AWARD OF OPTIONAL ITEMS: The Government reserves the right to award the optional items shown above at any time prior to July 1, 2009. The optional items for each given schedule will be awarded on an all-or-nothing basis contingent upon securing the necessary funding.

B-2 – BOND PREMIUMS Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price Construction Contracts, shall not be in addition to the contract price.

B-3 - BASIS OF AWARD The Government anticipates making one award on the basis of the past performance of the firm, Stream Restoration Specialist and significant subcontractors; experience and qualifications of the firm, project supervisor, Stream Restoration Specialist, lead employees, and significant subcontractors; production schedule (work plan); and price. Technical and price proposals are required for evaluation of offers. See Sections L and M for proposal instructions and evaluation/award information. Commitments made in proposals will become part of the requirements of the awarded contract. You may use the following form as your technical proposal.

B-4 - IDAHO USE TAX - Under clause 52.236-7, Permits and Responsibilities, Contractors shall be responsible for complying with any Federal, State, and municipal laws, codes and regulations applicable to the performance of the work. Questions regarding the applicability of the Idaho Use Tax to the performance of this contract should be directed to the Idaho State Tax Commission at (208) 799-3491.

TECHNICAL PROPOSAL FORM:

Contractor Name:

(1) PAST PERFORMANCE: Provide a record of the past performance of the firm, stream restoration specialist, and significant subcontractors.

· List and briefly describe all of the contracts awarded to your firm and significant subcontractors in the last 5 years and supply client names, current phone numbers and who to contact for those contracts listed.

· List and briefly describe all of the contract work performed by your proposed stream restoration specialist in the last 5 years and supply client names, current phone numbers and who to contact for those contracts listed.

· We will assess your history and that of your proposed stream restoration specialist of giving customer satisfaction and performing quality and timely work.

· If performance problems were experienced on any of these projects, describe the steps taken to prevent a recurrence. Those with no history of past performance will receive neither a positive nor a negative evaluation for this criterion.

(2) EXPERIENCE AND QUALIFICATIONS:

· Provide a list of past projects performed by the firm, project supervisor, stream restoration specialist, lead employees and significant subcontractors. Include a description of the work performed, dollar value of the contract, and date of project completion. Specifically highlight experience performing stream rehabilitation projects including floodplain construction, stream crossings, channel excavation and/or relocations, installation of log-rootwad-boulder composite vanes and related structures, and transplanting of riparian vegetation.

· For those without any direct work experience in stream rehabilitation projects, list similar projects where experience could be applied to this kind of job and briefly explain how the experience relates to the type of work to be performed under this contract.

· For each individual, list their relevant licenses, certifications, education and training for the proposed work to be accomplished.

(3) PRODUCTION SCHEDULE (WORKPLAN): Provide a plan that addresses who, what, where, when, and how you plan to do the work, from beginning to end.

· Describe all the significant work elements to be performed, the expected duration of that work, dates for completion of each work element, and the number of workers and type of equipment to be involved. Significant elements include new channel excavation, instream structure construction, floodplain construction, tailings leveling, road decommissioning, and work related to the roadway approaches and new pullout construction.

· Include a timeline for the collection and/or harvest and delivery of the materials (logs and boulders) to be used in construction.

· Include measures that will be taken to minimize the effects on stream turbidity during watering of newly constructed channel and measures that will be taken to ensure the care and maintenance of existing vegetation within the project.

(a) Objectives:

The objective of this contract is to improve the spawning, rearing, and off channel habitat conditions for anadromous fish and other native species.

The work shall be performed to accomplish the following goals:

1. Improve basic geomorphic valley bottom and stream channel function through the creation of floodplain.

2. Improve riparian conditions and reduce elevated summer water temperatures by establishing vegetation and creating floodplains.

3. Reduce human induced impacts on sedimentation and riparian conditions through controlled recreational access.

4. Improve habitat conditions by increasing in-channel complexity and cover with woody debris jams, channel structures and channel meanders.

(b) Description of Work: Red River Narrows Stream Improvement Project. The project consists of stream improvement work through 1.9 miles of the Red River. This work includes road decommissioning, instream habitat structure installation, channel relocation, earthwork, floodplain building, leveling of dredge tailings piles, and revegetation of disturbed areas. Contractor shall deliver materials needed to accomplish the items on the bid schedule (large rocks and tree stems with root wads attached) from identified locations in the project vicinity. The work to be accomplished is shown or described in the design drawings, maps, and descriptions found in project specifications.

(c) Project location: The project area is located approximately 60 miles from Grangeville, Idaho on state and county maintained roadways. To get to the project site, travel approximately 49 miles east of Grangeville, Idaho via. State Highway 14 to the junction with Red River Road #22, then south approximately 11 miles on the Red River Road #222. The work begins on the upstream side of the private bridge over Red River near the historic Gibler Ranch house. The project is located on the Red River Ranger District, Nez Perce National Forest, Idaho County, Idaho.

(d) Price Range: $250,000 - $500,000

C- 3 – Special Project Specifications

The special project specifications include the general description of work, products and materials required, and instructions governing the execution of work. Included specifications are as listed in this section Parts C-3.1 through C-3.3.

C- 3.1 – general Description of work and requirements

(a) Unless otherwise provided, the contractor will provide all labor, materials, tools, supplies and equipment necessary to complete the project in accordance with Drawings Section (C-2), specifications and Schedule of Items. This includes but is not limited to the mobilization and procurement of equipment or materials from on or off-site sources, preparation of materials, placement of materials, erosion and sediment control measures and structures, bank and channel excavation, structure excavation and backfill with native materials, broadcast seeding in disturbed areas, and transplanting of existing vegetation. Payment for work will only be made for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment for items shown.

(b) The contractor will provide a qualified stream restoration specialist to represent them and supervise the construction process. The qualified representative will have a background in fish biology, hydrology, geomorphology, engineering or a related field with experience and working knowledge of stream restoration practices. This specialist will directly oversee the equipment operation during floodplain construction, channel excavation and watering, and instream structure construction in order to assure that the construction is performed in a manner to minimize stream turbidity and fine sediment release while maximizing the habitat created. Examples of education/experience expectations for this individual are as follows: Bachelor’s Degree in one of the above or a closely related field and 2 years of relevant contract experience or Associate’s Degree and/or other technical training in one of the above or a closely related fields and 3 years of relevant contract experience. Specific past performance and experience information will be provided for this individual per the requirements outlined in Section M.

(c) Instream construction activities shall only be performed during the Fish Window from July 1st to August 15th. Instream activities include all work being performed below the ordinary high water mark where the channels are a part of, or connected to, Red River. Activities that do not affect channel processes within the ordinary high water mark such as staging of materials, leveling of some tailings and road decommissioning may be performed outside of the instream construction window. The excavation and construction of new channel shall be allowed outside of the instream construction window so long as sediment yield within Red River is not affected and ground conditions permit. Equipment crossing of the Red River outside of the instream construction window is prohibited except when authorized by the Contracting Officer.

(d) Access to the site will only be allowed when the ground conditions permit. The ground conditions should be sufficiently dry to allow equipment to be mobile without causing damage to the soil.

(e) All state and local water quality regulations will be met. Caution will be exercised by the contractor to minimize turbidity by strategic location of equipment on streambanks, rather than instream, when stable banks are present and riparian damage will not occur. Mitigation measures shall be implemented such as water diversions, temporary dams, and timing of water released into newly constructed channels to reduce fine sediment distribution into the stream and minimize turbidity. Watering of newly constructed channels will be monitored by Forest Service for turbidity.

(f) All instream construction activities will comply with fish management objectives and authorities. Upon watering of newly constructed channels, handling of fish shall be coordinated with the Contracting Officer and old channels will be cleared of aquatic species by Forest Service personnel. Forest Service personnel will be provided to conduct aquatic and fish rescue activities. Fish passage through the project area will be provided at all times during construction.

(g) Operators of construction equipment and/or construction personnel shall cease operation immediately and notify the Contracting Officer if a sick, injured, or dead specimen of a threatened or endangered species is found in association with project activities. Contractor shall take care in handling of sick or injured specimens to ensure effective treatment and preserve the dead specimen(s) in the best possible condition for later analysis of cause of death. Contractor shall preserve the site where the specimen was found to ensure that evidence as to the cause of death is not disturbed unnecessarily. Contractor shall obtain Contracting Officer approval prior to resuming activities.

(h) All work done by the contractor in the project area will be conducted in a workman like manner and will avoid unnecessary disturbance to vegetation.

C- 3.2 – PRODUCTS - MATERIALS

The contractor will be responsible for the collection, hauling and staging of logs and boulders required for the construction of structures in the Schedule of Items. Material source location maps for the logging unit and boulder sites are provided with the drawings. Materials may be staged on the project site prior to construction activities when ground conditions permit.

(a) LOGS

1. Contractor shall give written notification to Contracting Officer prior to harvest activities occurring.

2. The logs used in this project shall be harvested from Debris Unit 145 shown on the Materials Debris Source location map provided with the Drawings. Contractor shall refer to the Materials List in the Drawings for quantity and size of logs required. Species used for this project shall be (in order of preference): Spruce, Douglas Fir, or Lodgepole Pine.

3. Access to the log source unit is from the Deadwood Road to the 9816 road then the 9816D spur. Contractor may be required to do minor repairs on the 9816D spur to access the Debris Source unit 145. Repairs may consist of removal of earth berms and removal of debris from road. Contractor will leave the road in drivable condition upon completion of use and with surface drainage (dips) as directed by the CO.

4. Cut unit boundary will be marked prior to harvest by CO using flagging or other agreed means.

5. All Ponderosa Pine and Western Larch shall be left.

6. Logging requirements:

a. Logs shall be obtained and manufactured with consideration for minimizing damage to residual trees and to site (compaction).

b. Holes resulting from tree removal shall be filled in and smoothed.

c. Hauling vehicles will remain on roadways.

d. Skidding locations and methods shall be as agreed by the CO.

e. Skidding trails shall be treated for created compaction and slash placement as agreed by the CO.

f. Slash consists of debris, limbs, and small trees to 5’ DBH damaged during logging operations.

g. Slash shall be mechanically piled.

h. Slash piles shall be 12’ diameter maximum. Piles shall be located a minimum of 30’ upslope from leave trees (not downslope).

7. Logs will be of sound quality and free of insects, rot, and decay. Bark shall not be removed.

8. The logs requiring root wads will consist of a trunk and root structure containing multiple root branches. Root wads shall be cleaned of excess soil.

9. The cut ends of log trunk sections will be broken or rough not cut. Sawed log ends will require ends to be roughened by the excavator to disturb the clean cut appearance. Logs could also be broken during procurement to specified lengths listed in section C-3.2(a)11.

10. Approximately one half of log types 1 and 2 will retain branches extending from the trunk of maximum length to allow for safe transport. Avoid clean bucking of branch structures from the logs in general.

11. Logs will conform to the length and diameter requirements as shown on the structure drawings. The length specified in the Contract Drawings for logs with root wads shall be measured from the top of the root structure to the end of the log. Diameter requirements are to be measured 5 feet from the top of the root structure or the diameter at the largest end for sections without root structures. A description of the required logs specified follows:

a. Type 1 – Log w/out rootwad shall be 12 to 18 inches in diameter and a minimum of 40 feet long.

b. Type 1R – Log with a rootwad shall be 12 to 18 inches in diameter and a minimum of 40 feet long.

c. Type 2 – Log w/out rootwad shall be 9 to 15 inches in diameter and a minimum of 30 feet long.

d. Type 2R – Log with rootwad shall be 9 to 15 inches in diameter and a minimum of 30 feet long.

12. Logs will be trimmed to length during installation of structures as directed by Contracting Officer to properly construct structure dimensions as shown in Drawings or Typicals.

13. Dead dying or downed trees in the project area may be designated and used for slash distribution. These dead, dying or downed trees will be designated by the Contracting Officer. Trees will be removed by using cable or other methods agreed to by the Contracting Officer.

14. Salvage of wood products by the Contractor will not be permitted under this contract. All materials developed during project activities remain property of the government.

(b) BOULDERS

1. Forest Service will secure permissions for boulder sources under Idaho County and State jurisdiction. Contractor may use other sources not listed in this contract. Contractor is responsible for securing permission for those boulder sources not under Forest Service jurisdiction (site #8, Idaho Forest Group (Bennetts) is the responsibility of the Contractor).

2. Contractor shall refer to the Materials List, see Drawings, for the quantity and size of boulders required.

3. Contractor may need to manufacture boulders at listed sources to obtain required sizes. Forest service does not guarantee that there are sufficient numbers of all types of boulders are readily available. The following is a description of the various boulder types specified on the Drawings:

a. Type 1 – Boulders shall be a minimum of 48 inches in diameter measured at the intermediate axis of the boulder.

b. Type 2 - Boulders shall be a minimum of 36 inches in diameter and shall not exceed 48 inches diameter measured at the intermediate axis of the boulder.

c. Type 3 - Boulders shall be a minimum of 24 inches in diameter and shall not exceed 36 inches diameter measured at the intermediate axis of the boulder.

d. Type 4 – Native Cobble 12 inches up to 24 inches in diameter from adjacent cobble piles.

(c) SEED, STRAW MULCH, AND SLASH

1. Cereal Rye (Secale Cereale L.) seed is required. Cereal Rye seed shall be applied within 14 days of ground disturbance or as approved by the Contracting Officer. The application of live seed shall be applied at 80 pounds per acre. To determine that the total application quantity is met, 80 lbs pure live seed per acre is divided by the product of percent purity and percent germination of the seed mix obtained.

2. Certified weed free straw will be obtained by the contractor and distributed at a density of 1 ton per acre over top of the distributed seed.

3. Slash will be distributed over all disturbed ground surfaces on which seed and straw mulch is also distributed.

a. All slash developed during project operations will be distributed on disturbed areas. Excess slash developed will be placed as directed by the Contracting Officer. Areas requiring additional slash may require slash to be developed from close adjacent sites (within 100 feet) on the project area. Slash will only come from within the project site.

b. Slash comprised of tree trunks will be distributed between 15 ft to 50 ft spacing. Slash comprised of limbs will be distributed between 3 ft to 10 ft spacing.

(d) STRUCTURE BACKFILL Structure backfill and any fill below the ordinary high water line will consist of alluvial sediment and native fill materials excavated on site during the course of construction. Excavated materials deemed unsuitable for placement by the Contracting Officer shall not be used for backfill. Unsuitable material is defined as material not capable of creating stable foundations under the structures or streambanks. Unsuitable materials include muck, sod, or soils with high organic content.

C- 3.3 – EXECUTION

(a) GENERAL

1. Left and right channel designation is determined facing downstream.

2. Instream work will proceed from an upstream to downstream sequence unless otherwise approved by the Contracting Officer.

3. No more than two pieces of mechanized equipment will be allowed to work within the channel at the same time unless otherwise approved by the Contracting Officer.

(b) EQUIPMENT

1. Heavy equipment will be inspected to assure it is clean and there is no leakage of oil, fuel, or hydraulic fluid.

2. All equipment to be used off highway on the project shall be power washed clean of soil and plant parts prior to being mobilized to the project site. The cleaning of equipment will occur off National Forest lands. This does not apply to service and hauling vehicles that would stay on the roadways or within campground parking areas.

3. A track mounted hydraulic excavator in good operating condition with a “thumb” is required for this project. It is anticipated that an excavator shall be used to excavate new channel, install instream structures, excavate floodplain, etc. The excavator shall be of adequate size to be acceptable for any work the contractor may be directed to perform under this section.

(c) CLUMP PLANTING OF VEGETATION

1. Clumps of riparian vegetation in excess of 3 feet in height when removed from existing locations will be maintained and used to complete the project. These plants shall be transplanted to sites on the constructed channel and floodplain locations as approved by the Contracting Officer.

2. Clump planting also includes wetland vegetation and sod clumps.

(d) FLOODPLAIN CONSTRUCTION

Floodplain bench areas will be excavated along existing channel locations as shown on the site location maps and listed in Table 4 in the Drawings. Quantities shown in Table 4 are maximum quantities to be excavated or available at each site.

1. Floodplain unit boundaries will be staked and flagged by the Forest Service prior to contractor beginning work.

2. Excavation elevations are based upon the bankfull elevation at the channel edge. Floodplain surface will slope up to the base of the cut slope at the minimum possible. The cut slopes will be between 1:1 to 2:1 as material and spatial conditions permit.

3. Avoid and leave undisturbed, riparian vegetation between the floodplain and channel. Excavate floodplain around mature trees when staked or directed by Contracting Officer.

4. Excavated floodplain material requires removal to designated repository areas shown on site maps. The pullout to be constructed on county road #222 shown on site map requires excavated material from the project site.

5. Small, localized repository areas are not shown on the map. Use by contractor is by permission of the Contracting Officer.

6. Woody debris generated during the floodplain excavation activities will be distributed on the disturbed areas.

7. During excavation of group 1 units 22 and 23, contractor will provide a rough connection of small stream tributary with the main channel.

8. Grass seed, straw mulch and slash shall be distributed on excavated areas as described in section C-3.2(c).

(e) CHANNEL CONSTRUCTION

This section applies to both the upper and lower channel relocations.

1. Mitigation measures will be in place such that water quality regulations and standards are met during all phases of new channel construction. Contractor is responsible to know and comply with state and local water quality regulations. This information can be found by contacting Idaho Department of Environmental Quality and the U.S. Environmental Protection Agency.

2. Location of the new channel edges will be staked by the Contracting Officer or Forest Service personnel prior to construction. Contractor shall be responsible for the protection and maintenance of the staked design dimensions and grades of structures during entire duration of project. Contractor will be expected to replace at no cost to the government all damaged and displaced stakes and survey markers.

3. Drawings are provided as typicals and contractor is expected to use them as a template; slight variations may occur.

4. Banks along new channels may require modification to allow for smooth transitions with floodplain excavation areas so that flows above bankfull can access the floodplain.

5. The thalweg will be constructed as staked. Forest Service personnel will stake the thalweg prior to construction.

6. Pool and riffle sequences will be excavated with cross sectional areas as shown by the design typical Channel Dimensions and Cross-Sections for Channel Relocations. Pool and riffle sequences will staked prior to construction by Forest Service personnel.

7. Clump planting on channel edges shall be completed before watering of newly constructed channel.

8. Watering schedule of newly constructed channel will be submitted to Contracting Officer a minimum of 3 days prior to watering of new channel. Contracting Officer will coordinate with the appropriate authorities and personnel to achieve turbidity requirements and fish rescue handling. Forest Service will provide personnel for fish rescue and turbidity monitoring.

9. Contractor is required to be present during the watering process to adjust diversion structures to allow for slight incremental increases of flow into the new channel. Contractor should schedule at least 2 days for watering each new channel section. This time is necessary to achieve water quality standards for turbidity and for the Forest Service to complete the removal of fish and aquatic species from the old channel sections.

10. After watering a newly constructed channel, the LWD Complex – Full Channel Block will be constructed.

11. Upon construction of the channel block, excavated material from the new channel shall be used to fill the old channel as shown on the site maps. The estimated cut, fill, and excess volumes are provided in Table 2. Filling of the old channel with the material from the newly constructed channel shall be topped to an elevation no more than three feet above the old channel’s bankfull elevation as shown on the typical for the Full Channel Block. The old channel will be filled downstream to a location as shown on the site maps and staked by the Forest Service. Excess excavation from the new channels shall be relocated to repositories listed in Table 3 and shown on the site maps.

12. The exposed surface of the old channel shall have seed, mulch and slash distributed as prescribed in section C-3.2(c).

(f) INSTREAM STRUCTURES

This section applies to structures as shown in the project typicals.

1. Mitigation measures will be in place such that water quality regulations and standards are met during all phases instream structure construction. Contractor is responsible to know comply with state and local water quality regulations. This information can be found by contacting Idaho Department of Environmental Quality and the U.S. Environmental Protection Agency.

2. All structures will be built to the grades and dimensions as shown in the design drawings and as staked by the Forest Service. Minor modifications to staked structures may be required and will be adjusted by the Forest Service during construction.

3. Locations of structures are shown on the project site maps. Structure locations and elevations will be staked prior to construction by the Forest Service. Contractor shall be responsible for the protection and maintenance of the staked design dimensions and grades of structures during entire duration of project. Contractor will be expected to replace at no cost to the government all damaged and displaced stakes and survey markers.

4. Sequence of construction activities shall be as follows and shown in the submitted construction schedule unless otherwise approved by the Contracting Officer:

a. Removal and preservation of vegetation clumps.

b. Excavation of bank material and channel for log placement.

c. Placement of boulders and logs into excavated areas.

d. Transplant vegetation clumps and backfill structures.

e. Placement of additional boulders and logs.

(g) REPOSITORIES

1. Repository areas have been located throughout the project area.

2. Repository areas are indicated in Table 3.

3. The surface of the deposited material shall left leveled but not mechanically compacted.

4. Seed, mulch and slash will be distributed as prescribed in section C-3.2(c).

5. Small, localized repository areas are not shown on the map. Use by contractor is by permission of the Contracting Officer.

(h) ROADWAY APPROACHES

1. Roadway approaches shall be reconditioned and brushed to the dimensions as shown on the drawings.

2. Roadway approaches shall have borrow excavation roller compacted and finished to provide a smooth running surface.

(i) ROAD CLOSURES

1. Access to decommissioned roads will be blocked to prevent access by motorized vehicles. Closures will be constructed of approximately 10-15 cubic yards of riprap material between 24 inches to 48 inches in all dimensions.

2. Material will be mechanically placed, partially buried and arranged to blend into surroundings.

(j) UPPER CAMPGROUND PULLOUT

1. Pullout shall be constructed to the dimensions and locations as shown on the plans or as staked.

2. Pullout will be constructed from barrow excavation generated from floodplain excavation

Group 1.

3. Embankment construction for pullout shall be placed in lifts not exceeding 1 feet and each lift shall be roller compacted. Material shall be of composition suitable for embankment construction. Moisture content shall be suitable for embankment construction. Compaction shall be a minimum of three passes or until visible deformation is no longer evident.

4. Pullout shall be surfaced with a 4 inch lift of crushed aggregate. Crushed aggregate is stockpiled at a Forest Service site near Dixie Summit. Location is as shown on the plans.

(k) ROAD DECOMMISSIONING

1. Roadway sections decommissioned shall be as shown on the plans.

2. Roadway surface will be decompacted (excavated or ripped) to a depth of 18 inches to the full width of compacted road surface. Road will be left in a roughened condition such that it prevents off road vehicle use.

3. Surface will have seed, mulch and slash distributed as described in section C-3.2(c).

4. Decommissioned Roadway shall have available slash placed uniformly over the surface as directed by the CO

(l) USE OF EQUIPMENT RENTAL

1. The Forest Service anticipates that unanticipated work tasks will develop during the course of the project for which an Excavator and Dump Truck would be needed.

2. If tasks are found that require an excavator or dump truck, the Forest Service will use this item to complete tasks. When tasks are found, the Forest Service will schedule with contractor the use of rental equipment.

C- 4 – METHODS OF MEASUREMENT AND MOBILIZATION

C- 4.1 – mETHODS OF MEASUREMENT One of the following methods of measurement for determining final payment is DESIGNATED IN THE SCHEDULE OF ITEMS for each PAY ITEMS.

(a) Designed Quantities (DQ). These quantities denote the final number of units to be paid for under the terms of the contract. They are based upon the original design data available prior to advertisement of the project. Original design data include the preliminary survey information, design assumptions, calculations, drawings, and the presentation in the contract. Changes in the number of units DESIGNATED IN THE SCHEDULE OF ITEMS may be authorized under any of the following conditions:

1. Changes in the Work authorized by the CO.

2. A determination by the CO that errors exist in the original design that cause a PAY ITEM quantity to change by 15 percent or more.

3. A written request submitted to the CO showing evidence of errors in the original design that cause the quantity of a PAY ITEM to change by 15 percent or more. The evidence must be verifiable and consist of calculations drawings, or other data that show how the designed quantity is in error.

(b) Actual Quantities (AQ). These quantities are determined from measurements of completed work.

(c) Lump Sum Quantities (LSQ). These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job.

C- 4.2 – MOBILIZATION

(a) This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site. Mobilization includes the obtaining of permits, insurance, and bonds.

(b) Progress payments for mobilization include the obtaining of permits, insurance, and bonds.

1. Bond premiums will be reimbursed according to FAR Clause 52.232-5 Payments Under Fixed Price Construction Contracts, after receipt of the evidence of payment.

2. When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.

3. When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.

4. Any portion of mobilization item in excess or 10 percent of the original contract amount will be paid after final acceptance.

FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES

52.242-14 Suspension of Work (APR 1984)

FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984) Alternate I (APR 1984) The Contractor shall be required to (a) commence work under this contract within 30 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than September 30, 2010. The time stated for completion shall include final cleanup of the premises.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by June 1, 2009. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

INSTREAM OPERATING WINDOW: Instream construction activities shall only be performed during the Fish Window from July 1st to August 15th. Instream activities include all work being performed below the ordinary high water mark where the channels are a part of, or connected to, Red River. Activities that do not affect channel processes within the ordinary high water mark such as staging of materials, leveling of some tailings and road decommissioning may be performed outside of the instream construction window. The excavation and construction of new channel shall be allowed outside of the instream construction window so long as sediment yield within Red River is not affected and ground conditions permit. Equipment crossing of the Red River outside of the instream construction window is prohibited except when authorized by the Contracting Officer.

SECTION G--CONTRACT ADMINISTRATION DATA

AGAR 452.215-73 Post Award Conference (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled and held within 30 days prior to the commencement of work. The conference will be held at Nez Perce National Forest Supervisor’s Office, 104 Airport Road, Grangeville, ID 83530.

G-1 GOVERNMENT-FURNISHED PROPERTY

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

**Trees/logs and boulders

G-2 CONTRACTING OFFICER'S REPRESENTATIVE

The Contracting Officer will designate a representative, hereinafter referred to as the Contracting Officer's Representative (COR) or, alternatively, as the Engineer, who will provide on-the-ground administration for the Government. The COR will be designated in writing and a copy of the designation will be furnished to the Contractor before or at the prework conference. The Contractor is cautioned to read the COR designation because certain authority under the contract is reserved solely for the Contracting Officer. The term "Contracting Officer" as used throughout the Specifications, shall be interpreted to include the Contracting Officer's designated representative(s) acting within the limits of their delegation of authority.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H-1 CONDITIONS ON USE OF PREMISES (Camping)

(a) Camping will be allowed only at the sites designated on the project maps or approved in advance by the District Ranger.

(b) No improvements of a permanent nature shall be constructed without prior written approval of the C.O.R.

Temporary structures such as tent frames, hitch racks, tents and tent pegs shall be removed at the end of the period of use, all evidence of the camp eliminated, and the site restored to its original condition. Final payment will not be authorized until the campsite has been cleaned up and the site is approved by the Contracting Officer or his designated representative. Reusable native material may be neatly stacked for future use.

(c) Livestock will not be permitted without written approval from the Contracting Officer.

(d) Vegetation shall be undisturbed to the maximum extent possible. The Contractor will be permitted to cut only those trees designated by the COR.

(e) Storage of petroleum products in excess of 50 gallons at the campsite will require the approval of the COR. All petroleum spills shall be immediately cleaned up. All spills will be reported immediately to the CO or COR. Spills over 25 gallons will be reported to the Idaho State Department of Enviromental Quality. No waste disposal of petroleum product will be permitted on National Forest land.

(f) Chemical toilets are preferred for all campsites, however, the Contractor may be permitted to construct a slit trench when conditions warrant. Any slit trench constructed shall not be located closer than 400 feet to any live stream and is subject to approval of the COR. The trench shall be covered and the area restored to as natural a condition as possible when the camp is closed.

(g) Refuse including waste materials, garbage, and rubbish of all kinds, shall be disposed of in the following manner, and shall guard the purity of streams and living waters:

Garbage, trash, sewage waste, and other litter shall be kept in closed fly-proof containers and periodically hauled to an approved disposal facility located outside of the National Forest.

(h) Waste water shall be disposed of in a leach pit located at least 300 feet from springs, streams, and lakes. The pit shall be a minimum of 2 x 2 x 2 feet and shall be filled with rock two to eight inches in diameter. The leach pit shall be covered with at least two feet of compacted soil when the camp is closed.

(i) No waste or by-products shall be discharged if it contains any substances in concentrations which will result in substantial harm to fish and wildlife, or to human water supplies.

Storage facilities for materials capable of causing water pollution, if accidentally discharged, shall be located so as to prevent any spillage into waters, or channels leading into water, that would result in substantial harm to fish and wildlife or to human water supplies.
