About this file

This is Attachment 1 – Terms and Conditions for a Department of Homeland Security (DHS) acquisition of commercial items for the U.S. Coast Guard (USCG). The solicitation is being awarded on a sole source basis to Chelton Avionics, Inc. (Cage Code 1WZEZ2), with evaluation based on lowest priced, technically acceptable (LPTA) criteria. Technical acceptability will be assessed on the offeror's ability to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or OEM-approved sources, with required authorization/licensing documentation, traceability to the OEM, and a Certificate of Conformance (COC).

The terms and conditions establish specific operational requirements for products that will touch USCG aircraft. Contractors must immediately notify the Contracting Officer of supply changes, material defects, counterfeit/suspect parts, or non-conforming conditions, with USCG approval required before implementation. Quality control procedures must address risk management, testing, inspection, and counterfeit/suspect parts processes, with all requirements flowed down to subcontractors and suppliers. Packaging must meet USCG Aviation Logistics Center (ALC) standards using appropriate materials for land, air, or sea shipment, with individual parts labeled with National Stock Number, Part Number, Serial Number, Quantity, Nomenclature, Purchase Order Number, and Line-Item Number. Items ship F.O.B. Destination to USCG ALC in Elizabeth City, North Carolina. Inspection and acceptance occur at destination with count and condition verification only; a COC per FAR 52.246-15 is required for all items. Invoicing requires a fully executed purchase order, active SAM status, and submission to the ALC Fiscal Branch via email or mail, with electronic payment per FAR 52.232-33. The document incorporates numerous FAR clauses addressing commercial products, security prohibitions (including FASCSA, Iran, Sudan, and covered telecommunications restrictions), labor standards, sustainable products, and other federal compliance requirements.
