SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 Scope of Contract

This contract is for bridge maintenance work on Forest Service Road #90, on the Gifford Pinchot National Forest, in Skamania County. The work includes: removal and replacement of two abutment bridge joints, minor roadway excavation and asphalt paving, cleaning of bridge deck and drainage system, guardrail repair, minor painting of metal guardrail parapets, temporary traffic control and protection, and standard construction landscape preservation operations.

Swift Creek Bridge is a two lane cantilevered steel deck truss bridge located in a steep ravine, in Skamania County, Washington, on the Gifford Pinchot National Forest, Forest System Road 90, MP 4.2. The concrete deck and metal parapet is supported by four steel truss spans and one steel girder span. The superstructure is supported on two reinforced concrete abutments and four steel towers. The over-all length is 439 feet.

Roadway width is approximately 26’-0”. The bridge was built in 1957 in accordance with plan No. 10020.

C.2 Project Location

The project is located within the Gifford Pinchot National Forest, approximately 7 miles East of Cougar, Washington. To access the project, take exit 21 off of I-5 and proceed east along state highway SR503 towards Cougar. Continue through Cougar on SR503 for approximately 3 miles at which point SR503 becomes FS Road #90 at the County line. The project site is located approximately 4.2 miles past the county line on FS Road #90. See sheet 1 of the plans for a general location map.

C.3 Price Range

The Government’s estimate is:

between $25,000 and $100,000

C.4 Prosecution of Work & Traffic Control Management Plan

The contractor shall conduct activities so that interference with the public is kept to a minimum.

a. Use of Roads by Contractor:

The worksite and roadway will be closed to all traffic during working hours. All site work shall be completed during the time of the road closure. A seven night closure of Forest Road 90 shall be allowed at the project site for completion of the contract work, between the dates of May 28th, 2014 and June 11th, 2014. The work is anticipated to be completed during that time. The roadway and project site are approved for closure from 8 P.M. to 6 A.M. each work day. Road closure dates shall be coordinated with the CO/COR.

Provide 1” thick or greater steel plate to span the joint opening during joint removal and replacement operations. Steel plate shall be secure from movement caused by traffic with cold patch or other suitable material while the road is open. Steel plate thickness is based on maximum 6 foot opening span.

The contractor is authorized to use all Forest Service roads as needed for the completion of this contract.

b. Traffic control management plan:

Contractor shall submit a traffic control management plan. Allow 7 days for approval. Perform no work that interferes or conflicts with traffic or existing access to the roadway surface until the required traffic control management plan is submitted and approved by the CO/COR. Do not proceed with work on the project until all required signs and safety devises are in place and approved by the CO/COR.

Traffic control management plan shall incorporate sign plans for all stages of the project, including signing during pre-closure and closure. Sign plans shall include signs specified in this section and the sign detail in the plan set. Details for signing included in this contract are intended to provide the minimum level of informative signing acceptable to inform the public of the closure. The contractor is responsible for meeting the intent of the MUTCD and its requirements for providing adequate signing based on field conditions.

Accommodate traffic according to the approved traffic control plan, MUTCD, FP-03 section 156, and section 635. Use only certified flagging personal when flagging is required. If no detour or bypass is available at the site close road with appropriate signing and Type-3 barricades as recommended by the MUTCD and the specifications in this section. All road closures shall be coordinated with the Forest Service CO/COR.

c. Sign and closure plans:

There is no existing suitable detour route available for this project. As such there will be no detour signs required and all detour signing will be prohibited.

Contractor will be responsible for placing non-electronic information pre-closure signs two weeks prior to closure of the road, or as specified by the CO/COR, to inform the local public of the upcoming road closure, the dates of the closure, and how many miles ahead the closure is located. These informative closure signs shall remain in place until the closure is no longer in effect and then they shall be taken down, unless replaced with an electronic version prior. Locations for these sign placements include the following;

- At the project site. One informative sign on each side of the project site.

- At the intersection of Forest Service Road 25 and State Route 131, approximately one mile South of Randle, Washington.

- On the right side of the Wind River Highway, approximately 9 miles Northwest of Carson, just before the right turn after the fish hatchery.

- On the right side of the road just after leaving the town of Cougar, Washington located just west of the project site. (To be replaced with electronic version 2 days before closure)

- On the North side of the 90 Road 200 feet west of the Swift Forest Campground entrance, approximately 12 miles east of the project site. (To be replaced with electronic version 2 days before closure)

Contractor will be responsible for placing electronic information pre-closure signs two days prior to closure of the road, to inform the local public of the upcoming road closure, the dates of the closure, and how many miles ahead the closure is located. These informative closure signs shall remain in place until the closure is no longer in effect and then they shall be taken down. Locations for these sign placements include the following;

- One electronic message board on the right side of the road just after leaving the town of Cougar, Washington located just west of the project site.

- One electronic message board on the North side of the 90 Road 200 feet west of the Swift Forest

Campground entrance, approximately 12 miles east of the project site.

Full road closure will require the following signs;

- Type-3 barricades on both side of the closure with Road Closed Sign

- “Road Closed 500ft” at 50’ from both sides of project

- “Road Closed 1000ft” at 1000’ from both sides of project

- Additional closure signing as specified by special project specifications and in accordance with the current MUTCD, Figure 6H-8; Road Closure with an Off-Site Detour (TA-8).

Additional signs that may be recommended based on contractor plans include;

- (W20-1) ROAD WORK AHEAD

- (W3-4) BE PREPARED TO STOP

- (W20-4) ONE LANE ROAD AHEAD

- (W20-7) Symbol of Flagger Man Ahead

d. Staging area:

Shoulders and clear areas located on both sides of the project can be used for staging purposes. Ensure that staging areas are properly signed and/or barricaded for safety according to the MUTCD.

During the road closures, it is intended that the contractor use the roadway on both sides of the project for the purpose of staging the work.

Additional staging area can be provided within 3 miles of the project site at the contractor’s request. To initiate a request for additional staging area, provide written request to the CO/COR.

C.5 Applicable Specifications and Material Certifications

a. Applicable Specifications:

References to Standard Specifications in the contract refer to the STANDARD SPECIFICATIONS

FOR CONSTRUCTION OF ROADS AND BRIDGES ON FEDERAL HIGHWAY PROJECTS, FP-03

US CUSTOMARY UNITS.

Sections 100 through 149, and other Standard Specifications, listed on the Specification List, are included in this solicitation by reference only. Specifications not on the list but referenced by other Standard Specifications, shall also be applicable to this document.

The Supplemental Specifications are also given on the Supplemental List but are physically attached in Section J. All requirements contained on the Supplemental List are hereby made a part of this solicitation and any resultant contract.

b. Product Substitution:

Any modification of other items, designs, materials, products or equipment (including Government- Furnished Property), made necessary because of a substitution, will be the responsibility of the Contractor without adjustment in contract price or time. The Contracting Officer's approval of any substitute will not affect the Contractor's responsibility for such modification. Any and all substitutions will be requested by the Contractor after award of the contract has been made. No approvals will be made prior to award

Physical examples shall illustrate materials, equipment, or workmanship, and establish standards by which completed work shall be judged. Samples shall be of sufficient size and quantity to illustrate the functional characteristics of product or material, with integrally related parts and devices.

Manufacturer's requirements:

Supply manufacturer's catalog sheets or brochures with diagrams, schedules, or performance charts.

Illustrations shall be clearly marked to identify pertinent materials or models, dimensions, and clearances required. Supplement standard drawings to provide information unique to this project.

Approval or Rejection Time Allowance:

Submittals will be reviewed and either approved or rejected within 30 calendar days of their receipt by the Contracting Officer or COR unless otherwise noted.

C.7 AGAR 452.236-78 Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects (NOV 1996)

The STANDARD SPECIFICATIONS FOR CONSTRUCTION OF ROADS AND BRIDGES ON FEDERAL HIGHWAY PROJECTS, FP-03, U.S. CUSTOMARY UNITS, is included by reference. The requirements contained in these specifications are hereby made a part of this solicitation and any resultant contract.

C.8 FP-03 Specifications and Special Project Specifications

Follow FP-03 specifications in addition to the following special project specifications created for the project found in this contract.

C.9 Removal and Replacement of Abutment Expansion Joints

a. Bridge Deck Saw cut to a minimum depth of 3/4” into the concrete deck. Do not cut existing reinforcing. Remove concrete full depth including the joint and the joint anchors using no greater effort than a 30 lb. pneumatic hammer. Remove existing transverse reinforcing bar. Reincorporate existing longitudinal bar into new construction. Care should be taken to not damage the existing longitudinal bars extending into the new construction or metal angles on top of steel stringer. Blast clean the exposed reinforcement to remove rust and scale and leave saw cut surfaces roughened.

Abutment Backwall Remove the concrete partial depth, the joint including the joint anchors 9” deep. For the top 6” of concrete, use no greater effort than a 30 lb. pneumatic hammer. For the bottom 2” of concrete, use no greater effort than a 15 lb. pneumatic chipping hammer. Care should be taken not to damage the existing vertical bars extending into the new construction. Blast clean the exposed reinforcement to remove rust and scale.

If in the opinion of the engineer, any reinforcing bar that is to remain is damaged due to the contractor’s method of removal, a new bar shall be drilled and grouted in its place at no cost to the government. If in the opinion of the engineer, any reinforcing bars are deteriorated such that they cannot be reused in the new construction, drill and grout new #4 rebar next to deteriorated or damaged bar.

Clean the area by vacuuming or blowing with air that is free of oil and moisture.

b. Install Expansion Joint

1. Provide Watson Bowmen WABO stripseal expansion joint or approved equal and single armor angle at back of abutment. Coordinate with Forest Service Engineering for shop drawing approval prior to ordering expansion joint. Armored expansion joint to be installed per manufacture’s recommendation.

2. Use high strength/early concrete as approved by engineer for abutment headwall reconstruction and full depth deck replacement. Use AASHTO M31, GRADE 60 reinforcing steel for header reconstruction. Provide a full penetration field weld to angle armor near centerline of bridge if necessary.

3. Install expansion joint gland per manufacturer’s recommendations. The gland shall be installed as one (1) piece.

c. Clean abutment bearing seats of all existing and construction debris at Abutment 1 and Abutment 2.

C.10 Asphalt Roadway Approaches

Asphalt pavement shall be placed at both bridge approaches to provide a smooth riding surface to vehicles traveling across the bridge and to eliminate bumps and dips that may have otherwise been created by the joint reconstruction. Both sides of the bridge require a final paved approach surface that is to be 5 feet long by 28 feet wide, with a minimum allowable depth of 4 inches. Perform initial compaction while the mixture is above 250° F. Perform finish rolling with steel-wheel rollers and continue until no roller tracks remain. Final edges of approach asphalt shall be clean, uniform, and compact in appearance and not be raveling after placement.

Pavement roadway edges leading up to bridge shall be constructed at ~30-45 degrees to prevent safety issues caused by sharp pavement edge drop-off. Grade surface according to existing road grade and so that water is directed away from the bridge, preferably towards existing ditch lines.

Asphalt Specified: WSDOT HMA Class ½”- mix with PG 64-22 binder

C.11 Cleaning of Bridge Deck

Broom sweep clean all debris from entire deck and construction areas. Remove all deck and construction debris from project site.

C.12 Cleaning of Deck Drains and Underbridge Drainage Pipe System

Refer to the plan sheets titled “Drainage, Parapet, Guardrail Details” and “Drainage Details” for the locations of all 22 drain openings located on the deck needing to be cleaned along with the 4” steel underbridge drain pipes attached to those drains that run at an angle towards the center of the bridge that need to be cleaned out as well.

An electric drain cleaner, sewer jetter, or combination of such tools shall be used to flush the drainage system clean of debris. Other methods that don’t involve pressurized water, air, or electric “snakes” shall be submitted to and approved by the CO/COR before use.

C.13 Guardrail and Parapet Maintenance

At NW corner of structure (upstream beginning of bridge);

1. Replace one guardrail end section.

2. Replace one treated timber block cut from 8x12x1’-2”.

3. Paint last 3’-0” of metal parapet with paint as specified in FP-03 section 563 & 708. Before painting, prepare surface as specified in section 563.07(b)(2). Match existing color and finish as close as possible and submit sample for approval.

4. Replace two guardrail end sections, one at each end of this rail section.

5. Replace one treated timber block cut from 8x12x1’-2”.

6. Replace one 13’-6” w-beam rail section.

52.242-14 Suspension of Work (APR 1984)

F.2 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

(APR 1984)

The Contractor shall be required to (a) commence work under this contract within 3 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 65 days after issuance of the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.

F.3 Additional timing information and restrictions

Estimated start work date: April 7th, 2014

Allowable timeframe for 7 day road closure and construction window:

May 28th to June 11th

Coordinate closure date information with CO/COR.

F.4 Maximum Workweek – Construction Schedule (AGAR 452.236-75)(NOV 1996)

Within 7 calendar days after receipt of a written request from the Contracting Officer, the Contractor must submit the following information in writing for approval:

(a) A schedule as required by FAR clause 52.236-15, Schedules for Construction Contracts, and

(b) The hours (including the daily starting and stopping times) and days of the week the Contractor proposed to carry out the work.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 Designation of Contracting Officer’s Representative

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer.

Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

G.2 AGAR 452.215-73 Post Award Conference (Nov 1996)

A post award conference with the successful offeror is required. It will be scheduled and held within 5 days after the date of contract award. The conference will be held at the Gifford Pinchot National Forest Headquarters office in Vancouver, WA.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H.1 Landscape Preservation

(a) The Contractor shall confine operations to within the clearing limits or other areas designated in contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Material which falls outside of these limits shall be retrieved, disposed of, or incorporated in the work as directed by the Contracting Officer, and damage to vegetation or structures outside the clearing limits shall be repaired as directed by the Contracting Officer.

(b) Operation shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(c) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged into or near rivers, streams, and impoundments or into natural or manmade channels leading thereto. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live steams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

Mechanized equipment shall not be operated in live streams without written approval by the Contracting Officer.

(d) Prevention of Oil Spills - If the Contractor maintains storage facilities for oil or oil products on Project

Area, appropriate preventive measures shall be taken to insure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual States.

(e) The Contractor shall prepare a Spill Prevention Control and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112).

(f) Minimize disturbance of existing vegetation in ditches and at stream crossings.

(g) Refuel power equipment (or use absorbent pads for immobile equipment) and prepare concrete at a location remote from water bodies (usually at least 100 feet distant) to prevent direct delivery of contaminants into a water body.

H.2 Cleaning Of Equipment

Cleaning of Off-Road Equipment used by the Contractor for contract work shall be conducted outside the boundary of any National Forest Service land prior to moving each piece of equipment onto the project. The Contractor shall notify the Forest Service prior to moving each piece of equipment onto the project. Upon request from the Forest Service, arrangement will be made for Forest Service to inspect each piece of equipment prior to it being placed into service. The Contractor shall use cleaning methods necessary to ensure equipment is free of all attached mud, dirt, and plant parts. If noxious weeds are present at a project site, cleaning may also be required before moving between locations within the same project. These measures will assist to prevent the introduction/spread of the seeds of noxious weeds onto National Forest land. The Contractor shall certify in writing, compliance with the above requirements. "Off-road Equipment" includes all machinery other than log trucks, chip vans, pickup trucks or vehicles used to transport personnel on a daily basis.

H.3 Plan For Weather-Caused Suspensions Of Work

The Contractor shall prepare a plan for weather-caused suspensions of work to ensure preservation of resources affected on the work site or sites. The plans shall be be consistent with the requirements in the LANDSCAPE PRESERVATION clause contained in this contract. The plan shall be submitted in writing to the Contracting Officer for review and, if acceptable, shall be approved not later than 14 days from the day accepted. The plan shall distinguish between short-term shut-downs caused by intermittent weather activity and longer-term shut-downs associated with the advent of winter. If rejected by the Contracting Officer, the Contractor shall revise the plan and re-submit it for consideration within three working days of verbal or written notification by the Contracting Officer. The Contractor shall take action consistent with the plan before suspending activity on the site(s). Acceptance of the plan by the Contracting Officer in no way waives any of the requirements of the LANDSCAPE PRESERVATION clause.

H.4 Use of Premises

(a) Forest Service Regulations for Use of Campground prohibits occupancy of developed recreation sites for other than primarily recreation purposes. One camp unit will be allowed at the project site for use by a watchman.

(b) A storage site will be permitted at a designated site within the project area. The Forest Service assumes no liability for materials stored within the storage site. The Contractor will be allowed to erect a temporary fence to secure materials and equipment, however, the fence shall be removed and the site restored prior to final acceptance of the contract.

(c) When the Contractor's operations require a temporary electrical power distribution system, the system shall comply with the National Electrical Code, applicable local codes and utility regulations. The Contractor shall make all arrangements with the serving utility for temporary power and shall pay the serving utility for all applicable fees and power consumed.

(d) Potable water and sanitary facilities are not available for use during construction.

(e) The Contractor is authorized to use roads that are part of the construction project.

(f) Load Limits - All vehicles and equipment shall not exceed State legal highway loads and widths or posted limits without valid State and Forest Service overload, overwidth permits. Forest Service overload permits for this project may be obtained from the Forest Headquarters Bridge Engineer, located in Vancouver, WA.

I.3 FAR 52.225-9 Buy American Act-Construction Materials (Sep 2010)

(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 (

46 U.S.C. App. 1702), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the

Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means—

(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements the Buy American Act (41 U.S.C. 10a - 10d) by providing a preference for domestic construction material. In accordance with 41 U.S.C. 431, the component test of the Buy American Act is waived for construction material that is a COTS item (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including—

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the

Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American Act applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American Act applies, use of foreign construction material is noncompliant with the Buy American Act.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

I.4 FAR 52.228-13 Alternative Payment Protections (JUL 2000)

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 5 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

I.5 AGAR 452.209-71 Assurance Regarding Felony Conviction Or Tax Delinquent Status For

Corporate Applicants (FEB 2012) (ALTERNATE 1) (FEB 2012)

(a) This award is subject to the provisions contained in sections 433 and 434 of the Consolidated Appropriations Act, 2012 (P.L. No. 112-74), Division E, as amended and/or subsequently enacted regarding corporate felony convictions and corporate federal tax delinquencies. Accordingly, by accepting this award the contractor acknowledges that it –

(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.
