SECTION 010000 - GENERAL REQUIREMENTS

PART 1 - GENERAL

1.1 CONTINUING OBLIGATION

A. The Contractor’s obligation to perform and complete the Work in accordance with the Contract Documents shall be absolute. Neither recommendation of any progress or final payment by Contracting Officer’s Representative, nor the issuance of a Certificate of Substantial Completion, nor any payment by U.S. Forest Service to Contractor under the Contract Documents, nor any use or occupancy of the Work or any part thereof by U.S. Forest Service, nor any act of acceptance by U.S. Forest Service, nor any failure to do so, not any review and approval of shop drawings or sample submission, nor the issuance of a notice of acceptability by Contracting Officer’s Representative, nor any Correction of defective Work by the U.S.

Forest Service will constitute an acceptance of Work not in accordance of the Work in accordance with the Contract Documents.

1.2 REUSE OF DOCUMENTS

A. Neither Contractor nor any Subcontractor or Supplier or other person or organization performing or furnishing any of the Work under a direct or indirect Contract with U.S. Forest Service shall have or acquire any title to or ownership rights in any of the Drawings, Specifications or other documents (or copies thereof) prepared by or bearing the seal of CO.

They shall not reuse any of them on extensions of the Project or any other project without written consent of the U.S. Forest Service and CO and specific written verification or adaption by CO.

1.3 DISCREPANCIES AND OMISSIONS

A. If, during the performance of the Work, Contractor finds a conflict, error, or discrepancy in the Contract Documents, Contractor shall so report to Contracting Officer’s Representative in writing at once and before proceeding with the Work affected thereby shall obtain a written interpretation or clarification from Contracting Officer’s Representative, however, Contractor shall not be liable to U.S. Forest Service or Contracting Officer’s Representative for failure to report any conflict, error, or discrepancy in the Contract Documents unless Contractor had actual knowledge thereof or should reasonably have known thereof.

Figured dimensions on Plans shall take precedence over scale dimensions. Detailed Plans in the Contract Documents shall take precedence over general Plans.

The Contract Documents are intended to include all work and materials necessary for completion of the Work. Any incidental item of material, labor, or detail required for the proper execution and completion of the Work and omitted from the Contract Documents but obviously required by governing codes, local regulations, trade practices, operational functions, and good

Northwest Design Group, LLC© GENERAL REQUIREMENTS 010000 - 2 workmanship, shall be provided as a part of the Work without extra charge, even though not specifically detailed or mentioned.

1.4 ORAL AGREEMENTS

A. No oral order, objection, claim or notice by any party to the others shall affect or modify any of the terms or obligations contained in any of the Contract Documents, and none of the provisions of the Contract Documents shall be held to be waived or modified by reason of any act whatsoever, other than by a mutually agreed waiver or modifications thereof in writing and no evidence shall be introduced in any proceedings of any other waiver or modification.

1.5 UNIT PRICES AND SCHEDULED QUANTITIES

A. The quantities listed in the Bid Schedule requiring field measurements for payment purposes are engineering estimates and field conditions will likely cause some variance from scheduled quantities. Payments for specific items shall be in strict conformance with “Measurement and Payment” section. All “left over” materials, purchased by the Contractor, shall be the property of the Contractor and the CO shall not be responsible for any associated charges.

1.6 SALVAGE ITEMS

A. The CO reserves the right to any salvaged equipment and materials destined to be removed or made obsolete by the project.

PART 3 - EXECUTION

3.1 DEWATERING ACTIVITIES

A. Dewatering of the work area shall be incidental to the individual work items requiring dewatering.

3.2 MAINTAINING ACCESS AND ROADWAYS

A. The Contractor shall maintain, at all times, access for residents and emergency vehicles. The cost of this work shall be considered incidental to the project.

The Contractor shall utilize methods to protect existing gravel and paved roadways from damage during all construction activities. The Contractor’s equipment shall not damage existing roadways. Excavated materials and stockpiles shall not damage existing roadways.

The Contractor shall not place stockpiles or excess materials on any roadway. The Contractor shall restore all roadway surfaces to pre-construction condition at their own expense after

Northwest Design Group, LLC© GENERAL REQUIREMENTS 010000 - 3 construction. Final payment will not be made until U.S. Forest Service approves restoration of all roads impacted by construction activities.

All costs associated with this maintenance work shall be included in the associated bid items.

3.3 ROAD WEIGHT RESTRICTIONS

A. Contractor shall abide by weight restrictions as set by the County. This item will be discussed at the pre-bid meeting.

If there are damages to the roads due to hauling during the posted weight restrictions, the Contractor shall repair the associated damages at no cost to the U.S. Forest Service. The U.S.

Forest Service shall review the condition of the roadways that the Contractor plans to use before and after the construction of the project.

3.4 UTILITY COORDINATION

A. The Contractor will be responsible for coordinating their activities and addressing any conflicts with regard to existing utilities including notifications, bracing, shoring and other utility relocations that may be required to complete the Work. The costs for utility coordination shall be considered as incidental and included in the price for other items of work.

1.3 PROJECT INFORMATION

A. Project Identification: Black River Harbor – Harbor Improvements.

1. Project Location: Black River Harbor, Gogebic County, Michigan.

B. Owner: U.S. Department of Agriculture, Forest Service.

1. Owner's Representative: U.S. Department of Agriculture, Forest Service Ottawa National Forest Watersmeet, Bessemer, Iron River Ranger Districts, Ironwood, Michigan.

Contracting Officer (CO) refers to the person assigned by the USDA Forest Service to

2. Contracting Officer: Shawn Lacina, Lake States Contracting, 500 Hanson Lake Road, Rhinelander, WI 54501.

3. Contracting Officer’s Representative (COR): TBD

C. Engineer: Northwest Design Group, LLC 2940 Parkview Drive, Petoskey, MI 49770.

D. Engineer's Consultants: Engineer has retained the following design professionals who have prepared designated portions of the Contract Documents:

1. Electrical Engineer: Comprehensive Engineering 4653 Plainfield Avenue, NE, Grand Rapids, MI 49525.

1.4 WORK COVERED BY CONTRACT DOCUMENTS

A. The Work of Project is defined by the Contract Documents and consists of the following:

1. The work includes the removal and replacement of the docking system, storm drainage improvements and other Work indicated in the Contract Documents.

B. Type of Contract:

1. Project will be constructed under a single prime contract.

1.5 ACCESS TO SITE

A. General: Contractor shall have full use of Project site for construction operations during construction period. Contractor's use of Project site is limited only by CO's right to perform work or to retain other contractors on portions of Project.

1.6 COORDINATION WITH OCCUPANTS

A. Partial CO Occupancy: CO will occupy the premises during entire construction period, with the exception of areas under construction. Cooperate with CO during construction operations to minimize conflicts and facilitate CO usage. Perform the Work so as not to interfere with CO's operations. Maintain existing exits unless otherwise indicated.

1. Maintain access to existing walkways and other adjacent occupied or used facilities. Do not close or obstruct walkways or other occupied or used facilities without written permission from CO and authorities having jurisdiction.

2. Provide not less than 48 hours' notice to CO of activities that will affect CO's operations.

1.7 WORK RESTRICTIONS

A. Work Restrictions, General: Comply with restrictions on construction operations.

1. Comply with limitations on use of public streets and with other requirements of authorities having jurisdiction.

B. On-Site Work Hours: Limit work in the existing building to normal business working hours of 6 a.m. to 6 p.m., Monday through Friday, unless otherwise indicated.

1. No work shall be allowed on weekends without prior approval from the CO

2. Early Morning Hours: No work shall be allowed outside of the normal hours without prior approval from the CO

3. Hours for Utility Shutdowns: TBD

4. Hours for Rock Blasting: TBD

C. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by CO or others unless permitted under the following conditions and then only after providing temporary utility services according to requirements indicated:

1. Notify CO not less than two days in advance of proposed utility interruptions.

2. Obtain CO written permission before proceeding with utility interruptions.

1.8 SPECIFICATION AND DRAWING CONVENTIONS

A. Specification Content: The Specifications use certain conventions for the style of language and the intended meaning of certain terms, words, and phrases when used in particular situations.

These conventions are as follows:

1. Imperative mood and streamlined language are generally used in the Specifications. The words "shall," "shall be," or "shall comply with," depending on the context, are implied where a colon (:) is used within a sentence or phrase.

2. Specification requirements are to be performed by Contractor unless specifically stated otherwise.

B. Division 01 General Requirements: Requirements of Sections in Division 01 apply to the Work of all Sections in the Specifications.

C. Drawing Coordination: Requirements for materials and products identified on Drawings are described in detail in the Specifications. One or more of the following are used on Drawings to identify materials and products:

1. Terminology: Materials and products are identified by the typical generic terms used in the individual Specifications Sections.

2. Abbreviations: Materials and products are identified by abbreviations published as part of the U.S. National CAD Standard and scheduled on Drawings.

3. Keynoting: Materials and products are identified by reference keynotes referencing Specification Section numbers found in this Project Manual.

PART 1 - GENERAL

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and other Division 01 Specification Sections, apply to this Section.

1.2 SUMMARY

A. Section includes administrative and procedural requirements for unit prices.

B. Related Requirements:

1. Section 012100 "Allowances" for procedures for using unit prices to adjust quantity allowances.

2. Section 012300 "Alternates" for procedures for adjusting unit prices and quantity amounts for adding similar work later in the project.

1.3 DEFINITIONS

A. Unit price is an amount incorporated into the Agreement, applicable during the duration of the Work as a price per unit of measurement for materials, equipment, or services, or a portion of the Work, added to or deducted from the Contract Sum by appropriate modification, if the scope of Work or estimated quantities of Work required by the Contract Documents are increased or decreased.

1.4 PROCEDURES

A. Unit prices include all necessary material, plus cost for delivery, installation, insurance, applicable taxes, overhead, and profit.

B. Measurement and Payment: See individual Specification Sections for work that requires establishment of unit prices. Methods of measurement and payment for unit prices are specified in those Sections.

C. CO reserves the right to reject Contractor's measurement of work-in-place that involves use of established unit prices and to have this work measured, at CO's expense, by an independent surveyor acceptable to Contractor.

D. List of Unit Prices: A schedule of unit prices is included in Part 3. Specification Sections referenced in the schedule contain requirements for materials described under each unit price.

3.1 SCHEDULE OF UNIT PRICES – GENERAL WORK – BASE BID

A. Item No. 015000-01 – Staging and Site Control

1. Description: Perform staging and site control in accordance with specification section

“015000 Temporary Facilities and Controls”. Staging and Site Control includes preparatory work and operations including, but not limited to; barricades, fencing, signing, supplies and incidentals to the project; to set up control of the construction area and protect the public from harm. The site will remain open to the public during construction and it is the responsibility of the Contractor to control their portion of the site to prevent access or conflicts with the public.

2. Unit of Measurement: Lump Sum

3. Measurement and Payment: Lump sum payment, 50% paid when 50% of original

Contract Amount earned, 100% paid when 100% of original Contract Amount earned.

B. Item No. 017300-01 – Mobilization

1. Description: Mobilization includes preparatory work and operations including, but not limited to; movement of personnel, equipment, supplies and incidentals to the project;

temporary construction office and restroom facilities; other work and operations that must be performed; expenses incurred prior to beginning work on the various contract pay items on the project site; pre-construction costs, exclusive of bidding costs, which are necessary direct costs to the project rather than directly attributable to other pay items under the contract; and all other job incidentals necessary for completion of the Project as indicated and not specifically included in other pay items.

2. Unit of Measurement: Lump Sum

3. Measurement and Payment: Lump sum payment, 50% mobilization paid when 5% of original Contract Amount earned, 100% mobilization paid when 25% of original Contract Amount earned.

C. Item No. 312000-01 – Soil and Sedimentation Control

1. Description: Procure erosion control permit(s), install, maintain, relocate and remove erosion and sedimentation controls according to Section 312500 “Erosion and Sedimentation Controls” as required by authorities having jurisdiction, as indicated on the Drawings, and as directed by the Engineer. Work includes relocating or replacing soil erosion and sedimentation control measures to maintain traffic, accommodate contractor logistics or comply with permit(s) or orders by authorities having jurisdiction. Includes SESC measures required at project site and at rock excavation processing site area.

Includes washing of trucks and equipment, and associated wash bays.

2. Unit of Measurement: Lump Sum

3. Measurement and Payment: Lump sum payment for completion of the work as described.

3.2 SCHEDULE OF UNIT PRICES – WALL RECONSTRUCTION – BASE BID

A. Item No. 024119-01 – Remove Existing Wood Dock Wall and Stone Fill

1. Description: Remove and dispose of existing dock wall structures or portions thereof, Ironwood, Michigan

Northwest Design Group, LLC© UNIT PRICES 012200 - 3 including all attached parts and connections according to Section 024119 “Selective Demolition”. Remove stone fill according to Section 312000 “Earth Moving” and stockpile for use as bin wall backfill.

2. Unit of Measurement: Lump sum

3. Measurement and Payment: Lump Sum payment for completion of the work as described. No adjustment in unit price will be permitted for this pay item, regardless of the actual quantity completed.

B. Item No. 024119-02 – Site Removals

1. Description: Remove and dispose or salvage and relocate items indicated on Drawings, according to Section 024119 “Selective Demolition” and other applicable specifications.

Includes removal of existing wood decking not attached to existing dock wall, benches, railing, signs and all items requiring removal or relocation not included in other pay items. Includes reinstallation of items where indicated on Drawings.

2. Unit of Measurement: Lump Sum

3. Measurement and Payment: Lump Sum payment for completion of the work as described.

C. Item No. 051200-01 – Bin Wall

1. Description: Construct bin wall as indicated on Drawings. Includes all associated backfill

(structure and engineered fill), installation of geotextile, bedding course, CLSM (flowable concrete fill), and other work indicated on Drawings. Includes delegated design for bin wall. Includes delegated design for connection to existing dock wall where applicable. Excavation paid for separately.

2. Unit of Measurement: Square Foot

3. Measurement and Payment: Payment by the square foot on water side face of bin wall.

D. Item No. 033000-01 – Concrete Retaining Wall

1. Description: Construct concrete retaining walls as indicated on Drawings, according to

Section 033000 “Cast in Place Concrete”. Includes all earthwork and backfill, placement, finishing, curing, reinforcing steel, temporary bracing, shoring, dewatering, and weep holes.

2. Unit of Measurement: Cubic Yard

3. Measurement and Payment: Payment by the cubic yard of concrete placed measured in place.

E. Item No. 033000-02 – Concrete Headwall

1. Description: Construct concrete headwalls as indicated on Drawings, according to

Section 033000 “Cast in Place Concrete”. Includes all earthwork and backfill, formwork, placement, finishing, curing, reinforcing steel, temporary bracing, shoring, and dewatering.

2. Unit of Measurement: Cubic Yard

3. Measurement and Payment: Payment by the cubic yard of concrete placed measured in place.

F. Item No. 033000-03 – Concrete Walking Surface

1. Description: Construct concrete walking surface as indicated on Drawings, according to

Section 033000 “Cast-In-Place Concrete”. Includes forming, steel reinforcing, placing, finishing, curing, control joints and expansion joints, and dewatering. Does not include earthwork or restoration.

2. Unit of Measurement: Square Foot

Section 061533 “Wood Patio Decking”. Includes foundations, framing, decking, hardware, fasteners, placing. Does not include earthwork or restoration.

2. Unit of Measurement: Square Foot

3. Measurement and Payment: Payment by the square foot measured in-place by length and width.

H. Item No. 055213-01 – Pipe and Tube Railing

1. Description: Construct pipe and tube railing as indicated on Drawings, according to

Section 055213 “Pipe and Tube Railings”. Includes galvanizing, painting, fasteners, and all work required to attach to surface as detailing on drawings.

2. Unit of Measurement: Linear Foot

3. Measurement and Payment: Payment by the lineal foot measured in-place along the top of each railing section.

I. Item No. 129300-01 – Site Furnishings – Dock Cleats

1. Description: Furnish and install dock cleats, as indicated on the Drawings, per manufacturer’s installation requirements. Includes all hardware and fabrication required to install the cleat.

2. Unit of Measurement: Each

3. Measurement and Payment: Payment per each dock cleat for completion of the work as described.

J. Item No. 129300-02 – Site Furnishings – Picnic Tables

1. Description: Furnish and install picnic table, as indicated on the Drawings, per manufacturer’s installation requirements. Includes all hardware and fabrication required to install the table.

3. Measurement and Payment: Payment per each picnic table for completion of the work as described.

K. Item No. 129300-03 – Site Furnishings – Wood Bumpers

1. Description: Furnish and install wood bumpers, as indicated on the Drawings, per bin wall manufacturer’s installation requirements. Includes all hardware and fabrication required to install the bumpers.

1. Description: Excavate Earth material to the lines and grades indicated, according to

Section 312000 “Earth Moving”. Take possession and haul to other upland disposal site.

A. Alternate: An amount proposed by bidders and stated on the Bid Form for certain work defined in the bidding requirements that may be added to or deducted from the base bid amount if the Owner decides to accept a corresponding change either in the amount of construction to be completed or in the products, materials, equipment, systems, or installation methods described in the Contract Documents.

1. Alternates described in this Section are part of the Work only if enumerated in the Agreement.

2. The cost or credit for each alternate is the net addition to or deduction from the Contract Sum to incorporate alternates into the Work. No other adjustments are made to the Contract Sum.

1.4 PROCEDURES

A. Coordination: Revise or adjust affected adjacent work as necessary to completely integrate work of the alternate into Project.
