Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price Construction Contracts, shall not be in addition to the contract price. Include bond payments under 151.01 Mobilization.
Payment will be made on actual work performed as described in FP-03 109.01 unless otherwise noted. All units are measured as Actual Quantity unless denoted by an asterisk (*). If denoted by an asteriske, the quantity is measured as a Contract Quantity in accordance with FP-03.
SE CTI O N C – STATEM ENT O F W O R K
C-1 PROJ E CT SCOPE
Lyndon Creek Culvert Replacement: Project consists of replacing an existing culvert with a pipe-arch culvert that includes stream simulation and rebuilding the roadway. Work includes but is not limited to:
temporary traffic control, construction survey and staking of road and pipe-arch, soil erosion and pollution control, structural excavation, placing stream simulation rock, placing riprap, installing pipe-arch, roadway excavation and embankment, waste removal, placing aggregate base and asphalt surfacing. All materials shall be provided by the contractor.
C-2 PROJECT LOCATION
The project can be located as follows: Starting from Waldport Oregon (97394), travel north on Highway 101 1 mile to North Bayview Road. Travel east on Bayview for approximately 5.1 miles to National Forest System Road 5100 (Elkhorn). Turn left onto NFS road 5100 and follow for approximately 1 mile.

The following is an example list of products that may be used in this contract for minor construction for which biobased products are available. The list is not all inclusive. It is desirable that vendors be able to supply the greatest number of biobased products meeting the health and environmental specifications.

SECTION F – DELIVERIES OR PERFORMANCE

The following performance time requirements shall apply to this project:

1 August 6, 2016 45 Days Installation will occur in the summer of 2016. See Clause H-13, Prosecution of Work, for timing restrictions.
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than time listed above. The time stated for completion shall include final cleanup of the premises.
G-9 POST AWARD CONFERENCE (AGAR 452.215-73) (NOV 1996)
A post award conference with the successful offeror is required. It will be scheduled and held within TBD days after the date of contract award. The conference will be held at: the Headquarters of the Siuslaw National Forest, 3200 SW Jefferson Way, Corvallis, OR, or at the district office.
SECTION H - SPECIAL CONTRACT REQUIREMENTS
H-1 PHYSICAL DATA (FAR 52.236-4) (APR 1984)
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
(a) The indications of physical conditions on the Plans and in the Specifications are the result of site investigations by drive probing.
(b) Weather conditions: Waldport, Oregon, 97394
(c) Transportation facilities: NFS road 5100, Single lane with turnouts

Roadway and suitable areas adjacent to the site may be utilized for temporary stockpiling of materials as approved by the CO.

Designated disposal sites for this project are located at the junction of NFS road 5100 and 5147.
H-13 PROSECUTION OF WORK
(a) For the protection of natural resources, daily time restrictions will apply. Work will be conducted only during the time frames listed below:
Perform all in-stream work during the in-water work period from August 6th to September 30th, unless other time periods are agreed upon by the Oregon Department of Fish and Wildlife and the Contracting Officer. Perform all other work between August 6th to October 1st. If protection measures prove inadequate, if other such areas are discovered, or if new species are listed as Federally threatened or endangered or as sensitive by the Regional Forester, Forest Service may either cancel or unilaterally modify this contract to provide additional protection regardless of when such facts become known.
Discovery of such areas by either party shall be promptly reported to the other party.
(b) Construction activity shall be limited to two hours after sunrise to two hours before sunset from August 6th to September 15th, Monday through Friday, unless other hours are approved in writing by the Contracting Officer. Other than closing the roads at the reconstruction site, the Contractor shall conduct activities so that interference with the public shall be kept at a minimum. Any activities requiring other closures to the public shall be scheduled with the COR at least 10 days in advance.
(c) The Contractor shall use measures and precautions necessary to warn and protect the public and
Government personnel during work at the project site. Such actions include, but are not limited to, furnishing and maintaining barricades and signs around the work site and roping off the area.
(d) Blasting is prohibited. The Contractor shall use mechanical equipment to excavate bedrock or non explosive means that will fracture rock, be non-toxic, and are approved in writing by the COR.
H-22 SPECIAL CONTRACT REQUIREMENTS FOR THE WILLAMETTE AND SIUSLAW
NATIONAL FOREST PROJECTS AND SALEM AND EUGENE BLM PROJECTS

(a) The Contractor is authorized to use roads that are listed as access to this project.

If the Contractor requests use of a National Forest road or segment not designated for use, the Forest Service may authorize such use if not in conflict with the current Road Rules Document. Authorization to use such additional roads may include maintenance requirements and use limitations.
The roads authorized for use are subject to the following provisions:
1. The Road Rules in the current Siuslaw, Willamette, Mt. Hood, Deschutes and Umpqua National Forest Road Rules Document are applicable to all commercial road users. These documents titles

(Willamette National Forest), MT. HOOD NATIONAL FOREST ROAD RULES POLICY, DESCHUTES NATIONAL FOREST COMMERCIAL ROAD RULES, and COMMERCIAL ROAD RULES (Umpqua National Forest) are available for inspection at the Willamette and Siuslaw National Forest Supervisor's Offices.
2. State laws governing traffic rules and equipment requirements on State and County highways.
3. Federal Regulations contained in 36 CFR 261.12. These regulations prohibit use of vehicles or equipment in excess of State legal highway loads or posted limits without valid State or Forest Service overload permits, damaging a road while using it, and blocking a road open to use by others, except as may otherwise be provided in the contract.
4. Federal Regulations contained in 36 CFR 261.54 as applied to the area by an order issued under 36 CFR 261.50. These regulations authorized the Forest Service as a sovereign act, to issue additional restrictions and closures any time conditions warrant. Such closures will be in addition to those shown in the current Road Rules Document and will be posted on the road.
5. Unless otherwise provided, the Government will not snowplow roads for the Contractor's use. The Contractor may snowplow any road designated for its use, unless snowplowing of the road is prohibited below or in the Road Rules Document. On roads where snowplowing is authorized, a permit defining snowplowing requirements is required. The Contractor will be responsible for repair of any damage to the road structure caused by the snow removal operations. Vehicles, other than conventional over-the-snow vehicles (snowmobiles), will not be permitted to use roads when there is an average uncompacted depth of more than 4 inches of snow unless the road has been snowplowed.
The Contractor shall erect warning signs in advance to any place on the project where operations may interfere with the use of the road or trail by traffic and at all intermediate points, where the project crosses or coincides with an existing road or trail.

SECTIO N M – E VAL UAT I O N FAC T O R S FO R AW AR D
M-2 EVALUATION OF QUOTES
The Government will evaluate quotes based on the best overall value to the Government, price and other factors considered. Factors to be considered include:
• FACTOR 1: NON PRICE EVALUATION CRITERIA
o Contractor's capability based on Questionnaire responses
• FACTOR 2: PRICE
Evaluation of Price Proposals: No weight will be applied to price. Price is approximately equal in importance to the non price evaluation factors. As the difference between technical scoring decreases, price will increase in relative importance.
The Government may reject any or all quotes, make award to other than the lowest offeror and waive minor informalities or irregularities in quotes received. If necessary, the Government may conduct discussions with any quoter.
The Government may award a task order on the basis of quotes as received, without entering into discussions with any quoter. Therefore, each initial quote should contain the quoter's best terms.
Questionnair e
Technical Capability and Past Performance History are of equal importance. After these first two items, items are in descending order of importance.
1. Technical Capability:
a. Explain how your company will proceed from dewatering and construction of the proposed streambed to the point of reintroducing water to the streambed. Include references to plans and specifications, the specific materials source you plan to use, and the advantages to the Government of the proposed source. You can include a description of the work you plan to subcontract out.
b. Include a list of equipment you will provide to complete the work (owned or rented).
c. Identify key project managers by name and provide their experience with relevant construction projects.
2. Past Per for mance Histor y:
Provide a listing of your work for the past three years which is most closely related to this type of construction. Include the dates of performance, who you worked for, the name of their contact person and their phone number.
3. Pr oject Schedule:
Provide your expected schedule including sequence of work items and approximate time to complete each item.
4. BioPreferred Items:
The Contractor shall submit with a complete list of biobased products, indicating the name of the manufacturer, cost of each material, and the intended use of each of the materials that are to be used in carrying out the requirements of the task order.
