USDA Forest Service Requirement for Motorola Preventative Maintenance, Maintenance and Repair.
Date: 9 April 2016
1. INTRODUCTION
The Forest Service requires logistics and maintenance support for the Law Enforcement’s Motorola subscriber special purpose radio inventory. This contract will include portable and mobile preventative maintenance, portable battery and antenna replacement, mobile removal and reinsert, mobile radio antenna replacement, radio repair after warrantee expiration, and remote speaker or microphone repair or replacement.
2. BACKGROUND
The US Forest Service has approximately 500 each APX7000 and 7500 radios in inventory across 52 states and provinces used to support LEI operations, in order to improve equipment reliability and to extend the usable life of these radios a contract needs to be established to perform recurring annual preventative maintenance and routine maintenance as necessary to support continued radio reliability and officer safety in the field. This contract will service the gap needed to insure continued support. The Motorola inventory will be provided:
3. SCOPE OF WORK
The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary that are required to support and maintain the integrity of the portable and mobile equipment throughout their lifecycle. The contractor shall be responsible to maintain a reference copy of the code plug prior to performing maintenance and will reload the code plug before returning the radio to the customer. The contractor shall be the focal point for the government for payment and issues. The contractor will supply all necessary test equipment, software, and hardware to insure a fully operable and current radio is returned to service using Motorola OEM parts and material only with no authorized substitutions to using off market manufactured parts. The contractor will provide shipping labels and establish processes to ship and track the radios until those radios are returned. The contractor will provide a monthly report on all radios that were inspected with the results of the inspections or maintenance by serial number to support maintenance program tracking.
4. TECHNICAL REQUIREMENTS
Any maintenance and support for the USFS APX Motorola inventory will be supported by Motorola Original Equipment Manufacturer (OEM) parts and accessories with no suitable substitutions to protect the reliability of the APX inventory. Further, maintainers must be Motorola certified/qualified, and test equipment must meet Motorola depot standard test equipment. A monthly report must be submitted prior to payment on the quantity of radios serviced, results of the service, and serial numbers of the radios services to the PM. It will be acceptable to have months without any service during peak operational season. The contractor will perform maintenance services for approximately 500 subscriber radios to include:
4.1 Subscriber Preventative Maintenance (PM) to provide an operational test and alignment of Subscribers to ensure they meet original manufacturer’s specifications. Subscriber Preventative Maintenance detects potential issues before they have a chance to cause any malfunction or operational interruption.
· Once a year, trained Motorola technicians will:
· Physically inspect equipment. Remove dust and foreign substances.
· Clean filters.
· Measure, record, align, and adjust the equipment to meet original manufacturer’s specifications.
· This service will be performed annually on APX Subscribers sent to the Motorola Federal Technical Center. The average repair cycle time is 5 days plus shipping.
· Maintain radio program if at all possible and if not maintainable reprogram equipment to original operating parameters based on the Customer template, if retrievable, or from a Customer supplied backup diskette. If the Customer template is not usable, a generic template or code plug utilizing the latest Radio Service Software (RSS) or Customer Programming Software (CPS) version for that Equipment will be used. The Equipment will require additional programming by the Customer to restore the original template.
· All Firmware is upgraded to the latest release for each individual radio.
· Motorola will provide shipping labels and payment of shipping will be the burden of Motorola.
4.2 The APX Portable Battery and Antenna Replacement Program must provide for battery and antenna replacement service for radios covered under the plan using OEM parts. A new battery and antenna will be exchanged for any battery that is rated 80% capacity or less and APX antenna that is damaged or no longer functioning. Normal wear and tear repairs to the radio will be covered under the existing radio warranty in effect.
· This service will be performed on APX Subscribers with battery and antenna attached that are sent to the Motorola Federal Technical Center in Lanham MD.
4.3 For APX Mobile Radio PMs, a local and within 60 miles Motorola authorized Service Provider will remove the mobile from the vehicle and ship the mobile unit to the Motorola Federal Technical Center for the annual PM. After the PM is completed and returned, the local Motorola Service Provider will reinsert the mobile into the vehicle. Additionally the Service Provider will conduct an operational check to ensure the radio is performing within manufacturer specifications to insure no changes occurred during shipping.
· For APX mobile Antennas replacement, a local Motorola authorized Service Provider will provide and install antennas which are external to the vehicle or installed in the trunk using OEM parts and like and kind of original specified and installed antennas.
· Motorola has the following responsibilities:
· Check and replace Motorola branded antenna as needed for APX mobile radio for PM or service. Replacement will be same part number or exact like and kind.
· Customer has the following responsibilities:
· The US Forest Service will be responsible for arranging to have the vehicle available at the Service Provider for mobile removal and reinsert into the vehicle.
4.4 Remote Speaker Microphone Option provides for the Restoration and/or replacement of remote speaker microphones that have become defective through normal wear and usage.
This Option includes service to the remote speaker microphone cord that attaches to the portable. Motorola has the following responsibilities:
· Restore and/or replace remote speaker microphone as needed, if replaced only OEM parts and like and kind of original part will be used to replace the faulty unit.
· US Forest Service has the following responsibilities:
· Ship remote speaker microphone to the Motorola Technical Center payment for shipping will be the burden of Motorola and they will provide shipping labels.
4.5 Motorola will pay for inbound and outbound Next Day Express shipping including a supply of specially designed shipping materials to prevent radio damage.
4.6 When current warrantee expires, Motorola will provide complete factory repair support for the US Forest Service subscriber products manufactured and supported by Motorola at their Federal Technical Center located in Lanham, Maryland. Service of the two-way portable and mobile radios for trunked, clear, and encrypted technology will utilize factory level depot tools, automated test and alignment diagnostic equipment and factory available repair and Host and DSP code updating. Defective component boards will be replace with OEM Motorola new stock to insure repair reliability.
4.6.1 Repair will include:
Test and Restore the Equipment to Motorola factory specifications, including Factory Mutual (FM), and Mine Hazard Safety Association (MHSA).
· Reprogram Equipment to original operating parameters based on the Customer template, if retrievable, or from a Customer supplied backup diskette. If the Customer template is not usable, a generic template or code plug utilizing the latest Radio Service Software (RSS) or Customer Programming Software (CPS) version for that Equipment will be used. The Equipment will require additional programming by the Customer to restore the original template.
· All Firmware is upgraded to the latest release for each individual radio.
· Clean external housing of the Equipment. External components of unit will only be replaced when functionality has been diminished.
· Replace currently manufactured equipment if it is determined that the equipment is not repairable. Motorola will contact the customer to inform them if equipment needs to be replaced and that the cycle time may be increased because of the replacement.
· If non-repairable equipment is no longer manufactured, the contractor will return the radio.
· Motorola will pay the inbound freight charges if the Customer uses the Motorola designated delivery service.
· Provide customer with the Motorola repair request form.
· Perform covered services as requested by Customer on the Motorola repair request form.
· Customer has the following Responsibilities:
· Ship APX Portable radio to Motorola Federal Technical Center
· Deliver and pick up Equipment to/from the Servicer facility
· Supply Motorola complete and accurate serial numbers and model description.
· If desired, supply Motorola with a backup CD with the Software template or programming in order to assist in returning the Equipment to original operating parameters. This step must be completed for equipment that will not power up. If applicable, record the current flashcode for each radio.
· If Motorola must utilize a generic template or code plug to Restore Equipment to operating condition, Customer is responsible for any programming required to Restore Equipment to desired parameters.
5. PERIODS OF PERFORMANCE
The contractor shall deliver services within 90 days of contract establishment.

8.1 By accepting this contract/agreement, the Contractor/Cooperator and other external organizations (hereafter called Contractor) providing Information Technology (IT) services to the US Forest Service (FS) agrees to comply with the applicable IT security policy as outlined in this document. The Contractor and other external organizations will be responsible for IT security for all systems connected to the FS network or operated by the Contractor and other external organizations for the FS, regardless of location. This clause is applicable to all or any part of the contract that includes IT resources or services in which the Contractor and other external organizations must have physical or electronic access to FS sensitive information that directly support the mission of the FS. The term 'information technology', as used in this clause, means any equipment or interconnected system or subsystem of equipment, that is used in the automatic acquisition, storage, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information. This includes both major applications and general support systems as defined by OMB Circular A-130.
8.2 The Contractor shall, be responsible for properly protecting all information used, gathered, or developed as a result of work under this task. The Contractor shall also protect all unclassified Government data, equipment, etc., by treating information as sensitive business, confidential information, controlling and limiting access to the information, and ensuring the data and equipment are secured within their facility.
8.3 The Contractor or other external organization will not publish or disclose in any manner, without the FS Contracting Officer's written consent, the details of any programs, documentation, data, or safeguards either designed or developed by the Contractor or other external organization under this Contract or otherwise provided by the Government. Contractor may be required to sign non-disclosure or other appropriate security agreements. A written agreement between the FS and any contractors and other external organizations will be entered into before FS data and information otherwise exempt from public disclosure may be disclosed to the contractors and other external organizations. The contractor and other external organizations will agree to establish and follow security precautions considered by the FS to be necessary to ensure proper handling of data and information. As may be identified elsewhere in this contract, the Contractor agrees that:
| • | The draft and final deliverables and all associated working papers and other materials deemed relevant by the COTR that have been generated by the Contractor in the performance of this contract are the property of the U.S. Government and must be submitted to the COTR at the conclusion of the tasks. |
| • | All documents produced for this project are the property of the U.S. Government and cannot be reproduced or retained by the Contractor. |
To the extent required to carry out a program of inspection to safeguard against threats and hazards to the security, integrity, and confidentiality of Government data, the Contractor will afford the Government access to the Contractor's or other external organization's facilities, installations, technical capabilities, operations, documentation, records, and databases.
The Contractor will cooperate with Federal agencies and their officially credentialed representatives during official inspections or investigations concerning the protection of FS information. Cooperation may include providing relevant documentation showing proof of compliance with federal and agency requirements, and rendering other assistance as deemed necessary.
8.4 If new or unanticipated threats or hazards are discovered by either the Government or the Contractor or other external organization, or if existing safeguards have ceased to function, the discoverer will immediately bring the situation to the attention of the other party. The Contractor will report real or suspected incidents or violations to the FS Computer Incident Response Team (CIRT), by e-mail, at CIRT@fs.fed.us.
8.5 The Contractor shall insert these clauses in all subcontracts when the subcontractor is required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. Failure to comply with said requirements will constitute cause for termination.
The Contractor Agrees To –
(a) Comply with the Privacy Act of 1974 (the Act) and the agency rules and regulations issued under the Act in the design, development, or operation of any system of records on individuals to accomplish an agency function when the contract specifically identifies
| (i) | The systems of records; and |
| (ii) | The design, development, or operation work that the contractor is to perform; |
(b) Include the Act notification contained in this contract in every solicitation and resulting subcontract and in every subcontract awarded without a solicitation, when the work statement in the proposed subcontract requires the redesign, development,, or operation of a system of records on individuals that is subject to the Act; and
(c) Include this clause, including this paragraph (3), in all subcontracts awarded under this contract which requires the design, development, or operation of such a system of records.
8.6 In the event of violations of the Act, a civil action may be brought against the agency involved when the violation concerns the design, development, or operation of a system of records on individuals to accomplish an agency function, and criminal penalties may be imposed upon the officers or employees of the agency when the violation concerns the operation of a system of records on individuals to accomplish an agency function. For purposes of the Act, when the contract is for the operation of a system of records on individuals to accomplish an agency function, the Contractor is considered to be an employee of the agency.
8.7 Definitions of the clause:
| (a) | "Operation of a system of records," as used in this clause, means performance of any of the activities associated with maintaining the system of records, including the collection, use, and dissemination of records. |
| (b) | "Record," as used in this clause, means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, education, financial transactions, medical history, and criminal or employment history and that contains the person's name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a fingerprint or voiceprint or a photograph. |
| (c) | "System of records on individuals," as used in this clause, means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual. |
8.8 The contractors and other external organizations will ensure that the following banner is displayed on all FS systems that contain Privacy Act information operated by the contractors and other external organizations prior to allowing anyone access to the system:
"This system contains information protected under the provisions of the privacy act of 1974 (public law 93-579). Any privacy information displayed on the screen or printed must be protected from unauthorized disclosure. Employees who violate privacy safeguards may be subject to disciplinary actions, a fine of up to $5,000, or both.
