PERFORMANCE WORK STATEMENT

REFUSE/RECYCLING SERVICES

PART 1

GENERAL INFORMATION

1.0 GENERAL: This is a non-personal services contract to provide refuse and recycling services. The

Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform refuse and recycling services at the National Bio and Agro- Defense Facility (NBAF) as defined in this Performance Work Statement (PWS), Section 3.0 except for those items specified as government furnished property and services. The location of the refuse/recycling containers are identified in Appendix A. The Contractor shall perform to the standards of this PWS. All performance times referred to in this PWS are calendar days, unless otherwise specified.

1.1 Objectives: The objective of this contract is to support mission accomplishment by providing refuse and recycling services for occupants, users, and visitors to NBAF through this contract. To meet this objective, close coordination is required between the Contractor and the Contracting Officer’s Representative (COR), to efficiently provide improved grounds maintenance while minimizing disruptions to operations within the facilities/grounds and meeting security requirements.

1.2 Scope: The Contractor shall perform refuse and recycling services to the standards in this contract and in a manner that will maintain safe and healthy facilities identified on Appendix A. See Technical Exhibit (TE) 1 for dumpster information. During the performance of this contract USDA- ARS reserves the right to add or delete refuse/recycling collection locations. A modification to the contract will be executed to incorporate these changes.

1.3 Licenses, Permits and Bonds: The Contractor shall provide at his own expense all licenses, permits and bonds as required by the State, Counties and Municipalities where they will operate in the transport and disposal of the solid waste removed under the terms of this contract.

1.4 Period of Performance: The period of performance (POP) shall be for one (1) Base Year of 12 months and four (4) 12-month option years.

1.5 Place of Performance: The work to be performed under this contract will be performed at the United

States Department of Agricultural NBAF Transshipping facility, located in Manhattan Kansas, identified on Appendix A.

1.6 Hours of Operation: The Contractor is responsible for providing services between the hours of 0800 to 1600, Monday through Friday except Federal holidays or when the USDA-ARS facility is closed due to unforeseen facility closings. Unforeseen facility closings: meaning when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. Contractor will be notified by the COR of the NBAF closure.

The contractor will not be reimbursed when the NBAF is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the USDA-ARS facility is not closed for the above reasons.

When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. When an unforeseen NBAF closure occurs on a regularly scheduled day of work, the Government shall have the following options:

1.6.1 To require the Contractor to perform the work on the following day unless the following day is a Saturday or Sunday and routine work is not scheduled for Saturday or Sunday.

1.6.2 To reschedule the work on any day satisfactory to both parties.

1.7 Delivery Vehicles: Delivery vehicles shall be in conformance with DOT Motor Carrier Safety Standards 49 CFR parts 390 through 396. All delivery vehicles shall enter the thru the North Entry Control Point (ECP) off Kimball Ave. Vehicle drivers must successfully complete a criminal background check and/or possess a valid DOD ID, or NBAF Access Badge or Pass. Badges and visitor passes for delivery vehicles are available at the Visitor Center, which can be accessed off Denison Ave., thru the West ECP. All delivery vehicles will be searched.

1.8 Electronic Mail (E-mail) Address: Establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments as text files, pdf files, and other similar formats. Within 10 days after contract award, provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice information, request for proposals, and other correspondence. The Contracting Officer may also use email to notify the Contractor of NBAF access conditions when emergency conditions warrant, such as hurricanes or terrorist threats.

Multiple email addresses are not allowed.

It is the Contractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). Promptly notify the Contracting Officer, in writing, of any changes to this email address.

1.9 Correspondence: Identify all Contractor correspondence to the Government with a serial number.

Prefix correspondence initiated by the Contractor's site office with "S". Prefix letters initiated by the Contractor's home (main) office with "H". Letters are numbered starting from 0001. (e.g., H-0001 or S-0001). The Government's letters to the Contractor will be prefixed with "C" or "RFP".

1.10 Work Coordination: The Contractor’s service personnel shall contact the ARS Engineering Project Management Groups Contracting Officer Representative (COR) on each visit to the Facility prior to beginning work that day to inform the COR of what work is being completed during the visit.

1.11 Federal Observed Holidays:

1.12 Quality Control (QC): Quality Control is the responsibility of the contractor. The contractor is responsible for the delivery of quality services/supplies to the Government (see FAR 52.212-4, Contractor Inspection Requirements). A formal Quality Control Plan (QCP) is not required for this commercial service. However, the contractor shall maintain an inspection system commensurate with commercial practices to ensure the Contractor only tenders for acceptance those items or services that conform to the requirements of this contract.

1.13 USDA-ARS Performance Assessments: USDA-ARS performance assessments will be assigned to an authorized individual or will be done by the COR. The COR will evaluate the contractor's performance under this contract IAW the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what USDA-ARS must do to ensure that the contractor has performed IAW the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). Although USDA-ARS may develop a QASP, USDA-ARS surveillance of Contractor performance is not limited to the QASP or the performance objectives, incentives/remedies, etc. USDA-ARS has the right to inspect and test all services called for by the contract and commitments made by the Contractor during the solicitation process, to the extent practicable at all places and times during the term of the contract. USDA-ARS will perform inspections and tests in a manner that will not unduly delay the work. If any of the services performed do not conform to contract requirements, USDA-ARS may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, USDA-ARS may: (1) require the Contractor to take necessary action to ensure that future performance conforms to contract requirements, and (2) reduce the contract price to reflect the reduced value of the services performed. If the Contractor fails to promptly perform the services again or take the action necessary to ensure future performance in conformity with contract requirements, USDA-ARS may:

(1) by contract or otherwise, perform the services and charge to the Contractor any cost incurred by USDA-ARS that is directly related to the performance of such service, or (2) terminate the contract for default. "Services", as used in this clause, includes services performed, workmanship, and material furnished or used in performing services.

1.13.1 A USDA-ARS Inspector may accompany Contractor personnel during refuse/recycling service calls to observe and / or ask for explanation of work performed. The intent is not to delay the Contractor in any way.

1.13.2 Performing quality assurance in accordance with the PWS does not preclude USDA-ARS from conducting inspections as defined in Federal Acquisition Regulation (FAR) 52.212-4 Contract Terms and Conditions for Commercial Items for Inspection/Acceptance.

1.13.3 The contractor will be notified of Government inspection results within 5 business days.

The contractor shall acknowledge receipt of the inspection results via email or letter within 2 business days. The contractor may be notified of inspection results verbally. Verbal notifications of defective work will be confirmed in writing. When Government inspectors are unable to contact the contractor to notify the contractor of inspection results, acceptance or rejection of work will be made on the basis of the initial inspection.

1.14 Type of Contract: USDA-ARS will award a performance-based commercial services contract. This means that USDA-ARS has described WHAT is to be accomplished, not HOW to accomplish it, and states a basis for determining whether finished work meets USDA-ARS quality requirements. It does not state detailed procedures for accomplishing the requirement unless there are safety, security or communication requirements. It is the intent of USDA-ARS to provide the Contractor the maximum amount of flexibility to propose an innovative approach, and to find the most efficient and cost-effective method for meeting the stated objectives and requirements.

1.15 Post Award Conference / Performance Evaluation Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The CO, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the CO will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced.

Appropriate action shall be taken to resolve outstanding issues. These meeting shall be at no additional cost to the Government.

1.16 Contracting Officer’s Representative (COR): The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions:

Assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, and specifications; monitor Contractor's performance and notifies both the CO and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.17 Personnel

1.17.1 Contractor Key Personnel: The Contractor shall provide a contract manager who shall be responsible for the performance of the work and shall be the central point of contact with the Government. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the CO. The contract manager or alternate shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available from 0800 to 1600, Monday through Friday except Federal holidays or when the USDA-ARS facility is closed for administrative reasons. Since this is a performance-based contract, the manpower and labor mix of employees to perform this contract remain the discretion of the Contractor for all services addressed in the Technical Exhibits.

1.17.2 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are USDA/Government officials. They must also ensure that all documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

1.17.2.1 Rosters: For NBAF Facility security purposes, the Contractor shall provide the CO a list of all employees who will perform work under this contract. The list shall include name and work assignment of each employee. The Contractor shall maintain revisions and updates to this list and submit them to the COR monthly.

1.17.2.2 Employee Badges: The Contractor shall furnish each employee a contract identification badge that shall be conspicuously displayed when working. The ID badge shall include the full name of the employee, company name, a badge serial number and the employee’s picture.

1.17.3 Contractor Personnel Conduct: Contractor personnel’s conduct shall not reflect discredit upon USDA-ARS. The Contractor shall ensure that personnel present a professional appearance. The Contractor’s employees shall observe and comply with all local policies and procedures concerning fire, safety, environmental protection, sanitation, security, and possession of firearms or other lethal or illegal weapons or substance. The Contractor is responsible for ensuring that any contractor employees providing services under this contract conduct themselves and perform services in a professional, safe, and responsible manner. The Contractor shall remove from the job site any employee for reasons of misconduct or security. Particular attention should be paid to acceptance of gifts/ gratuities, and on non-disclosure of sensitive or classified information. The Contractor shall ensure employee conduct complies with 41 USC 423 relative to release of acquisition related information, or actions or discussions which may prejudice future competitions. The Contractor shall ensure no contractor employees conduct political related activities or events on the NBAF premises.

1.18 Reporting and Record Keeping Requirements: Refer to section 3.3.3 for reporting requirements.

1.19 Payments: Payments for refuse and recycling services shall be on a monthly, fixed price basis.

1.20 Environment, OSHA, and DOT: The Contractor shall comply with all local, state, and Federal environmental and occupational safety laws, rules, and regulations, and applicable DOT requirements. Any apparent conflict between compliance with such local, state and Federal laws, rules and regulations, and compliance with the requirements of the contract shall be immediately brought to the attention of the CO and/or the COR for final resolution. The Contractor shall notify the CO and COR in writing in addition to any verbal notification of such conflicts within 24 hours of occurrence. The Contractor shall be liable for all fines, penalties, and costs which result from violations of, or failure to comply with, all such local state, or Federal laws, rules, and regulations.

All unsafe acts or conditions fostered by the Contractor or Contractor personnel may be grounds for the CO or COR, to halt all Contractor performance with a commensurate deduction of monies due the Contractor until such unsafe conditions are corrected. The Contractor shall take due caution not to endanger personnel during performance of this contract. Upon discovery of any hazard such as, but not limited to, fire, or large fuel spill, the Contractor shall immediately notify the CO or COR.

1.21 Security Requirements: Personnel employed by the Contractor or any representative of, or agent of the Contractor, entering this facility shall conform to the facility security regulations. Each person accessing the site will be required to provide personal details, (full name, DOB, SSN, DL#) and will undergo a routine background check, such as a National Agency Check with additional inquiries, which may include a criminal and credit check. Details required for the check should be submitted to the security office NLT 5 days prior to the visit. Results of this check may return earlier. However, it should not be planned to have results earlier than 5 days.

1.21.1 If, while on site the contractor/vendor will have access to sensitive information, they must complete a National Disclosure Agreement, along with the required training. This training will most likely be completed by reviewing a series of slides covering the topics of the definition of controlled unclassified information (CUI), access, handling, distribution, storage and destruction of CUI. Each person will acknowledge receiving and understanding the training on the NDA. The process should not exceed two hours.

Acknowledgement and completion of the NDA will be turned in with the form required for the background check. Results will be returned through the Contracting Officer or Contracting Officer Representative.

1.21.2 Physical Security: The Contractor shall safeguard all USDA-ARS equipment, information and property provided for Contractor use. At the close of each work period, USDA-ARS facilities, equipment, and materials shall be secured.

PART 2

DEFINITIONS & ACRONYMS

2.0 Definitions: As used throughout this performance work statement, the following terms shall have the meaning set forth below:

2.1 Bulk Refuse: All lumber, pipe or debris exceeding three (3) feet in length, or two (2) feet by two (2) feet square, or two (2) feet in diameter, concrete blocks, and other similar material or equipment of a weighty or bulky nature such as sofas and other similar items.

2.2 Business Day: Shall mean any day banking transactions can be conducted in Kansas, USA and does not include any day which is a federal or state holiday in such location.

2.3 Collection: Solid Waste collection is an organized and systematic method of transporting solid waste from the point of generation or from pick up points to site of disposal or a materials recovery facility.

2.4 Commingled: Any combination of recyclable materials which, when combined in one container, do not contaminate or effect the quality of the materials. In this case, we are referring to plastics #1 and #2, glass food/beverage containers and metal food/beverage containers.

2.5 Containers/Dumpsters: Suitable containers/dumpsters are receptacles of a size and so constructed as to enable pick up and emptying.

2.6 Contract Administrator. The official Government representative delegated authority by the Contracting Officer to administer a contract. This individual is normally a member of the appropriate Contracting/Procurement career field and advises on all technical contractual matters.

2.7 Contractor. A supplier or vendor awarded a contract to provide specific supplies or services to the government. The term used in this contract refers to the prime.

2.8 Contracting Officer (CO). A person with the authority to enter into, administer, and/or terminate contracts, and make related determinations and findings on behalf of the government. Note: The CO is the only individual who can legally bind the Government.

2.9 Contracting Officer's Representative (COR). An employee of the U.S. Government appointed by the KO to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor if that direction is within the scope of the contract, does not constitute a change, and has no funding implications. Note: This individual does NOT have authority to change the terms and conditions of the contract.

2.10 Debris. Is a category of solid waste. Debris, often referred to as “Construction and Demolition” or “bulky waste”, means roofing materials, plastic siding, stone, masonry, brick, concrete, tile, Formica, plasterboard (drywall), non-recyclable glass, etc. Not included in this category are grass clippings, leaves, yard waste, stumps, and wood waste, scrap metal and similar waste materials.

2.11 Defective Service. A service output that does not meet the standard of performance associated with the PWS.

2.12 Deliverable. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

2.13 Disposal. Disposal is the process of spreading and covering in sanitary fills, spreading and covering in landfills, and dumping in public dumps, or other solid waste disposal facility.

2.14 Garbage: Garbage is a category of solid waste. Garbage means animal and vegetable waste (and containers thereof, but not including recycling containers) resulting from the handling, preparation, cooking and consumption of foods.

2.15 Government-Furnished Property (GFP), Government-Furnished Equipment (GFE), or Government-Furnished Facility (GFF). Property or area in the possession of, or directly acquired by, the Government and subsequently made available to the Contractor.

2.16 Hazardous and Special Waste. Any material that poses a hazard to health and/or environment as defined in the Resource Conservation and Recovery Act (RCRA) of 1976, applicable state and county regulations/ordinances. Such wastes include but are not limited to those material that are toxic, corrosive, ignitable or reactive, requiring special handling and procedures for disposal. This waste shall not be collected as part of this contract.

2.17 His/Her. Wherever used in the Performance Work Statement, the term “his” is meant to be synonymous with “her” unless otherwise stated. The same shall be true for him and her.

2.18 Key Personnel. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.19 Materials Recovery Facility (MRF). A Materials Recovery Facility is a center where recovered solid waste materials are delivered for processing and marketing. MRF’s usually have State permit to operate.

2.20 Physical Security. Actions that prevent the loss or damage of Government property.

2.21 Quality Assurance. The government procedures to verify that services being performed by the Contractor are acceptable in accordance with established standards and requirements of this contract.

2.22 Quality Assurance Specialist. An official Government representative concerned with matters pertaining to the contract administration process and quality assurance/quality control. Acts as technical advisor to the Contracting Officer in these areas.

2.23 Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.24 Quality Control. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.25 Recyclable: Any material that can be recovered before final disposal, processed, and marketed or used to make a new product.

2.26 Recyclable Materials: All materials that are normally collected and sorted for reprocessing into new or different commodities. Present normal collection and sorting are aluminum and steel cans, glass, plastic, paper and cardboard. These items may change and other items are added to the recyclable materials list as markets are developed and expanded.

2.27 Refuse: Refuse is a category of solid waste. Refuse includes all garbage, ashes, debris, rubbish and other similar waste materials. Not included are recyclable materials; hazardous waste; and contaminated waste from medical or radiological processes.

2.28 Rubbish: Rubbish is a category of solid waste. Rubbish means a variety of unsalvageable materials such as floor sweepings, paper wrappings, non-recyclable containers, cartons, and similar articles not used in preparing or dispensing food. It is easier to define rubbish as any material that is not a recyclable, not debris, not ash, not yard waste and not garbage.

2.29 Sanitary Landfill: As a minimum, four basic conditions should be met by any site design and operation before it can be regarded as a sanitary landfill: Full or partial hydro geological isolation: if a site cannot be located on land which naturally contains leakage security, additional lining materials should be brought to the site to reduce leakage from the base of the site (leakage) and help reduce contamination of groundwater and surrounding soil. If a liner - soil or synthetic - is provided without a system of leakage collection, all leakage will eventually reach the surrounding environment. Leakage collection and treatment must be stressed as a basic requirement.

Formal engineering preparations: designs should be developed from local geological and hydro geological investigations. A waste disposal plan and a final restoration plan should also be developed.

Permanent control: trained staff should be based at the landfill to supervise site preparation and construction, the depositing of waste and the regular operation and maintenance.

Planned waste emplacement and covering: waste should be spread in layers and compacted.

A small working area which is covered daily helps make the waste less accessible to pests and vermin.

2.30 Solid Waste: Solid waste means all those materials that are not liquid waste, but includes recyclables, refuse, rubbish, garbage, ash debris, yard waste and under certain conditions, hazardous waste.

2.31 Subcontractor. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.32 Transfer Station: A solid waste handling facility used for the consolidation of waste in preparation for transporting to a point of further processing and ultimate disposal.

2.33 Transfer Vehicle: Any vehicle used for the transportation of solid waste from the point of waste origin to a point of further processing or ultimate disposal.

2.34 Work Day. The number of hours per day the Contractor provides services in accordance with the contract.

2.35 Work Week. Monday through Friday, except for Federal holidays unless specified otherwise.

2.36 Yard Waste: Yard Waste is a category of solid waste. Yard waste means leaves, grass clippings, brush, and small stumps.

SPECIFIC TASKS

3.0 SPECIFIC TASKS: The Contractor shall be responsible for performing refuse and recycling services.

It is anticipated that during the course of this contract there will be workload increases and decreases.

Payment will only be made by the Government for services received and accepted at the prices specified in the contract. The Contractor shall perform to the standards and specifications outlined in the PWS.

3.1 Refuse & Recycling Services

3.1.1 The Contractor shall collect up to four (4), Government supplied, 30 CY dumpsters/containers and two (2), 2 CY dumpsters, with refuse and recycling, dispose these materials and return the dumpsters/containers to the NBAF. The Contractor shall coordinate pick up schedules with the COR or Designated Representative to meet the scheduled requirements set forth in the contract. The Contractor shall submit these schedules to the COR or Designated Representative for approval within five (5) business days after contract award. Collections shall be made according to established schedules; any changes to the schedules must be approved by the COR prior to the change.

3.1.2 Quote shall be based on picking up three (3) 30 CY dumpsters per week and one (1) 2 CY dumpster per month.

3.1.3 The Contractor shall steam clean all four dumpsters annually, inside and out at an offsite location.

3.1.4 The Contractor shall after dumping of containers, return containers to their proper station.

3.1.5 The Contractor shall receive at least 24 hour advanced notice from the COR or designated representative for Will-Call dumpsters for Emptying and Returning and to be completed within 48 hours after notification.

3.1.6 In the case of inclement weather, the Contractor shall reschedule pickup with the COR within 24 hours after inclement weather has ended.

3.1.7 The Contractor shall not dispose of any material that has obvious value and appears to have been inadvertently placed near the collection point unless such material is designated as refuse or recycling and notify the COR of findings.

3.2 The Contractor shall attach the NBAF Solid Waste Disposal Report on a monthly basis along with the invoice.

3.3 Performance Evaluation Meetings. The Contractor ‘s Project manager shall be required to meet with the COR on a monthly basis for the first three months of the contract, and as necessary thereafter, to discuss contract deliverables and contract issues. The time and location will be mutually agreed upon between the two parties.

3.3.1 Support Services. The Contractor shall provide acceptable support services which meet professional standards and requirements in the performance of each task of this PWS.

3.3.2 Reports. The Contractor shall provide all reports to the COR as required in accordance with each task performed and required by the local, Federal and State.

3.3.3 Weight. The Contractor shall provide accurate weights of refuse and recycled commodities as follows:

1. Comingled recycled commodities from 30 CY containers shall be reported.

2. Any single recycling commodity added for separate pickup (white paper only, aluminum cans only, etc.) shall be reported separately from other single and comingled commodities.

3. Refuse 30 CY containers shall be reported separately.

4. All weights shall be reported using the Spreadsheet provided.

5. All weights shall be reported on a monthly basis, within 10 working days of the last day of each month.
