This solicitation is issued under the provisions of the AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009.

Provide all labor, materials, supplies to complete trail rehabilitation per specifications contained in this contract.

SECTION C - DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

Upper Silvis Lake Trail Reconstruction

Ketchikan Ranger District, Tongass National Forest

Ketchikan, Alaska

C.1 PROJECT DESCRIPTION AND LOCATION

(a) Description: The work is to reconstruct the Upper Silvis Lake Trail. The major work items include stone pitching, stone steps, full bench trail construction, blasting, aggregate surfacing, and laborer work. Substantial portions of the existing trail will be abandoned and the relocated to a new alignment that follows a more gentle grade. The work will be marked on the ground as follows:

1). The Forest Service will stake the trail centerline by August 15, 2010.

2). The contractor will clear and grub the centerline to expose subsurface conditions.

3). The Forest Service will stake trail work areas defining type of work along the centerline as it is grubbed by the contractor and provide a trail log that will be incorporated into this contract.

4). The contractor will complete the work according to the staking, trail log and other contract provisions.

(b) Location and Facilities: The project is located at Upper Silvis Lake, located 16 miles by road and 5.5 air miles northeast of downtown Ketchikan, Alaska. Ketchikan is located on Revillagedo Island, and is accessible by scheduled airline service, boat, barge, and the Alaska Marine Highway system.

The work area is within a .5 mile radius around 55deg. 22.923’N, 131deg. 31.831’W. at an elevation between 1,000’ and 2,200’.

The Silvis Lake Access Road and the land around Upper and Lower Silvis Lakes are managed by the Ketchikan Public Utilities (KPU). See Section H for requirements regarding operations on these lands.

(c) Price Range: Between $250,000 and $500,000.

(d) Pre-bid Tour: A pre-bid tour will be arranged by request.

(e) Period of Performance: See Part I, Section F, Clause 52.212-3.

(f) Government-Furnished Property: (For details see also Section H, Government Furnished Materials):

1). Stone for the contractor’s use in the construction of the various log structures.

2). 300 ea. one-half cubic yard capacity woven bags for moving materials.

901.01 Terms, Organizations, and Standards

(a) Specification Terms. These specifications are generally written in the imperative mood. In sentences using the imperative mood, the subject “the Contractor,” is implied. Also implied in this language is “shall,” “shall be,” or similar words or phrases. In material specifications, the subject may also be the supplier, fabricator, or manufacturer supplying material, products, or equipment for use on the project. Wherever “directed,” “required,” “prescribed,” or similar words are used, the “direction,” “requirement,” or “order” of the CO is intended. Similarly, wherever “approved”, “acceptable”,” suitable”, “satisfactory”, or similar words are used, they mean “approved by,” “acceptable to,” or “satisfactory to” the CO. Section 902—Definitionstc \l1 "Section 902—Definitions When the following terms, or pronouns in place of them, are used in these specifications or in other contract documents, the intent and meaning are as follows:

Base Course. The layer or layers of specified material of designed thickness placed on a trailbed to support surfacing.

Batter. A backward and upward slope of the face of a wall.

Berm. The ridge of material formed on the outer edge of the trail that projects higher than the tread.

Borrow. Suitable materials taken from approved sources designated on the drawings or on the ground, to be used for embankments and backfilling.

Bridge. A structure, including supports, erected over a depression or stream, and having a deck to carry traffic.

Catch Point. The outer limits of a trailway where the excavation and/or embankment intersect with the ground line.

Clearing Limit. The area over and beside the trail that is cleared of trees, limbs, and other obstructions.

Compacted. Consolidation that is obtained by tamping or rolling suitable material until no noticeable displacement of material is observed.

Contracting Officer (CO). An official of the Government with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the CO acting within the limits of their authority as delegated by the CO.

Danger Tree. An unstable tree 5 inches or greater in diameter at breast height that is likely to fall across the trail.

Designated on the Ground. The location of materials, work areas, and construction items, including lines and grades, marked on the ground with stakes, flagging, tags, or paint.

Drawings. Documents showing details for construction of a facility, including but not limited to straight-line diagrams, trail logs, standard drawings, construction logs, plan and profile sheets, cross-sections, diagrams, layouts, schematics, descriptive literature, and similar materials.

Duff. Organic material overlying rock or mineral soil.

Embankment. A structure of suitable material placed on the prepared ground surface and constructed to the trailbed elevation.

Excess Excavation. Material in the trailway in excess of that needed for construction of designed trailways.

Ford. A water-level stream crossing constructed to provide a level surface for safe traffic passage.

Full Bench. Trailbed constructed entirely on undisturbed material.

Grade. The vertical distance of ascent or descent of the trail expressed as a percentage of the horizontal distance.

Header Rock. Rock laid with the narrow end towards the face of the wall.

Inslope. Where the trail tread is sloped downward toward the backslope.

Mineral Soil. Soil or aggregate that is free from organic substances and contains no particles larger than 2 inches at their greatest dimension.

Outslope. Where the trail tread is sloped downward toward the embankment or daylight side of the trailway.

Sideslope. The natural slope of the ground, usually expressed as a percentage.

Slough. That material from the backslope or the area of the backslope that has raveled onto the trailbed.

Slump. Where the trailbed material has moved downward, causing a dip in the trail grade.

Special Project Specification. Specifications that detail the conditions and requirements peculiar to an individual project, including additions and revisions to the standard specifications.

Surfacing. Material placed on top of the trailbed that provides the desired tread.

Suitable Material. Rock that can be accommodated in the trail structure, and soil free of duff with a recognizable granular texture.

Switchback. A reverse in direction of trail grade with a level landing used to change elevation on a steep slope, usually involving special treatment of the approaches, barriers, and drainages.

Trailbed. The finished surface on which base course or surfacing may be constructed. For trails without surfacing the trailbed is the tread.

Trailway. The portion of the trail within the limits of the excavation and embankment.

Tread. The surface portion of the trail upon which traffic moves.

Turnout. A short section of extra trail width to provide for passage of trail users.

Waterbar. A structure used for turning water off the trail, usually made of logs or stones.

Water Courses. Any natural or constructed channel where water naturally flows or will collect and flow during spring runoff, rainstorms, etc.

Section 903—Intent of Contracttc \l1 "Section 903—Intent of Contract

903.01 Intent. The intent is to provide for the completion of the work described in the contract. Furnish all labor, materials, equipment, tools, transportation, utilities, and supplies, and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract.

Section 904—Maintenance for Traffic

904.01 General. Before any suspension of work, take precautions necessary to prevent damage to the project, such as temporary detours, approaches, crossings, or intersections, and make provisions for normal drainage and to minimize erosion.

During helicopter operations, blasting, or at other times when hazards are present, provide professional appearing trail closure sign at the gate at Tongass Highway, and provide other signs as needed. Provide verbal warnings to the public that the trail and the staging area are closed.

905.01 Handling Materials. Transport and handle all materials to preserve their quality and fitness for the work. Stockpile, load, and transport aggregates in a manner that will preserve specified gradation and avoid contamination.

Store materials to assure the preservation of their quality and fitness for the work. Locate stored materials to facilitate their prompt inspection. Arrangements for storage on other than designated sites are the responsibility of the contractor.

Section 906—Measurement and Payment tc \l1 "Section 906—Measurement and Payment

906.01 General. Measurement and payment for contract work will be made only for and under those pay items included in the SCHEDULE OF ITEMS. All other work and materials will be considered incidental and included in the payment of the PAY ITEMS in the SCHEDULE OF ITEMS.

When more than one class, size, or thickness is specified in the SCHEDULE OF ITEMS for any PAY ITEM, suffixes will be added to the item number to differentiate between the items.

906.02 Determination of Quantities. The following measurements and calculations are to be used to determine contract quantities for payment:

Measure Aggregate Surfacing, Base Course, Aggregate Surfacing with Ditch (ASD), in linear feet measured along the centerline and parallel to the specified grade.

Measure Stone Riser Steps (SRS), Stone Open Drain (SOD) as each. Note that the Aggregate Surfacing D-1 material used in the construction of these items will be incidental to these items and no additional payment will be made.

Measure Stone Pitching (SP) in linear feet measured along the centerline and parallel to the specified grade. Note that the Aggregate Surfacing D-1 material used in the construction of this item will be incidental to these items and no additional payment will be made.

Measure Laborer Work, as hours, Each. One hour is one unit.

Measure Aggregate Surfacing Spread on Trail as cubic yard.

Manufacturer’s tolerances will be accepted unless controlled by tolerances in the cited specifications.

906.03 Units of Measurement. Payment will be made by units defined and determined according to standard measure and by the following:

(a) Cubic Yard (CY). Measurement by calculating volume in helicopter sling bags or other approved method.

(b) Each (EA). One complete unit, which may consist of one or more parts.

(c) Lump Sum (LSQ). The quantities that denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job.

(d) Linear Feet (LF). Measurement in feet taken along the centerline of the trail and parallel to the finished grade.

906.04 Methods of Measurement. One of the following methods of measurement for determining final payment is DESIGNATED ON THE SCHEDULE OF ITEMS for each PAY ITEM:

(a) Designed Quantities. These quantities denote the final number of units to be paid for under the terms of the contract. They are based upon the original design data available prior to advertising the project. Original design data include the preliminary survey information, design assumptions, calculations, and drawings. Changes in the number of units DESIGNATED IN THE SCHEDULE OF ITEMS may be authorized under the following conditions:

(1) As a result of changes in the work approved by the CO.

(2) As a result of the CO determining that errors exist in the original design that cause a PAY ITEM quantity to change by 15 percent or more.

(3) As a result of the contractor submitting to the CO a written request showing evidence of errors in the original design that cause a PAY ITEM quantity to change by 15 percent or more. The evidence must be verifiable and consist of calculations, drawings, or other data that show how the designed quantity is believed to be in error.

(b) Actual Quantities (AQ). These quantities are determined from measurement of completed work or certified receipts.

(c) Lump Sum Quantities (LSQ). These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job.

(d) Vehicle Quantities (VQ). These quantities are measured or weighed in hauling vehicles. Aggregate woven bags are considered hauling vehicles.

907.01 Work. Work consists of providing certification that the quality and quantity of construction conform to the drawings, specifications, and requirements of the contract.

907.02 Certification and Measurements

(a) Offsite-Produced Materials. Furnish signed certificates executed by the manufacturer, supplier, or vendor, stipulating that all offsite-produced materials incorporated in the work meet applicable requirements SHOWN ON THE DRAWINGS or stated in the specifications. Furnish a certificate for each commodity or invoice.

(b) Quantity Measurements. Submit quantities to the CO for periodic progress payments, and the CO will compute payments. Quantities are subject to verification.

Measurement

907.03 Method. There will be no separate measurement for this item.

Payment

907.04 Basis. Payment will be considered incidental to other pay items in this contract.

Section 911—Clearing and Grubbingtc \l1 "Section 911—Clearing and Grubbing

Description

911.01 Work. Work consists of clearing, grubbing, trimming, removing, and treating trees, logs, limbs, branches, brush, plants, and other vegetation within the clearing limits. Also included are the protection from injury or defacement of trees and other objects not designated for removal and the treatment of damaged trees.

911.02 Clearing Limits. Clear brush to the dimensions 36 inches each side of the trail centerline. Clear trees designated to be removed within 36” of trail centerline.

911.03 Material to Be Cleared. Remove and dispose of trees, logs, limbs, branches, brush, herbaceous plants, and other vegetation within the clearing limits, except for live brush, herbaceous plants, and trees between the trailway and clearing limits that are less than 12 inches in height and less than ½ inch diameter at ground line.

Except as provided above, cut all limbs and branches within 7 feet of the ground and more than 1/2 inch in diameter that extend into the clearing limits. Cut tree limbs flush with the outside of the branch collar and cut brush at the ground surface.

911.04 Damaged Trees. When felling, cutting, trimming, or using trees as anchors, protect tree bark in such a way so damage does not occur. Remove and dispose of trees with major roots exposed by construction that are rendered unstable.

911.05 Disposal of Clearing Slash, Logs, Stumps, Brush, and Roots. Limb all felled trees to a 4 inch diameter top, including designated trees outside the clearing limits.

Consolidate all products of clearing and grubbing in approved locations outside the clearing limits and out of sight of the trail.

Do not place clearing and grubbing debris in water courses, snow ponds, lakes, meadows, or in locations where it could impede the flows to, through, or from drainage structures.

Measurement

911.06 Method. There will be no separate measurement for this item.

Payment

911.07 Basis. Clearing and Grubbing will be considered incidental to the pay item under which the work is being done, and additional payment will not be made.

Section 912—Excavation and Embankmenttc \l1 "Section 912—Excavation and Embankment

Description

912.01 Work. Work consists of the excavation and placement of excavated material, regardless of its nature, from within the trailway or from other sources, except for material included under other pay items SHOWN IN THE SCHEDULE OF ITEMS.

Includes excavation, embankment, and backfill construction required to shape and finish the trailbed, ditches, backslopes, and fill slopes.

Construction

912.02 Use and Disposal of Excavated Material.

Conserve and use soil and herbaceous vegetation and moss removed during excavation to revegetate excavated areas to provide a neat appearance and to control erosion. For soil placed on slope shoulders for Types AS and ASB, use soil that is free of debris larger that 2” in any dimension.

Place excess and unsuitable excavation beyond the downslope edge of the trailbed, except in locations where the material would be placed within 5’ of a stream or in staked locations where it is desirable not to impact the native vegetation; in these locations place in approved locations. Do not obstruct drainage and spread to a depth not exceeding 4 inches. This includes any material removed in the grubbing operation and deposited in the same area.

Place rocks over 4 inches in greatest dimension not used in construction beyond the hinge point on the downslope side. Place rocks so that the tops are at least 6 inches lower than the trailbed surface. Ensure that no blockage of drainage or creation of a windrow effect occurs.

912.03 Trailbed Preparation. Remove soil to the depth required to accommodate the aggregate surfacing, bedding and base course and provide the finished grades specified on the drawings. Retain roots over 2” diameter except where approved for removal.

912.04 Trailbed Approval. Obtain approval of trailbed prior to placing corduroy, geotextile, aggregate surfacing, stone riser steps, or stone pitching.

912.05 Cut and Fill Slopes. Construct trail so cut and fill slopes are less steep than the angle of repose. Trim exposed roots flush with the finished cut slope.

Measurement

912.06 Method. There will be no separate measurement for this item.

Payment

912.07 Basis. Excavation and embankment will be considered incidental to the pay item under which the work is being done, and additional payment will not be made.

Section 930—Blasting

Description

930.01 Work. Work consists of the fracturing rock and constructing stable final rock cut faces and trail surface using controlled blasting techniques. Controlled blasting uses explosives to form a shear plane in the rock along a specified backslope. Controlled blasting includes presplitting and cushion blasting. The work also includes mucking out the blasted area to provide a finished trail surface and backwall.

Construction

930.02 Regulations. Furnish copies or other proof of all-applicable permits and licenses. Comply with Federal, State, and local regulations on the purchase, transportation, storage, and use of explosive material. Federal regulations include the following:

a). Safety and health: OSHA,29 CFR Part 1926, Subpart U.

b). Storage, security, and accountability: Bureau of Alcohol, Tobacco, and Firearms (BATF), 27 CFR Part 181.

c). Shipment: DOT, 49 CFR Parts 171-179, 390-397

930.03 Blaster-in-Charge. Designate in writing a blaster-in-charge. Submit evidence that the blaster-in-charge has a valid State blaster’s license or other license accepted by the State where the project is located and issued by an equivalent licensing body for the type of blasting required.

930.04 Blasting Plans. Blasting plans are for quality control and record keeping purposes and are to be signed by the blaster-in-charge. The review and acceptance of blasting plans does not relieve the Contractor of the responsibility for using existing drilling and blasting technology, and for obtaining the required results.

Do not deliver explosives to the project until the general blasting plan is accepted.

a). General blasting plan. Submit a general blasting plan for acceptance at least 14 days before drilling operations begin. Include, as a minimum, the following safety and procedural details:

1). Working procedures, and safety precautions for storing, transporting, handling, and detonating explosives.

2). Proposed product election for both dry and wet holes. Furnish Manufacturer’s Material data Sheets for all explosives, primers, initiators, and other blasting devices.

3). Typical plan and section views for both production and controlled blasting, including maximum length of the shot, burden, hole spacing, hole inclination, hole depth, hole diameter, subdrill depth, and powder factor.

4). Proposed initiation and delay methods and delay times.

930.05 Blasting. Drill and blast according to the blasting plan.

Cap all holes to prevent unwanted backfill. Place a stake next to each hole with hole number and total depth drilled.

Use the types of explosives and blasting accessories necessary to obtain the required results. A bottom charge may be larger than the line charges if no overbreak results.

Free blast holes of obstructions for their entire depth. Place charges without caving the blast hole walls. Stem the upper portion of all blast holes with dry sand or other suitable granular material. Do not stem hole with drill cuttings.

Following a blast, stop work in the entire blast area, and check for misfires before allowing worker to return to excavate the rock.

Remove or stabilize all cut face rock that is loose, hanging, or potentially dangerous. Scale by hand or machine methods as approved by the CO. Leave minor irregularities or surface variations in place if they do not create a hazard. Drill the next lift only after the cleanup work and stabilization work is complete.

If blasting operations cause fracturing of the final rock face, repair or stabilize it in an approved matter at no cost to the Government. Repair or stabilization may include removal, rock bolting, rock dowels, or other stabilization techniques.

Halt blasting operations when any of the following occur and perform additional test blast:

1). Slopes are unstable;

2). Slopes exceed tolerances or overhangs are created;

3). Backslope damage occurs;

4). Safety of the public is jeopardized;

5). Property or natural features are endangered;

6). Fly rock is generated; or

7). Excessive ground or airblast vibrations occur in an area where damage to buildings, structures, or utilities is possible.

930.06 Finish. Treat trail surface to provide a free draining outslope of 2% min, 5% max. Break out rock extending more than 2” above general grade of walking surface. Where trail crosses perennial or intermittent water drainages provide dip to channel water cleanly across the trail.

930.07 Basis. Pay for the accepted quantities in accordance with Section 906 at the contract unit price of each PAY ITEM SHOWN IN THE SCHEDULE OF ITEMS.

Section 941—Aggregate and Stone Construction Description

941.01 Work. This work consists of preparing the trailbed and furnishing, hauling, and placing Aggregate Surfacing (Type AS), Aggregate Surfacing with Base Course (ASB), Aggregate Surfacing with Ditch (ASD), Stone Pitching (Type SP), Stone Open Drain (SOD), Stone Rest Area, Stone Retaining Wall (SRW) and Stone Riser Step (SRS).

Materials

941.02 Handling Materials. Stockpile, remove, transport, and spread aggregates in a manner that will preserve specified gradation and avoid contamination.

941.03 Aggregate Surfacing. Provide aggregate surfacing meeting the specification D-1 per Alaska Department of Transportation and Public Utilities, “Standard Specifications for Highway Construction, 1998”, Section 703.

941.04 Base Course. Provide 2” min. stone from native or offsite sources.

941.05 Seed-Free Aggregate. Provide aggregate materials that are free of viable seeds. Ensure that contamination by seeds does not occur from equipment and tools used to handle aggregate or construct trail. Thoroughly wash all equipment and tools that come into contact with aggregate or are used at the work site, to remove all soil, debris, and other material that could contain seed. Use only aggregate from an active stockpile that is located in a seed-free zone. Provide notification one week before moving material from the stockpile and allow inspection.

941.06 Approval for Aggregates. Provide a sample of D-1 crushed aggregate at the source facility for approval prior to moving to project site.

941.07 Required Stone Sizes and Shapes. Hand select native stones to provide the general shape and dimensions shown on the drawings. Stones are to be sound and durable. If shot rock is used, rusticate the edges to provide a weathered appearance.

Select stone that meets the following size and shape requirements:

Stone Riser Step (SRS)

· 2.5 cubic feet minimum volume

· Construct steps primarily from single stones, however two stones may be used if fit tightly together and are 1.5 cubic foot min. size.

· A shape suitable for constructing a stable step

· A generally flat top surface suitable for a 8” min. width step tread Stone Pitching (SP) surfacing

· .3 cubic foot minimum volume

· 4” min. thickness over at least 2/3 of the stone’s area

· A generally flat top surface that is suitable for a walking surface

Stone Pitching (SP) Steps

· 1.5 cubic foot minimum volume, unless approved by CO. Construct steps primarily from single stones, however two stones may be used if fit tightly together and are .75 cubic foot min. size.

· A shape suitable for constructing a stable step

· A generally flat top surface suitable for a 6” min. width stair tread

Construction

941.08 Trailbed Preparation and Approval. See Specification 912.03.

941.09 Base Course. Install base course where staked. Base course is in addition to aggregate surfacing

941.10 Handling of Aggregate. Do not place aggregate directly on the ground outside of the trailway without a tarp or some other means of separation.

941.11 Compaction and Finished Grading. For Aggregate Surfacing (AS) and Base Course, compact firmly by hand. Following final spreading, smoothing and compaction, correct any irregularities or depressions that develop by adding or removing material until the surface is smooth and uniform.

941.12 Acceptance, Testing, Sampling, and Tolerances. Provide the minimum compacted thickness of aggregate surfacing shown on the drawings. If excess aggregate has been delivered to the work area it may be stockpiled in approved locations or spread evenly over the trail; the method to be approved and at no cost to the Government.

941.13 Representative Sample. Prepare a 10’ representative sample of Stone Pitching (SP) and two Stone Riser Steps (SRS) at an approved location that will serve as a standard of workmanship and materials for other work on the project. Obtain review of the representative sample, correct any deficiencies, and obtain final approval before proceeding with any other Stone Pitching. When accepted, the sample will be incorporated into the work.

941.14 Additional Aggregate Surfacing on Trail. Provide, spread, and compact aggregate surfacing where staked. Quantities will be designated in ½ cubic yard min. increments.

Measurement

941.15 Method. Measure the quantities in accordance with Section 906.

Payment

941.16 Basis. Pay for the accepted quantities in accordance with Section 906 at the contract unit price of each PAY ITEM SHOWN IN THE SCHEDULE OF ITEMS. The Aggregate Surfacing used in the construction of all trail types other than Aggregate Surfacing (AS) will be incidental to those items and no additional payment will be made.

Section 949—Development of Material Sourcestc \l1 "Section 951—Mobilization Description

949.01 Work. This work includes activities related to the development of stone material sources.

Materials

949.02 Locations of Material Sources. Provide stone from approved native sources in the vicinity of the project or approved offsite sources. If shot-rock is proposed for use, obtain approval of the material at the source before hauling to the project site. The area around Upper Silvis Lake has substantial quantity of stone on the shoreline when water levels are not too high, and there is native stone available at various locations on talus slopes on the mountain slopes around the trail. Do not use stone from the immediate vicinity of the dam outflow structures.

Construction

949.03 Approval. Obtain approval for all material sources prior to development. Approval will be granted on the basis of issues such as the quality of material, proximity to streams, suitability for restoration, visibility from the trail, etc. Expose the proposed material source locations for review and obtain approval prior to development.

949.04 Restoration. Upon completion of stone collection from native sources, submit a rehabilitation plan for approval for material sources and access trails to return the site to a natural appearing condition and to restore natural drainage patterns and appearance. Obtain approval for all restoration work.

Payment

949.05 The contractor is responsible for determining the locations, haul distances, and qualities. No additional payment will be made if identified potential sources do not yield material meeting the required specifications.

Section 951—Mobilizationtc \l1 "Section 951—Mobilization Description

951.01 Work. This work consists of moving personnel, equipment, material and incidentals to the project and performing all work necessary before beginning work at the project site. Mobilization includes the costs associated with obtaining permits, insurance, and bonds. Mobilization is not intended to pay for the costs of materials before they are used on the project site.

Payment

951.02 Basis. Pay for the accepted work at the contract unit price for the PAY ITEM SHOWN IN THE SCHEDULE OF ITEMS.

Make progress payments for mobilization as follows:

(a) Reimburse for bond premiums before issuing the Notice to Proceed if evidence of payment is received.

(b) When 5 percent or more of the original contract amount is earned from other PAY ITEMS, pay mobilization at the rate of 50 percent, or up to 5 percent of the original contract amount, whichever is less.

(c) When 10 percent or more of the original contract amount is earned from other PAY ITEMS, pay mobilization at the rate of 100 percent, or up to 10 percent of the original contract amount, whichever is less.

(d) Pay any unpaid amount for mobilization upon final acceptance of all work items.

52.242-14 Suspension of Work (APR 1984)

F.2 FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984) The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 400 calendar days after the date the contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 Administrative Officers.

(a) CONTRACTING OFFICER’S REPRESENTATIVE. The Contracting Officer will designate a representative, hereinafter referred to as the Contracting Officer’s Representative (COR) or, alternatively, as the Engineer, who will provide on-the-ground administration for the Government. The COR will be designated in writing and a copy of the designation will be furnished to the Contractor before or at the pre-work conference. The Contractor is cautioned to read the COR designation because certain authority under the contract is reserved solely for the Contracting Officer. The term “Contracting Officer” as used throughout the contract shall be interpreted to include the Contracting Officer’s designated representative(s) acting within the limits of their delegation of authority.

(b) CONTRACTOR’S REPRESENTATIVE. Any representative of the Contractor shall be designated in writing. The designation shall clearly indicate the name and limitations of authority, if any, of the representative.

G.2 Administrative Requirements

(a) ARRA Reporting Requirements – by signing this contract the contractor agrees to quarterly reporting requirements as stated in the ARRA clauses in Section I and via the reporting website. Data required for reporting will be provided with the award letter. Should the contractor have difficulty with reporting or have questions the EROC Contracting Office should be consulted for help.

(b) All invoices should be provided to the COR designated in this contract with a copy provided to the EROC Contracting Office. The Forest where this work is performed will NOT be processing payments for this procurement.

H.2 Landscape Preservation

a) No foot traffic or movement of materials or equipment is allowed over uncompleted and unprotected portions of the trail. Workers shall walk away from the trail centerline, dispersing their travel route, to avoid walking on uncompleted portions of the trail. Rehabilitate and revegetate sites where damaged has occurred to vegetation.

b). Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams and rivers.

Pollutants such as raw sewage and other harmful materials shall not be discharged into or near streams and rivers or into natural or manmade channels leading thereto.

Waste motor oil, fuel, lubricant, bitumen and similar hydrocarbons shall be collected and returned to the supplier. They shall not be wasted on the ground or buried.

H.3 Use of Premises a). Before any camp, storage area, or access is opened or operated on National Forest land, written permission shall be obtained through the Contracting Officer. A camp includes the campsite of any employee working for the Contractor. Such permission, if granted, will be without charge to the Contractor. The Contractor will follow all rules and regulations specific to the use of the National Forest.

Campsite occupancy will be permitted for duration of work plus 14 days mobilization and 7 days cleanup time, as approved.

b). The area may be frequented by bears, which may become habituated to humans and may be attracted by activity and food. In the campsite, store food in a bear-proof container or hang at least 12 feet above ground. Avoid leaving any food scraps at any time in camp or on the trail.

c). Sanitation Facilities: Unless provided otherwise, the Contractor shall provide and maintain the following facilities:

1. Potable water supplies for drinking, washing, and cooking shall meet the State of Alaska drinking water regulations 18 AAC 80. Drinking water may not be available at the camp location.

2. Domestic sewerage shall meet the State of Alaska wastewater disposal regulations 18 AAC 72.

3. Solid waste shall be removed and disposed of in Ketchikan or other approved location.

4.

Fuel storage shall meet the requirements of 40 CFR 112 (Oil Pollution Prevention).

d). Transportation, Access and Equipment: Do not allow helicopter flights directly over the persons on the ground at any location.

e). Provide a plan for camp development, occupation and clean-up prior and obtain approval prior to any camp development activities. The plan should contain the following information:

1.

Layout and location of the proposed camp.

2.

Number of users and dates of occupancy.

3.

Sewage and waste disposal systems.

4.

Layout of cooking, sleeping and common areas.

5.

Camp trails layout.

6.

Equipment and fuel storage area and Spill Prevention Control and Countermeasure (SPCC) plan.

7.

Fire prevention and control plan.

8.

Site Restoration plan.

9.

Helicopter operations plan.

10.

Mobilization and boating plan.

The Government shall review the Contractor's plan as submitted for completeness and applicability. Proposed modifications of Contractor's plans will be discussed with the Contractor prior to approval.

f). There are no known eagle nest trees in the vicinity of the project area, but if such trees are discovered no disturbance will be allowed within 330 feet of the trees and additional mitigation measures may be applied.
