This law appears in Section 11-35-1524 of the South Carolina Code of Laws. Scope of Work/Specification in the paragraph from Licenses and Permits on page 16 of the solicitation document.

LICENSES AND PERMITS

During the term of the contract, the Contractor shall be responsible for obtaining, and maintaining in good standing, all licenses (including professional licenses, if any), permits, inspections, and related fees for each or any such licenses, permits, and /or inspections required by the state, county, city, or other governmental entity or unit to accomplish the work specified in this contract. The tester needs to be certified by the steel tank institute and listed on DHEC's web site.

Questions Received STI does not offer licensure for "regular" compliance testing of USTs (only Cathodic Protection). Can you please clarify the STI license requirement mentioned in the original bid scope? Can a cathodic protection technician be licensed by NACE instead?

State’s Response: The STI license is required exclusively for Cathodic Protection testing; however, NACE certification is also recognized as an acceptable alternative.

Spill Bucket / Containment Sump hydrotesting - this is required by SC DES every three years for UST systems, but these line items are not listed on the bid. Is there an expectation of the winning bidder to perform these tests?

State’s Response: No, there is no expectation for the awarded bidder to perform the spill bucket and containment sump hydrostatic tests. SCDE performs these tests internally.

Certification – The bid materials currently state that technicians are required to be certified by STI for this work. But the only certification STI provides for testing is for CP and there are 5 other types of testing required in this bid.

So I was hoping for clarity from SCDE on the bid as to what they are expecting.

Something like this?

1. Line tightness testing - manufacturer test equipment certification required

2. Leak detection - no certification required

3. Sensor - manufacturer certification required (if Veeder Root)

4. Overfill - no certification required

5. Release Detection/ATG - manufacturer certification required (if Veeder Root)

6. Cathodic Protection - AMPP/NACE or STI certification required State’s Response: See Response for Question #1.

The current pricing sheet does not include two required SC DES compliance tests that must be performed every three years: hydrostatic testing for single-walled containment sumps and spill buckets, or interstitial vacuum testing for double-walled containment sumps and spill buckets (documented on SC DES Forms D2562 and D3183). Should vendors include pricing for these additional required tests in our proposals, or will these be addressed under a separate procurement?

State’s Response: See Response for Question #2.

All other terms, conditions, bidding instruction, and specifications remain unchanged. If there are any questions or if any confusion or uncertainty arises as a result of this amendment, it is the sole responsibility of the Offeror to contact the procurement officer for clarification.
