About this file

This document is a justification for use of other than full and open competition in awarding a federal contract. The Navy requires 20 rolls of Z-Block fabric measuring 38 mil thick by 60 inches wide by 50 yards for use in welding processes to protect other objects. The Z-Block fabric, product number F-824 item 1100353 produced by Newtex, is specified as the brand name item needed to meet technical requirements for flame retardancy, off-gassing limits, and material properties established through research and development by welders. Using an alternative fabric would require new testing to verify specifications are met and revisions to technical work documents and nuclear safety procedures incorporating the Z-Block fabric.

(This is only applicable to acquisitions under the Simplified Acquisition Threshold. Acquisition using FAR Subpart 13.5 shall follow the special documentation requirements at FAR 13.501.)

USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION

UNDER THE SIMPLIFIED ACQUISITION THRESHOLD

I. BACKGROUND:

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

QUANTITY: 20 ROLLS

ZBLOCK FABRIC: 38 MIL THICK X 60 INCHES WIDE X 50 YARDS.

C.1.1 FLAME RETARDANT FABRIC, HIGH TEMP (1800OF).

C.1.2 POLYMER COATED FIBERGALSS FABRIC, SILVER FINISH.

C.1.3 FABRIC WILL NOT PRODUCE HAZARDOUS OUTGASSING.

C.1.4 VERTICAL FLAME RESISTANCE PER ASTM D6413-22

C.1.5 SURFACE FLAME PER ASTM E84-21

C.1.6 MOLTEN METAL SPLASH TESTING, 14 CFR APPENDIX F,

PART III & IV, FLAME PENETRATION RESISTANCE AND

SMOKE DENSITY TESTING PER ASTM F955-15

C.1.7 NEWTEX STYLE F-824, ITEM 1100353

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION IS BASED ON THE FOLLOWING (select all that apply):

A. ___ ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

Explain what rights are restricted, why the restrictive rights make the required item or service available from only one source, and why another company could not satisfy the Government’s need.

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.

OR

Identify the distributor(s)/authorized technical representative(s) for the item or service. Provide evidence of the exclusive licensing agreement as an attachment to this document. NOTE: If there is more than one distributor/authorized technical representative for an OEM part, then Part B, BRAND NAME SOLE SOURCE, is applicable, and Part A, ONLY ONE RESPONSIBLE SOURCE, should be left blank).

3. ___ OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.

B. X BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.

THE Z-BLOCK FABRIC, NEWTEX STYLE F – 824 ITEM 1100353, IS A BRAND

NAME MANDATORY ITEM. THE FABRIC IS USED TO PROTECT OTHER

OBJECTS AND ITEMS DURING THE WELDING PROCESS. THE WELDERS

PERFORMED RESEARCH AND DEVELOPMENT WITH DIFFERENT FABRICS.

THE WELDERS NEEDED THE FABRIC TO MEET CERTAIN REQUIREMENTS,

FIRE RETARDENCE, OFF GASSING LIMITS AND DETRIMENTAL MATERIAL

RANGES. THE FABRIC THAT MEETS THESE SPECIFICATIONS IS Z-BLOCK

FABRIC, NEWTEX STYLE F – 824 ITEM 1100353. NO OTHER BRANDS MET THESE

REQUIREMENTS AS WELL AS THE NEWTEX.

THE Z-BLOCK FABRIC WAS INCORPORATED WITHIN TECH CODE ENGINEERS’

TECHNICAL WORK DOCUMENTS AND NUCLEAR STANDARD INSTRUCTIONS.

THE SAIL-LOFT INTEGRATED Z-BLOCK FABRIC WITHIN THE CONTAINMENT

INSTRUCTIONS THAT ARE USED FOR WELDING.

IF A DIFFERENT FABRIC WAS PROCURED, NEW TESTING WOULD NEED TO BE

REQUIRED TO ENSURE THE FABRIC MET THE WELDERS’ NEEDS AND

TECHNICAL SPECIFICATIONS. TECH CODE ENGINEERS’ AND THE SAIL-LOFT

PERSONAL WOULD NEED TO RE-WRITE THE PROCEDURES SPECIFICALLY

CALLING OUT Z-BLOCK FABRIC. THESE ACTIONS WOULD CAUSE

SIGNIFICATE REWORK TO TECHNICAL WORK DOCUMENTS AND

PROCEDURES. IN ORDER TO CONSIDER AN NEW PRODUCT THE SAME

TESTING WOULD BE REQUIRED AND IF THE ITEM WAS ACCEPTABLE WOULD

HAVE TO BE ADDED INTO CURRENT TECHNICAL DOCUMENTATION AS AN

ACCEPTABLE ALTERNATIVE. THIS PROCESS WOULD TAKE A SIGNIFICANT

AMOUNT OF TIME, ADMINISTRATIVE EFFORTS, AND FINANCIAL IMPACT,

NONE OF WHICH WOULD RESULT IN ANY SIGNIFICANT RELIZED COST

SAVINGS THROUGH COMPETITION.

C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.

Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:

3. Explanation of why delivery/commencement of services by the date mentioned above is required: Explain the impact to the mission if the date above is not met, any special circumstances or conditions that exist which validate the requirement as “urgent,” estimated production lead time for the item, etc.

4. If appropriate, include any additional pertinent information:

IV. CERTIFICATIONS/APPROVALS:

A. Technical / Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.

Signature Name (Printed) / Phone # Date

B. Contracting Officer Approval:
