About this file

This amendment to an Invitation for Bid is issued by the South Carolina Department of Health and Environmental Control (DHEC) for Underground Storage Tank (UST) Corrective Action services at UST #11946 located at Broad River Amoco, 4335 Broad River Road, Columbia, South Carolina 29210. The solicitation requests corrective action comprising three specific components: free product removal, free product migration control, and excavation of contaminated soil at an adjacent PlayPals daycare property. The project requires contractors to implement a Corrective Action Plan (CAP) involving installation of an oxygen-releasing compound (ORC) backfill system with minimum 1,666 pounds of oxygen generation over six months, migration prevention barriers, free-phase product recovery, excavation to specified depths, site restoration, and semi-annual groundwater monitoring. The solicitation opening date and deadline for bid submission was May 21, 2020 at 2:30 p.m. ET, with award notification scheduled for May 28, 2020. No pre-bid conference or site visit was required. The contract term is five years for performance-based payment milestones.

This pay-for-performance contract structure allocates payment across three components with specific milestones: 35% upon completion of migration prevention barriers, 30% upon verification of remedy effectiveness, and 35% for site restoration, or alternatively 20% for CAP implementation with 80% for achieving interim and final free-phase product thickness reduction goals. As of May 4, 2020, prior expenditures from the SUPERB trust fund totaled $987,683.75 for Release #1 and $73,125.73 for Release #2, with contractors required to submit bids for the total cost to complete all contract requirements. The selected contractor must obtain access from affected property owners, coordinate with adjacent businesses including the daycare facility, follow all applicable federal excavation safety standards (19 CFR 1926 Subpart P), comply with state permits and quality assurance protocols, and provide detailed technical specifications for all proposed remediation methods in the submitted CAP.

Questions and Answers

Note: Please see the updated map that has been included as an attachment on the SFAA website (http://webprod.cio.sc.gov/SCSolicitationWeb/contractSearch.do?solicitnumber=5400019686)

1. The solicitation documents specify that the excavation must be backfilled with an oxygen releasing compound (ORC).

Please confirm whether or not the Department is requiring the use of the Regenesis product known as ORC or if any other industry accepted In-Situ Chemical Oxidation (ISCO) products can be used. Further, confirm any requirements for equivalents such as equivalent mass of oxygen, or is the only requirement to install 9,800 lbs of an ISCO product regardless of the amount of oxygen.

STATE’S RESPONSE: The selected ORC compound, regardless of the name brand or vendor, must generate a minimum of 1,666 pounds oxygen over a minimum 6-month time period. Per Solicitation Item VIII.3.b, all bidding contractors should provide the manufacturer and name of the proposed specific product at the time of bid submittal.

2. Further, the use of the ISCO amendments referenced in Question 2. typically result in long term changes to pH and/or other water quality parameters. Can the Department specify which, if any, related groundwater quality parameters will be required to be monitored and/or attenuated to achieve any required post remediation levels?

STATE’S RESPONSE: Per Bid Solicitation Item III.5.3.h “The Contractor must collect water samples from all wells and gauging points listed in the Appendix on a semi-annual schedule. Do not sample wells and sampling points containing measurable (>0.01’) FPP. If measurable FPP is present, the thickness of product and depth to groundwater must be recorded to the nearest 0.01’. The sampling will be conducted in accordance with applicable portions of the most current QAPP Revision. Additional samples (air, groundwater, effluent, soil) required by permits must be collected in accordance with established QA/QC protocol and submitted to an SC-certified laboratory for analysis. The samples will be analyzed for parameters stipulated in the permits.” Analytical parameters requested for this Pay for Performance Contract can be found in the Bid Appendix.

http://webprod.cio.sc.gov/SCSolicitationWeb/contractSearch.do?solicitnumber=5400019686

3. Is live loading during the excavation allowed or are excavated soils required to be staged onsite prior to disposal?

STATE’S RESPONSE: The selected contractor should follow all industry standards found within 19 CFR 1926 Subpart P – Excavation in regards to excavated soils, containment and disposal, and outline the proposed method in detail in their CAP.

4. Please provide any design details for the existing French drain available. Where does the French drain currently drain to? Is the receiving point for the French drain adequately sized to receive the increased runoff from the site due to the changes being proposed to the drainage, i.e. impermeable barrier, reduced infiltration, etc.?

STATE’S RESPONSE: It is believed that the current system drains at the southwest corner of the property and flows into a nearby surface water feature. Any reference or information available on DHEC’s behalf can be found in the online Technical file provided referencing UST Permit #11946.

5. Is the only requirement for the impermeable barrier material to be placed between the ORC and the French drain that it be compatible with the ORC and impermeable? For example, 6- or 10-mil plastic sheeting is a typically inert material that is considered compatible with most ORC products and byproducts.

STATE’S RESPONSE: The requirements for the impermeable barrier Per Bid Solicitation III.3.5.B.4.j “ an impermeable barrier compatible with the ORC installed at 3 feet below grade”, and Solicitation Item III.3.5.B.4.m “An impermeable liner will be placed at 3 feet below grade and then extended to the top edge of the pit“. The details regarding the impermeable barrier should be outlined in detail in the selected contractor’s CAP.

6. The Solicitation states multiple times that “disruption to the normal business at the site will be kept to a minimum”, please confirm whether or not the daycare facility will remain shut during excavation activities due to safety concerns with executing the excavation in such close proximity to the daycare facility, especially considering the need for sheet piles or other measures required to prevent the excavation from collapsing due to the proximity to the daycare building.

STATE’S RESPONSE: In accordance with the Bid Solicitation Item 3.5.B.4.e “The Contractor will secure access from each affected property owner to complete the excavation activities. The Contractor will be responsible for any equipment used for corrective action activities.” The selected contractor should coordinate with the affected property owners regarding status of business operation.

7. Pg. 28, Solicitation Item III. 3.5.B.4.l.7), refers to “figure d” to identify each of the excavation areas. Please confirm “figure d” is the figure in the Appendix labeled “Conceptual ORC Distribution – 4 ft Vertical Treatment Interval” as there is no figure labeled “figure d”.

STATE’S RESPONSE: The figure referenced is the “Conceptual ORC Distribution – 4 ft Vertical Treatment Interval Based on Percentage of Total Oxygen”. It has been corrected to reference the percentage of total oxygen per excavation section. In addition, “Figure C” references approximate volume and are estimations of the excavation area.

Please see the updated map that has been included as an attachment on the SFAA website

8. The conceptual ORC distribution map provided in the Appendix lists the amount of ORC to be installed within specific areas of the excavation. The amounts shown total 9,750 lbs. However, Solicitation Item III. 3.5.B.4.m., specifies: “9,800 lbs of an ORC shall be mixed with clean soil and placed in the bottom of the open excavation pit from 7 to 3 feet below grade.

Addition of the amendment shall be completed in accordance with the manufacturer’s instruction.” Please clarify the amount of ORC required to be placed into the excavation. Furthermore, please clarify the distribution of the ORC in the excavation pit is be either according to the “Conceptual ORC Distribution” map provided in the Appendix or if the specified quantity of

ORC is to be placed from 7 to 3 feet below grade uniformly throughout the excavation pit or in accordance with the manufacturer’s instructions.

STATE’S RESPONSE: The distribution of the product should approximately follow the percentages of total oxygen provided on the new figure labeled “Conceptual ORC Distribution – 4 ft. Vertical treatment Interval Based on Percentage of Total Oxygen”.

Please see the updated map that has been included as an attachment on the SFAA website

9. Pg. 28, Solicitation Item III. 3.5.B.4.m., provides requirements for backfill & completion to achieve compaction to 95% of the Standard Proctor maximum dry density as determined by ASTM D698. However, the instructions to backfill the excavation pit with ORC mixed with clean soil does not allow for a base transition typically consisting of crushed stone necessary to achieve compaction. Please advise as to how compaction requirements should otherwise be achieved.

STATE’S RESPONSE: All details regarding how the selected contractor plans to meet compaction requirements found in ASTM D698 should be outlined in their CAP.

10. Furthermore, the conceptual ORC distribution map referenced above, doesn’t provide reference labels of each discrete excavation area shown, though the table on pg. 8 of the Appendix presents a calculation for the total and discrete excavation areas which are labeled as reference areas 1 thru 8 although the conceptual ORC distribution map only has 7 discrete areas shown. Please address discrepancy in the number of excavation areas along with labeling the reference areas.

STATE’S RESPONSE: The new figure “Conceptual ORC Distribution – 4 ft Vertical Treatment Interval Based on Percentage of Total Oxygen” gives a proper percentage distribution for the total amount of ORC Amendment used on site.

There are 7 discrete areas.

Please see the updated map that has been included as an attachment on the SFAA website (http://webprod.cio.sc.gov/SCSolicitationWeb/contractSearch.do?solicitnumber=5400019686)

11. In multiple places throughout the solicitation in regards to performing the excavation, the contractor is advised to be prepared to dewater the excavation area. Please provide discretely any pump test data, or similarly relevant data such as hydraulic conductivity ranges, porosity, etc., available for this site to assist with estimating the amount of water that may be generated during excavation and FPP recovery tasks.

STATE’S RESPONSE: Any information referencing the data mentioned may be present in online Technical Files referencing UST Permit #11946.

12. Please confirm that existing monitoring wells with FPP can only be used as a compliance point and cannot be used for injection/extraction.

STATE’S RESPONSE: Per Bid Solicitation Item 3.5.B.3.a “The use of existing monitoring well(s) for injection, extraction, or FPP recovery purposes is not allowed. Accordingly, the CAP may propose installation of additional injection, extraction, or compliance wells.”

13. Pg. 26, Solicitation Item III. 3.5. B.4.c., CAP IMPLEMENTATION, states “contractor must implement the CAP within 15 days of receipt of the Notice to Proceed. If the CAP is not implemented within 15 days, a penalty of $100 per day will be assessed for each calendar day late unless the Contractor obtains written approval from DHEC regarding a change in the implementation schedule.” However, pg 17. Solicitation Item III. 3.2 SCHEDULE OF DELIVERABLES, states CAP Implementation deadline is within 30 days of receipt of Notice to Proceed for each component. Please clarify these items.

STATE’S RESPONSE: Per Bid Solicitation Item 3.5.B.1 “ The CAP may be one document detailing all required aspects detailed below or separate CAPs detailing each required component listed above, whichever the selected contractor determines to be most effective and efficient for the overall remediation strategy to be implemented at the site. a. Remedy must be such that the barrier is effective until the time that Free Product Removal is completed. Remedy must be such that the migration prevention is deemed, and can be verified, effective prior to the implementation of excavation activities on the adjacent PlayPals property.”

The Notice to Proceed will be sent out individually for each component and the corresponding CAP Implementation due dates are as follows:

i. The Notice to Proceed for CAP Implementation of Migration Prevention will be issued after review and approval of the CAP by the UST Division.

1. CAP Implementation of Migration Prevention should be initiated within thirty (30) days from receipt of the Notice to Proceed for CAP Implementation of Migration Prevention.

ii. The Notice to Proceed for CAP Implementation of Free Phase Product Removal will be issued after review and approval of the CAP by the UST Division.

1. CAP Implementation of Free Phase Product Removal should be initiated within thirty (30) days from the receipt of the Notice to Proceed for CAP Implementation of Free Phase Product Removal.

2. The CAP Implementation Report for Free Phase Product Removal should be received by The UST Division within sixty (60) days from receipt of the Notice to Proceed for Free Phase Product Removal.

iii. The Notice to Proceed for CAP Implementation of Excavation of the PlayPals Daycare Property will be issued after review and approval of the CAP by the UST Division and the installation and verification of effectiveness is complete for the Migration Prevention.

1. CAP Implementation of Excavation of the PlayPals Daycare Property should be initiated within fifteen (15) days from receipt of the Notice to Proceed for Free Phase Product Removal.

14. Pg. 27, Solicitation item III. 3.5, k., a vacuum truck is required to be on-site to remove any FPP and petroleum impacted groundwater that may enter the excavation. Must a vacuum truck be used if a more cost-effective solution can be implemented to accomplish same?

STATE’S RESPONSE: A vacuum truck is not necessary, the selected contractor may propose alternative methods to address dewatering, containment, and disposal of petroleum impacted water. These methods should meet all QAPP requirements, state and federal regulations, and be detailed in the selected contractor’s CAP.

15. Pg. 28, Solicitation Item III. 3.5. B.4.n.(6) states that “sheet piling may be necessary for this excavation”. Due to the proximity of the buildings to the excavation area, the force of driving the piles may result in loss of structural integrity (i.e., cracking) of the foundations of the nearby buildings. What alternatives, such as underpinning, to installing sheet piles would be acceptable to the SCDHEC?

STATE’S RESPONSE: The use of sheet piling is not required. The contractor may use alternative safety protocols relating to any excavation activities that are in compliance with 19 CFR 1926 Subpart P– Excavation.

16. On the last page of the Appendix, a table labeled “Target Free-Phase Product Thickness SSTL” is provided which lists ten monitoring wells for which the FPP SSTL applies. Please confirm these are the only wells for which payment milestones apply.

STATE’S RESPONSE: The wells listed in the “Target Free-Phase Product Thickness SSTL” Table found in the Appendix will be utilized for initial gauging comparisons and payment milestones up to 90% of the Cost component for Free Phase Product Removal. Per Bid Solicitation Item 3.5.2.b.2 “Payment of 80% of the Corrective Action Cost will be made based on achieving interim and final FPP thickness reduction goals as verified in the SSTL wells and gauging points listed in the Appendix, in all injection and/or extraction wells, and in all verification wells.” All wells installed and/or utilized on or off property in relation to the referenced UST Permit number are subject to inspection for the presence of FPP. No wells, injection points, verification, recovery wells, etc., should contain FPP greater than 0.01 feet.

17. Pg. 22, Solicitation Item III 3.5. B.3.b.2), states that “payment of 80% of the Corrective Action Cost will be made based on achieving interim and final FPP thickness reduction goals as verified in the SSTL wells and gauging points listed in the Appendix, in all injection and/or extraction wells, and in all verification wells.” Please provide an explicit list of all wells that will be used to determine interim and final FPP thickness reduction goals.

STATE’S RESPONSE: The wells listed in the “Target Free-Phase Product Thickness SSTL” Table found in the Appendix will be utilized for initial gauging comparisons and payment up to the 90% FPP Removal milestone. Prior to 100% payment and notice of completion, all wells, including monitoring, injection points, recovery wells, etc., should contain no FPP greater than 0.01 feet. All wells installed and/or utilized on or off property in relation to the referenced UST Permit number are subject to inspection for the presence of FPP.

18. The link to the website where the technical file can be downloaded on pg. 17 of the Solicitation provides links to 14 files, many of which do not appear to be related to this Solicitation. Please confirm that only files labeled 11946 are part of the technical files applicable to this solicitation.

STATE’S RESPONSE: Only the four (4) files labeled 11946 are related to the referenced UST Permit #11946.

19. As the technical file provided is four links labeled 11946, and the files total almost 5,000 pages which are for the most part largely jumbled with no discernable chronology per file, will the SCDHEC please provide the most recent discrete data files for each of the following:

a. current and historical depth to water,

b. current and historical FPP level thicknesses,

c. current and historical analytical data,

d. current estimated amount of FPP present and FPP plume/contour map,

e. all soil boring logs, and/or cross-sectional areas showing lithology across the site,

f. all well construction logs, especially for any well held to the FPP SSTLs,

g. estimated FPP recovered to date,

h. known amounts of FPP previously discharged on site.

STATE’S RESPONSE: Per Bid Solicitation Item III.3.3 “UST Site Rehabilitation Contractors are strongly encouraged to review the file(s) to ensure a complete understanding of corrective action requirements. DHEC will presume, upon submittal of an offer, that the UST Site Rehabilitation Contractor has reviewed and understands all available information in the technical file.”

20. In regards to the amount of FPP currently present, several wells have reportedly exhibited significant variations in FPP thickness. For example, MWR2-8 measured 12.5 ft of FPP in March 2019 but later was reportedly measured with no free product or was not gauged. MWR2-7 had similar variations. Is there an explanation for these significant variations? Is a recovery system already installed onsite? What free product thicknesses will be used as baseline thickness? How many FPP recovery events have been previously completed?

STATE’S RESPONSE: All assessment, corrective action, and historical data is presented as part of the online Technical File. The most current FPP values from 11/2019 listed in the Table “Dissolved CoC Groundwater Concentrations collected during Sampling/Gauging” in the Bid Appendix, should be used as baseline levels.

21. Does SCDHEC have limitations on technologies that would not be acceptable for FPP recovery at this site?

STATE’S RESPONSE: The Bid Solicitation VI. Corrective Action Cost and Completion Time the “proposed remediation technology (ies) or method(s) for active corrective action [must] achieve the payment milestones as set forth in Section III.3.4.A of this contract and must be protective of public health and the environment and be eligible for permitting by

DHEC.”

22. Are there any requirements regarding abatement of dissolved phase impacts at the site? Are there any concerns that FPP recovery techniques could result in an increased dissolved phase plume size?

STATE’S RESPONSE: The focus for this Pay for Performance Contract is Free Phase Product removal. The technology(ies) utilized must be such to prevent further impact to the environment and adjacent properties. The Migration Prevention Method in conjunction with the Free Phase Product Removal should be such that it prevents further contamination from migrating off site.

23. Please provide additional clarification on payment milestones. Section 3.5.B.2.b. (page number 20 of the PDF) states that 35% will be paid upon completion of the free phase product migration prevention barrier, 30% upon verification that selected remedy is effective in mitigating migration of free product, and 35% for site restoration. However, Section 3.5.B.3.b.1) (page 22 of the PDF) has different payment terms, including 20% for CAP implementation then 80% for achieving milestones.

Which one is correct?

STATE’S RESPONSE: Each component (Migration Prevention, Excavation, and FPP Removal) of the Pay for Performance Bid Solicitation has its own payment structure. Any contractor submitting a bid should provide accurate and proper cost proposals for all three (3) individual components.

24. Please clarify that the SSTLs for the verification wells (to be determined by DHEC) will be for free product only? In other words, it is assumed that no dissolved SSTLs will be required for this Solicitation.

STATE’S RESPONSE: The focus for this Pay for Performance Contract is FPP removal and payment milestones for that component are based on such. The technology(ies) utilized must be such to prevent further impact to the environment and adjacent properties. The Migration Prevention Method in conjunction with the FPP Removal should be such that it prevents further contamination from migrating off site.

25. Please clarify what site restoration includes. Should existing monitoring/recovery wells be left in place or abandoned? It's assumed wells should be left in place for future dissolved phase monitoring/treatment. It's also assumed that the barrier treatment will remain in place?

STATE’S RESPONSE: Per Bid Solicitation Item III.5.A.2, site restoration is complete when “all assessment and corrective action components (e.g., piping, wells, trenches, etc.) have been removed from the site or are properly abandoned; and 3) the facility and associated adjacent properties have been restored to the condition that existed prior to assessment and corrective action in accordance with Solicitation Item III.3.5.B.7”.The function of the migration prevention method should be at a minimum, verifiably effective throughout the duration of the Pay for Performance Contract period which is five (5) years.

26. Does the oxygen releasing compound have to combined with carbon pellets or is that a misprint on page 43, under 3) a.?

STATE’S RESPONSE: The reference stated in Bid Solicitation Item VIII.B.3.a for carbon pellets is a misprint.

27. It is understood that sampling of the side walls is required in the excavation area. Please clarify that the results of the soil sampling will NOT result in additional excavation requirements. In other words, if the contractor completes the excavation as outlined in the Solicitation, and detections are present in soil samples, will additional excavation activities be required?

STATE’S RESPONSE: If the selected contractor completes the excavation as outlined per Bid Solicitation Item III.5.B.4, no further excavation will be required.

28. The Solicitation asks for a table accounting for all anticipated costs. Please provide details on why this is being required.

Please clarify payment terms will not be affected by these numbers. Also, can the table be submitted as confidential?

STATE’S RESPONSE: Per Bid Solicitation IV. 29. Can you provide any additional information on the existing French drain system? Can DHEC provide a map showing the location of the existing French drain and construction information (as-built drawing)? Can we backfill the area with granular aggregate in order to further control drainage (with the liner)?

STATE’S RESPONSE: It is believed that the current system drains at the southwest corner of the property and flows into a nearby surface water feature. Any reference or information available on DHEC’s behalf can be found in the online Technical file provided. The construction and details of the French Drain system should be detailed in the selected contractor’s CAP.

30. It is understood that the bidder must obtain access to off-site properties. Is DHEC comfortable that the Pay Pals will allow access? What will happen if access cannot be obtained?

STATE’S RESPONSE: In accordance with the Bid Solicitation Item 3.5.B.4.e “The Contractor will secure access from each affected property owner to complete the excavation activities.” The selected contractor should coordinate with the affected property owners regarding status of business operation.

31. It's understood that DHEC is requesting implementation of the barrier first. Can corrective action for free product removal and excavation happen concurrently? Please clarify which phases can "overlap" versus what needs to be completed before another phase is started.

STATE’S RESPONSE: Per Bid Solicitation Item 3.5.B.1“There are three specific components to this solicitation: free product removal, free product migration control, and excavation. The free product migration control must be implemented first. The verification and/or monitoring methods proposed by the contractor, must be installed and tested immediately upon completion of the migration prevention control. Other items may be initiated as the contractor deems appropriate as stated in the CAP. The CAP may be one document detailing all required aspects detailed below or separate CAPs detailing each required component listed above, whichever the selected contractor determines to be most effective and efficient for the overall remediation strategy to be implemented at the site.

a. Remedy must be such that the barrier is effective until the time that Free Product Removal is completed.

Remedy must be such that the migration prevention is deemed, and can be verified, effective prior to the implementation of excavation activities on the adjacent PlayPals property.”

32. This appears to be a fairly complicated bid. There are several thousand pages of appendix files to review. Can DHEC provide a few paragraph summary of the site background that prompted this scope of work?

STATE’S RESPONSE: All technical information and history regarding site work, assessment, and monitoring can be found in the online Technical file for UST Permit #11946.Per Bid Solicitation Item III.3.3 “UST Site Rehabilitation Contractors are strongly encouraged to review the file(s) to ensure a complete understanding of corrective action requirements. DHEC will presume, upon submittal of an offer, that the UST Site Rehabilitation Contractor has reviewed and understands all available information in the technical file.”

33. Will any other state contractors be working on this site concurrently (i.e. conducting vapor sampling or any other emergency response actions)?

STATE’S RESPONSE: Only the selected contractor for the pay for performance contract should be on site performing site rehabilitation work.

34. Do you have any additional info on the French Drain location and details as to depth, length and what are the materials of construction? I’ve found nothing in the documents I have other than the mention of a French Drain on the PayPals property?

STATE’S RESPONSE: It is believed that the current system drains at the southwest corner of the property and flows into a nearby surface water feature. Any reference or information available on DHEC’s behalf can be found in the online Technical file provided.
