(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in paragraphs (e)(1) of this paragraph in a subcontract for commercial items. STATEMENT OF WORK

INTRODUCTION

C.1. SCOPE OF CONTRACT/DESCRIPTION OF WORK:

The following is a description for water quality sampling and analysis on the Sequoia National Forest. The forest will be separated into four (4) zones. Zone 1 is the Hume Lake Ranger district located in the northern portion of the forest directly east from Fresno, CA and includes three (3) sites. Zone 2 is the Western Divide Ranger District located in the central portion of the forest directly east from Porterville, CA and includes eight

(8) sites. Zone 3 is the Kern Plateau portion of the Kern River Ranger District located in the southern portion of the forest northeast from Bakersfield, CA and includes eight (8) sites. Zone 4 is the Lake Isabella portion of the Kern River Ranger District located in the southern portion of the forest east from Bakersfield, CA and includes eight (8) sites. See zone maps and individual location maps for additional information.

Most of the water systems are classified as transient non-community systems. All systems are to be sampled every month (approximately 30 days apart) for bacteriological analysis, nitrate (as NO3) analysis every year and nitrite (as NO2) analysis every 3 years. Sampling should be performed as early in the month as feasible to allow for repeat sampling or other follow up actions as necessary. Approximate travel times to each water system location, Regulatory Authority, the approximate season of use (days in service), and the dates of the last nitrate and nitrite analyses are listed in the attached Water System Reference Information table. Three systems (Pinehurst Work Center well #3, Fulton Work Center, and Old Isabella /Auxiliary Dam Area) currently require quarterly analysis for nitrates due to high levels. All analyses shall be conducted by a state certified lab. Nitrate and Nitrite analysis results shall be submitted electronically to the correct Regulatory Authority.

All persons taking water samples shall be “trained samplers” in accordance with the CA Safe Drinking Water Act regulations. Bacteriological sampling and analysis shall be in accordance with California Code of Regulations, Division 4, Chapter 15, Article 3 Primary standards – bacteriological standards. Routine monthly water quality samples shall be analyzed for Total Coliform and E.coli using the Present/Absent method (unless otherwise directed by the Forest Service or Regulatory Authority). In the event of an E.coli positive analysis, the jurisdiction having authority shall be contacted for direction on disinfection/inspection/sampling and any type of additional analysis (Presence/Absence, Most Probable Number, etc).

Chemical sampling and analysis shall be in accordance with California Code of Regulations, Division 4, Chapter 15, Article 4 Primary standards inorganic chemicals.

Water meters, where installed, shall be read once each month when the monthly water sample is taken.

Approximate locations (planned or actual) of the water meters are shown on the sample siting plans. Readings will begin at each site as meters are installed.

All samples shall be taken in accordance with supplied sampling siting plans. All positive analyses shall be reported to the Forest Service within 24 hours. All repeat samples shall be taken within 24 hours of notification in sets of four (4) until all analysis results are negative and a set of five (5) the following month for every total coliform positive sample, except as noted. Six systems (Big Meadows Station, Camp 4 ½ Station, Boulder Creek Camp, Upper Grouse Valley, Cannell Station, and Democrat Work Center) require repeat samples in sets of one sample until the test results are negative, and one follow up sample the next month.

All analysis results and water meter readings shall be mailed or faxed to the Contracting Officer with the monthly invoices. Analysis results only shall also be sent to the county or state health department contact listed as the Regulatory Authority in the attached Water System Reference Information table. Other Water System Services:

Additional field services are occasionally required to inspect, troubleshoot, disinfect, and take other actions needed to bring a water system back in to compliance after a total coliform positive analysis occurs and the routine corrective actions taken by the Forest Service fail to correct the problem. All persons performing work or disinfecting Public Water Systems shall be Certified Distribution Operators in accordance with CA Safe Drinking Water Act regulations. Submit names, certification numbers, and expiration dates of certified personnel (or a copy of the State of CA Distribution Operator Certificate) with solicitation proposal. These field services will be ordered on an hourly basis as needed using the Field Troubleshooting Services pay item shown in the Schedule of Items, including transportation and incidental materials required for disinfection of a water system.

Additional office services are occasionally required to amend or modify existing water system permits or to comply with other requirements of the Regulatory Authority. These services will be ordered on an hourly basis as needed using the Office Regulatory and Permit Services pay item shown in the schedule of values, including incidental office supplies and support required to complete transactions with the Regulatory Authority.

Provide hourly rates for field troubleshooting services and office regulatory and permit services as described above in addition to prices for sampling and analysis of any combination of zones.

FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 calendar days prior to the expiration of the contract; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

GOVERNMENT-FURNISHED PROPERTY

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause 52.245-1 contained in Section I of this contract.

PREWORK CONFERENCE

Prior to commencement of work the Contractor shall meet with the Contracting Officer to discuss contract terms and work performance requirements, and the work progress schedule. The meeting will be held at a location to be determined following award of the contract.

INSURANCE COVERAGE (AGAR 452.228-71) (NOV 1996)

Pursuant to the clause "Insurance - Work on a Government Installation (FAR 52.228-5)", the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compassable under those statues, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage, or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

AGAR 452.204-70 INQUIRIES (FEB 1988)

Inquiries and all correspondence concerning this solicitation should be submitted in writing to the Contracting Officer. Offerors should contact only the Contracting Officer issuing the solicitation about any aspect of this requirement prior to contract award.

SSP.2 SUBCONTRACTS

The Contractor shall request permission in writing from the Contracting Officer to subcontract any portion of the contract and furnish sufficient evidence that the subcontractor is experienced and equipped for such work.

Written consent to subcontract any portion of the contract shall not be construed to relieve the Contractor of any responsibility under the contract.

SSP.4 CONTRACTOR'S RESPONSIBILITY FOR CONTRACTOR CAUSED FIRE

The contractor, whether or not directed by the Forest Service, shall immediately extinguish, without expense to the Government, all fires on or in the vicinity of the project which are caused by the Contractor's employees, whether set directly or indirectly as a result of construction operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government resulting from fires set or caused by Contractor's employees or resulting from construction operations.

52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS (Nov 2007)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(l) for those representations and certifications that the offeror shall complete electronically);

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for quotes, it was the only quote received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

The DUNS+4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same parent concern. (l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award;

(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.

(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

EVALUATION FACTORS FOR AWARD

52.212-2 EVALUATION—COMMERCIAL ITEMS (Jan 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers (Contractors are required to submit a technical proposal responding to these factors.):

1. Past Performance/Relevant experience: Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, state, and local laws and regulations.

The Government may contact some of each offeror's customers to ask whether or not that: (1) that the offeror was capable, efficient, and effective; (2) the offeror's performance conformed to the terms and conditions of its contract (specifications); (3) finished within the contract time; (4) the offeror was reasonable and cooperative during performance; and (5) the offeror was committed to customer satisfaction. The attached experience questionnaire is provided to assist with obtaining the information required to perform this evaluation. Relevant experience must be clearly demonstrated in the offer and not left to speculation. Identify the projects you have successfully completed that you consider offers evidence that proves your firm has the experience required to complete this project.

2. Quality Control Plan: Quality Control Plan should be a written plan that identifies how the contractor intends to inspect their own work as its being completed to ensure compliance with the government’s specifications or statement of work.

3. Price.

Award will be made to that offeror whose proposal meets the technical requirements of the solicitation and has the lowest evaluated price. The Government may reject any or all offers if such action is determined to be in the best interest of the Government. Proposals will be evaluated using the following:

ACCEPTABLE PROPOSAL is a proposal that is in full compliance with Federal, Contractual and State requirements as stated in this solicitation. The proposal must demonstrate that the contractor has sufficient knowledge, skills and experience to perform the contract requirements within the time specified by the contract.

UNACCEPTABLE PROPOSAL is a proposal that is not in full compliance with Federal, Contractual and State requirements as stated in this solicitation. The proposal does not demonstrate that the contractor has sufficient knowledge, skills and experience to perform the contract requirements within the time specified by the contract.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the

Unit: Sequoia National Forest option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). See FAR 52.217-5 Evaluation of Options.

(c) Offerors may submit an offer on Zone 1, Zone 2, Zone 3, and/or Zone 4 for the base and all option years.

However, an offeror must also, in additional to submission of a price of a zone or zones, submit a price for Field Troubleshooting Services, and Office Regulator & Permit Services for the Base and all Option Years.

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

EVALUATION

Technical Proposal Instructions: The technical proposal will be used to evaluate and determinate whether the proposal will meet the requirements of the Government. Therefore, the technical proposal must present sufficient information to reflect a thorough understanding of the requirements and a detailed description of the techniques, procedures, subcontractors, and program for achieving the objectives of the specifications/statement of work. Proposals which merely paraphrase the requirements of the Government’s specifications / statement of work, or use such phrases as “will comply” or “standard techniques will be employed” will be considered unacceptable and will not be considered further. The technical proposal must address all of the technical evaluation factors described below for all of the technical work items listed above.

EVALUATION FACTORS

FAR 52.217-5 EVALUATION OF OPTIONS (JULY 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

2009) An offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representations and certificates electronically at http://orca.bpn.gov . If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (m) of this provision.

(a) Definitions. As used in this provision-- “Emerging small business” means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement…
