Performance Work Statement Environmental Services

C. GENERAL INFORMATION

1.1 Introduction and Background

NOAA’s mission is to understand and predict changes in Earth’s environment and conserve and manage coastal and marine resources to meet our Nation’s economic, social, and environmental needs. The SECO within NOAA is responsible for safeguarding NOAA’s workforce and assets while aiding in environmental and energy stewardship. SECO establishes NOAA-wide standards, guidelines and procedures to implement Federal, state, and local statutes and regulations; develops NOAA-wide policies and working procedures promoting occupational health, industrial hygiene, safety and environmental compliance; develops program goals and objectives, training programs, evaluates the implementation of programs; monitors and assessments compliance progress; and advances best practices within NOAA for these programs.

To support this effort, SECO requires an Indefinite Delivery, Indefinite Quality (IDIQ) contract that will provide expertise and technical assistance with environmental services. SECO intends, through this procurement, to increase the number of contractors and resources available to provide required services, to enhance the ability to produce various data and reports. The contractor must ensure the continuity of effort for the duration of the order.

1.2 General Scope of Services Needed

The intent is to acquire professional expertise in environmental compliance and sustainability program areas to assist NOAA in initiatives such as: Environmental, Safety and Occupational Health assessments, Environmental impact statements (EIS), Environmental assessments (EA), Endangered Species Act (ESA)compliance, Environmental program and project management, Archaeological & cultural resources management, National Historic Preservation Act (NHPA Section 106), Historic services (NHPA Section 110), Waste and pollution prevention surveys and plans, Compliance effects of process modifications, Economic, technical, and/or risk analysis, Spill prevention/control Permitting, Environmental regulations and environmental policy/procedure updates, ISO 14001 Environmental Management System (EMS) and sustainable performance measure development, Resource Conservation and Recovery Act/Comprehensive Environmental Response Compensation and Liability Act (RCRA/CERCLA) site investigations and other environmentally related studies and/or consultations. The selected contractor(s) shall have subject matter expertise and demonstrated experience supporting Federal governmental agencies of similar size and scope to NOAA. The contractor shall provide all resources necessary to perform the specific requirements as defined in the Orders. Individual Orders will not be awarded that exceed $500,000 dollars or one year. Individual Orders will be awarded on a firm-fixed price or cost reimbursable basis. The Contracting Officer may waive the dollar limit and the period of performance ceilings for individual orders. Solely the Contracting Officer, on a case-by-case basis, shall determine deviations from the dollar limitation and the period of performance ceilings.

An individual order may require services in only one of these activities or a combination of the activities. All requirements, tasks and deliverables apply to contractors and all subcontractors awarded under this contract and all orders.

1.3 Contract Requirements

1.3.1 Quality Assurance. The contractor will develop a quality control plan that covers all aspects of the work to be performed under this contract. The quality control plan will include a contract management system that: facilitates early identification and rectification of potential problems; ensures high-quality data and deliverables; adherence to schedules, controls project costs, and maintains close communication with SECO. Project operations will include frequent conversations concerning progress and challenges, meetings to discuss and resolve problems, and regular reporting between the contractor and the Contracting Officer Representative (COR).The contractor will provide staff training as required for the project. The SECO COR, together with other NOAA staff, will make announced and unannounced visits to monitor contractor operations on-site.

1.3.2 Confidentiality Plan and Data Security Procedures. The contractor will ensure the highest degree of security to protect personal and confidential from intentional or unintentional release, loss, or destruction. Prior to receipt of any data files from NOAA, the contractor will submit a confidentiality plan and data security procedures for approval by the COR and revise it per the COR’s instructions. Data will be transferred, retained, utilized, and destroyed in All individuals working on the project must sign Non-Disclosure Statements. Contractors, contractor personnel, subcontractors, and subcontractor personnel shall be subject to the same Federal laws, regulations, standards, and NOAA Directives and Handbooks as NOAA and NOAA personnel regarding information and information system security. Every effort must be made to avoid inadvertent breaches of confidentiality.

1.3.3 Order Proposals. The contractor shall submit a technical and cost proposal for each TO under this contract within ten calendar days of receiving the TO's SOW from the CO, unless it calls for a different response time. The TO proposals shall address all requirements and options stated in the Order SOW, and shall describe how the requirements will be fulfilled, including a time schedule.

The Contractor shall summarize all exceptions it takes to the requirements of the Order SOW, and all deviations from the SOW which it requests be approved by the Government.

The Contractor may, at its discretion and in consultation with the CO, submit alternate proposals or proposals which deviate from the Order requirements; provided, that the Contractor also submit a proposal for performance of the work as specified in that SOW. Any "alternate" proposal may be considered if overall performance would be improved or not compromised, and if it is in the best interest of the Government. Alternate proposals, or deviations from any requirement of the Order SOW, must be clearly identified.

The Government intends to award either Firm Fixed Price or Cost Reimbursement TOs.

1.3.4 Issuance of Orders.

1.3.4.1 Ordering of Services. Services to be performed shall be ordered by the issuance of individual TO by the CO in consultation with and developed by the COR. As the need for professional services arises, the CO shall review the task to assure the requirement meets the guidelines outlined in part 8.405-3 of the Federal Acquisition Regulation (FAR). If the task meets the FAR requirement, the CO shall provide a proposed order to the Contractor.

1.3.4.2 Preparation of Proposals for TO. The contractor shall prepare a price proposal in a format which includes the following: labor-hours and the associated loaded rates, travel, subcontractor, other direct costs, G&A burden, and profit/fee. The contractor shall provide sufficient detail for each element to allow a thorough analysis by the Government. The proposal shall be submitted to the CO within a Government-specified schedule, normally within two calendar weeks.

1.3.4.3 TO Agreement. When agreement is reached, a bilateral TO shall be issued specifying all agreed terms and incorporating the provisions of this contract. If agreement cannot be reached, the CO shall terminate negotiations with the contractor. In the event such negotiations are terminated, the Government reserves the right to commence negotiations with other contractors.

2 SPECIFIC TASKS AND DELIVERABLES (general descriptions below, specific Scopes of Work (SOW) provided separately).

2.1 Task 1. Environmental Compliance, Safety and Occupational Health Assessments

The contractor shall conduct compliance assessments at NOAA facilities aimed at monitoring current compliance with environmental, safety, and occupational health requirements (Federal, State, local, and agency-specific). These compliance assessments shall occur at NOAA facilities throughout the continental United States.

2.2 Task 2. National Environmental Policy Act (NEPA) and Related Support for Proposed NOAA Actions

The contractor shall conduct the necessary impact analyses for proposed federal actions and prepare associated documents to assist in compliance with the National Environmental Policy Act (NEPA). This includes but is not limited to: Environmental Assessments (EA) and Environment Impact Statements (EIS), and application materials for other local, state, and federal regulatory permits and documentation and studies (i.e., endangered species surveys, cultural resource investigations and coordination, etc.)

The contractor shall provide, compile and obtain all necessary documentation for preparing EAs, EISs and other regulatory compliance materials such as Section 7 consultations under the Endangered Species Act, Section 106 of the National Historic Preservation Act, Sections 404 and 401 of the Clean Water Act, and Essential Fish Habitat under the Magnuson-Stevens Act.

2.3 Task 3. Floodplain and Wetlands Surveys

For proposed NOAA projects, the contractor shall evaluate compliance with compliance with EO 11988 and EO 11990, and conduct necessary surveys/delineations (floodplain delineation, and wetlands delineation) as required

2.4 Task 4. Hazardous Material Surveys

The contractor shall conduct surveys of facilities for hazardous materials including, but not limited to: asbestos containing materials (ACM), lead based paint (LBP), polychlorinated biphenyls (PCBs), and radon.

2.5 Task 5. Environmental Site Assessments

The contractor shall conduct Phase I and Phase II Environmental Site Assessments in accordance with ASTM Standards 1903-11, 1527-13

2.6 Task 6. Site Characterization, Remediation and Restoration Services

The contractor shall provide site characterization, remediation, and restoration services to fully characterize the nature and extent of contamination, as well as recommend and implement (as required) remediation and restoration activities to address identified site contamination.

This shall include, but not be limited to the following: preliminary assessment, site inspection, testing, remedial investigation, feasibility studies, remedial design, containment, remedial action, removal of contaminated materials, storage of contaminated materials and security and site closeouts.

2.7 Task 7. Data Management related to Environmental Compliance Programs.

The contractor shall maintain NOAA databases by entering new and updated information for various environmental programs. This will included, but is not limited to: Preparation of data for computer entry by compiling and sorting information; establishing entry priorities, processing documents by reviewing data for deficiencies; resolving discrepancies by using standard procedures or returning incomplete documents to the team leader for resolution, verification of entered data by reviewing, correcting, deleting, or reentering data; purging files to eliminate duplication of data, security of information by completing data base backups and preparation of tables, diagrams, or other documents needed for reporting purposes.

2.8 Task 8. Support Implementing the NOAA Environmental Management System.

The contractor shall support NOAA’s implementation/execution of the compliance-focused EMS. Examples include but are not limited to: development and delivery/implementation of environmental action plans, guidance documents, and training; support with the NOAA environmental compliance website, and develop and/or deliver training and guidance documents (i.e. Standard Operating Procedures).

2.9 Task 9. Building/Structural Demolition Related to Environmental Site Restoration The contactor shall provide all labor, equipment, and materials for demolishing buildings/structures as related to site restoration work. The site restoration work shall be required for the disposal of real property or as part of an environmental site remediation project. This shall include, but not be limited to the following: obtaining permits, performing line locates, disconnecting utilities, removing hazardous materials (e.g. asbestos, PCBs) from buildings/structures prior to demolition, removing personal property from the premises, transporting and disposing of demolition debris, hazardous materials, and personal property at off-site location(s), and grading the site to fill voids, depressions, etc. after demolition activities to restore the site to its original condition.

2.10 Task 10. Support of Sustainability and Energy Program

The contactor shall provide all labor, equipment, and materials to assist in: monitoring and reporting energy performance data; preparing energy and sustainability reports and guidance documents; conducting greenhouse gas inventory calculations; providing technical expertise and analysis of regulations and executive orders in the areas of energy and sustainability.

3 HOURS OF OPERATION

Hours of operation will be identified in individual Call Orders. Generally, Government offices are closed for the following Federal holidays and occasionally during other designated periods. Contractors who may be working at DOC or other Government facilities shall not be able to perform activities onsite on these days or during those periods designated for closure:

When any such holiday falls on a Saturday, the preceding Friday is observed; when any such holiday falls on Sunday, the following Monday is observed.

Government closures may occur during the contract performance period as a result of Executive Order, Office of Personnel Management direction or other form of Federal proclamation. These closures are often due to inclement weather, potentially hazardous conditions or other special circumstances. Closures or delays of this nature during the performance period do not entitle the Contractor to compensation for time not worked or to an automatic period of performance extension.

Hours will be identified in each Call order. General facility base hours are between 8:00 am and 5:00 pm Monday through Friday. Extended hours are not an authorization for overtime or premium pay.

4 GOVERNMENT FURNISHED RESOURCES

The Government will provide access to facilities where services are required.

5 TRAINING, LICENSES AND CERTIFICATIONS

The Contractor shall be responsible for any special training, licensing and certifications of Contractor personnel necessary to provide the expertise and support required by this contract.

The Contractor shall be responsible for training the Government on any software or reporting systems that are developed during the performance of this contract.

a. IDENTIFICATION OF CONTRACTOR EMPLOYEES All contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

b. TRAVEL Travel may be required in performance of the tasks. Authorized travel will be identified in individual Call orders. If travel is not specifically authorized in writing, travel is not authorized as a separate billable expense. Authorized travel shall be in accordance with the Federal Travel Regulation and the Federal Acquisition Regulation part 31.205-46. Travel reimbursed under Task/Call Orders issued under this contract shall be based on the most economical form of transportation available only. Any costs deemed unreasonable will be reduced to a reasonable amount. Improper costs will be disallowed and deducted from the invoice. Any exceptions shall be fully justified and documented with the invoice. All travel shall be scheduled sufficiently in advance to take advantage of available discount rates.

Travel requirements shall be met using the most economical form of transportation available. This includes using connecting rather than direct flights, and reasonable efforts to insure the most economical flights are secured. Simply relying on a travel agent may not be sufficient. If economy class transportation is not available, the invoice must include justification for use of higher class travel indicating dates, times, and flight numbers.

6 SECURITY REQUIREMENTS

Computers and Information Technology Systems Data collected under this Order may reside on the contractor’s or designated partner’s server. Therefore the Certification and Accreditation (C&A) requirements of Clause 1352.239-73 do not apply.

Site Specific Security Issues Contractor shall comply with all pertinent site-specific security regulations and procedures for each facility. This includes but is not limited to obtaining proper qualifications and identification badges for facility access; securing escorts where appropriate for entry into sensitive areas; and adherence to security requirements.

7 CONFLICTS OF INTEREST

Performance under this contract is not anticipated to create any Organizational Conflict of Interest (OCI). However; should the Contractor and/or subcontractor personnel performing work under this contract come into contact with information that may create a competitive advantage on a future Government acquisition, the Contractor is required to notify the Contracting Officer within 3 business days of when the potential OCI is discovered.

8 DATA RIGHTS

The Government has unlimited rights to all documents/material produced under Call orders. All documents and materials, to include the source code of any software produced, designs, blueprints and plans, whether resulting in a solicitation or not, shall be Government owned and the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the Contractor without written permission from the CO. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose. This right does not abrogate any other Government rights.

9 DIRECT LABOR COSTS

Direct Labor costs under this contract includes Contractor employee labor, Sub-Contractor employee labor and Consultant labor. Maximum direct labor rates are identified in Attachment 1, BPA Pricing.

10 REPORTS AND DELIVERABLES

All deliverables must be submitted electronically only to the government along with the supporting administrative record (e.g., notes of discussion, photos, references, etc.). Materials (e.g., supplies, binders, copies) are not anticipated under this Order. Appropriate verification electronically (e.g., e-mail delivery confirmation, etc.) shall be proof that the submission was made in a timely manner.

a. DELIVERABLE SCHEDULE The contractor shall prepare and submit the deliverables as required and defined in this SOW in accordance with the Schedule of Deliverables, Section F.3.
