4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

The statutory authority permitting other than full and open competition is Title 41, U.S.C.

3204(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy the agency requirement.” This OpenText brand name is peculiar to one manufacturer and is essential to the Government’s requirements in accordance with FAR 6.302-1(c).

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE

OF THE AUTHORITY CITED:

In accordance with FAR 6.302-1, brand name Open Text Software Licenses and Maintenance are essential to the Government's requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency's requirements. A brand name, whether available on one or more contracts, is an item peculiar to one manufacturer and may be procured by brand name specification if essential to the Government's requirements. The Open Text brand name specification is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company.

DLA has a requirement to secure licensing required for the operation and sustainment of Document Automation Content Services (DACS) operations. Because DACS operates on the OpenText platform and products, DLA requires the continued software subscription and support for the OpenText products it utilizes as the platform for the DACS system. The OpenText products form the basis of DACS and as such, are essential to its operation. DACS consists of 50+ external and internal data stores consisting of over 90 Terabytes of data that are accessed by over 20,000 external and internal users. Therefore, OpenText Licensing, Maintenance, and Support is essential to the Government’s requirement and are the only products that will meet the Government’s needs.

OpenText Content Suite (previously called IOXS and Livelink) is the seamlessly integrated business records management and document solution for SAP applications which enables businesses to archive and manage the large amounts of documents and data produced by their SAP systems. OpenText Content Suite is a required component of DLA’s SAP architecture and has many features. It is used to archive R/3 transaction data to archive storage systems in order to maintain a reduced data footprint for the R/3 system. Content Suite accomplishes this by automatically moving older, less frequently accessed data from costly online disks to less expensive Azure BLOB disk storage, thus saving operational costs. Because Content Suite is seamlessly integrated with the SAP system, retrieval, access, and document display all take place directly within the SAP application. Content Suite and its associated background processes are used by SAP R/3 to access information without the need for end-user interaction.

The system makes archived data available for congressionally mandated time periods, reduced operational costs, and improves system performance for more frequently accessed online data.

Because this specific OpenText product is integrated with the Government’s SAP business systems and is an integral part of users’ day to day interaction with their business data, DLA requires that the maintenance support for this software be purchased to avoid risk of data loss, or system failure due to the lack of availability of essential vendor patches and help desk support that are required to keep the system operating flawlessly. OpenText provides patches, which would be included in the maintenance support, which may include items that close discovered security vulnerabilities, improve performance, correct software glitches or provide additional functionality, all of which hep to protect DLA’s assets, control costs, and keep the current end users of the DLA’s SAP systems working efficiently and effectively to support the war fighter.

OpenText brand support services are the only services that can meet the Government’s requirements because OpenText is the only source with access to OpenText Operating System software code. Additionally, OpenText possesses unique knowledge of future OpenText products and the associated updates. OpenText support is essential to the Government’s requirement precluding consideration of a product, manufactured by another company. In short, the OpenText software maintenance are the only products that can meet the Government’s needs as stated.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

The current action will be issued on an Unrestricted basis via “Open Market” procedures as a Request for Proposal (RFP) posted to SAM.gov in accordance with FAR 5.201(b). All responsible parties, including authorized OpenText resellers will be given an opportunity to submit an offer.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE:

As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. The Government will attempt to obtain offers from as many vendors as practicable. Proposals will be analyzed in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1)
