Solicitation 140P8323Q0077 – Restroom Trailers – Olympic National Park (OLYM)

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued.

This solicitation is a Request for Quotations, numbered as 140P8323Q0077. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-04, effective June 2, 2023.It is the contractor’s responsibility to be familiar with applicable clauses and provisions. Clauses and provisions can be found at https://www.acquisition.gov/?q=/browse/far/52.

The associated North American Industrial Classification System (NAICS) code for this procurement is 562991 – Septic Tank and Rental Services with an associated small business size standard of $7.5 million in average annual receipts or 336999 – All Other Transportation Equipment Manufacturing with an associated small business size standard of 1,000 in number of employees. The Product Service Code (PSC) is W085 – Lease or Rental of Equipment Toilets.

This solicitation is a 100% total small business set-aside and will result in a firm fixed price contract to a single contractor/vendor determined to be responsive and responsible. The Government will consider past performance in determining responsibility.

The purpose of this contract is to supply and delivery of temporary restroom trailers to specified location. Transport trailers will need to be removed once restroom trailers are in place. Trailers to be leveled and secured at Government personnel specified location onsite.

Units provided shall be in as new condition when delivered, with clean interior and exterior and fully intact and functioning doors.

All questions and quotes shall be sent to Mickey Chisolm at Mickey_Chisolm@nps.gov with the subject line text: 140P8323Q0077 Restroom Trailers. Questions are due no later than Wednesday September 6, 2023 at 3:00 pm Pacific Time. No further questions will be taken after this deadline.

Telephone calls will not be accepted.

Quotes shall be submitted no later than Wednesday 5:00 pm Pacific Time, September 13, 2023 to Mickey Chisolm at Mickey_Chisolm@nps.gov . Late submissions shall be treated in accordance with the solicitation provision at FAR 52.212-1(f)(1). Any quote, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is “late” and will not be considered.

An organized site visit will NOT be scheduled.

The government reserves the right to cancel this solicitation.

01 – DESCRIPTION.

Temporary Facility Requirements

1. Restroom Trailer: Excellent condition, prefabricated mobile unit, durable, sufficiently lighted, heated, and ventilated toilet facilities in weatherproof, sight proof, ABAAS accessible, sturdy enclosures with privacy locks.

a. Minimum eight (8) stations, plus minimum two (2) ABAAS compliant stations

b. Mobile unit; excellent condition, structurally sound, insulated, weather tight

c. Paneling or freshly painted walls, acoustical tile or painted ceilings, and resilient flooring

d. Heater, temperature controls

e. Ceiling mounted general lighting fixtures

f. Flushable fixtures of minimum 1.6 gallons per flush and operable lavatories for handwashing

g. Electric, sewer, and water connections

Location

Hurricane Ridge is located approximately 18 miles south of Port Angeles, WA 98362, at an elevation of 5,242 feet above sea level. The Hurricane Ridge Road is a steep, winding road with a vehicle/trailer height limit of 14’-6”.

The developed area of Hurricane Ridge receives an average annual snowfall of 382 inches per year and winds potentially up to 100 mph. During the months of December, January, and February the average maximum temperature is 34 degrees Fahrenheit, and the average minimum temperature is 24 degrees Fahrenheit. Average temperature for these months is 29 degrees Fahrenheit.

02 – PRICE SCHEDULE.

Quoter shall fill in price in all line items; do not add line items or costs elsewhere. Failure to do so may render the quote ineligible from further consideration. In case of errors in summations, the total of the corrected amounts governs. Quoter shall factor prices quoted to include all labor, travel, equipment, materials, transportation, overhead and profit necessary for completing all work performed in accordance with the Scope of Work, terms, provisions, and clauses.

04 – CONTRACT CLAUSES.

DIAR 1452.201-70 Authorities And Delegations (SEPT 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence.

Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the

COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

The contract’s main COR will be determined after award. The Contracting Officer will delegate inspection and acceptance of work to the COR who will review segments of work completed/delivered, review invoices, perform any necessary inspections, and will be responsible for documenting the Government’s acceptance of work as 100% complete. Final payment shall not be made prior to the CO’s written final inspection, documenting date of acceptance.

ELECTRONIC INVOICING & PAYMENT REQUIREMENTS - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: Vendor’s standard business invoice (upload your business invoice as an attachment to the IPP invoice before you click “submit” in IPP). Vendor’s failure to attach the required documentation will result in the IPP invoice being rejected. NOTE:

Content of a proper invoice shall include the following, in accordance with Federal Acquisition Regulation 32.9 – Prompt Payment:

(a) Name and address of the contractor.

(b) Invoice date and invoice number (Contractors should date invoices as close as possible to the date of mailing or transmission).

(c) Contract number or other authorization for supplies delivered or services performed (including order number and contract line item number).

(d) Description, quantity, unit of measure, unit price, and extended price of supplies delivered or services performed.

(e) Shipping and payment terms (e.g., shipment number and date of shipment, discount for prompt payment terms). Bill of lading number and weight of shipment will be shown for shipments on Government bills of lading.

(f) Name and address of contractor official to whom payment is to be sent (must be the same as that in the contract or in a proper notice of assignment).(g) Name (where practicable), title, phone number, and mailing address of person to notify in the event of a defective invoice.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(d) Comptroller General Examination of Record. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years and 6 months.

REQUIRED STATEMENTS

a) The service is a contractual arrangement and not a personnel appointment;

b) Payment is based on an end product or the accomplishment of a specific result;

c) The service does not constitute and employer/employee relationship;

d) The Contractor will not be subject to Government supervision, although Contractor performance will be monitored; and

e) The Contractor shall not have any direction or control of federal employees.

Information and requirements stated to this point apply to both this solicitation and the subsequent contract.

BASIS FOR AWARD DECISION.

NPS will select a quote that represents the best overall value to the government based on the relevant experience, past performance, and price factors listed below. The Government may elect to accept other than the lowest-priced quote when the perceived benefits of a higher-priced quote merit the additional costs.

FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Relevant Experience, Past Performance and Price. Relevant Experience and Past Performance are approximately equal when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

EVALUATION FACTORS. Evaluation will be conducted using simplified acquisition procedures described in FAR Part 13 and will be solely on the quote and its associated documents. Review list below to ensure your quote is complete. The following factors will be used to evaluate quotes:

A)

Relevant Experience. Quoter shall provide two relevant conservation treatment services in the past ten years that clearly demonstrate a relevant similarity of the service requirement. Quoter shall have at least three years or more of experience providing conservation treatment services.

NOTE: if the quoter will be subcontracting the service, the experience must be provided from both the quoter’s experience and subcontractor’s experience. You may provide this information on the “Attachment 3, Forms to Submit with Quote” attached. Provide the following:

1. Customer name/business name, location delivered and date(s).

2. Project relevance: Provide a description of how the project is relevant to the service identified in Attachment 2, Statement of Work.

4. Current primary point of contact for your customer: At a minimum, provide a name, relationship to the servicer, agency/firm, phone number and email address and total price of the service.

BE SURE TO NOTE WHO THE EXPERIENCE REFERS TO. IF YOU ARE PROVIDING THE

SUBCONTRACTOR’S EXPERIENCE, NOTE THE SUBCONTRACTOR’S NAME FOR THAT

PARTICULAR EXPERIENCE. IF THS INFORMATION IS NOT CLEAR, THE EXPERIENCE

WILL BE LISTED AS UNACCEPTABLE.

Past relevant experiences will be rated as Acceptable or Unacceptable:

Acceptable: Service experiences clearly demonstrate all the required experience in the past three years. Unacceptable: Service experiences do not clearly demonstrate all the required experience in the past three years.

B)

Past Performance. Past Performance is the measure of degree to which a contractor has satisfied its customers in the past. The NPS will evaluate past performance based on contracting references provided by the quoter and/or subcontractor as required in the Experience evaluation factor. The Government’s knowledge of Quoter’s past performance, and/or subcontractor’s references may be obtained from any other source. The following inquiries will be made to the quoter’s and/or its subcontractor’s customer:

- Demonstrated ability to stay on schedule and successfully meet the needs of deadlines.

- Business relations skills – capable, reasonable, committed to customer satisfaction and cooperative behavior and communication during the performance period.
