101.04 Definitions.

Delete the following definitions and substitute the following:

Bid Schedule--The Schedule of Items.

Bridge--No definition.

Contractor--The individual or legal entity contracting with the Government for performance of prescribed work. In a timber sale contract, the contractor is the “purchaser”.

Culvert--No definition.

Right-of-Way--A general term denoting (1) the privilege to pass over land in some particular line (including easement, lease, permit, or license to occupy, use, or traverse public or private lands), or (2) Real property necessary for the project, including roadway, buffer areas, access, and drainage areas.

Add the following:

Adjustment in Contract Price--“Equitable adjustment,” as used in the Federal Acquisition Regulations, or “construction cost adjustment,” as used in the Timber Sale Contract, as applicable.

Change--“Change” means “change order” as used in the Federal Acquisition Regulations, or “design change” as used in the Timber Sale Contract.

Design Quantity--“Design quantity” is a Forest Service method of measurement from the FS-96 Forest Service Specifications for the Construction of Roads and Bridges. Under these FP specifications this term is replaced by the term “Contract Quantities”.

Forest Service--The United States of America, acting through the Forest Service, U.S. Department of Agriculture.

Neat Line--A line defining the proposed or specified limits of an excavation or structure.

Pioneer Road--Temporary construction access built along the route of the project.

Purchaser--The individual, partnership, joint venture, or corporation contracting with the Government under the terms of a Timber Sale Contract and acting independently or through agents, employees, or subcontractors.

Protected Streamcourse--A drainage shown on the plans or timber sale area map that requires designated mitigation measures.

Road Order--An order affecting and controlling traffic on roads under Forest Service jurisdiction. Road Orders are issued by a designated Forest Officer under the authorities of 36 CFR, part 260.

Schedule of Items--A schedule in the contract that contains a listing and description of construction items, quantities, units of measure, unit price, and amount.

Utilization Standards--The minimum size and percent soundness of trees described in the specifications to determine merchantable timber.

Supplemental Project Specification Kalispell Bay Boat Launch Facility 103 - Scope of Work

103.00_ipnf_us_06_03_2009 103 Delete

Delete all but subsection 103.01 Intent of Contract and add the following.

103.01 Intent of Contract. This project is for the removal and disposal of an existing dock system and replacing it with a new steel truss dock system, and to make improvements to the dock/pier system, launch area, access roads and parking areas. Project includes designing, furnishing, and installing floatable and permanent steel truss dock systems, furnishing and installing piling, forming and placing concrete for sidewalks, drive pad and dock abutment, furnishing and installing precast boat ramp planks, excavation, embankment, crushed aggregate surfacing, asphalt paving, surface drainage improvements and all other incidental work items necessary to complete the project in accordance with the plans and specifications.

Furnish all labor, material, equipment, tools, transportation, and supplies necessary to complete the work in accordance with the contract specifications and drawings.

104.03 Specifications and Drawings.

Add the following:

(c) As-Built-Plans. Furnish one set of as built plans to the Government. The Government will provide one set of contract plans to be used exclusively for recording the as-built details of the project. Use red pencil or red ink to record the information described below.

Note all additions or revisions to the location, character, and dimensions of the prescribed work shown on the contract plans. Line out all details shown that are not applicable to the completed work. Check off details shown that were incorporated into the completed work without change.

Retain the plans at the project site and, as work progresses, continuously update them to reflect the as-built details. Upon request, make the plans available to the CO to review for compliance with these specifications.

As a minimum, show the following types of changes on the as-built plans:

(1) Plan and elevation

· Changes in the construction limits

· Revisions in location, type, and grade of dock system and ramps

· Location and type of utilities

· Elevations for all aerial and underground crossings of utilities

· Revisions to grades, elevations, and stationing

· Location, length, stationing, and type of retaining walls

(2) Dock System

(a) Revisions to footing elevations

(b) Pile length, location, size, type, and tip elevation

(c) Any changes in plan or dimensions including any major changes in reinforcing

(3) Miscellaneous

(a) Revisions to parking areas or turnouts

(b) Final location, type and length of curbs, sidewalks, etc. (c) Dock material revisions and details

(d) Final location, type and length of curbs, sidewalks, boat ramps, etc. (e) Dimension revisions.

Furnish the as-built working plans to the CO before the final inspection. Correct all details found during the final inspection that are not shown on the as-built plans and return to the CO within 5 working days.

104.06_ipnf_us_06_03_2009 Add the following:

104.06 Use of Roads by Contractor

The Contractor is authorized to use roads and trails under the jurisdiction of the Forest Service for all activities necessary to complete this contract, subject to the limitations and authorizations designated in the Road Order(s) or described in the contract, when such use will not damage the roads or National Forest resources, and when traffic can be accommodated safely.

Contractor will be responsible to restore or repair any road surface damage associated with their construction operations or the transportation of materials to the construction site.

Supplemental Project Specification Kalispell Bay Boat Launch Facility 105 - Control of Material

105.02 Material Sources.

Add the following before the first paragraph.

Sources have been designated for this project as follows:

Crushed Aggregate Source - Commercial Source – There is no Government source for crushed aggregate material under this contract.

Borrow Site – No off site borrow material is anticipated for completion of this project.

Waste Site - Government Furnished – Government Designated Waste Site located at the Government pit at the end of Forest Road 789 in Section 10, T.60N., R. 5W AS SHOWN ON THE DRAWINGS. This waste site is to be used for the disposal of unsuitable or excess excavated material and clearing and grubbing debris only. All other materials designated for removal and disposal must be disposed of off National Forest System Lands per Section 203.05.

Under (b) Contractor-located sources add the following:

Prior to any pit development or use of materials, the pit site shall be approved by the Contracting Officer that the pit site is free of noxious weed as listed on the "All States Noxious Weeds List”.

105.05 Use of Material Found in the Work.

Delete 105.05 (a) and (b) and the last sentence of the second paragraph and substitute the following:

Materials produced or processed from Government lands in excess of the quantities required for performance of this contract are the property of the Government. The Government is not obligated to make reimbursement for the cost of producing these materials.

Supplemental Project Specification Kalispell Bay Boat Launch Facility 106 - Acceptance of Work

106.01_nat_us_07_31_2007

106.01 Conformity with Contract Requirements.

Delete Subsection 106.01 and substitute the following:

Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

(1) Sampling method;

(2) Number of samples;

(3) Sample transport;

(4) Test procedures;

(5) Testing laboratories;

(6) Reporting;

(7) Estimated time and costs; and

(8) Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute.

The CO will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

(1) Have the work accepted at a reduced price; or

(2) Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

Supplemental Project Specification Kalispell Bay Boat Launch Facility 107 - Legal Relations and Responsibility To the Public

107.02_ipnf_us_06_03_2009

107.02 Protection and Restoration of Property and Landscape.

Add the following:

Landscape Preservation

(a) Do not remove, deface, injure, or destroy trees, shrubs, lawn, or natural features not designated for treatment. Confine operations to within the clearing limits or other areas designated in the contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Retrieve material which falls outside of these limits and dispose of, or incorporate in the work as directed by the Contracting Officer.

(b) Prevention of Oil Spills. If the Contractor maintains storage facilities for oil or oil products on site, take appropriate preventive measures to insure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual states. If a spill of petroleum product should occur in water, immediately notify the Contracting Officer.

Service all equipment only in the areas approved by the Contracting Officer. If the total oil or oil products storage exceeds 1320 gallons or if any single container exceeds a capacity of 660 gallons, prepare a Spill Prevention Control and Countermeasures (SPCC) Plan. Meet all applicable EPA requirements (40 CFR 112) including certification by a registered professional engineer.

Preserve the scenic and natural environment along this construction project.

(c) Do not allow objectionable material to enter any stream, river, lake, or other body of water. Retrieve material which falls in these areas and dispose of, or incorporate in the work as directed by the Contracting Officer, and repair damage to vegetation or structures outside the project limits as directed by the Contracting Officer.

(d) Do not operate equipment or otherwise disturb the natural vegetation and soil beyond the areas flagged on the ground or beyond two feet from edge of walkways, top of cuts, or toe of fills.

(e) Prior to the start of construction, submit to the Contracting Officer for approval a schedule and plan for temporary pollution control measures for the following phases of work:

· Boat ramp, concrete abutments and sidewalk construction

· Piling driving and filling

· Site excavation or ground disturbances that can promote surface erosion

Add the following:

Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.

Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill. Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information. Immediately notify the CO of all hazardous material spills. Provide a written narrative report form no later than 24 hours after the initial report and include the following:

· Description of the item spilled (including identity, quantity, manifest number, and other identifying information).

· Whether amount spilled is EPA or state reportable, and if so whether it was reported, and to whom.

· Exact time and location of spill including a description of the area involved.

· Containment procedures.

· Summary of any communications the Contractor had with news media, Federal, state and local regulatory agencies and officials, or Forest Service officials.

· Description of clean-up procedures employed or to be employed at the site including final disposition and disposal location of spill residue.

When available provide copies of all spill related clean up and closure documentation and correspondence from regulatory agencies.

The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract. Clean up spills or leaks to the satisfaction of the CO and in a manner that complies with Federal, state, and local laws and regulations.

109.02 Measurement Terms and Definitions

Add the following to this subsection:

One of the following methods of measurement for determining final payment is DESIGNATED IN THE PAY SCHEDULE for each PAY ITEM:

Methods of Measurement:

(a) Designed Quantities (DQ). These quantities denote the final number of units to be paid for under the terms of the contract. They are based upon the original design data available prior to advertising the project. Original design data include the preliminary survey information, design assumptions, calculations, drawings, and the presentation in the contract. Changes in the number of units DESIGNATED IN THE SCHEDULE OF ITEMS may be authorized under any of the following conditions:

(1) Changes in the work authorized by the CO.

(2) A determination by the CO that errors exist in the original design that cause a PAY ITEM quantity to change by 15 percent or more.

(3) A written request submitted to the CO showing evidence of errors in the original design that cause the quantity of a PAY ITEM to change by 15 percent or more. The evidence must be verifiable and consist of calculations, drawings, or other data that show how the designed quantity is in error.

(b) Stake Quantities (SQ). These quantities are determined from staked measurements prior to construction.

(c) Actual Quantities (AQ). These quantities are determined from measurements of completed work.

(d) Vehicle Quantities (VQ). These quantities are measured or weighed in hauling vehicles.

(e) Lump Sum Quantities (LSQ). These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job.

109.02 Measurement Terms and Definitions.

(p) Thousand Board Feet (MFBM). 1,000 board feet based on nominal widths, thickness, and extreme usable length of each piece of lumber or timber actually incorporated in the job. Supplemental Project Specification Kalispell Bay Boat Launch Facility 151 - Mobilization

151.00_01_us_10_11_2006

Delete Section 151 in its entirety and replace with the following.

Description

151.01 This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site; obtaining of permits, insurance, and bonds. This work also includes washing and treating construction equipment and vehicles necessary for equipment transport to remove seeds, plants, and plant fragments before the equipment is used on Forest Service lands, according to the requirements within.

Construction Requirements

Wash the sides, tops, and undercarriages of all construction equipment. Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment. Only equipment inspected by the Forest Service will be allowed to operate within the project area. All subsequent move-ins of equipment to the project area will be treated in the same manner as the initial move-in. This requirement does not apply to cars, pickup trucks, and other vehicles that regularly travel between the construction site and areas off the National Forest.

Equipment will be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment, components or the need for specialized inspection tools is not required.

Notify the Contracting Officer in writing at least 72 hours before moving any construction equipment onto the national forest. Notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service. Inspection will be required after every cleaning.

Use methods of cleaning and locations for cleaning approved by the Contracting Officer.

For work at a commercial washing facility, use an approved facility.

New infestations of noxious weeds of concern to Forest Service and identified by either Contractor or Forest Service, in the Project Area or on the haul route, will be promptly reported to the other party. Contractor and Forest Service will agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found. A current list of noxious weeds of concern to Forest Service is available at each Forest Service office.

Measurement

151.02 Clean equipment prior to moving onto this project. The initial cleaning will not be included in the measurement for payment. Payment for cleaning will only be made if subsequent cleanings are ordered by the Contracting Officer. Measurement shall be on an “each” basis, meaning one complete cleaning of all equipment required for this contract. Subsequent cleanings necessitated by the Contractor’s actions but not directed by the Contracting Officer will not be included in the measurement for payment.

Measure mobilization according to Subsection 109.02.

Payment

151.03 The accepted quantity, measured as provided in Subsection 109.02, will be paid at the contract price per unit of measurement for the Section 151 pay item shown in the bid schedule. Payment will be full compensation for the work prescribed in this Section. See Subsection 109.05.

Progress payments for mobilization lump sum will be paid as follows:

(a) If applicable, bond premiums will be reimbursed according to FAR Clause 52.232-5 Payments Under Fixed-Price Construction Contracts, after receipt of the evidence of payment.

(b) When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.

(c) When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.

(d) Any portion of the mobilization item in excess of 10 percent of the original contract amount will be paid after final acceptance.

Include all costs associated with the initial cleaning of equipment in the unit bid price for Mobilization. Cleaning for subsequent move-ins will not be paid for unless after a suspension ordered by the Contracting Officer.

Supplemental Project Specification Kalispell Bay Boat Launch Facility 152 – Construction Survey and Staking

It will be the Contractor’s responsibility to protect construction stakes until the work has been accepted by the Government. Any replacement of construction stakes that are lost due to Contractor’s construction activities will be re-established at the expense of the Contractor. Once the project has been accepted, the Contractor will remove all construction staked within the project area.

Short traffic delays not to exceed 30 minutes can be approved upon a written request outlining the traffic delays. Submit to the Contracting Officer at least 7 days prior to starting construction operations that necessitates the traffic delays.

Prior to the start of construction, submit a written Erosion Control Plan detailing all permanent and temporary control measures. Submit the erosion control plan proposal to the CO at least 14 days before beginning any operations.

Include all special concerns and measures necessary to protect resources and government improvements in the Erosion Control Plan. Provide as a minimum, the following items in the Erosion Control Plan:

1.

Construction activities and sequence of implementation relating to specific erosion control measures.

2. The location and type of permanent controls to be implemented during construction.

3.

The location and type of temporary controls to be implemented during construction.

4.

For work in the lake, include a detailed dewatering plan or in-water work plan.

5.

For work in the lake, describe level of ground and vegetative disturbance and measures to reduce potential sediment delivery to the lake. Include methods to minimize disturbance to the lake and prevent runoff from the construction site entering directly into the lake.

6. The monitoring procedures that will take place.

As part of the “Soil Erosion Control Plan”, Contractor to provide the following:

(a) Emergency Spill Kit. Keep sufficient quantities of absorbent materials on the project site to absorb accidental fuel, hydraulic oil, or other petroleum produc spills. Use absorbent materials that are biodegradable, non-water absorbing and designed specifically for the types of spills associated with the Contractor’s operations.

(b) Straw/Hay Bales. Contractor to stockpile ten(10) straw/hay bales on the project site for the discretionary use as directed by the Contracting Officer in addition to any bales or silt fence that the Contractor intends to incorporate into the project as a part of the permanent and temporary erosion control measures as required under this specification. These straw/hay bales are intended for unforeseen emergency use and as the straw bales are used from the stockpile, Contractor shall replace the used bales within 48 hours. Upon completion of the project, the straw/hay bales shall remain in place or removed as directed by the Contracting Officer. Removed bales and remaining stockpiled bales shall be uniformly spread over seed disturbed areas upon substantial completion of the project.

Add the following to the third paragraph:

Upon completion of construction at the site, remove all temporary erosion control devices, dewatering materials and equipment from Government property.

This work consists of minor clearing and grubbing within the clearing limits of the construction site. Clearing shall be limited to only the construction areas and only that clearing necessary for construction of the access roads and parking areas. All clearing must be clearly delineated and then approved by the Contracting Officer before any clearing and grubbing can take place.

Supplemental Project Specification Kalispell Bay Boat Launch Facility 203 – Removal of Structures and Obstructions

(b) Burn. All clearing slash is to be disposed of at the Government Designated Waste Site located at the Government pit at the end of Forest Road 789 in Section 10, T60N, R5W. Stumps and slash shall be relatively clean of dirt and piled in a location approved by the Contracting Officer for burning by the Contractor.

(c) Bury. Delete this subsection

(d) Decking. Deck unmerchantable logs at the Government Designated Waste Site located at the Government pit at the end of Forest Road 789 in Section 10, T60N, R5W. Should the Contractor elect not to take possession of merchantable logs as specified under Section 201.06, they can be cut into marketable saw log lengths and decked at the Designated Waste Site in a location approved by the Contracting Officer.

Adjust the moisture content to a level suitable for compaction. Fill the interstices around rock with earth or other fine material as practical. Use compression-type rollers at speeds less than 6 feet per second and vibratory rollers at speeds less than 3 feet per second. Compact each layer of material full width with one of the following and until there is no visible evidence of further consolidation.

(1) Four roller passes of a vibratory roller having a minimum dynamic force of 40,000 pounds impact per vibration and a minimum frequency of 1000 vibrations per minute.

(2) Eight roller passes of a 20-ton compression-type roller.

(3) Eight roller passes of a vibratory roller having a minimum dynamic force of 30,000 pounds impact per vibration and a minimum frequency of 1000 vibrations per minute.

Increase the compactive effort for layers deeper than 12 inches as follows:

( For each additional 6 inches or fraction thereof, increase the number of roller passes in (1) above by four passes.

( For each additional 6 inches or fraction thereof, increase the number of roller passes in (2) and (3) above, by eight passes.

204.13 Sloping, Shaping, and Finishing.

(d) Finishing. Remove all material larger than 6 inches from the top 6 inches of the roadbed. Remove unsuitable material from the roadbed, and replace it with suitable material. Ensure that the subgrade is visibly moist during shaping and dressing. Bring low sections, holes, cracks, or depressions to grade with suitable material. Finish roadbeds to within ±0.05 feet of the staked line. Finish ditch cross-sections to within ±0.10 feet of the staked line and grade. Maintain proper ditch drainage. Finish the boat ramp surface to be smooth, uniform, and shaped to conform to the existing ramp sections. Remove unsuitable material from the boat ramp and replace it with suitable material. Finish surfaces to match the existing boat ramp.

551.01 Contractor is required to submit for approval a “Pile Driving Plan”. This plan shall outline the equipment, manpower, materials, schedule and testing requirements for the pile driving operation.

Contractor shall engage the services of a Professional Engineer responsible for the dock design with pile driving credentials to approve the pile driving plan and witness the installation of the piles at the site. Outside consultant shall monitor the pile driving operations and verify that the ultimate capacity is achieved during installation and certify that the installation of the driven piles meets the intent of the design.
