The magnitude of the project is between $100,000.00 and $250,000.00.

SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
C.1 DESCRIPTION OF WORK
The work shall consist of installation of approach guardrails and terminal end sections on Bridge # 101-16.8, 109-0.1 and 213-0.4 located on the Shoshone National Forest.
C.2 PROJECT LOCATION
Bridge # 101-16.8: From Cody, Wyoming take State Highway 120 16 miles north to State Highway 296, travel approximately 20 miles northwest to County Road 7GQ (FSR 101), travel approximately 17 miles on County Road 7GQ (FSR 101)to Bridge # 101-16.8. The bridge is located in the SW corner of Section 7, Township 54 N, Range 106W
Bridge # 109-0.1: From Cody, Wyoming take State Highway 120 16 miles north to State Highway 296, travel approximately 40 miles northwest to FSR 109, travel 0.1 miles on FSR 109 to Bridge # 109-0.1. The bridge is located in the SW corner of Section 9, Township 56 N, Range 106W
Bridge # 213-0.4: From Cody, Wyoming take State Highway 120 approximately 50 miles south to Hot Springs County Road 17 (4 Mile Road) travel 4 miles southwest to Hot Springs County Road 36 (Grass Creek Road), travel west 22 miles west to FSR 214, travel north 1.5 miles to FSR 213, travel northwest 4 miles to Bridge #213-0.4. The bridge is located in the SE corner of Section 6, Township 45 N, Range 101W
C.3 STORAGE
The Contracting Officer will approve an area for the contractor to use to store materials and equipment. Contractor shall retain full responsibility for security of such storage.
C.4 GOVERNMENT-FURNISHED PROPERTY
There is no Government furnished material.
| C.5 | CONTRACTOR-FURNISHED PROPERTY AND SERVICES |
| C.5.1 | CONTRACTOR FURNISHED ITEMS: Unless otherwise specified herein, the Contractor shall provide all labor, supervision, transportation, materials, and equipment necessary to perform the work as described herein. |
| C.5.2 | SECURITY OF MATERIALS: The Contractor may leave their equipment and Government-furnished property at the work site. The Contractor shall be responsible for the Contractor's equipment and Government-furnished property if it should be lost, stolen or damaged. |
| C.6 | USE OF PREMISES |
| C.6.1 | General: Contractor shall have full use of premises for construction operations, including use of Project site, during construction period. Contractor's use of premises is limited only by the Government's right to perform work or to retain other contractors on portions of Project. |
| C.6.2 | Contractor shall at all times conduct his operations to ensure the least inconvenience to the public and employees. Confine storage of materials to areas as approved by the Contracting Officer. |
| C.6.3 | Preservation of Natural Features: |
| C.6.3.1 | Confines all operations to work limits of the project. Prevent damage to natural surroundings. Restore damaged areas, repairing or replacing damaged trees and plants, at no additional expense to the Government. |
| C.6.3.2 | Provide temporary barriers to protect existing trees and plants and root zones. |
| C.6.3.3 | Do not remove, injure, or destroy trees or other plants without prior approval. Consult with the Contracting Officer and remove agreed-on branches that interfere with construction. |
| C.6.3.4 | Do not fasten ropes, cables, or guys to existing trees. |
| C.6.3.5 | Do not damage remaining exterior or interior features, including logs. |
| C.6.4 | The contractor is responsible for repairing any damage resulting from the contractor’s negligence during the term of this contract. |
| C.6.6 | SUPERVISOR(S): A working (English literate) supervisor, who is knowledgeable and experienced in the required work and supervision, shall be provided for each crew and is required to stay with the crew while work is in progress. |
| C.6.5 | NOXIOUS WEEDS: Equipment cleaning requirements must be followed (see section H.9). |
| C.7 | WORK PLAN AND SCHEDULE |
The Contractor shall provide a work plan and schedule that demonstrates how the work will be completed and in what time frame at the pre-work meeting. No work shall start until the work plan and schedule is approved by the Contracting Officer.
C.8 SUSTAINABLE PROCUREMENT PROGRAM
The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C. 8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February, 2012 to provide biobased products.
The Contractor shall utilize products and material made from biobased materials (e.g. biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer.
The following is an example list of products that may be used in this contract for operations and maintenance for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.
Diesel Fuel Additives
(1) Any substance, other than one composed solely of carbon and/or hydrogen, that is intentionally added to diesel fuel (including any added to a motor vehicle's fuel system) and that is not intentionally removed prior to sale or use.
(2) Neat biodiesel, also referred to as B100, when used as an additive. Diesel fuel additive does not mean neat biodiesel when used as a fuel or blended biodiesel fuel (e.g., B20). 90% - Minimum Biobased Content Hydraulic Fluids - Mobile Equipment Hydraulic fluids formulated for general use in nonstationary equipment, such as tractors, end loaders, or backhoes. 44% - Minimum Biobased Content Penetrating Lubricants Products formulated to provide light lubrication and corrosion resistance in close tolerant internal and external applications including frozen nuts and bolts, power tools, gears, valves, chains, and cables. 68% - Minimum Biobased Content Greases - Truck Lubricants composed of oils thickened to a semisolid or solid consistency using soaps, polymers or other solids, or other thickeners. Lubricants that are designed for use on the fifth wheel of tractor trailer trucks onto which the semi-trailer rests and pivots. 71% - Minimum Biobased Content Gear Lubricants Products, such as greases or oils, that are designed to reduce friction when applied to a toothed machine part (such as a wheel or cylinder) that meshes with another toothed part to transmit motion or to change speed or direction. 58% - Minimum Biobased Content Fuel Conditioners Products formulated to improve the performance and efficiency of engines by providing benefits such as removing accumulated deposits, increasing lubricity, removing moisture, increasing the cetane number, and/or preventing microbial growths within the fuel system. 64% - Minimum Biobased Content Erosion Control Woven or non-woven fiber materials manufactured for use on construction, demolition, or other sites to prevent wind or water erosion of loose earth surfaces, which may be combined with seed and/or fertilizer to promote growth (77% - Minimum Biobased Content).

101.04 Definitions.

Bid Schedule-- The Schedule of Items.

Contractor-- The individual or legal entity contracting with the Government for performance of prescribed work. In a timber sale contract, the contractor is the “purchaser”.
Culvert-- No definition.
Right-of-Way-- A general term denoting (1) the privilege to pass over land in some particular line (including easement, lease, permit, or license to occupy, use, or traverse public or private lands), or (2) Real property necessary for the project, including roadway, buffer areas, access, and drainage areas.

Schedule of Items-- A schedule in the contract that contains a listing and description of construction items, quantities, units of measure, methods of measurement, unit price, and amount.
Utilization Standards-- The minimum size and percent soundness of trees described in the specifications to determine merchantable timber.

Materials produced or processed from Government lands in excess of the quantities required for performance of this contract are the property of the Government. The Government is not obligated to make reimbursement for the cost of producing these materials.

Delete Subsection 106.01 and substitute the following:
Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.
References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.
Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.
Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more restrictive.
Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.
When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.
The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.
Acceptable work conforming to the contract will be paid for at the contract unit bid price. Three methods of determining conformity and accepting work are described in Subsections 106.02 to 106.04 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.
Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.
(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:
(1) Sampling method;
(2) Number of samples;
(3) Sample transport;
(4) Test procedures;
(5) Testing laboratories;
(6) Reporting;
(7) Estimated time and costs; and
(8) Validation process.
If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute.
The CO will review the proposed resolution protocol and may modify it before final approval and execution.
The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.
| (b) | Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to: |
| (1) | Have the work accepted at a reduced price; or |
| (2) | Be given permission to perform corrective measures to bring the work into conformity. |
The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.
106.05 Statistical Evaluation of Work and Determination of Pay Factor (Value of Work).
Replace the entire section with the following:
Statistical evaluation of the work will not be required. All specifications referring to this Subsection shall instead be referred to Subsections 106.02 through 106.04 as appropriate for the work performed.
106.07 Partial and Final Acceptance
Delete subsection 106.07.
107 -- LEGAL RELATIONS AND RESPONSIBILITY TO THE PUBLIC
107.05 Responsibility for Damage Claims.
Delete subsection 107.05.
107.06 Contractor’s Responsibility for Work.
Delete the following:
“except as provided in Subsection 106.07”.
107.08 Sanitation, Health, and Safety.
Add the following:
Perform all operations in a prudent, conscientious, safe and professional manner. Ensure that all personnel involved in handling and packaging the hazardous waste are trained for the level of expertise required for the proper performance of the task and, in particular, in the areas of chemical incompatibility, general first aid procedures, and spills. Provide handling and personal protective equipment appropriate to ensure safe handling of the hazardous waste according to 29 CFR 1910.120. Notify the Forest Service of all hazardous material that may be brought onto the National Forest.
107.09 Legal Relationship of the Parties.
Delete subsection 107.09.
107.10 Environmental Protection.
Add the following:
Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.
Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill. Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information. Immediately notify the CO of all hazardous material spills. Provide a written narrative report form no later than 24 hours after the initial report and include the following:
· Description of the item spilled (including identity, quantity, manifest number, and other identifying information).
· Whether amount spilled is EPA or state reportable, and if so whether it was reported, and to whom.
· Exact time and location of spill including a description of the area involved.
· Containment procedures.
· Summary of any communications contractor had with news media, Federal, state and local regulatory agencies and officials, or Forest Service officials.
· Description of clean-up procedures employed or to be employed at the site including final disposition and disposal location of spill residue.
When available provide copies of all spill related clean up and closure documentation and correspondence from regulatory agencies.
The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract. Clean up spills or leaks to the satisfaction of the CO and in a manner that complies with Federal, state, and local laws and regulations.
107.11 Protection of Forests, Parks, and Public Lands.
Add the following:
| (a) | Fire Prevention and Control |
| (1) | Tools and equipment. The Contractor shall furnish and maintain in a serviceable condition one shovel, size O or larger, for each employee working in the project area. The shovels may be stored in the employees private vehicle or the contractor's vehicles, but must be readily available to each employee while in the project area. |
For each yarder, loader, jammer, chipper, crawler tractor, skidder, hauling truck, portable welder, or comparable type equipment, the Contractor shall furnish one shovel, size O or larger, attached to each unit and one two and one-half pound or larger dry chemical or four pound or larger carbon dioxide type fire extinguisher attached to each unit.
For each power saw, soil auger, portable pump, or like powered equipment, the Contractor shall furnish one shovel, size 0 or larger, and one dry chemical fire extinguisher, 8 ounce or larger, immediately available to the operator of the equipment. The fire extinguisher shall be with the operator of the equipment; the shovel may be with the fuel can used to refuel the equipment.
Refueling of the equipment shall be done in an area cleared and void of flammable materials. Power saws shall be moved from the spot of refueling before starting.
(2) Fire Prevention.
Blasting - Advance approval in writing is required from the District Ranger through the CO. The use of fuses shall not be permitted, except near power lines where the danger of accidental detonation is present. Use of prima cord will not be allowed in clearing operations where flammable materials are present. A watchman will remain on site for at least one hour after detonation in areas of blasting where flammable fuels are present. Explosives will be stored at all times in a locked box marked "Explosives." All Federal, State, and local laws concerning the use and storage of explosives shall be followed.
Welding - All flammable materials will be cleared for a minimum distance of 10 feet around any welding operation. Fire extinguishers and fire tools are required as shown in Section B-1(b).
Open Fires - In accordance with State and local regulations.
Pursuant to 36 CFR 261.50a the following is prohibited on each National Forest or National Grasslands in the Rocky Mountain Region:
Operating or using any internal or external combustion engine on any timber, brush or grass covered land, including trails traversing such land, without a spark arrester, maintained in effective working order, meeting either (i) Department of Agriculture, Forest Service Standard 5100-1a; or (ii) the 80 percent efficiency level determined according to the appropriate Society of Automotive Engineers (SAE) recommended Practices J335 and J350.
Violation of this regulation and the general prohibitions of 36 CFR 261.3 to .20 is punishable by a fine of not more than $500 or imprisonment for not more than 6 months or both.
Gas and Oil Use and Storage - Gasoline will be stored and transported only in metal containers with tight caps or seals. Gas and oil drum storage areas will be cleared of all flammable material for a distance of 50 feet around the drums. Storage areas will be posted with "No Smoking" signs. Oil filters, oil cans, oily rags, etc., will be removed from the project area and discarded in proper waste disposal receptacles or sites.
Smoking - Smoking is prohibited while operating tractors or open-type vehicles, or while walking or working in an area with flammable fuels.

Slope stakes and references. When required, locate slope stakes on designated portions of the road. Locate the slope stake catch points and use them to establish clearing limits and slope stake references.
Mark slope stakes with the station, the amount of cut or fill, the horizontal distance to centerline, and the slope ratios.
Place slope reference stakes at least 10 feet outside the clearing limit and mark with the offset distance to the slope stake. Place sight stakes when required.
Prior to clearing and grubbing operations, move the slope stake outside the clearing limit to the slope reference stake. After clearing and grubbing and before excavation, reset the slope stakes in their original position.
Use the designated method to establish the slope stake catchpoint.
· Method I -- Computed Method. Use the template information shown in the plans or other Government-provided data to calculate the actual location of the catchpoint. The slope stake “catchpoint distance” provided may be used as a trial location to initiate slope staking. Recatch slope stakes on any section that does not match the staking report within the tolerances established in Table 152-2.
· Method II -- Catchpoint Measurement Method. Determine the location of slope stake catchpoints by measuring the catchpoint distances shown in the plans or other Government-provided data.
(d) Clearing and grubbing limits.
Add the following:
Establish clearing limits on each side of the location line by measuring the required horizontal or slope distances shown in the stake notes. Mark the clearing limits with flagging or tags on trees to be left standing, or on lath. Make markings intervisible, and no more than 90 feet apart.
After establishing clearing limits, move the location line stake outside the clearing limits for station identification purposes, and mark it with horizontal distance to location line
(e) Centerline reestablishment.
Replace with the following:
Reestablish centerline from instrument control points. The maximum spacing between centerline points is 25 feet when the centerline curve radius is less than or equal to 200 feet. When the centerline curve radius is greater than 200 feet, the maximum distance between centerline points is 80 feet.
(g) Culverts.
Replace subsection with the following:
Set culvert reference stakes at all culvert locations. Set a culvert reference stake on the centerline of the culvert 10 feet from each end or beyond the clearing limit, whichever is greater. Record the following on culvert reference stakes:

Unless otherwise indicated within the plans or specifications, keep existing roads open to all traffic during road improvement work, and maintain them in a condition that will adequately accommodate traffic. Perform no work that interferes or conflicts with traffic or existing access to the roadway surface until a plan for the satisfactory handling of traffic has been approved by the CO.
Specific requirements for temporary closures, detours, part-width construction, and access to adjacent or intersecting facilities will be indicated within the plans or specifications. Post construction signs and traffic control devices in conformance with the MUTCD and the project requirements. Do not proceed with work on the project until all required signs and barricades are in place and approved by the CO.
Before shutting down any operations, take all necessary precautions to prevent damage to the project, such as temporary detours, approaches, crossings, or intersections; and provide for normal drainage and minimization of erosion. Leave all travel ways in a condition suitable for traffic.
When indicated on the plans or described in the specifications, road segments may be closed to all traffic during the period(s) when construction is in progress. If any of the listed roads are to be closed during construction operations, give the CO at least 14 days advance notice. Unless otherwise provided, when construction activity is in progress, delays may not exceed 30 minutes, in order to reasonably accommodate traffic.
If optional bid item is chosen the bridge shall be closed to all traffic during construction.
156.04 Maintaining Roadways during Work.
Do not construct detours outside of the clearing limits or use alternate route detours without the approval of the CO.
156.05 Acceptance. Public traffic work will be evaluated under Subsection 106.02.
Traffic control devices and services will be evaluated under Section 635.
156.06 Measurement and Payment

The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of: (1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project, or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to become muddy or unsuitable; or (2) Failure of the Contractor to comply with Specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by his/her operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for equitable adjustment

SECTION G – CONTRACT ADMINISTRATION DATA
G.1 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE
The Contracting Officer will designate in writing a Contracting Officer's Representative (COR) at the time of contract award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless approved and formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).
On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.
G.2 CONTRACTOR’S REPRESENTATIVE
At all times during performance of this contract and until work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite competent representatives who are satisfactory to the Contracting Officer and has authority to act for the Contractor.
The Government may, at its option, suspend work with full count of contract time continuing, if the Contractor fails to provide a contractor representative (1) conversant in the English language and (2) able to read and understand the contract.
G.3 PAYMENT.
Payment will be made at the awarded schedule item price for satisfactorily completed work. Partial payment may be authorized by the Contracting Officer.
This contract incorporates the Construction Wage Rate Requirements (Formerly known as Davis Bacon Wage Rates). Weekly payrolls are mandatory and must be turned into the Contracting Officer Representative for review and approval. Invoices will not be processed until acceptable payrolls have been received.
A signed payment certification must accompany your invoice for payment to be authorized. See Attachment 1 in Section J.
G.3.1 Invoice Processing Platform The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). The contractor must follow the instructions on how to register and submit invoices via IPP as prescribed in the previous communications from USDA and Treasury. All invoices are to be submitted via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm. SECTION H — SPECIAL CONTRACT REQUIREMENTS
H.1 FIRE PREVENTION AND CONTROL
The Interagency Fire Dispatch Center will be contacted in the event of any fire in or near the project area(s) (1-800-295-9954). (See Section C11 paragraph 107.11)
H.2 SAFETY PLAN
(a) The Contractor shall provide a copy of their safety plan at the pre-work meeting.
(b) The Safety Plan should be available to all employees and subcontractors working on the contract.
(c) The Safety Plan should cover at a minimum:
i. Safety briefings covering the area working in, equipment being used, and any special considerations for the work under the contract
ii. Personal Protective Equipment required for the work under the contract
iii. Appropriate OSHA requirements for the type of work under the contract
iv. Weather considerations for the time of year of the contract.
v. Communication issues and locations of the nearest medical facilities to the job site.
vi. Emergency numbers to contact if an accident happens.
| H.3 | PERSONAL PROTECTIVE EQUIPMENT (PPE): |
| (a) | The contractor will train all workers in the safe operation and use of equipment. OSHA standards for personal protective equipment shall be followed. |

| H.4 | OIL AND HAZARDOUS MATERIALS SPILL CONTINGENCY PLAN |
If Contractor maintains storage facilities for oil or oil products on National Forest lands, Contractor shall take appropriate preventative measures to ensure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual States.
Contractor shall prepare a Spill Prevention Control and Countermeasures Plan for oil or oil products storage.
Contractor will have an oil/oil products spill remediation kit on site at all times. Kit contents will include: 20 – 15”x19” Pads, 3 – 3”x4’ socks, 5 Disposable bags & ties, 1 pair Nitrile gloves, 1 pair of Safety Goggles, 1 clear bag w/ zipper for packaging.
Contractor shall notify the Contracting Officer Representative, Contracting Officer, and appropriate agencies of all spills in the amount of five gallons or more of oil or oil products on National Forest lands that are caused by Contractor’s employees, equipment, agents, contractors, subcontractors, or their employees or agents, directly or indirectly, as a result of Contractor’s operations. Contractor will take whatever initial action may be safely accomplished to contain all spills.
H.5 HAZARDOUS SUBSTANCES
