly reinforced for operations on inland waterways of the Boise River in the Pacific Northwest.
2.4 The general layout of the vessel shall incorporate a partially enclosed cabin area with glass windshield, sliding glass side windows on the port and starboard, hard top, doghouse engine cover, and a continuous level deck from the transom to the bow or to the greatest extent possible.
2.5 A trailer shall be provided that can transport the vessel to and from dry storage. The trailer shall be capable of safely towing the vessel at speeds greater than 55 MPH.
2.6 All welding shall be accomplished in accordance with the recommendations of the manufacturer and for the material used in the construction of the vessel. All sharp and /or rough edges shall be ground round and smooth and all weld splatter and slag shall be removed. All exterior seams and butts shall be flush and smooth and the hull plating shall be shrunk as required to remove all ripples and make fair.
3.0 WORKBOAT MINIMUM REQUIREMENTs
3.1 Hull:
3.1.1 Length: 24 feet (maximum)
3.1.2 Width: 9 feet (minimum)
3.1.3 Material: Appropriate ASTM standard for fresh water marine vessels
3.1.4 Shell Plating: 3/8” aluminum plate (minimum)
3.1.5 Bulwarks: Continuous all around hull.
3.1.6 Bitts: One 4 inch (maximum) OD center line aft towing bitt.
3.1.7 Anodes shall be installed on hull below the waterline.
3.1.8 Dog House: Engine shall be covered with a doghouse and be hinged for access.
3.1.9 Anchor box: An anchor box shall be installed in the bow of the vessel.
3.1.10 Swim deck: An extended swim deck shall be installed.
3.1.11 Ladders: One ladder shall be install on the bow and one ladder shall be installed on the swim deck.
3.1.12 Fuel Tank: 80 gallon (maximum) belly tank.
3.1.13 Coating: Deck area, gunnels, and doghouse shall be covered in a nonskid coating or material.
3.1.14 Light bar mount: Rooftop light bar mount
3.2 Cabin:
3.2.1 Seating: Both pilot and co-pilot seats shall be air ride single passenger seats. Two bench style seats shall be installed aft of the pilot and co-pilot seats. All seats shall be covered in standard marine grade upholstery.
3.2.2 Bow Door: Watertight door in the center of the windshield to access the bow of the vessel.
3.2.3 Windows: Stationary glass windshields shall be fitted with windshield wipers for pilot and co-pilot poisons. Horizontal sliding side windows on port and starboard and removable soft cover with zip and/or roll up capability to cover the aft section of the cabin. All glass windows made of tempered safety glass and have solar tint.
3.2.4 Washdown kit: A minimum of one washdown kit shall be installed.
3.2.5 Rearview Mirror: A rearview mirror shall be installed on the pilot’s side.
3.2.6 Heater: Marine grade heater shall be installed.
3.2.7 Cup holders: A minimum of 2 cup holders shall be installed. Cup holders shall be assessable to pilot and co-pilot.
3.3 Propulsion Machinery:
3.3.1 Single gas powered 4 stroke engine, 440 HP (minimum).
3.3.2 Reverse: 212 hydraulic reverse pump.
3.3.3 Steering: Starboard helm steering.
3.3.4 Propulsion: Jet drive is preferred but propeller is acceptable.
3.4 Instrumentation & Electronics:
3.4.1 Analog gauge package: Engine tachometer, oil pressure, and volt meter. Audible and visual alarm for low oil, high temperature, and fuel level.
3.4.2 12-volt electric or air signal horn.
3.4.3 Standard four speaker stereo.
3.4.4 Two 12-volt ports
3.4.5 Ray Marine Axiom Pro 12.
3.4.6 Ray Marine Axiom pro 9 Display.
3.5 Lighting and Electrical:
3.5.1 Electric Batteries: Two 12-volt heavy-duty marine batteries mounted in Coast Guard approved battery boxes.
3.5.2 Bilge Pump: Minimum of two 12-volt bilge pumps.
3.5.3 An auto bilge switch shall be installed.
3.5.4 A minimum of 2 dome lights with the option for red light.
3.5.5 Rear deck lights.
3.5.6 Blackout switch for night vision.
3.6 Trailer
3.6.1 Galvanized tandem axle (approximately 5200 lbs).
3.6.2 Electric brakes.
3.6.3 Side roller guides.
3.6.4 Spare tire.
4.0 WARRANTY:
Builder to warrant workmanship and equipment installation for a minimum of one (1) year (longer if builder’s standard practice). Builder to provide all equipment and materials warranty/guarantee documents to purchaser at point of delivery.
5.0 OPERATION AND MAINTENANCE MANUALS
5.1 Two (2) complete copies of the Operation and Maintenance Manual shall be provided. The manuals shall include instructions on the maintenance, repair, troubleshooting, warranty, and a list of recommended spare parts. Any information pertaining to models or components not supplied under this contract shall be crossed out.
5.2 Also included shall be the name, phone and fax numbers, and email address of the contractor, manufacturer, and a distributor where spare parts can be purchased.
6.0 SHIPMENT & DELIVERY:
6.1 All items shall be delivered FOB destination to Lucky Peak Dam & Lake within six (6) months of contract award.
6.2 The contractor shall be responsible for packing and shipping the boat in a manner that will ensure undamaged and complete arrival to Lucky Peak Dam & Lake.
6.3 No shipments are allowed other than normal business hours of Monday through Thursday 7:00 a.m. -
4:00 p.m., excluding Federal holidays.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (MAR 2020)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at http://www.sba.gov/content/table-small-business-size-standards.
(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
(h) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

52.246-17 WARRANTY OF SUPPLIES OF A NONCOMPLEX NATURE (JUN 2003)
(a) Definitions. As used in this clause --
Acceptance means the act of an authorized representative of the Government by which the Government assumes for itself, or as an agent of another, ownership of existing supplies, or approves specific services as partial or complete performance of the contract.
Supplies means the end items furnished by the Contractor and related services required under this contract. The word does not include ``data.''
(b) Contractor's obligations.
(1) Notwithstanding inspection and acceptance by the Government of supplies furnished under this contract, or any condition of this contract concerning the conclusiveness thereof, the Contractor warrants that for a minimum of one
(1) year (longer if builder’s standard practice):
(i) All supplies furnished under this contract will be free from defects in design material or workmanship and will conform with all requirements of this contract; and
(ii) The preservation, packaging, packing, and marking, and the preparation for, and method of, shipment of such supplies will conform with the requirements of this contract.
(2) When return, correction, or replacement is required, transportation charges and responsibility for the supplies while in transit shall be borne by the Contractor. However, the Contractor's liability for the transportation charges shall not exceed an amount equal to the cost of transportation by the usual commercial method of shipment between the place of delivery specified in this contract and the Contractor's plant, and return.
(3) Any supplies or parts thereof, corrected or furnished in replacement under this clause, shall also be subject to the terms of this clause to the same extent as supplies initially delivered. The warranty, with respect to supplies or parts thereof, shall be equal in duration to that in paragraph (b)(1) of this clause and shall run from the date of delivery of the corrected or replaced supplies.
(4) All implied warranties of merchantability and "fitness for a particular purpose" are excluded from any obligation contained in this contract.
(c) Remedies available to the Government.
(1) The Contracting Officer shall give written notice to the Contractor of any breach of warranties in paragraph (b)(1) of this clause within 45 days after discovery of the defect.
(2) Within a reasonable time after the notice, the Contracting Officer may either--
(i) Require, by written notice, the prompt correction or replacement of any supplies or parts thereof (including preservation, packaging, packing, and marking) that do not conform with the requirements of this contract within the meaning of paragraph (b)(1) of this clause; or
(ii) Retain such supplies and reduce the contract price by an amount equitable under the circumstances.
(3) (i) If the contract provides for inspection of supplies by sampling procedures, conformance of suppliers or components subject to warranty action shall be determined by the applicable sampling procedures in the contract.
The Contracting Officer--
(A) May, for sampling purposes, group any supplies delivered under this contract;
(B) Shall require the size of the sample to be that required by sampling procedures specified in the contract for the quantity of supplies on which warranty action is proposed;
(C) May project warranty sampling results over supplies in the same shipment or other supplies contained in other shipments even though all of such supplies are not present at the point of reinspection; provided, that the supplies remaining are reasonably representative of the quantity on which warranty action is proposed; and
(D) Need not use the same lot size as on original inspection or reconstitute the original inspection lots.
(ii) Within a reasonable time after notice of any breach of the warranties specified in paragraph (b)(1) of this clause, the Contracting Officer may exercise one or more of the following options:
(A) Require an equitable adjustment in the contract price for any group of supplies.
(B) Screen the supplies grouped for warranty action under this clause at the Contractor's expense and return all nonconforming supplies to the Contractor for correction or replacement.
(C) Require the Contractor to screen the supplies at locations designated by the Government within the contiguous United States and to correct or replace all nonconforming supplies.
(D) Return the supplies grouped for warranty action under this clause to the Contractor (irrespective of the f.o.b.
point or the point of acceptance) for screening and correction or replacement.
(4) (i) The Contracting Officer may, by contract or otherwise, correct or replace the nonconforming supplies with similar supplies from another source and charge to the Contractor the cost occasioned to the Government thereby if the Contractor--
(A) Fails to make redelivery of the corrected or replaced supplies within the time established for their return; or
(B) Fails either to accept return of the nonconforming supplies or fails to make progress after their return to correct or replace them so as to endanger performance of the delivery schedule, and in either of these circumstances does not cure such failure within a period of 10 days (or such longer period as the Contracting Officer may authorize in writing) after receipt of notice from the Contracting Officer specifying such failure.
(ii) Instead of correction or replacement by the Government, the Contracting Officer may require an equitable adjustment of the contract price. In addition, if the Contractor fails to furnish timely disposition instructions, the Contracting Officer may dispose of the nonconforming supplies for the Contractor's account in a reasonable manner.
The Government is entitled to reimbursement from the Contractor, or from the proceeds of such disposal, for the reasonable expenses of the care and disposition of the nonconforming supplies, as well as for excess costs incurred or to be incurred.
(5) The rights and remedies of the Government provided in this clause are in addition to and do not limit any rights afforded to the Government by any other clause of this contract.

ARITHMETIC DISCREPENCIES
(a) The following will be used in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by the bidder:
(1) In a discrepancy between unit price and extended price, the unit price stated on the bid schedule will govern;
(2) Apparent errors in the extension of unit prices will be corrected;
(3) Apparent errors in the addition of lump-sum and extended prices will be corrected.
(b) For the purpose of bid evaluation, the government will proceed on the assumption that the bidder intends his bid to be evaluated on the basis of the unit prices, the totals arrived at by resolution of arithmetic discrepancies as provided above and the bid will be so reflected on the abstract of bids.

RESPONSIBILITY CRITERIA
1. Responsibility Criteria IAW FAR Subpart 9.1: To ensure award is made to the responsible bidder, a determination of responsibility will be conducted. As part of this responsibility determination, the Contracting Officer will utilize the guidance contained in FAR Subpart 9.1, Responsible Prospective Contractors. In accordance with FAR 9.104-1, to be determined responsible, a prospective contractor must:
(a) Have adequate financial resources to perform the contract, or the ability to obtain them (see form below);
(b) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments;
(c) Have a satisfactory performance record, similar in scope and magnitude of that stated in the contract requirements;
(d) Have a satisfactory record of integrity and business ethics;
(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them;
(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
2. ATTENTION: Definitive Responsibility Criteria (DRC): In addition to examining the criteria in FAR
9.104-1 as listed above, the Contracting Officer will also examine whether the low bidder can meet the requirements of the definitive responsibility criteria mentioned in sections a) below. The apparent low bidder will be required to meet the following experience requirements:
a) Provide a minimum of two (2) projects completed* within the last ten (10) years** which demonstrate experience in the following:
o Must demonstrate experience in boat fabrication, meeting a dimension of at least 20’ long and 9’ wide and operates a minimum 440 horsepower engine.
*All Project examples must be at a minimum 75% complete in order to be considered.
**Define “10 years” as 10 years from the date the solicitation is posted.
The Contracting Officer will verify the submitted projects meet the definitive responsibility criteria as part of the responsibility determination. Bidders are not required to submit additional documentation related to these criteria at the time of the bid. Instead, the Government will request the supporting documentation within a reasonable timeframe after bid opening and the apparent low bidder will be expected to provide the DRC information within two (2) business days after the Government's request.
