PERFORMANCE WORK STATEMENT
PYROTECHNICS
2024 DOVER AFB AIRSHOW
DOVER AFB, DE
The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services, to perform pyrotechnic displays of approximately 20 minutes in duration, daily during the 2024 Dover AFB Airshow 17-20 May 2024. The contractor shall perform a single show each day on 17 and 20 May. The contractor shall arrive at Dover AFB in adequate time to attend the safety briefing and practice day on Friday 17 May 2024.
Contractor Requirements: The Contractor shall abide by USAF Explosives Safety Standards, AFMAN 91-201 found at http://static.epublishing.af.mil as directed by Dover AFB Safety representatives and shall follow guidance in DoD 4145.26-m, DoD Contractors' Safety Manual for Ammunition and Explosives. The contractor shall also abide by the guidance set forth in DESR 6055.09 AFMAN91-201 and AFMAN 10-1004. The contractor shall be on the ACC approved “Shooter in charge List.” Contractor shall possess a U.S. Bureau of Alcohol Tobacco and Firearms High Explosive Class 33 AFT User License. The contractor shall also possess state and local licenses/permits.
Pyrotechnic Display Requirements: The Contractor shall perform multiple pyrotechnic displays to complement a bombing and strafing simulation display.
(1) The Contractor shall provide full shot pyrotechnic display in support of this act on 17 and 20 May 2024.
(2) The detailed breakdown of each pyrotechnic display will consist of:
• One Firewalkers' Super Bomb and three large bombs to accompany the B-2 Flyover
• Four total strafes across two days to accompany the P-51 Flight
• Four bombs on Saturday May 21st and six bombs on Sunday May 22nd to accompany the dual B-25 Flight
• Two bombs on Saturday May 21st and three bombs on Sunday May 22nd to accompany the TBM Flight
(3) The detailed breakdown is subject to change upon completion of field survey.
Period of Performance: Contractor shall have all required equipment at Dover AFB not later than 1500 EST on 17 May 2024. Contractor shall depart Dover AFB no earlier than 1800 EST on 19 May 2024 and will plan on departing no later than 1400 EST on 20 May 2024.
Limitations: The Contractor will operate within the limitations prescribed by Federal Aviation Regulation Waiver (FAA Form 7711-1) on the dates specified above provided weather, mechanical, and site conditions permit.
Pre-Show Requirements: The Contractor, or a Contractor’s representative, will attend a pre-show briefing planned for Saturday and Sunday. The Contractor’s failure to attend the pre-show briefing will result in cancellation of that day’s performance and the Contractor’s fee will be adjusted accordingly. No later than 10 May 2024, the Contractor is required to provide the Director and Air Operations Officer a list of all team members. The information required is full name, date of birth, driver’s license number and state of issue. This information will be protected and limited access to it for the purposes of running a security background check to allow access to the installation. The contractor shall provide a copy of the projected pyro influence with blast and heat utilizing the current designated crowd lines IAW DESR 6055.09 AFMAN91-201 dated 28 May 2020 and AFMAN10-1004 dated 23 August 2018. Contractor shall coordinate with Dover AFB CE for a pre-burn of the pyro area prior to any live displays.
Logistics:
(1) General. The Contractor will coordinate logistical requirements with the Airshow Director of Operations to ensure the fulfillment of all referenced requirements. The alternate point of contact is the Director of Ground Operations. The Contractor shall ensure coordination with base EOD prior to arrival in addition to briefing them on the types of explosives that will be used.
(2) Fuel. The Government will provide the required MOGAS up to 200 gal. The Contractor will provide all transportation and storage of MOGAS. The Contractor shall include the type and how many gallons of fuel are needed in their quote.
(3) Utility Vehicles. All commercial explosives will be handled, stored, and transported by the contractor responsible for the pyrotechnic display. DoD (military or civilian) personnel, on or off-duty, will not handle or transport commercial explosives. Dover AFB personnel will only be allowed to escort the explosives to the demonstration site.
(4) Storage Space. All off-base opportunities to store commercial explosives intended for use in the airshow must be exhausted prior to considering use of on-base storage facilities. If all off-base opportunities are exhausted, the contractor will coordinate with the air show director and air operations officer to determine suitable storage on base.
Should equipment need to be stored the contractor shall include the type of equipment and the amount in their quote. Any excess explosives or explosives residue will be removed by the contractor immediately following the demonstration through coordination with EOD and associated on base organizations.
Report of Damage, Destruction, Injury, or Death:
(1) The Contractor shall report all incidents of damage or destruction to property, or personal injury or death to any person, arising out of and during the performance of this contract. For the purposes of this paragraph, the term “property” includes equipment, freight, or property of any type, whether Government-owned or not, and the term “Contractor” includes the Contractor, its agents, or employees. If incident occurs on base, the 628th Security Forces Squadron (SFS) Law Enforcement and the Airshow Fire Chief shall be notified within 5 minutes of the occurrence.
(2) The Contractor shall submit the following reports to the Contracting Officer and the Government Representative:
- A preliminary written report, to include witness statements, as soon as practicable.
- A complete written report within 96 hours of the incident.
Contractor’s Liability Insurance: The Contractor declares that they will maintain personal liability insurance within the limits of one million dollars ($1,000,000.00) per occurrence for bodily injury or property. A copy of proof of insurance shall be provided to the Organizer no later than 7 May, 2024.
Compensation: Should the 2024 Dover AFB Airshow be abandoned, cancelled, or otherwise prevented from occurring due to conditions outside the control of either party, including, but not limited to, national or military emergency, disaster, terrorism, or an act of God, neither party hereto shall be liable to the other for any expense incurred at the time of cancellation.
Negligence, equipment failure, sickness, and loss of employees/subcontractors do not create conditions outside the control of the party and do not excuse performance. If, on the day of the event, the Contractor is on site and ready to perform, but cannot due to circumstances outside of his/her control the Contractor will be paid 100% of the performance fee. If the Contractor fails to perform for a reason other than those stated above, he/she shall not be entitled compensation of any type; to include 100% of the performance fee or a percentage thereof that is commensurate with the amount of non-performance.
Deposits. The Government will not pay any deposits. All costs will be inclusive and will be paid in one lump sum. Payment will be made within 30 days of receipt of invoice and material inspection and receiving report (DD-250).
Lodging. The Contractor will not include a fee for lodging. The Government will provide non-smoking rooms for Contractor personnel from 16 May to 20 May 2024. The Contractor will submit the number of rooms required in their official quote. Contractor, and all individuals/ Sub-Contractors assisting the Contractor in the execution of this PWS and/or accompanying the Contractor under terms of this PWS, will be responsible for paying for all sundry items consumed. A credit card for each room provided will be required upon check-in to cover any sundry item costs or damages to the hotel.
Transportation: The Contractor shall not include a fee for ground transportation or airfare.
Contractor shall include vehicle request (quantity and type) within their quote.
Donations: Air Force shows are free to the public and charge no admission. The contractor shall not solicit donations as additional compensation from the public. The Contractor may not display or present any signage or charge for an admission fee in any way, shape, or form to tour an aircraft or display. See AFM 10-1004 for further guidance.
