SAFETY AND ENVIRONMENTAL COMPLIANCE OFFICE (SECO)
NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION (NOAA)

Performance Work Statement
NOAA Environmental Compliance & Safety Assessment System (NECSAS) Program
1. GENERAL INFORMATION
1.1 Introduction and Background
NOAA’s mission is to understand and predict changes in Earth’s environment and conserve and manage coastal and marine resources to meet our Nation’s economic, social, and environmental needs. The SECO within NOAA is responsible for safeguarding NOAA’s workforce and assets while aiding in environmental and energy stewardship. SECO establishes NOAA-wide standards, guidelines and procedures to implement Federal, state, and local statutes and regulations; develops NOAA-wide policies and working procedures promoting occupational health, industrial hygiene, safety and environmental compliance; develops program goals and objectives, training programs, evaluates the implementation of programs; monitors and assessments compliance progress; and advances best practices within NOAA for these programs.
To support this effort, SECO requires professional assistance from a contractor to provide expertise and technical assistance by performing assessments for environmental compliance, safety and occupational health. The period of performance is one year after date of award. The government does have option periods that may be exercised for up to an additional four years. The contractor must ensure the continuity of effort for the duration of the order.
1.2 Scope
The purpose of this order is to provide the necessary technical professional services to conduct environmental compliance, safety and occupational health assessments for SECO, which is under the Office of Chief Administrative Officer (OCAO).
The Contractor shall provide all personnel, tools, materials, supervision, and other items necessary to provide these services that meet the Government’s requirements in accordance with this Performance Work Statement.
2. DEFINITIONS
2.1 Contracting Officer (CO).
A person with the authority to enter into, administer, and/or terminate contracts (also referred to in this document as Orders) and make related determinations and findings. The term includes certain authorized representatives of the contracting officer acting within the limits of their authority as delegated by the contracting officer.
2.2 Contracting Officer’s Representative (COR).
A Federal employee delegated limited authority by a Contracting Officer to monitor and perform specific, enumerated contract management duties related to contract planning, contract administration, technical oversight, and closeout to ensure that the Contractor’s performance meets the standards set forth in the contract.
2.3 Defective Service.
A Service output that does not meet the standard of performance requirement specified in the Order for that service.
3. TECHNICAL ORDER REQUIREMENTS
3.1 Contract Manager/Program Manager
3.1.1 The Contractor shall provide a contract manager who shall be responsible for the performance of all work. The name of this person, and an alternate or alternates, who shall act for the Contractor when the manager is absent, shall be designated in writing to the contracting officer (CO).
3.1.2 The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this Order.
3.1.3 The contract manager or alternate shall be available during normal duty hours within thirty (30) minutes to meet by phone or at the facility with government personnel (designated by the CO) to discuss problem areas. After normal duty hours, the manager or alternate shall be available within two (2) hours. The contract manager shall provide an emergency phone/cell phone to the COR and CO.
3.1.4 The contract manager and alternate or alternates shall be able to read, write, speak, and understand English.
3.2 Contractor Employees
3.2.1 The Contractor shall not employ persons for work on this C if such employee is considered by the CO to be a potential threat to the health, safety, security, general well-being, or operational mission of the facility and its population.
3.2.2 Contractor personnel shall present a neat appearance and be dressed appropriately for the work to be completed.
3.2.3 The Contractor shall not employ any person to work under this Order if employing that person would create a conflict of interest. Before employees can begin work, they shall sign and submit a “Conflict of Interest Certificate,” otherwise known as Attachment 4, and “Employee/Contractor Non-Disclosure Agreement Form,” otherwise known as Attachment 5 to the CO and COR as specified in the specific Call Order. These documents shall be provided to the COR.
3.2.4 Public Communication: The Contractor shall not represent itself as NOAA to outside parties. To maintain public trust and not mislead the public, the Contractor shall when communicating with outside parties, at the outset of any communications concerning all matters relating to the performance of this Order, explain that it is an Agency Contractor.
3.3 Contractor Work Force Responsibility
It shall be the full responsibility of the Contractor to organize, furnish, maintain, supervise, and direct a workforce, which, within the limitations of the provisions of this Order, is thoroughly capable of effectively performing the work set forth in this Order. The contractor shall provide all required personnel with subject matter expertise to assess NOAA facilities.
3.5 Performance Evaluation Meetings.
The CO may require the contract manager to meet with the CO, COR, and other government personnel as deemed necessary. The contractor may request a meeting with the CO when he or she believes such a meeting is necessary. Written minutes of any such meeting shall be prepared by the Contractor. The contract manager, COR, and CO shall sign those minutes. If either party does not concur with any portion of the minutes, such non-concurrence shall be provided to the CO within seven (7) calendar days following receipt of the minutes.
3.7 Performance of Contractor and/or Subcontractor(s)
3.7.1 The Contractor’s performance will be evaluated at interim intervals during the performance of this Order and upon completion. Past performance reviews shall occur no less frequently than annually. Subcontractor information may be included for evaluation areas where the subcontractor actions have significantly influenced the prime contractor’s performance.
3.7.2 Marginal or unsatisfactory interim evaluations and final evaluations will be uploaded to the Past Performance Information Retrieval System (PPIRS) at www

PPIRS is a web-enabled application that supports the completion, distribution, and retrieval of Contractor performance information, as required by Federal Acquisition Regulation (FAR) Subpart 42.15. At the post award conference, the Government will provide the Contractor an explanation of the performance elements against which the Contractor’s performance will be evaluated. The discussion will also include the expectations for satisfactory and unsatisfactory performance.
3.8 Government Point of Contact for Quality Assurance.
See CAR Clause 1352.201-72, Contracting Officer’s Representative (COR). If a QAE is designated on a Call Order, a separate letter shall be provided to the Contractor indicating that individual’s authority.
3.9 Hours of Operation and Holidays
3.9.1 The Government’s hours of operation are typically from 7:30 AM to 6:00 PM Monday through Friday, except for legal holidays. Any deviations from this schedule shall be annotated in the specific Call Order. The Contractor shall be required to complete all work during the specified hours of operation. If any unique circumstances arise in which there is a need to deviate from these hours, the Contractor shall contact the CO at least five (5) business days prior with the specific details regarding the need for a deviation. If the deviation is acceptable, the CO will notify the Contractor.
3.9.2 Official Federal Holidays

3.10 Weapons, Firearms, and Ammunition
Contractor employees are prohibited from possessing weapons, firearms or ammunition, on themselves or within their contractor-owned vehicle or privately owned vehicle while on Government property.
3.11 Insurance
See FAR Clause 52.228-5, Insurance – Work on a Government Installation and CAR Clause 1352.228-70, Insurance Coverage for more details.
3.12 Security
3.12.1 Computers and Information Technology Systems. Data collected under this Order may reside on the contractor’s or designated partner’s server. Therefore the Certification and Accreditation (C&A) requirements of Clause 1352.239-73 do not apply.
3.12.2 Site Specific Security Issues. Contractor shall comply with all pertinent site-specific security regulations and procedures for each facility. This includes but is not limited to obtaining proper qualifications and identification badges for facility access; securing escorts where appropriate for entry into sensitive areas; and adherence to security requirements.
3.13 Government-Furnished Materials
The government shall provide copies of the following government furnished materials (GFM) for use by the contractor during the performance of this Order. All GFM, shall remain the property of NOAA. The Government shall provide the following items for use by the Contractor by the kickoff meeting:
3.13.1 Applicable access to facilities to be assessed.
3.13.2 Applicable requirements to support the assessment of NOAA’s internal requirements (e.g., NOAA Administrative Orders (NOAA), etc.).
3.13.3 Previous assessment findings, corrective action plans, and open/closed findings for the applicable facilities to be assessed.
3.13.4 The government shall provide checklists on NAO requirements to contractor to be used as protocols during the assessment. Other information shall be furnished based on request.
3.13.5 Conference call numbers, web-meetings, and office space within the assessed facilities to conduct team meetings during the course of the assessments.
3.14 Government-Contractor Relations (Non-Personal Services)
3.14.1 The Government and Contractor understand and agree that the services to be delivered under this Order are non-personal services as defined in the Federal Acquisition Regulations Part 37.101. No employer-employee relationship exists or will exist under this Order between the Government and the Contractor’s personnel.
3.14.2 Contractor personnel under this Order shall not be placed in a position where they are under relatively continuous supervision and control of a Government employee.
3.14.3 Employee relationship. The rules, regulations, directives, and requirements that are issued by NOAA under its responsibility for good order, administration, and security are applicable to all personal who enter the Government installation or who travel using Government transportation. This is not to be construed or interpreted to establish any degree or Government control that is inconsistent with a non-personal services contract.
3.14.4 Inapplicability of employee benefits. This Order does not create an employer-employee relationship. Accordingly, entitlements and benefits applicable to such relationships do not apply.
3.14.5 Notice. The Contractor should notify the CO in writing promptly, within three (3) calendar days from the date of any incident that the Contractor considers to constitute a violation of this clause. The notice should include the date, nature and circumstance of the conduct; the name function and activity of each Government employee, or Contractor official or employee, involved or knowledgeable about such conduct; identify any documents or substance of any oral communication involved in the conduct; and the estimate in time by which the Government shall respond to the notice to minimize cost, delay, or disruption of performance.
3.15 Invoices
3.15.1 The Contractor shall prepare and submit to the COR via email, with a copy to the CO, partial payment estimates, which shall serve as the request for payment. Invoices shall be accompanied by a progress report and other supporting documentation (such as timesheets, travel reimbursement requests, etc.) to verify the amount requested by the Contractor. All partial payments shall be based on work completed as of the end of the most recent billing period and shall be submitted by the 10th day of the subsequent month. The pay estimate shall state the work accomplished during the billing period.
3.15.2 To constitute a proper invoice in accordance with FAR 52.212-4(g), it shall include the items listed in paragraphs (1) through (7) of this section. If the invoice does not comply with these requirements, it will be returned within seven (7) calendar days after the date the designated office received the invoice with a statement of the reasons why it is not a proper invoice.
3.15.2.1 Name and address of the Contractor;
3.15.2.2 Invoice date and number (Contractors are strongly encouraged to assign a sequential invoice numbering system and date invoices as close to the date of mailing as possible);
3.15.2.3 Contract number & Order number, and line item number;
3.15.2.4 Description, quantity, unit of measure, unit price, and extended price of items delivered (supplies and/or services);
3.15.2.5 Terms of any discount for prompt payment offered;
3.15.2.6 Name and address of official to whom payment is to be sent; and
3.15.2.7 Name, title, and phone number of person to be notified in the event of a defective invoice (Contractors are encouraged to also include the mailing address of this individual).
3.16 Monthly Progress Reports
The monthly progress reports, under 1352.237-74, shall also capture any performance issues, estimated completion dates, percentage of completion, outstanding government issues/concerns/data requests, and document any outstanding issues from the Contractor. Additionally, the monthly progress report shall develop and maintain a chronological record of all relevant e-mails, telephone conversations, discussions and meetings with other Federal agencies (e.g. Occupational Safety and Health Administration (OSHA), Council on Environmental Quality (CEQ), etc.) and other parties associated with performance of work relative to this PWS. The first report shall include a detailed work outline of the project by reporting period. This report shall be submitted electronically via email in MS Word 2010 compatible or Adobe to the COR and CO. The monthly progress report shall accompany the monthly invoice submission.
3.17 Confidential Information
3.17.1 The term "information", as defined herein, includes, but is not limited to, oral or written communication, planning documents, strategy, research documents, data, conclusions, field notes, computer files, designs, equipment, photographic or video media, or conversations related to any work performed for NOAA. The term “information” also includes internal Government memoranda, draft and final documents, procurement sensitive information including information on other contractors, cost or pricing information, financial information, as well as information marked “Confidential Business Information” or information not specifically marked, but falling within the meaning of “Confidential Business Information,” and “Attorney-Client Work Products.”
3.17.2 Any information viewed, received, obtained, developed or generated pursuant to the work assigned or work performed with NOAA is sensitive and may be used as a basis for identifying and evaluating policy options, planning future budget and work priorities, or ongoing or future litigation. Some information may carry additional sensitivities and restrictions relative to use or disclosure including “Confidential Business Information” and “Proprietary Information.”
3.17.3 The Contractor shall keep any such information confidential and to otherwise use discretion and exercise reasonable care and caution to prevent the potential compromise of any restrictive markings or ongoing or future plans or litigation. The Contractor shall not use, make reference to or reveal to any person or entity not working under the direction of NOAA, any information, whether that information is provided to the Contractor by NOAA, provided to the Contractor by another party at NOAA direction, or developed or generated by the Contractor pursuant to a work assignment, without the prior written approval of the CO or COR.
3.17.4 The Contractor shall make no public announcements or disclosures relative to information and/or data, preliminary or otherwise, developed in this contract. This also applies to Government-owned information and/or data made available to the Contractor. The confidentiality of this extends to other Government agencies and other NOAA offices, unless specifically authorized by SECO/OCAO.
3.18 Travel
3.18.1 In order to receive payment, all travel expenses shall be approved by the Government prior to travel. Travel proposed and approved by the Government in the Contractor’s quote is considered Firm-Fixed Price and shall not require additional approval.
3.18.3 The travel expenses will be computed at the per diem rate(s) provided in the Federal Travel Regulations (FTR) in effect at the time of the Contract Award. When evaluating proposed costs of travel, the Government will make the following assumptions:
3.18.3.1 Travel with a privately owned vehicle shall be at the rate effective in the Federal Travel Regulations at Award.
3.18.3.2 No per diem (including meals) will be paid when the official travel is 12 hours or less, within the continental United States.
3.18.3.3 Commercial Airline tickets purchased will be:
3.18.3.3.1 Lowest non-penalty coach fare available which satisfies the schedule (except for immediate departure) or
3.18.3.3.2 Reserved/purchases as far in advance as possible to make maximum use of discounts.
3.18.3.3.3 Airport parking for one (1) night or more will be paid for at the long-term parking rate.
3.18.5.5 Rental vehicles are authorized as follows:
3.18.5.5.1 For 3 or less people – not to exceed the cost of the least expensive compact size; or
3.18.5.5.2 For 4 or 5 people – not to exceed the cost of the least expensive mid-size car/station wagon; and van.
3.18.5.5.3 For 6 or more people, or for carrying equipment, samples, or other materials – the least expensive of a van, or combination of station wagon, compact and van.
3.18.5.6 Per Diem expenses for the day of departure and last day of travel are at 75% of the applicable Meal and Incidental Expense (M&IE) rate.

3.18.7 When submitting a proposal for a call order that involves travel, the Contractor shall provide the information below:
3.18.7.1 Purpose of the Travel;
3.18.7.2 Tentative Travel Dates;
3.18.7.3 Method of Travel (e.g. Private vehicle, airplane, etc.), cost for that method, and baggage expense, if applicable;
3.18.7.4 Duration of Travel;
3.18.7.5 Departure Location and Arrival Location;
3.18.7.6 Number of people on Travel:
3.18.7.7 Per diem expenses per day;
3.18.7.8 Lodging Expenses per day, if applicable;
3.18.7.9 Lodging Taxes per day, if applicable;
3.18.7.10 Distance from Office or Home to Airport or Other Transportation Facility, if applicable;
3.18.7.11 Parking costs per day at the Airport, if applicable;
3.18.7.12 Method of Transportation at Arrival Destination (e.g. – Subway/Metro, Bus, Taxi, Rental Car) with projected costs, if applicable; and
3.18.7.13 Quantity and Cost of Fuel for a Rental Car, if applicable.
4. TASKS TO BE COMPLETED
4.1 General Information
The Contractor shall provide all personnel, tools, materials, supervision, and other items necessary to provide these professional and technical services that meet the Government’s requirements in accordance with this Performance Work Statement. The principal objective of this Performance Work Statement is for the Contractor to conduct environmental compliance, safety and occupational health, compliance assessments at the NOAA facilities.
4.2 Kick-off Meeting. The contractor shall participate in a meeting hosted by the government via conference call to discuss the Order requirements, Quality Control Plan, and coordinate tasking and schedule of deliverables for the tasks listed in paragraph 4.5. This meeting shall be held within thirty (30) days of award.
4.3 Assessment and Reporting System. The contractor shall provide a web-based assessment protocol, tracking, and reporting tool. The web-based assessment and reporting system allows employees to provide comment/feedback on draft findings. The contractor should be competent in using this assessment tool and able to provide training to NOAA personnel to become familiar with the software. The assessment and reporting IT system must meet the following specifications:
· Be web-based; accessible through Internet Explorer, Google Chrome, or other equivalent internet browser.
· Allow full user access up to a total of 20 individuals in the NOAA.
· Allow limited access (e.g., input data for an incident report) by all employees in the following organizations:
· National Marine Fisheries Service (NMFS)
· National Ocean Service (NOS)
· National Environmental Satellite, Data & Information Service (NESDIS)
· Oceanic & Atmospheric Research (OAR)
· National Weather Service (NWS)
· Office of Marine & Aviation Operations (OMAO)
· Include the following environmental compliance and safety assessment regulatory protocols:

· 40 CFR [all parts]
· 36 CFR 800
· 49 CFR 100 – 185
· ISO 9001/14001/18001 Standards
· State Environmental Regulations (all 50 States)

· Allow NOAA to customize assessment questions and make findings based on internal policies.
· Track Notices of Violation or other regulatory agency findings.
· Allow the ability to add ad-hoc findings.
· Track progress and completion of tasks and corrective actions resulting from self-assessments, second-party assessments, and third-party assessments.
· Assign individuals responsible for tasks/corrective actions via e-mail.
· Generate standard summary reports providing the number of outstanding findings, average time to close findings, most frequently occurring findings, etc.
· Conduct trend analysis.
· Be administered by assigned individuals within NOAA without needing outside assistance (e.g., add/delete users, add internal protocols, generate reports, etc.).
· Provide administrator-level training and unlimited web-based general use trainings.
· Allow the ability to add and upload environmental inventory forms.
· Allow all data to be extracted to an Excel spreadsheet.
· Be FEDRAMP certified and able to adhere to NOAA IT security guidelines.
NOAA’s access to the full and limited user accounts shall be provided no later than (60) sixty days after award to the COR.
4.4 Assessment Planning
4.4.1 The contractor shall perform activities as outlined in the paragraphs below. If the contractor finds that industry standards, legal or other agency requirements require specific organization or additional information not requested by COR, the contractor shall follow those relevant industry standards, legal, or other agency requirements and advise the COR of any discrepancy with the instructions received. The contractor must perform the work within the delivery schedule outlined in Section 5.
4.4.2 Plan Appropriate FY Assessments and Prepare an Assessment Schedule. The contractor shall coordinate with the COR to develop a schedule of all on-site visits, including assessment briefings and duration of facility visits. This schedule shall be utilized for the duration of the Order. Any changes to the schedule must be approved by CO. The schedule is due within (60) sixty days after the kick-off meeting. It shall be provided to the CO and COR for review and approval. The list of potential locations and number of assessments is provided in Attachment 6.
4.4.3 Prepare Assessment Checklists. NOAA will provide site information for the Contractor to develop and complete assessments checklists for the various locations. The assessment checklists shall be used during the assessments along with applicable protocols. The assessment checklists shall be provided at least ten (10) days prior to each on-site assessment per the Assessment Schedule to the COR.
4.5 Performance of the Environmental Compliance, Safety, and Occupational Health Assessments
4.5.1 Prepare and Conduct the Assessment Briefings. The contractor shall provide a draft of the pre-assessment briefings to the COR at least ten (10) days prior to the assessment. The Contractor shall prepare and conduct an entrance, daily update, and exit briefings for NOAA staff at each assessment facility. The entrance and exit briefings shall be PowerPoint 2010 compatible. The entrance briefing shall include, but not be limited to, introduction, protocols, procedures, schedule, and expectations. Daily briefings will include, but not be limited to, briefing findings needing immediate resolution, identifying best management practices, determining/finalizing logistics for the upcoming day. The exit briefing shall include, but not be limited to, findings, observations, noncompliance and adherence to sound management practices. Photo-documentation shall be included in the exit briefing, as appropriate.
4.5.2 Conduct the Assessment. The Contractor shall conduct an on-site assessment using the protocols specified in paragraph 4.3 above. The assessment will be based on objective evidence of compliance, including a records search, interviews, and visual site surveys. During the on-site assessment, the Contractor shall use applicable protocols to document site conditional data (preparation of draft dataset). An analysis of all environmental and safety hazards (findings) shall be made to determine the degree of risk associated with each hazard.
4.5.3 Data Collection. The Contractor shall collect and compile all data regarding any findings of noncompliance related to safety, health, environmental compliance or sustainability. Any data collected during an on-site assessment shall be entered into the iEHS software tool (also see paragraph 4.4.5). In the event the Contractor detects conditions that pose an immediate danger to human health and safety or extreme hazard to the environment, the Contractor team member shall immediately report the facts to the on-site coordinator for the assessment facility and COR.
4.5.4 Draft Dataset. Following the conclusion of the site assessment activities, the Contractor shall conduct a more thorough QC review of the data collected with assistance and comments from COR, as received from Line Office personnel and/or SECO as required. The draft dataset will contain only validated findings and issues as determined by the joint review. The Draft Dataset will be posted to iEHS within seven (7) days of each assessment. The dataset will be finalized in the Draft Assessment Report and used as a corrective action plan for each assessed facility.
4.5.5 Draft Assessment Report. The Contractor shall use the data collected during the on-site assessment to prepare a draft assessment report. The information within the draft assessment report will be briefed during the exit briefing. The draft assessment shall be provided as an electronic softcopy via email in Word 2010 compatible format or other approved format such as from the iEHS software reporting feature within fourteen (14) calendar days of completion of the Draft Dataset. The draft assessment shall be provided to the COR.
4.5.6 Final Assessment Report. The COR shall review the Draft Assessment Report and provide the contractor all necessary rewrites, corrections, and comments within fourteen (14) calendar days of receipt. The final assessment report shall incorporate all these suggestions. The Final Report is due within fourteen (14) calendar days of receipt of the feedback on the draft report. The report shall be in Word 2010 compatible, other approved format from the iEHS software reporting feature, or Adobe and shall be provided to the COR.
4.5.7 Summary Assessment Report. The Contractor shall use the final assessment reports to roll-up the assessment data/information into a summary assessment report for briefing to NOAA leadership. The summary assessment report shall be completed within fourteen (14) calendar days after completion of the Final Assessment Report per each site assessment.

DELIVERABLES AND DELIVERY SCHEDULE SUMMARY
All deliverables must be submitted electronically only to the government along with the supporting administrative record (e.g., notes of discussion, photos, references, etc.). Materials (e.g., supplies, binders, copies) are not anticipated under this Order. Appropriate verification electronically (e.g., e-mail delivery confirmation, etc.) shall be proof that the submission was made in a timely manner.
