About this file

Addendum No. 1 was issued by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) for the Park Office / Entrance Reconstruction – Phase 2 project at Wellesley Island State Park. The addendum provides updates to the bidding documents for four contracts (General Construction, Electrical, Mechanical, and Plumbing) with contract numbers D006297-D006300. Key modifications include changes to the contractor registry requirements, updated lump sum bid forms, pre-bid site access details for March 24, 2025, and responses to 16 specific questions from potential bidders. The addendum clarifies technical specifications, including emergency responder communication system requirements, window glazing specifications, and environmental product declaration (EPD) submission guidelines.

The addendum addresses critical bidding details such as the contractor registry requirement effective December 30, 2024, which mandates that contractors and subcontractors register with the Bureau of Public Work and Prevailing Wage Enforcement. Minority and Women-Owned Business Enterprise (MWBE) participation goals vary by contract, ranging from 4% to 25% for MBE and 5% to 17% for WBE, with an additional 6% Service-Disabled Veteran Owned Business (SDVOB) participation goal. The project has a total completion timeline of 645 days, with an anticipated Notice to Proceed on July 9, 2025, onsite construction beginning December 15, 2025, and a contract end date of May 15, 2027. The engineer's estimate for the entire project ranges from approximately $2,183,633 to $2,954,326, with specific bid security requirements for each contract segment.

The following item (Addenda No. 1) herewith amends and becomes part of the Contract Documents.

Addenda number 1 contains 4 Items.

Item 1 – Change to the Notice to Bidders: In the section, “CONTRACTOR REGISTRY REQUIREMENT in December 2024”, delete the paragraph, “Newly established subsection 220-i to NYS Labor Law Article 8 requires contractors and subcontractors to register with the Bureau of Public Work and Prevailing Wage Enforcement for public work. This registration must be completed prior to bidding on public work projects covered under Article 8 of Labor Law. The effective date of the registration requirement is December 30, 2024. No contractors or subcontractors are required to register prior to that date; however, after the effective date, bidders may be found to be non-responsive if they fail to include a digital copy of their registration certificate with their bid submission, and registration number on the project bid form. The apparent low bidder will additionally be held responsible to provide copies of registration certificates for all subcontractors on their approved Utilization Plan before the contract is submitted to the Office of the Comptroller for approval.” and replace the paragraph with, “Newly established subsection 220-i to NYS Labor Law Article 8 requires contractors and subcontractors to register with the Bureau of Public Work and Prevailing Wage Enforcement for public work. This registration must be completed prior to bidding on public work projects covered under Article 8 of Labor Law.

The effective date of the registration requirement was December 30, 2024. Bidders must prove they are registered at the time of bid opening by submitting a digital copy of their company’s registration certificate with their bid. Failure to provide the registration certificate at bid opening will result in automatic disqualification. The apparent low bidder will additionally be held responsible to provide copies of registration certificates for all subcontractors on their approved Utilization Plan before the contract is submitted to the Office of the Comptroller for approval.”

Item 2 – Updated Lump Sum Bid Forms: Attached are the updated bid forms for each trade. Please use the updated version, “Lump Sum Bid Form / March 2025”.

Item 4 – Questions 1 – 16 with Answers:

Question 1:

SECTION 27 51 29, EMERGENCY RESPONDER COMMUNICATION ENHANCEMENT SYSTEM

(ERCES)

o PART 1 – GENERAL, 1.6 PROJECT CONDITIONS, B.

Is there any information that can be provided for the existing installed antenna system, specifically, Is this radio antenna system for the Park Police or is it referring to the Public Safety P25 Trunked Repeater system?

If this is the Park Police radio system, please provide the frequencies to be tested for this system along with an authorized point of contact.

Answer:

Response: Specification 275129, Part 1.6C inadvertently referred to an existing antenna system. There is no antenna system present which is relevant to an ERCES system. Please disregard Part 1.6C

Question 2:

Is the fire alarm vendor or the municipal emergency services department responsible for the antenna testing per bid specification?

Answer:

The contractor is responsible for testing existing organic coverage of the building to determine if an ERCES is necessary, and to test after walls and ceilings are installed. The ERCES and related testing should be included in the bids.

Question 3:

If the Local AHJ determines that an ERCES/BDA solution is required for this facility, and the abovementioned radio system is for the Park Police and not the trunked P25 system, must the Park Police radio frequencies to be accounted for within the new ERCES/ BDA Solution?

Answer:

There is no relevant existing system at this facility.

These are only available to bidders through NYS Parks Staff.

Question 4:

Please note and clarify that if the Local AHJ requires an ERCES/BDA solution in this facility, a fire alarm panel must be installed to provide for monitoring & supervision per NFPA 72, & NFPA1221.

o At a minimum, the fire solution would encompass the fire alarm panel, (2) dedicated telephone lines, (1) smoke detector, (1) manual pull station, and (1) monitor module, to provide connection to the BDA Annunciator.

Answer:

Response: As part of the bids, please include a dedicated suitable monitoring panel for the ERCES, per Spec Section 2.2L. This may include a fire alarm panel

Question 5:

The owner would need a service agreement for fire alarm monitoring by a Central Station Answer:

Agreed.

Question 6:

Per Drawing C-10, Keyed Note 2, will this building to be electrically connected to the building constructed in the Park / Office Entrance Reconstruction in Phase , Project No 22103 Dated March 29, 2024?

o If yes, it may be possible to share the fire alarm panel and BDA/DAS located in the Phase I project with this new structure, provided that the conduit has a minimum interior diameter of 2” to accommodate the ½” coax. We could extend the distributed antenna system to include the new structure

Answer:

At this time, it is not known if the Building being constructed as part of Phase I will require an ERCES and related monitoring system. The bidders should plan on needing standalone compliance for the Phase 2 project being bid at this time.

Question 7: Clarify the type of grout to be used Cement or Epoxy?

Answer: Grout should be "Water-Cleanable Epoxy Grout: ANSI A118.3, with a VOC content of 65 g/L or less"

Question 8: Notation for glazing opening 101.1 is G-4 and 101.2 and G2 respectively, is calling out bird friendly glass. Is this correct?

Answer: Door 101.1 is to have G4 glazing as shown. Door 101.2 should also have G4 glazing, not G1 currently shown. Doors 102.1 and 102.2 should continue to receive G2 glazing as shown.

Question 9: Window Glazing Clarification

Answer: Drawings call for ORNILUX® glazing, for windows and exterior doors, change to "Cardinal Bird Strike" with dot pattern.

NOTE: Question/Answers 10 through 14 refer to EPDs.

Question 10: The asphalt Spec calls out that EPDs have to be submitted for each asphalt mix on the project.

Answer: EPDs do need to be submitted for each asphalt mix in the project as specified in the General Conditions, ARTICLE 27 – EMBODIED CARBON DISCLOSURE

27.1 Executive Order 22: Leading by Example (EO 22) requires the disclosure of embodied carbon that will result from all OPRHP construction projects costing over $1 million that use certain minimum quantities of concrete mixes, asphalt mixes, steel, and glass (“Covered Construction Materials”) as those quantities are set forth in the GreenNY Council Embodied Carbon Guidance. The GreenNY Council Embodied Carbon Guidance is available here: https://ogs.ny.gov/executive-order-22-embodied-carbon-guidance. Contractor warrants that Contractor has reviewed and is familiar with all GreenNY Council Embodied Carbon guidance and/or guidelines.

At the website linked above it states this: “This guidance is for New York State construction contracts awarded by Affected Entities (per E.O.#22 – see Appendix A) signed after October 1, 2023. If it is a non-transportation contract, this guidance applies only to State Contracts over $1 million. For transportation contracts the applicability is by material quantity only, not construction cost.”

27.2 Contractor shall be required to submit environmental product declarations (EPDs) for all Covered Construction Materials, if available, used in the Project……

Question 11: This is greatly going to increase the price of the mix

Answer: This was a requirement at the time of bidding and is a certification for the asphalt mix. The specification or the mix itself isn’t changing but the EPD is required for the mix.

Question 12: The state has had this in paving contracts for a while now, but only if quantity was over 8,000 ton.

Answer: The requirements are for State Contracts over $1 million that meet the minimum threshold for concrete, asphalt, steel, or glass (as shown below). Once the minimum threshold for one of the materials is met, then EPDs need to be provided for all covered construction materials in the list. Additionally, the 8,000 ton threshold is for transportation project and does not apply here.

Question 13: The park quantities are 800 and 125 Ton.

Answer: The minimum threshold for a project to require EPDs is $1 million that meet the minimum threshold for concrete, asphalt, steel, or glass. Once the minimum threshold for one of the materials is met, then EPDs need to be provided for all covered construction materials in the list. The minimum quantity for asphalt on a $1 million dollar park project is 10 cubic yards. This project meets the minimum threshold for requiring EPDs in one of the categories, EPDs are then required to be submitted for all categories.

Question 14: If we could find out if the EPDs will be required on the mixes.

Answer: Yes, EPDs are required for asphalt mixes.

Question 15: Is there anyone specified for the display cases? Not sure if we can get these quoted correctly without?

Answer: The design intent for the display cases, "Factory-fabricated display case," as noted in the spec 10 12 00, was that these would be custom millwork done by a cabinetry or similar fabrication shop.

Question 16: There is a note on drawing L-101 that refers to deer protection fencing.

Please provide some clarification as to how many trees and shrubs require this protection.

Also many of the shrubs are in a contiguous planting bed, are we to enclose the entire bed?

Answer: All new trees and other plants should be enclosed in deer fence. Individual trees planted in lawn areas should be individually caged. Where plants are within planting beds including the courtyard area adjacent to the building, enclose the entire bed. Trees and shrubs north of the building around the constructed stormwater mitigation area should be enclosed with a single fence around the perimeter of the planting area.

This addendum forms a part of the contract documents. Receipt of this Addenda shall be acknowledged on the bid form.
