PREFERENCES - A NOTICE TO VENDORS (SEP. 2009): On June 16, 2009, the South Carolina General Assembly rewrote the law governing preferences available to in-state vendors, vendors using in-state subcontractors, and vendors selling in-state or US end products. This law appears in Section 11-35-1524 of the South Carolina Code of Laws. A summary of the new preferences is available at www.procurement.sc.gov/preferences . ALL THE PREFERENCES MUST BE CLAIMED AND ARE APPLIED BY LINE ITEM, REGARDLESS OF WHETHER AWARD IS MADE BY ITEM OR LOT. QUESTIONS FROM OFFERORS (FEB 2015)
(a) Any prospective offeror desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing. Questions regarding the original solicitation or any amendment must be received by the Procurement Officer no later than five (5) days prior to opening unless an earlier date is stated on the Cover Page. Label any communication regarding your questions with the name of the procurement officer, and the solicitation's title and number. Oral explanations or instructions will not be binding. [See R. 19-445.2042(B)] Any information given a prospective offeror concerning a solicitation will be furnished promptly to all other prospective offerors as an Amendment to the solicitation, if that information is necessary for submitting offers or if the lack of it would be prejudicial to other prospective offerors. See clause entitled "Duty to Inquire." We will not identify you in our answer to your question. (b) The State seeks to permit maximum practicable competition. Offerors are urged to advise the Procurement Officer -- as soon as possible -- regarding any aspect of this procurement, including any aspect of the Solicitation that unnecessarily or inappropriately limits full and open competition. · From a technical perspective, how are you defining success for this project? A new hosting provider would need to be attentive to our immediate requests to consider it a successful relationship. Technically capable of delivering as much horsepower and bandwidth as needed for the situation.
· Is there any defined budget you can share? No Statement: The websites and all related infrastructure and platform components SHALL be hosted in a FedRAMP authorized environment owned, managed, and maintained by the contractor, with a minimum of a Moderate JAB authorization for IaaS and PaaS. The environment shall be fully redundant with a FedRAMP authorized failover IaaS and PaaS capable of taking over operations in the event the primary facility is inoperative. The contractor MUST provide their FedRAMP package ID to SCEMD for verification of security posture.
Question: Would you accept offers of an Azure Government environment managed by the offeror rather than owning the environment? No
Statement: The websites and all related infrastructure and platform components SHALL be hosted in a FedRAMP authorized environment owned, managed, and maintained by the contractor, with a minimum of a Moderate JAB authorization for IaaS and PaaS. The environment shall be fully redundant with a FedRAMP authorized failover IaaS and PaaS capable of taking over operations in the event the primary facility is inoperative. The contractor MUST provide their FedRAMP package ID to SCEMD for verification of security posture.
Question: Would an offeror be considered compliant as a MSFT CSP selling Azure given, we’re selling MSFT services and MSFT owns the data center? No
A reseller of services does not meet the requirements. Microsoft is FedRAMP authorized, but Microsoft is not providing the services to SCEMD or managing and maintaining the websites, performing the security scans and remediation for the websites per FedRAMP requirements
SCEMD services are mission-critical, and security-sensitive and the FedRAMP requirements ensure the contractor is FedRAMP authorized as part of the process. SCEMD can rely on a FedRAMP authorization to ensures the service provider (contractor) has been assessed by a 3PAO for compliance, has a recent Information System Contingency Plan and has performed a live test of their disaster & contingency plans (see SOW item 3), meet specific FedRAMP requirements, and have policies and procedures in place and that have been tested for the following:

The bidding schedule – page 17 of the solicitation identifies “1 each” website hosting. Does the 1 each mean 1 (one) complete environment that contains multiple servers, a load balancer, O/S licensing, and unlimited bandwidth?

1. Is EMD able to extend the due date two or more weeks, in order to provide the best response possible? No
2. As the terms and conditions are silent in regard to any limitation of Contractor’s liability, is EMD willing to negotiate some limitation of Contractor’s liability? No
3. Is EMD willing to negotiate further terms and conditions after bid submission? No
4. EMD has requested per year pricing for the services. However, there are requirements for scalability (by increasing the number of public-facing servers) in support of emergency operations. How should this potential variability in the amount of services to be provided be handled in the pricing? Feel free to adjust your bid based on readily available historical data.
5. There will be one-time charges associated with initial implementation. These could be included in the per year pricing for Year 1, but are not necessary for renewal years. How should that be handled in the pricing? The request is for a fixed price annual cost. Please adjust your offer accordingly.
