About this file

This is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form used for federal contracting opportunities.

The form serves as a self-certification mechanism for enterprises to represent whether they meet the definition of an "Indian Economic Enterprise" under the Buy Indian Act (25 U.S.C. 47) in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations. Enterprises must maintain this eligibility throughout three critical periods: at the time of offer submission, contract award, and during the entire contract performance period. If eligibility status changes during any of these periods, contractors must immediately notify the Contracting Officer in writing. The form includes spaces for solicitation number, project title, date, and requires specific information including the name of the 51% owner of the IEE firm, certifying signature, print name, name of federally recognized tribal entity, business name, and Unique Entity Identifier (UEI) number. Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards may be subject to protest if the successful offeror's eligibility is questioned. The form warns that false or misleading information is punishable under federal law, with violations subject to penalties under 18 U.S.C. 1001, 31 U.S.C. 3729-3731, and 18 U.S.C. 287.
