PROJECT DESCRIPTION

(a) Description of Work- This solicitation and any resultant contract is a stewardship project in accordance with Section 323 of Public Law 108-7 (16 U.S.C. 2104 Note, as revised February 28, 2003 to reflect sec. 323 of J.J. Res. 2 as enrolled), the Consolidated Appropriations Resolution, 2003, amending Public Law 105-277, sec. 347. This is a commercial item acquisition that has been tailored to fit the Government’s method of trading goods for services. Work includes performance of stewardship activities within the boundaries of this project as defined on the enclosed map “Howard Stewardship Contract Area Map” located in Attachments. The work required by this contract includes all of the requirements outlined herein and in the attachments, and includes, but is not limited to:

* POL treatment, slash treatment and related work (see Appendix A);

*Timber harvest and removal and related work (see Appendix B);

* Road Maintenance T-Specifications (see Appendix C);

The Contractor shall provide everything necessary to perform this contract unless such items are specifically identified herein as Government-furnished property.

(b) Resulting Contract – The resultant contract will be a firm-fixed-price contract, including services and timber removal activities.

(c) Project Location – This project is located on the Pike San Isabel National Forest, administered by the South Park Ranger District and the project is located in T13S, R71W, Section 4,5,8,9,16 and 17 Park County, CO. See Attachments for maps.

2. USE OF BIOBASED PRODUCTS

The Contractor must comply with Section 9002 of the Farm Security and Rural Investment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” and the Federal Acquisition Regulation to provide biobased products. The Contractor shall utilize products and material made from biobased materials to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer (CO).

The following is an example list of products that may be used in this contract. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products listed meeting the health and environmental specifications.

· 2-Cycle Engine Oils

The period of performance for this contract is 18 months from date of contract award.

18.

AGAR 452.215-73 POST AWARD CONFERENCE (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled within 30 days after the date of contract award. The conference will be held at: to be determined, and will include discussion of contract terms and work performance requirements, work progress schedule and fire prevention/suppression and safety plans.

25.

PROTECTION MEASURES NEEDED FOR PLANTS, ANIMALS, CULTURAL RESOURCES, AND CAVE RESOURCES

Locations of known areas needing special measures for the protection of plants, animals, cultural resources, and/or cave resources are shown on Contract Area Map and/or identified on the ground. Special protection measures needed to protect such known areas are identified.

In addition to any special protection measures noted, Contractor has a general duty to protect all known and identified resources referenced in this Subsection from damage or removal during Contractor’s operations. Discovery of additional areas, resources, or members of species needing special protection shall be promptly reported to the other party, and operations shall be delayed or interrupted at that location, if Contracting Officer determines there is risk of damage to such areas, resources, or species from continued operations.

Wheeled or track-laying equipment shall not be operated in areas identified as needing special measures for the protection of cultural resources, except on roads, landings, tractor roads, or approved skid trails. Unless agreed otherwise, trees will not be felled into such areas. Contractor may be required to backblade skid trails and other ground disturbed by Contractor’s Operations within such areas in lieu of required cross ditching.

Contractor shall immediately notify Forest Service if disturbance occurs to any area identified as needing special protection measures and shall immediately halt operations in the vicinity of the disturbance until Forest Service authorizes Contractor to proceed. Contractor shall bear costs of resource evaluation and restoration to identified sites. Such payment shall not relieve Contractor from civil or criminal remedies otherwise provided by law.

Forest Service has exercised due diligence and followed established protocols in identifying known areas needing special protection measures. Nevertheless, nothing in this provision shall be interpreted as creating any warranty that all locations and special measures for the protection of plants, animals, cultural resources, and cave resources have been described herein, elsewhere in the contract, or designated on the ground.

26.

EROSION PREVENTION AND CONTROL

Contractor’s Operations shall be conducted reasonably to minimize soil erosion. Equipment shall not be operated when ground conditions are such that excessive damage will result. The kinds and intensity of erosion control work done by Contractor shall be adjusted to ground and weather conditions and the need for controlling runoff. Erosion control work shall be kept current immediately preceding expected seasonal periods of precipitation or runoff.

If Contractor fails to do seasonal erosion control work prior to any seasonal period of precipitation or runoff, Forest Service may temporarily assume responsibility for the work and any unencumbered deposits hereunder may be used by Forest Service to do the work. If needed for such work, Contractor shall make additional deposits on request by Forest Service. Any money deposited or used for this purpose shall be treated as cooperative deposits.

A. Skidding with tractors within 100 feet of live streams shall not be permitted except in places designated in advance by Forest Service, and in no event shall skid roads be located in live or intermittent streamcourses. Skid trails shall be located high enough out of draws, swales, and valley bottoms to permit diversion of runoff water to natural undisturbed forest ground cover.

B. Prior to periods of accelerated water runoff, especially during the spring runoff and periods of heavy rainfall, Contractor shall inspect and open culverts and drainage structures, construct special cross ditches for road runoff, and take other reasonable measures needed to prevent soil erosion and siltation of streams.

C. Unless otherwise agreed in writing, Contractor shall keep erosion control work current with his operations under the sale and in any case not later than 15 days after completion of skidding on each payment unit or cutting unit.

28.

PROTECTION OF RESIDUAL TREES

The contractor’s operations shall not unnecessarily damage residual trees. Residual trees are defined as POL and Sawtimber size trees.

28.1 RESERVE TREES. (04/07) Notwithstanding the designations for cutting elsewhere live or dead _____Wildlife__________ reserve trees or groups of reserve trees within such cutting units or clearings shall be left uncut. Reserve trees are identified by ___ Pink Flagging and Orange Paint (Three dots on three sides of the boundry tree. Middle dot facing into the reserve plot. Blue tags will face into the cutting unit.)___ and shall be protected. Units with reserve trees are shown on Contract Area Maps.

28.2 PROTECTION OF RESERVE TREES. (9/04) Contractor’s damage or destruction of reserve trees described in Solicitation 28.1 will cause serious and substantial silvicultural or other damage to the National Forest. It will be difficult if not impossible to determine the amount of such damage. Therefore, Contractor shall pay as fixed, agreed, and liquidated damages _____N/A_____ or each ______N/A_________ reserve tree and $___100_______ for each ______All Species_______ reserve tree damaged or destroyed by Contractor's Operations, in addition to amounts payable under Appendix B- D.4.4 and Appendix B- D.4.5.

Damage, as used herein, includes any injury to the living crown, bole, or roots of reserve trees. If areas are marked on the ground around such reserve trees, operation of heavy equipment or skidding of products within the area shall be considered to be damage to the tree.

29.

OPERATIONS

29.1 UNIT BOUNDARIES (407) The boundaries of work units are designated as shown in the following table. The trees used for boundary designation are not to be cut.

Cutting Unit Boundary Designation Table

Cutting Unit Paint Color

Designation

All Orange

Orange Streaks of paint on three sides of the cutting unit boundary tree extending below stump height to a height of four feet or more. The middle streak of paint faces the area to be cut.

30.

DESIGNATIONS

30.1 - C.3 Timber Designations. Timber designated for cutting shall be confined to Contract Area, except as otherwise provided. Contract Area Map indicates subdivisions, if any, where Marking is to be done after advertisement, except for construction clearing, minor changes, and damaged timber. The boundaries of cutting units were plainly marked on ground before advertisement and are shown on Contract Area Map.

30.2 - C.3.2 Construction Clearing. All timber is designated for cutting that is within the clearing limits of roads constructed hereunder or is in other authorized clearings. All dead or unstable live trees are designated for cutting that are sufficiently tall to reach Contractor’s landings, work areas, or the roadbed of Specified and Temporary Roads when Marked in advance of work in the immediate area. Pieces meeting Utilization Standards from such dead or un-stable live trees shall be removed, unless there is agreement that to do so could damage the road. Such designation may be revised as part of agreed changes in road locations.

30.3 - C.3.2.2 Other Authorized Clearings. Timber within authorized clearings for Temporary Roads, landings, or other construction clearings is designated for cutting. Quantities of such timber are not included in Appendix B - Division A.

30.4 - C.3.7 Minor Changes. Within Contract Area, minor adjustments may be made in boundaries of cutting units or in the timber individually Marked for cutting when acceptable to Contractor and Forest Service.

30.5 - C.4 Volume Estimate. The estimated volumes of timber by species designated for cutting and expected to be cut under Utilization Standards are listed in Appendix B - Division A and are not to be construed as guarantees or limitations of the timber volumes to be designated for cutting under the terms of this contract.

30.6 - DESIGNATION BY PRESCRIPTION. (407) As shown on Contract Area Map, the following criteria shall be used by Contractor to designate trees and other products for cutting and removal within the Subdivision(s) or unit(s) listed below.

Contractor will be required to sample leave tree mark an area with Contractor's non-tracer __Blue_____ paint for approval by Forest Service prior to cutting. If Forest Service approves marking than contractor will not be required to mark leave trees prior to cutting. If at any time Forest Service determines that cutting is not according to prescription than Contractor shall mark leave trees with Contractor's non-tracer ___Blue____ paint if requested to do so by the Forest Service. Forest Service shall inspect and approve Contractor marking prior to cutting.

(a) Additional trees to be cut, if any, are Marked by Forest Service with ___Blue,Yellow or Green____ tracer paint.

(b) Cutting unit boundaries and other trees that shall be left uncut are Marked by Forest Service with __Orange_____ tracer paint.

(c) Subdivision/Unit Criteria

1,2,3,4

1. In general, Limber pine will not be cut, except where their removal would be needed to meet the objectives of a particular treatment. Aspen and Ponderosa pine would be favored for retention. Douglas-fir would be favored for removal. Preferred tree species for retention is Ponderosa pine but do not mark a superior Douglas-fir for removal over a less desirable ponderosa pine and favor large diameter trees over small diameter trees for retention. Trees selected for retention should have live crown ratios greater than 30%, show good form and vigor and not have forked tops.

2. Retain 10-80 sqft. of basal area in leave trees unless identified differently in the description of treatments. Use a prism to help determine your “leave tree” basal area. The marking should be irregular, patchy and not 'tree farm' in nature. The marking should consider placement of openings on south and west exposures where openings historically would have persisted for decades. The areas targeted for openings are predominantly dense seedling and sapling stands or are adjacent to small openings that have shrunk from tree encroachment. Other areas targeted for openings would be dwarf mistletoe-infected trees, or pockets of trees infected with insects or other pathogens.

3. All POL size trees are designated to be cut unless otherwise agreed to by the US Forest Service or are located within an established clump of leave trees which includes sawtimber and POL size trees. These clumps have been established as leave trees and will not be cut. Clumps generally do not exceed a 1/10 acre in size and range generally from 60 to 100 sqft in basal area. The clump will be defined as a group of contiguous trees with varying size classes that may have interlocking crowns with sawtimber size trees defining the outer limit of the clump. Also, if the trees are located within an excluded area that has been designated by pink flagging and orange spot paint marks.

4. In areas where mountain mahogany or other ground vegetation is crowded out, remove edge trees to invigorate the mahogany.

5. In areas of Dwarf mistletoe infection, favor noninfectious trees over infected trees. In heavily infected areas with Douglas-fir present favor the Douglas-fir. Use these areas as possible openings. Openings shall not exceed 10 acres in size with the typical opening not exceeding 1 acre in size.

6. Cut all merchantable conifer trees inside Aspen clumps and within 1 1/2 tree height of the Aspen. The intention is to encourage Aspen sprouting in this area.

7. Where the existing stand structure allows, maintain 20-30 snags in all stages of development on each 10 acres of harvested area. Retain 2 "hard" snags 12 inches DBH or larger per 10 acres. Retain all "soft" snags, except where they are safety hazards. See Appendix D for “hard” and “soft” snag definition.

8. Remove all live Mountain Pine beetle infested trees. This includes trees with old hits, new hits, or visible signs of dying trees such as thinning, browning crowns. Save snags, which have already lost their needles for wildlife habitat.

9. Protect two turkey roost tree clumps (minimum 0.1 acre) if available, in the contract area. Turkey roost trees are defined as tall mature or over-mature ponderosa pines with relatively open crowns and large horizontal branches starting at 20-30 feet from the ground.

37.

FIRE PRECAUTIONS AND CONTROL

Specific fire prevention measures are listed below and shall be effective for the period May 1st – November 30th of each year. The Forest Service may change the dates of said period by advance written notice if justified by unusual weather or other conditions. Required tools and equipment shall be kept currently in serviceable condition and immediately available for initial attack on fires.

1. Smoking and Lunch Fires. Smoking is prohibited except inside a building, developed recreation site, vehicle, or while seated in an area of at least three feet in diameter that is barren or cleared of all flammable materials. 36 CFR 261.52(d).

The building of camp, lunch, warming and other fires within the contract area and vicinity is prohibited, except at established camps or at other safe places where all flammable material has been cleared away sufficiently to prevent the start and spread of wildfires. Forest Service may, upon written request of Contractor, designate specific places where campfires may be built for purposes of heating lunches.

2. Spark Arrester and Mufflers. Operating or using any internal combustion engine, on any timber, brush, or grass covered land, including trails and roads traversing such land, without a spark arrester, maintained in effective working order, meeting either (I) Department of Agriculture, Forest Service standard 5100, "SPARK ARRESTERS FOR INTERNAL COMBUSTION ENGINES," (current edition); or (II) the Society of Automotive Engineers (SAE) recommended Practices J335, "MULTIPOSITION SMALL ENGINE EXHAUST SYSTEM FIRE IGNITION SUPPRESSION," (current revision) and J350, 36 CFR 261.52(j), is prohibited.

Passenger carrying vehicles, pickups, medium and large highway trucks (80,000 GVW) will be equipped with a factory designed muffler system which is specified for the make and model of the respective vehicle/truck or with a muffler system that is equivalent or that exceeds factory specifications.

Exhaust systems shall be properly installed and continually maintained in serviceable condition.

3. Fire Extinguishers and Tools on Equipment. While in use, each internal combustion engine including tractors, trucks, yarders, loaders, welders, generators, stationary engines, or comparable powered equipment shall be provided with at least the following:

(a) One fire extinguisher, at least 5#ABC with an Underwriters Laboratory (UL) rating of 3A - 40BC, or greater.

(b) One shovel, sharp, size O or larger, round-pointed with an overall length of at least 48 inches.

(c) One axe, sharp, double bit 3-1/2#, or one sharp pulaski.

Extinguishers, shovels, axes, and pulaskis shall be mounted so as to be readily available from the ground. All tools shall be maintained in a serviceable condition.

4. Power Saws. Each gasoline engine power saw shall be provided with one chemical-pressurized fire extinguisher of not less than 8-ounce capacity by weight, and one size O or larger, round-pointed shovel with an overall length of at least 48 inches. The extinguisher, and shovel shall be maintained in good working order. The extinguisher shall be with the power saw operator and immediately available for use at all times. The extinguisher shall not be affixed to the saw. The shovel shall be readily available to the operator of the saw at all times. Having the shovel with the gas can used to refuel the saw may be considered "readily available" if not more than 200 feet from the saw. During periods of critical fire danger, Forest Service may prescribe other precautionary measures.

Any fueling or refueling of a power saw shall be done in an area which has first been cleared of material which will carry fire. The power saw shall be moved at least 10 feet from the place of fueling or refueling before starting.

5. Blasting and Welding. The use of fuses in blasting shall not be permitted except near power lines where the danger of accidental detonation is present, and then only by special written permission of Forest Service. Whenever the relative humidity falls below 50 percent, Contractor shall place a watchman at each point where blasting is done who shall remain on duty for at least one hour after blasting is finished, and who shall be equipped with a shovel and a water-filled backpack can equipped with hand pump. During periods when the relative humidity falls below 20 percent, blasting shall be discontinued unless authorized, with special provisions, in writing by Forest Service. Blasting shall not be permitted in any area not cleared to mineral soil without advance written approval of Forest Service and with such special precautions as may be required.

Prima Cord shall not be used in clearing operations, and in other areas where timber has been felled and slash not burned.

Unless otherwise directed in writing by Forest Service, all flammable material shall be cleared for 10 feet around any piece of equipment being welded. In addition, Contractor shall provide a fire extinguisher of a size and type designed to extinguish a fire in the flammable materials surrounding the spot being welded.

In order to determine the relative humidity, Contractor shall either (a) provide and maintain weather instruments, that will measure relative humidity, in the area where blasting will occur; or (b) provide communications to obtain weather data from Forest Service.

Explosives shall be stored at all times in a locked box marked "Explosives. "Powder and blasting caps shall be stored in separate boxes.

6. Storage of Flammables. Gasoline, oil, grease and other highly flammable material shall be stored either in a separate building, or at a site where all debris is cleared within a radius of 25 feet. Storage buildings or sites shall be a minimum distance of 50 feet from other structures. Storage buildings shall be adequately posted to warn of the flammables and to prohibit smoking in or around the building.

7. Camp Fire Protection. The grounds around all trailers, buildings, other facilities constructed or placed on or near Contract Area shall be kept free of flammable material for a distance of at least 20 feet from the wall of such structure. Burning of such flammable material shall be as prescribed by Forest Service in writing.

Stovepipes of all wood burning stoves shall be equipped with suitable roof jacks and serviceable spark arresters. Stovepipes shall be no closer than 2 feet from any wood or other flammables unless adequately protected by metal or asbestos shield

39.

USE OF ROADS BY CONTRACTOR

ROAD MAINTENANCE

Contractor shall maintain roads, commensurate with Contractor’s use, in accordance with Road Maintenance Requirements and the Road Maintenance T-Specifications located in Appendix C. Performance of road maintenance work by Contractor may be required prior to, during, or after each period of use. The timing of work accomplishment shall be based on Contractor’s Operating Schedule.

When two or more commercial users are simultaneously using the same road where Forest Service is not requiring maintenance deposits, the commercial users will develop maintenance responsibilities and arrangements for accomplishing the work. Forest Service must agree to this plan. If the commercial users cannot agree on maintenance responsibilities, Forest Service shall resolve the differences. If Contractor elects to use different roads than those listed, Forest Service shall determine Contractor’s commensurate share of road maintenance and revise road maintenance deposits. If Forest Service cannot perform its full commensurate share of road maintenance, Forest Service shall make a cash payment to Contractor for performance of such work.

Unless agreed in writing, prehaul maintenance shall be completed on any portion of road prior to hauling on that portion. Maintenance, as used in this contract, does not include road reconstruction or repairs of an extraordinary nature.

Contractor shall maintain roads in accordance with the following Contract Road Maintenance Requirements Summary:
