52.212-2 – Evaluation – Commercial Items

(a) The Government will award a contract resulting from this solicitation to the responsible quoter shose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

Price

Relevant Past Performance

Technical Approach and Work Plan

Knowledge of Southeastern Oregon Archaeology

Price

The quoter’s Price quote shall consist of the individual items and the total price as quoted in the Schedule of

Items.

Relevant Past Performance

Quoters shall submit past performance information for their firm and any proposed major subcontractors performing more than 20% of the work. Performance information may be obtained from references provided.

The quoter shall provide information for any relevant project completed during the past three years and all contracts and subcontracts in progress. The list should include, but is not limited to, contracts and subcontracts similar in nature and complexity to that required by this solicitation. Include contracts with the

Federal Government, agencies of state, and local governments, and commercial customers. Quoters that are newly formed entities, without prior contracts as an entity, should list contracts and subcontracts completed by all key personnel deemed vital to successful performance.

Each quoter will be evaluated on their performance under existing and prior contracts of a similar nature. Performance information will be used as an evaluation factor against which quoters' relative rankings will be compared to assure best value to the Government. The Government will focus on information that demonstrates quality of performance relative to the size and complexity of the procurement under consideration. The Government may contact references beyond those identified by the quoter to obtain additional information for use in both the responsibility determination and in further evaluation of the quoters's past performance.

Note: If the quoter does not provide past performance information, or specifically indicate a lack of past performance, the Contracting Officer need not give further consideration to the quote.

Technical Approach and Work Plan

Work Approach

The work plan should be in as much detail as the quoter considers necessary to fully explain the proposed work approach or method and should reflect a clear understanding of the nature of the work being undertaken. Quotes merely offering to conduct a program in accordance with the requirements of the Government’s statement of work will not be eligible for award. Provide a general project information narrative that specifically includes the following information:

an appropriate safety plan, quality assurance plan, statement of how the work will be performed, a listing, along with the qualifications, of the personnel (including any sub-contractors) who will be working on the project (see #19 Personnel Qualifications on page 22), and a work schedule.

Knowledge of Southeastern Oregon Archaeology

Brief description of knowledge.

The Government may, issue orders to other than the lowest quote, waive minor informalities or irregularities in quotes received, or elect to not award at all. If necessary, the Government may conduct discussions with any or all quoters. The Government may issue an order on the basis of quotes as received, without entering into discussions with any quoters. Therefore, each initial quote should contain the quoter's best terms.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an quote is unacceptable if the option prices are significantly unbalanced Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an quote, mailed, or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter’s specified expriation time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before the award.

On a separate document, address the evaluation criteria above and include your response with the

Contractor Packet to Return.

Relevant past performance, technical approach and work plan, and knowledge of southeastern

Oregon archaeology, when combined, are more important than price.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter’s specified expiration time, the

Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
