3. DESCRIPTION OF SUPPLIES/SERVICES.
The DLA Information Operations’ Network and Telecom Branch (J64B) is responsible for procuring and managing Business Internet Services requirements for Non-DLA connected equipment, augmentation of communication capabilities and support for cellular support for DLA locations and customers. Business High Speed Internet is necessary to provide a means of communication for the point-of-sale devices, increase wireless signals and a means for connection communication for non-DLA equipment within the DLA Enterprise.
The total estimated value for this requirement is with a period of performance of twelve (12) months after contract award.
4. IDENTIFICATION OF STATUTORY AUTHORITY:
The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304
(c) (1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source as reference by the name brand citation, “Comcast.” The Comcast brand name is essential to the Government’s requirements and market research indicates that Comcast equipment is proprietary and cannot be serviced by any other provider. Without Comcast, DLA will not be able to provide cable internet services.
5. DEMONSTRATION OF CONTRACTOR’S UNIQUE QUALIFICATIONS:
DLA Information Operations (J6) has been designated to support DLA communication mission requirements. Obtaining High Speed Business Internet Services is one such way DLA Information Operations supports mission-critical communication. The Federal Communications Commission (FCC) defines high-speed internet as having a minimum download speed of 25 megabits per second (Mbps) and a minimum upload speed of 3 Mbps. Computers connected to the internet transfer information to each other in electronic packets which is simply a unit of data. Download speed is the speed at which information travels from the internet to your internet-connected device. Upload speed is the opposite. It is the speed at which information travels from your internet-connected device to the internet.
J6 Information Operations in support of the Distribution Command Interactive wall requires the installation of a dedicated Comcast Internet Service connection. J6 Information Operations previously implemented a Cratepoint and Router with a Verizon SIM Card but the connection was not sufficient as a means of connection to allow the vendor to support the interactive wall remotely. When the Verizon signal was determined to not have enough bandwidth Information Operations installed Cell Repeaters to assist with increasing the Verizon signal but was unsuccessful.
In order to help accomplish its mission of supporting the warfighter, DLA has a need to obtain High Speed internet Services from Comcast for its local and field site personnel located in New Cumberland, PA. No competitor service exist in the market at this time as DirecTV does not have internet and would require a DirecTV bundle with AT&T TV with 100Mbps.
Additionally, Comcast Internet plans are in 40 states and the download speed is 15-2,000

Mbps where Verizon is 9 states and has a Download speed of 200- 940 Mbps.
Comcast is the only vendor that can provide Internet Service support without having to modify the existing building as the installation would require the breaching the roof of the building and/or the side of the building. Installation Support New Cumberland is the entity responsible for the management of building onsite and they have not authorized DLA Information Operations to modify the building.
Only brand-name Comcast services are capable of meeting the Government’s needs. There are no other similar products and services on the market that can meet, or be modified to meet, the Government’s need high speed internet services in New Cumberland while satisfying information security requirements and ensuring the reliable transmission of mission-critical communication.
The brand name description “Comcast” is essential for the Government to meet mission requirements. The use of different Internet Service Providers services and equipment introduces risks that compromise communication, such as incompatible software and unavailable security patches.
6. FEDBIZOPPS ANNOUNCEMENT/POTENTIAL SOURCES:
Comcast is the only known firm that provides local internet services that do not require modifying the building struture. However, the requirement will be synopsized to solicit Comcast within FedBizOpps. All authorized dealers will be given an opportunity to submit an offer.
Based on procurement history only one vender is known to provide software maintenance/support for this product and that is Comcast.
7. DETERMINATION OF FAIR AND REASONABLE COST:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).
8. MARKET RESEARCH:
In April 2022, informal market research was conducted by contacting Comcast, the only authorized provider. Information received from this research was used to establish the Government’s estimated cost for this procurement. No competitor service exist in the market at this time as DirecTV does not have internet and would require a DirecTV bundle with AT&T
TV.
9. ANY OTHER SUPPORTING FACTS:
The procurement and integration of a Business High Speed Internet other than Comcast would eliminate the technologic integration currently established and create a burden on the government by requiring the removal and connection of equipment and applications that could compromise the DLA network by introducing devices and applications that cannot be harden in accordance with the mandated cybersecurity requirements.

THAT LED TO THE EXCEPTION TO FULL AND OPEN COMPETITION:
Based on the device and application configuration and connection requirements, it has been determined that only Comcast Business Internet Service will support the Government needs.
Comcast does not do option years for Internet Services. The Government will continue to conduct market research to determine if there are changes in the marketplace with would enable future competitive actions.
DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government, as a continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure future full and open competition. Requirements will continue to be posted on FedBizOpps to ensure fair opportunity is given and no other providers are available.
