PERFORMANCE BASED WORK STATEMENT (PWS)

FOR

COMMERCIAL TRUCKING SOLUTIONS (CTS)

OKINAWA ISLAND TRUCK TRANSPORTATION SERVICES

1.0. DESCRIPTION OF SERVICE. The Contractor shall furnish services of transporting Government Cargo by the Contractor provided trucks with the pricing set forth in the Price List, IAW the terms and conditions of this contract and applicable Government of Japan (GOJ) laws and trade practices. The Contractor shall provide qualified drivers, supervision, trucks, equipment, required permits, licenses, and maintenance of vehicles utilized for this contract. The Contractor’s driver shall have a basic understanding of conversational English or use communication tools such as translation applications and/or translated documents of Japanese to English vice versa in order to coordinate with the Government personnel at multiple Government facilities. The scope of this requirement can be described by identifying the typical nature of the trucking transported and the typical types of trucking used to transport trucking. Any slash “/” included in this document means “and/or”.

1.1.0. AREA OF PERFORMANCE. The areas of performance shall be the island of Okinawa to meet transportation requirements in support of all United States Armed Forces and supporting agencies located in Okinawa, Japan. The types of required trucks along with the specifications are listed in 1.3. Types/Sizes of Trucks. The point-to-point routes and the distance matrix are specified in Appendix A.

1.1.1. Period of Performance. The period of performance of shall be 60 months from the award date. The Period of Performance reads as follows:

28 August 2023 through 27 August 2028

Both parties (Government or Contractor) may discontinue future applicability of the BPA upon providing an written notice at least 30 days before discontinuation date.

1.2. CATEGORIES OF TRUCKING SERVICES. There are five (5) categories of required trucking services: Small Trucking, General Trucking, Oversized Trucking, Perishable Trucking, and Dangerous/Hazardous Trucking. The Contractor shall provide transportation services to cover one and/or all the categories of services as listed below.

1.2.1. Small Trucking. The Contractor shall furnish small trucking services of transporting Government trucking by the Contractor provided vehicles/equipment with the pricing set forth in the Price List. The typical size/types and the truck usage are identified in the Table 1.

1.2.2. General Trucking. The Contractor shall furnish general trucking services of transporting Government trucking by the Contractor provided trucks with the pricing set forth in the Price List. The typical size/types and the truck usage are identified in the Table 2.

1.2.2.1. For the transportation service for Camp Kinser, Bldg. # 401, the Contractor will be required to transport cargo to one and/or multiple locations within the timeframe identified in an order (TRUCK TRANSPORTATION ORDER FORM). The types and the number of vehicles required will be determined upon a request by the Government. The Government reserves the right to assign a pallet rider for each Contractor’s truck as necessary. The assigned pallet riders are responsible for contacting consignees and ensuring shipments being delivered in a timely manner.

1.2.3. Oversized Trucking. The Contractor shall have vehicles available for preloading oversized cargo at the time and place specified. The Government will be responsible for cargo loading and unloading. The Contractor shall comply with all GOJ regulations and laws dealing with over-dimension cargo. Upon requests by the Government, the Contractor shall furnish transportation services of oversized cargo with the pricing set forth in the Price List. The sizes/types of trucks will be determined upon a request by the Government. The typical size/types of vehicles and the truck usage for transporting oversized trucking are identified in the Table 3.

1.2.4. Perishable Trucking: The Contractor shall provide the transportation services with trucks identified in Table 4 with the pricing set forth in the Price List. The Contractor shall assign one dispatcher and several drivers in support of Defense Commissary Agency (DeCA) operations.

The dispatcher shall be the point of contact for the assigned driver(s) and responsible for coordinating with DeCA personnel and providing the information for drivers to follow along with their routes and coordinating delivery times and locations within DeCA facilities (Camp Kinser Building # 202, 208, and 303). The assigned drivers shall transport goods from one location to another within DeCA facilities. The Contractor shall provide the dispatcher’s point of contact information to the Government upon receipt of a truck order. The typical size/types of and the usage of vehicles used for transporting cargo are identified in the table 4.

1.2.5. Dangerous/Hazardous Trucking

1.2.5.1. Dangerous Trucking. Upon request by the Government, the Contractor shall furnish transportation services of dangerous trucking with the pricing set forth in the Price List. The sizes/types of trucks will be determined upon a request by the Government. Dangerous trucking shall consist of items which are applied to the GOJ “Fire Service Act, Act No.86 of 24 July 1984” (Law No. 86, 24 July 1948, with revisions thereto), “Poisonous and Deleterious

Substances Control Law” (Law No. 303, 28 December 1950, with revisions thereto), “High Pressure Gas Safety Law” (Law No. 204, 7 Jun 1951, with revisions thereto) and other related laws/ordinances. These items must be transported IAW such laws/ordinances. (Ref:

https://www.japaneselawtranslation.go.jp/en/laws/view/3772/en) To briefly describe the requirements for dangerous trucking services, the typical types of and the usage of vehicles used for transporting dangerous trucking are identified in the Table 5.

1.2.5.2. Hazardous Trucking. Upon requests by the Government, the Contractor shall furnish transportation services of hazardous trucking with the pricing set forth in the Price List. The sizes/types of trucks will be determined upon a request by the Government. Hazardous trucking shall consist of low explosive, high explosive, or such other materials of explosives listed under the GOJ “Explosives Control Law” (Law No. 149, 4 May 1950, with revisions thereto) and other related laws/ordinances. These items must be transported IAW such laws/ordinances. Upon a request by the Authorized Caller (AC), the Contractor shall submit a hazardous materials transportation plan to the Prefectural Public Safety Commission (local police station) responsible for the area from which the explosives are shipped, and it must be carried when the explosives are being transported. An additional charge for obtaining a road clearance permit is specified in the Price List. To briefly describe the requirements for hazardous trucking services, the typical types of and the usage of vehicles used for transporting hazardous trucking are identified in the Table 6.

1.2.5.2.1 As defined in the GOJ Explosives Control Law, the following Items shall not require the GOJ clearance based on Net Explosive Weight (NEW) or quantities specified below (https://www.esd.whs.mil/Portals/54/Documents/DD/forms/dd/dd0626.pdf).

1.2.5.2.1.1 Low explosives: NEW of 200 kilograms or less.

1.2.5.2.1.2 High explosives: NEW of 100 kilograms or less.

1.2.5.2.1.3 Blasting caps, electric and non-electric: 40,000 each or less.

1.2.5.2.1.4 Small arms primer: 400,000 each or less.

1.2.5.2.1.5 Detonating cord: 6 kilometers length or less.

1.2.5.2.1.6 Live or blank Small Arms Ammunition (SAA) NEW of 0.5 grams or less per round:

400,000 each or less.

1.2.5.2.1.7 Live or blank SAA NEW of over 0.5 grams per round: 200,000 each or less.

1.2.5.2.1.8 Other explosive materials not listed above: NEW of 100 kilograms or less.

1.2.5.2.2 Palletization for Ammunition: For breakbulk or palletized Ammunition and Explosives (AAE) shipment, the Contractor shall provide at least 18 millimeter (3/4") thickness plywood sheets on truck beds whenever AAE is transported. As required, the Government will nail wood blocking and bracing to the plywood for securing AAE in accordance with the applicable regulations at the loading points.

1.2.5.2.3. Condition of the Loading Platform. The Contractor shall provide van/wing-type trucks of any sizes defined in paragraph 1.3.1 and 1.3.2 as ordered by the AC for transportation of hazardous trucking. Flatbed trucks with double tarp and double tie down may be used for transportation of hazardous trucking if van/wing-type trucks are not available. The outer layer shall be a canvas or rain cover and must be both fire and water resistant.

1.2.5.2.4. Loaded Incoming Motor Vehicle Inspections for Ammunition.

1.2.5.2.4.1 The Government reserves the right to escort Contractor's vehicles and provide special (safety) instructions including truck inspection to the Contractor’s driver(s) prior to releasing the truck loaded with explosives. The Government will provide a DD FORM 626 Motor Vehicle Inspection (Transporting Hazardous Materials) and inspect the assigned truck(s) to ensure driver(s) fully understand the contents (~10 to 15 minutes). Vehicles loaded with AAE shall be inspected IAW DD FORM 626 Motor Vehicle Inspection (Transporting Hazardous Materials) upon arrival at remote sites. If no problems are found, vehicles may be opened for interior inspection or moved to the designated unloading location.

1.2.5.2.4.2 Motor vehicles loaded with AAE that are suspected of being in hazardous condition shall be moved to a suspected truck site that is separated from other potential explosion sites or exposed sites by the applicable quantity distance criteria IAW Transportation of Explosives issued by U.S. Forces Japan (Ref: https://www.usfj.mil/Portals/80/Documents/Instructions/24- 100%20(USFJI).pdf)

1.2.5.2.4.3 Vehicles shall be inspected after unloading AAE to ensure that they are clean and free from loose explosives and flammable materials and that placards and vehicle certificates have been removed. Explosives waste cleaned and removed from the floors shall be disposed of properly.

1.2.5.2.5. Dual Driver Protective Service (DDP) and Signature and Tally Record Service.

The Contractor shall comply with the following when transporting trucking designated as hazardous trucking by the AC.

1.2.5.2.5.1. DDP. Any truck transporting hazardous trucking shall be manned by two (2) drivers possessing applicable driver’s licenses as identified in paragraph 1.5.1. The truck loaded with the said trucking must be attended by at least one (1) of the two (2) drivers in the cab of the truck and not in a sleeper berth or within 25 feet of truck at all the time during brief stops when required.

1.2.5.2.6. Safety Requirement for Ammunition and Explosives (AAE). 1.2.5.3. Special Trucking Order for Vessel Operations. Upon requests by the Government, the Contractor shall furnish trucks to transport hazardous goods in support of vessel operations with the pricing set forth in the Price List. The sizes/types and the number of trucks will be determined upon a request by the Government. These items must be transported IAW such laws/ordinances. Based on shipping information provided by the AC, the Contractor shall obtain a GOJ clearance from the Prefectural Public Safety Commission responsible for the area from which the explosives are shipped, and it must be carried when the explosives are being transported. An additional charge for obtaining a road clearance permit is specified in the Price List. The typical types of and the usage of vehicles used for transporting special trucking order are identified in the table 7.

1.3.2. Specifications for Trucks.

1.3.2.1 Wing-Type Truck. Wing-type truck shall be aluminum or stainless steel enclosed cargo compartment/body, equipped with rear and/or side cargo door(s) with latches/hasps for securing doors with a padlock or similar locking device.

1.3.2.2. Cargo-Type Truck. Carto type truck shall be aluminum or stainless steel open bed cargo compartment/body, equipped with rear and/or side cargo side flaps with for securing cargo. (30 ft / 40ft)

1.3.2.3. Inside Dimensions of Loading Platform/Bed.

1.3.2.3.1. Length. 8-10-ton trucks to be used under this contract shall have a minimum loading platform/bed length of nine (9) meters.

1.3.2.3.2. Width. 8-10-ton trucks to be used under this contract shall have a minimum loading platform/bed width of 2.3 meters. Must hold 18 or more pallets (minimum). Pallet sizes are 40 inches (101.60 cm) wide, by 48 inches (121.92 cm) long, by 75 inches (190.50 cm) high.

1.3.2.4. The trucks having loading platforms/beds smaller than dimensions specified above can be dispatched only with permission from the AC at the time of placing an order for services with the Contractor.

1.3.2.5. Truck Tractor. Conventional equipment capable of moving 10,000 Kg ~ 20,000 Kg (22,046 pounds~ 40,000 pounds.) and towing 20-foot and 40-foot transporting Standardization (ISO) containers in support General Trucking services, Dangerous/Hazardous Trucking services specified in paragraph 1.2.2 and 1.2.5 respectively -and Perishable refer trailer trucks in support of the Perishable Trucking services specified in paragraph 1.2.4.

1.3.2.6. Truck Tractor with Chassis Trailer (Flatbed). Measures at least 40’ in length, capable of moving up to 20 tons (40,000 pounds) safely.

1.3.2.7. Truck Tractor with Chassis Trailer (Low Bed). Measures at least one (1) meter in height (39.37 inch) from ground to bed and capable of transporting up to 20,000 Kg (44,092 pounds), equipped with loading ramps.

1.3.2.8. Perishable Reefer Van (Chilled and Frozen). A refrigerated (reefer) Van is required for this type of cargo. Temperature inside the container must not exceed 35 degrees Fahrenheit (or

1.6 degrees Celsius) for items transported. Must hold 18 or more pallets (minimum). Pallet sizes are 40 inches (101.60 cm) wide, by 48 inches (121.92 cm) long, by 75 inches (190.50 cm) high.

The Reefer vans have lock capabilities (padlocks) to ensure security.

1.3.2.9. Container Van. Container van requires a completely enclosed truck that provides protection from the elements to include, but not limited to, dust and other debris, and tamper resistant. Pallet sizes are 40 inches (101.60 cm) wide, by 48 inches (121.92 cm) long, by 75 inches (190.50 cm) high. The Container vans have lock capabilities (padlocks) to ensure security.

1.3.2.10. 20ft/40ft ISO Chassis. A reusable conveyance used to provide confinement or protection of cargo from possible loss or damage. When in-transit, containers are considered a transport unit capable of mounting and securing in or on marine or highway equipment. Types of containers are weatherproofed, dry enclosed (20ft/40ft), refrigerated reefers, shelter, van, tank, non-weatherproofed, open top, car carrier, or flat-rack or a platform that meets ISO standards.

1.3.2.11. Semi-Trailer (Super Lowboy). 0.5 meters (19.68 inch) height from ground level, with Truck Tractor and operator. Trailer bed width up to 3.2 meters (126 inches), length: up to 9 meters (354 inches), capable of moving up to 30,000 kg (66,139 pounds) safely.

1.3.2.12. Small Wrecker truck (Less than 5 ton/11,023 lbs.) must be capable of towing up to 4,999 kg (11,021 pounds.). In the event a Government vehicle cannot be hauled by lowbed trailer or semi-trailer without exceeding a road height limitation, the Contractor shall provide wrecker service to perform the same service.

1.3.2.13. Large Wrecker truck (5 ton or greater/11,023 lbs.) must be capable of towing up to 30,000 kg (66,139 pounds.). In the event a Government vehicle cannot be hauled by Lowbed trailer or Semi-trailer without exceeding a road height limitation, the Contractor shall provide wrecker service to perform the same service.

1.3.2.14. All trucks shall be clean, free of rust and issued with proper road tax and shall be properly inspected/insured in Japanese Compulsory Insurance and accident insurance (a minimum of JPY 30,000,000 for property damage and bodily injury)

1.4. SAFETY REQUIREMENTS.

1.4.1. Safety Requirement for Contractor Personnel. It is the Contractor’s responsibility to ensure the safety of their personnel. Requirements for safety shall be strictly adhered to as they pertain to Contractor operations and as required. The Contractor shall implement safety practices in accordance with the respective installation they Contractor is entering and operating on..

1.4.2. Written Procedures. -The Contractor shall prepare written procedures to ensure for safe and efficient transportation of AAE in motor vehicles. The Contractor shall deliver its written procedures within 30 days after contract award and two copies of the written procedures shall be submitted: one to the Contracting Officer (CO), and another copy to the AC. These procedures shall include, as a minimum:

1.4.2.1. Brakes shall be engaged, and the wheels chocked when the possibility exists that the vehicle could move during loading or unloading.

1.4.2.2. AAE shall not be loaded or unloaded when a motor vehicle’s engine is running, unless the engine is providing power to accessories used in the loading and unloading, such as mechanical handling equipment. If the engine is diesel powered, it may continue to run during loading or unloading of explosives except when exposed explosives are involved.

1.4.2.3. Vehicles, including partly or completely loaded flatbeds, shall have the load blocked and braced to prevent shifting during transit.

1.4.2.4. The operator shall not transport AAE material in the passenger compartment of the vehicle.

1.4.2.5 Motor vehicles transporting AAE within the establishment but outside the explosives area shall bear at least two appropriate placards identifying the hazard division of the AAE. These placards should be removed or covered whenever the vehicle is not loaded. Reflectorized placards shall be used whenever possible.

1.4.2.6 The vehicle operator shall be trained in emergency procedures to be followed in the event of a vehicle fire, breakdown, accident, damaged or leaking containers, and spilled AAE material.

1.4.2.2. Pre-Loading Motor Vehicle Inspections. All motor vehicles used to transport AAE shall be inspected daily before loading to verify:

1.4.2.2.1 Vehicles are in a safe operating condition.

1.4.2.2.2. Batteries and wiring are not in contact with containers of AAE.

1.4.2.2.3. Exposed ferrous metal in the interior of the vehicle body is covered with spark resistant material when scrap and bulk explosives are being transported in containers that could be damaged or when explosives could otherwise become exposed.

1.4.2.2.4. A serviceable portable fire extinguisher of the appropriate class is carried on the motor vehicle IAW the referenced manual and the local standards.

1.4.3. Safety Requirement for Government Facilities. The Contractor shall comply with the following safety requirements when working in Government facilities such as warehouses:

1.4.3.1. Contractor vehicles shall be in a safe operating condition and brakes shall be engaged and the wheels chocked when the possibility exists that the vehicle could move during loading or unloading.

1.4.3.2. Trucking shall not be loaded or unloaded when a motor vehicle’s engine is running, unless the engine is providing power to accessories used in the loading and unloading, such as mechanical handling equipment.

1.4.3.3. Vehicles, including partly or completely loaded flatbeds, shall have the load blocked and braced to prevent shifting during transit.

1.4.4. Occupational Safety and Health. The Contractor shall be responsible for maintaining a safe working environment in compliance with 29 CFR 1910 – Occupational Safety and Health Standards (OSHA). The OSHA provisions shall be applied to the Contractor’s truck(s) being utilized for this requirement.

1.5. QUALIFICATIONS OF CONTRACTOR

1.5.1 Required Driver’s License. All Contractor drivers shall possess and maintain the required motor vehicle license (Unten Menkyosho) allowing them to operate the motor vehicles as identified in the following categories:

1.6. OPERATIONAL REQUIREMENTS.

1.6.1. Transportation Schedule. The Contractor shall perform services in accordance with the scheduled requested by the AC to meet the established loading and unloading dates and times.

The Contractor is required to follow the operational definitions and requirements described below.

1.6.2. Truck Trip Charge

1.6.2.1. For the orders which require the Contractor to transport cargo to one location, the Contractor shall furnish the transportation service with trip rate. The Contractor shall perform services in accordance with the scheduled location (pickup and drop off) requested by the AC at the timeframe specified in the order(s). Trip charge mileage only includes from pickup location to drop of location (i.e., does not include mileage from drop off location to Contractor facility.)

1.6.2.2. When an order with trip charge is requested, the Contractor shall track the actual miles traveled the drivers spent working for the required tasks and submit invoice(s) along with supporting documents showing the actual miles expensed. The distance matrix provides the distance figured to be used in computing revenue miles. Truck trip charge shall be charged for one way (APPENDIX A).

1.6.3. Ordering.

1.6.3.1. Ordering via Blanket Purchase Agreement (BPA) Call Register.

The Government is only obligated to the extent of authorized calls under this BPA. The Government is in no way guaranteeing or committing to any specified requirement, only those that are entered into in the form of subsequent authorized calls.

1.6.3.1.1. The Government shall only be obligated under this BPA to the extent of the authorized calls placed by authorized personnel identified by the CO. The Contractor must ensure the member placing the call is on the current iteration of AC List. Call limitations are outlined in the BPA, as well as the AC List.

1.6.3.1.2. Ordering Officer and the 18th Contracting Squadron (18 CONS) are the only units authorized to issue calls and will maintain an ongoing call register.

1.6.3.1.3. A requesting activity shall provide a complete set of Truck Transportation Order Form and Cargo List to the Office no later than (NLT) the time frame set forth below. *Note:

Incomplete/partial documents will NOT be processed.

1.6.3.1.3.1. Small and General Trucking: NLT 03:00 PM on a working day prior to the day service is required. Service requests for Saturday through Monday shall be placed preceding Friday.

1.6.3.1.3.2. Perishable Trucking: NLT 03:00 PM on a week prior to the day service is required.

Service requests for Saturday through Monday shall be placed preceding Friday.

1.6.3.1.3.3. Oversized and Dangerous/Hazardous Trucking: NLT Ten (10) working days prior to the day of a service required.

1.6.3.1.4. The term “working days” used herein covers Monday through Saturday including Japanese Holidays. Small percentage of operations occurs on Sundays and U.S. legal holidays (see para. 1.10.8.) depending on Air/Ocean trucking schedules.

1.6.3.1.5. Services from the Contractor shall only be rendered once the Ordering Officer verifies the following required documents: 1. Truck Transportation Order Form and 2. Cargo List, at that time the Ordering officer shall contact the Contractor to provide requested services. After the order schedule is confirmed with the Contractor, The Ordering Officer will send a confirmation email notification to the requesting activity.

1.6.3.1.6 Ordering Procedures Under the Micro Purchase Threshold. The AC will issue a Call to the BPA holder who can meet mission requirements and is most advantageous to the Government.

1.6.3.1.7 Ordering Procedures Over the Micro Purchase Threshold. The AC will take into consideration each BPA holder and execute a call that is most advantageous to the Government IAW with FAR 13.303-5.

1.6.4. Wide Area Workflow (WAWF): After the service is rendered under any Call Registers the Contractor shall submit the properly executed Truck Transportation Order Form / BPA Call Register and any supporting documents along with the invoices to WAWF. The Contractor may submit invoice(s) on a semi-monthly and/or a monthly basis.

1.6.5. Cost of Operation. All Costs of operation under this contract shall be borne by the Contractor, including but not limited to licenses, costs of overtime/Sunday or holiday work, or for operations during stormy or inclement weather.

1.6.6. Government Installations – Shall consist of United States Forces Japan installations as listed below.

1.6.6.16. Trucking Loading Point – A shipping point designated by the AC.

1.6.6.17. Trucking Unloading Point – A receiving point designated by the AC.

1.6.6.18. Loading and Unloading. All trucking shall be loaded and unloaded by the Government. However, the Contractor shall not be relieved from the responsibility for the proper stowage and securing of trucking against loss or damage while in transit.

1.6.6.19. Free Time. The Contractor shall provide free time for loading and unloading of trucking at no cost to the Government for thirty (30) minutes period for all trucking services applicable to a “trip charge” commencing at the time –

1.6.6.20. The truck is placed by the Contractor at the trucking loading point within an installation and notice thereof is given to the AC placing orders.

1.6.6.21. The truck arrives at the trucking unloading point within an installation and notice thereof is given to the AC.

1.7. Basis for Charges.

1.7.1. If the Contractor furnishes a truck of larger size than that ordered due to non-availability of the ordered size, the Contractor should charge the original request made by the Government and a payment will be made based on an originally ordered size of truck.

1.7.2. Accessorial Services

1.7.2.1. Midnight and Early Morning Charges. When the Contractor furnishes services between the hours of 2200 and 0500 Japan Standard Time (JST) specifically directed by the AC, the midnight and early morning rate shall be charged in accordance with the price specified in in the Price List.

1.7.2.2. Retention Charge. In case the Contractor is required to leave a chassis/trailer after loading cargo, at no fault of the Contractor, in the designated Government installations for overnight, the Contractor shall submit an invoice for the retention charge in accordance with the Price List.

1.7.2.3. Standby Charge. At no fault of the Contractor, a vehicle is not loaded and dispatched or discharged and released within the allowable free time as specified in paragraph 1.6.6.19., the Contractor shall submit an invoice for detention of the vehicle by the Government beyond the free time at the rate indicated in in the Price List. Standby Charge is only applicable for the orders with trip charge.

1.7.2.4. Reimbursable Toll Charges: For expediting delivery/transportation to meet the required delivery/arrival time at destination, the AC may request the Contractor to use toll road(s) for the transportation of hazardous trucking accompanied by the Government escorts, or.

1.7.2.5. Truck Transportation Order Form shall be annotated with “Use of toll roads authorized” respectively in the “Remarks” column thereon. A sample of Truck Transportation Order Form is listed in Appendix B. Actual amount will be paid to the Contractor for the use as directed by the AC and as supported by toll road receipts. The Contractor is responsible for submission of the original toll road receipts when submitting invoice to WAWF for reimbursement.

1.7.2.6. Cancellation of Requirement. Cancellation shall be applied when service is scheduled and the requirement is cancelled, rescheduled, or postponed, regardless of whether the Contractor’s truck has been placed at the trucking loading point unless a cancellation is made by eight (8) hours prior to the starting time of the scheduled service. The cancellation charge is calculated based on the rates specified in the Price List.

1.8. Continuation of DoD Contractor Services During Crisis. Transportation Services at U.S.

Military Installations in Okinawa, Japan, have been identified by the Functional Commander/Director as a fundamental service. The Contractor shall continue providing the services whenever a crisis has been declared. Priority of support will be given to units directly involved in contingency operations. The CO is the only authority to provide the crisis notification to the Contractor. No other individual, entities, to include the decentralized BPA ACs are authorized to provide this notification to the Contractor.

1.9. Payment. All payments under this contract shall be processed through DFAS Japan submitting invoices using electrical systems such as World Area Work Flow (WAWF). For the issued BPA Calls, the Contractor shall be registered in WAWF https://wawf.eb.mil/) and submit their invoices twice a month or every month to WAWF.

1.10. GENERAL INFORMATION.

1.10.1. Government Remedies. The CO will follow FAR 52.212-4, Contract Terms and Conditions-Commercial Items for the Contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

1.10.1. Re-Performance of Services. When the Contractor fails to meet the requirement, the Government may require the Contractor to perform the services again in order to conform to contract requirements, at no additional cost to the Government. If the Contractor fails to promptly perform the services again or is unable to take the necessary action to ensure future performance in conformity with contract requirements, the Government may by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service or terminate the contract for cause. Should the Government decide to terminate for cause; the excess cost will also include any expenses incurred.

1.10.2. Authorized Caller. The AC is authorized to place a call or schedule deliveries in the manner described herein. The AC shall have authority to certify the performance of services by the Contractor. A current list of ACs will be submitted to the Contractor at the pre-performance conference.

1.10.3. Obtaining Exemption of Japanese Tax and Submission of Vehicle’s Listing for Tax Exemption Certificate.

1.10.3.1. The basis whereby US Armed Forces obtain exemption from Japanese taxes are prescribed in paragraph 3, Article XII of the Status of Forces Agreement under Article VI of the Treaty of Mutual Cooperation and Security between the U.S. and Japan.

1.10.3.2 The Contractor shall be responsible for submission of the following documents to 18 CONS, KAB for verification and issuance of fuel tax exemption certificates under this contract.

1.10.3.2.1. Fuel consumption ratios of truck by size.

1.10.3.2.2. Accurate lists of all trucks to be used under this contract with copies of vehicle inspection certificates, and other information if required.

1.10.3.3. The Contractor shall submit requests for issuance of tax exemption certificates to the CO not later than 365 calendar days after receipt of an original voucher.

1.10.3.4. The Contractor shall also submit a certified statement to the CO for claiming deadhead distances for each ordered service during the performance period. The wording for the certification statement will be provided to the Contractor by the CO.

1.10.3.5. The Contractor shall not include any distance traveled by the trucks that owned or used by a third party. This service is not considered for official use for fuel tax exemption purposes.

1.10.3.6 The CO will review the accuracy of the Contractor’s figures on fuel consumption prior to issuance of appropriate tax exemption certificate.

1.10.4. Base Pass/IDs.

1.10.4.1. Installation Base Passes. For access to US Installations, the US Government will issue all required Gate Passes/Vehicle Passes to Contractor personnel at no cost to the Contractor. To obtain passes, the Contractor is required to submit documents (such as base pass applications and copies of driver’s license) IAW each installation instruction. The prime Contractor shall be responsible for all passes issued to his/her own or his/her subcontractor’s employees under this contract. The Contractor shall return all applicable passes upon termination of employment or completion of this contract to the Installation Pass Office.

1.10.4.2. ID Passes and Badges: Contractor is responsible for obtaining such clearances and passes as required for their employees to enter military installations on Okinawa prior to start to work. Contractor workforce must comply with all personal identity verification requirements (background investigations and security checks) as directed by DOD, USMC, USAF, Army, Navy, Host Nation, and local policy to secure access for Contractor employees to U.S.

Government facilities. Contractor is responsible for all passes issued to their employees under this contract. Contractor shall coordinate applications through the CO or designated representative. At time of application, Security Forces may conduct a background check on employees. Upon termination of employment, Contractor is responsible for returning identification cards and base passes to Security Forces within 24 hours of termination.

1.10.5 Incident Report

1.10.5.1. The Contractor shall report all incidents of damage or destruction to property, or personal injury or death to any person, arising out of and during the performance of this contract.

For the purposes of this paragraph, the term “property” includes equipment, trucking, or property of any type whether Government owned or not and the term “Contractor” includes the Contractor, its agents, or employees.

1.10.5.2. The Contractor shall submit these reports to the CO and the AC as follows:

1.10.5.2.1. A preliminary report shall be made as soon as practicable after the time the incident occurs. The report shall be submitted to the CO and the AC via e-mail.

1.10.5.2.1. A complete written report shall be submitted to the CO and the AC within 96 hours after a preliminary report is submitted.

1.10.6. Contractor’s Personnel.

1.10.6.1. Contract Manager (CM). The Contractor shall provide a CM who shall be responsible for the performance of work under this PWS. The name of this individual and alternate(s) who shall act for the Contractor when the CM is absent shall be designated in writing to the CO. The CM or alternate shall have full authority to act for the Contractor on all contract matters relating to the daily operations of the work performed under this contract. The CM and alternate shall be individuals who are capable of conversion in English writing and have comprehension of English.

1.10.6.2. The CM or alternate shall be responsible for overseeing the contractor’s performance to ensure services are performed in accordance with this PWS. The CM shall report any problems that are encountered in any work locations. The AC will document all the reported problems and obtain approval from the CO for any work that will incur costs.

1.10.6.3 Removal of Contractor’s Employee. The Contractor shall utilize only experienced, responsible and capable employees in the performance of this contract. The CO may require that the Contractor remove from the Government job any of his/her employees who endanger persons or property, or whose continued employment under this contract is inconsistent with the interests of military security.

1.10.6.4. Other Third Country Nationals (OCN). The Security Forces on each base control entry to the base. Under certain circumstances, the OCN might be denied entry. It is the Contractor’s responsibility to coordinate with Security Forces at each installation when there is a question about a particular circumstance.

1.10.7. Subcontracting. The subcontractors shall meet the standards required by this contract to perform the service. The prime Contractor is responsible for the performance of the subcontractors.

1.10.8. U.S. Legal Holidays. The U.S. legal holidays are specified below:

1.10.9. Liabilities.

1.10.9.1. The Government shall in no event be liable or responsible for damage or injury to any person or property occasioned through the use, maintenance, or operation of any vehicle or other equipment by, or the action of, the Contractor or the Contractor’s employees and agents in performing under this contract, and the Government shall be indemnified and saved harmless against claims for damage or injury in such cases.

1.10.9.2. Except when loss and/or damage arises out of causes beyond the control and without the fault or negligence of the Contractor, the Contractor shall assume full liability for any and all goods lost and/or damaged in the movement covered by this contract.

1.10.10. Typhoon Actions.

1.10.10.1. Tropical Cyclone (Typhoon) Actions: When Tropical Cyclone Condition of Readiness (TCCOR) 2 or TC-2 is declared by KAB weather authorities, the Contractor shall consult with the CO.

1.10.10.2. TCCOR 1 - When TCCOR 1 or TC-1C is declared by KAB weather authorities, the Contractor shall depart military installations and monitor radio/television for changes in TCCOR Conditions.

1.10.10.3. TCCOR SW - When TCCOR Storm Watch (SW) or TC-SW is declared by KAB weather authorities, the Contractor shall contact the AC and resume services.
