This is combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart Federal Acquisition Regulation (FAR) 12.6, as supplemented with additional information included in this notice. This announcement constitutes only Solicitation; Request for Quotes (RFQs) is being requested and a written solicitation will not be issued.

This requirement is for the Department of Interior (DOI), Bureau of Indian Affairs (BIA) to acquire Commvault Data Protection License and maintenance. A Justification for Other than Full and Open Competition – Brand Name Justification is attached to this RFQ as Attachment 1.

1. RFQ NUMBER: The RFQ Number is A17PS00370. This solicitation document incorporates provisions and clauses associated with commercial item procurement.

2. SET-ASIDE: The procurement will be made in accordance with Buy Indian Act, 25.U.S.C 47 and therefore, 100% set-side for Indian Small Business Economic Enterprise (ISBEE).

Only quotes received from ISBEE’s will be considered for award. Vendors who do not qualify under the ISBEE set-aside will be immediately removed from the competitive range.

3. NAICS CODE: The suggested North American Industry Classification System (NAICS) code is 423430 – Computer and Computer Peripheral Equipment and Software . The Product Service Code is 7030- IT Components.

4. DESCRIPTION: This requirement is to acquire:

5. DELIVERY:

The CommVault Software shall be provided via electronic delivery within three (3) days of the Award.

6. PERIOD OF PERFORMANCE:

The anticipated period of performance is provided below.

• Base Year: 02/27/2017 – 02/26/2018

• Option Year 1: 02/27/2018 – 02/26/2019

• Option Year 2: 02/27/2019 – 02/26/2020

• Option Year 3: 02/27/2020 – 02/26/2021

• Option Year 4: 02/27/2021 – 02/26/2022

7. DELIVERY ADDRESS:

Ship to Albuquerque. Delivery address will be provided at the time of the award.

8. PURCHASE ORDER TYPE:

Firm-Fixed-Price (FFP) Purchase Order.

9. QUESTIONS:

If you have questions regarding this requirement, please submit your inquiries immediately via email but no later than 2:00 PM Eastern Time, Wednesday, February 22, 2017 to nancy.shah@bia.gov.

All communications regarding this requirement shall be between the Quoter and BIA only.

Please be advised that the Government reserves the right to transmit those questions and answers of a common interest to all prospective vendors through email.

10. QUOTE DUE DATE:

The due date for responses to this RFQ shall be sent via email to nancy.shah@bia.gov, no later than 2:00 PM Eastern Time, Thursday, February 23, 2016.

Any submissions received after the date and time specified herein will NOT be considered for award. Quotes must be submitted through email to nancy.shah@bia.gov. Any other method of submission will NOT be considered. Please allow time for any delays that may impact submitting your quote.

11. INSTRUCTIONS FOR QUOTE PREPARATION AND EVALUATION:

BIA is issuing this Request for Quote (RFQ) to solicit ISBEE vendors for the purpose of entering into a Purchase Order. The quote submitted shall be in accordance with the terms and conditions of the RFQ.

The Quoter’s submission will be evaluated according to the factors shown below. The Government will make an award based on a Lowest Price Technically Acceptable (LPTA) determination.

The following information must be submitted in order to be considered for award:

Technical Quote

1. Description of brand name specification;

2. Product literature

3. The quote shall also contain the following:

a. Tax identification number (TIN)

b. Dun & Bradstreet Number (DUNS)

c. Complete business mailing address

d. Contact name, phone number, email address, and fax number

e. This RFQ number

f. Quoter ’s Quote number

g. Expiration date of the Quote

h. Proposed electronic delivery date

i. Proposed Period of Performance for Software Application Support

Price

1. Price: Provide a Firm-Fixed-Price quote.

2. Provide pricing information for each line item listed on pages one (1) through three (3) of this RFQ with any and all discounts taken into consideration;

Price quotes shall be all inclusive. The failure to submit any of the information requested in this RFQ may lead to the rejection of your quote without further consideration.

This is a RFQ only and in no way obligates the Government to award a Delivery Order or to reimburse Quoter (s) for any costs incurred in preparing their quote.

12. AWARD

The Government anticipates awarding one Firm-Fixed Price single award Purchase Order for all items. Partial awards will not be made.

Vendors shall address all requirements in this RFQ and shall provide clear evidence of understanding and the ability and willingness to comply with the Government’s specifications. Failure to address a specification/requirement will be construed by the Government as inability to meet the need, or the Vendor’s taking exception to it. Any assumptions not meeting the Government’s requirement will be considered as taking exception to the Government’s requirement and will be evaluated accordingly.

The Government intends award a Purchase Order without contacting with Quoter s.

Therefore, the Quoter’s initial quote should contain the best terms from a price and technical standpoint.

The Government reserves the right to contact Quoter (s) regarding their quote including price discounts or the Government may make award without contacting the Quoter.

The Government reserves the right to not make an award, if necessary.

This is a RFQ only and in no way obligates the Government to award a Purchase Order or to reimburse Quoter (s) for any costs incurred in preparing their quote.

13. PURCHASE ORDER ADMINISTRATION

The following sections will become a part of the resulting Purchase Order:

a) Deliverables All Riverbed equipment shall be delivered by the vendors on or before the due date and shall be delivered to the Contracting Officer’s Representative (COR) mentioned in the award. When questions concerning the requirement arise, the Quoter shall follow the direction of the COR who will coordinate with the Government Contracting Officer (CO).

b) Section 508.

All Software shall be compliant with the requirements referenced in these documents including Section 508 of the Rehabilitation Act of 1973 and 29 USC 794d, sub-part B, Technical Standards, 1194.21.

c) Software Maintenance Services All software maintenance services shall be delivered by the Quoter on or before the due date.

The software maintenance services shall be delivered to the Contracting Officer’s Representative (COR) mentioned in the award. When questions concerning the software maintenance services arise, the Quoter shall follow the direction of the COR who will coordinate with the Government Contracting Officer (CO).

14. PURCHASE ORDER PROVISION

The following clauses are applicable to this requirement:

The following provisions are applicable to this requirement:

FAR 52.217-5 – Evaluation of Options (Jul 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.225-18 Place of Manufacture. (MAR 2015)

(a) Definitions. As used in this clause— “Manufactured end product” means any end product in product and service codes (PSCs)

1000-9999, except—

(1) FPSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

(b) For statistical purposes only, the Quoter shall indicate whether the place of manufacture of the end products it expects to provide in response to this solicitation is predominantly—

(1) o In the United States (Check this box if the total anticipated price of offered end products manufactured in the United States exceeds the total anticipated price of offered end products manufactured outside the United States); or

(2) Outside the United States.

52.233-2 Service of Protest. (Sept 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from 12220 Sunrise Valley Drive, Reston , VA 20191_. [Contracting Officer designate the official or location where a protest may be served on the Contracting Officer.]

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

a) FAR 52.217-9 - Option to Extend the Term of the Contract (Mar 2000)

1. The Government may extend the term of this contract by written notice to the Contractor within 15 days prior to the expiration of the current period of performance; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days prior to the expiration of the current period of performance.

The preliminary notice does not commit the Government to an extension.

2. If the Government exercises this option, the extended contract shall be considered to include this option clause.

3. The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years which is also inclusive of options.

Funds are not presently available for performance under this contract beyond Fiscal Year 2013. The Government’s obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond Fiscal Year 2013, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

CLAUSES:

DIAR 1452.201-70 - Authorities and Delegations (Sep 2011)

1) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

2) The CO will designate a POC at time of award. The POC will be responsible for technical monitoring of the Vendor's performance and deliveries. The POC will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment. The POC for this contract will be:

3) The POC is not authorized to perform, formally or informally, any of the following actions:

i. Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

ii. Waive or agree to modification of the delivery schedule;

iii. Make any final decision on any contract matter subject to the Disputes Clause;

iv. Terminate, for any reason, the Contractor's right to proceed;

v. Obligate in any way, the payment of money by the Government.

4) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible; when the POC has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the POC's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

5) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

6) The Contractor shall provide copies of all correspondence to the Contracting Officer and the

POC.

7) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the POC acting within his or her appointment, shall be at the Contractor's risk.

DIAR 1452.203-70 - Restrictions on Endorsements (JUL 1996) The Contractor shall not refer to contracts awarded by the Department of the Interior in commercial advertising, as defined in FAR 31.205-1, in a manner which states or implies that the product or service provided is approved or endorsed by the Government, or is considered by the Government to be superior to other products or services. This restriction is intended to avoid the appearance of preference by the Government toward any product or service. The Contractor may request the Contracting Officer to make a determination as to the propriety of promotional material.

DIAR 1452.226-70 Indian Preference (APRIL 1984)

(a) The Contractor agrees to give preferences to Indians who can perform the work required regardless of age (subject to existing laws and regulations), sex, religion, or tribal affiliation for training and employment opportunities under this contract and, to the extent feasible consistent with the efficient performance of this contract, training and employment preferences and opportunities shall be provided to Indians regardless of age (subject to existing laws and regulations), sex, religion, or tribal affiliation who are not fully qualified to perform under this contract. The Contractor also agrees to give preference to Indian organizations and Indian-owned economic enterprises in the awarding of any subcontracts consistent with the efficient performance of this contract. The Contractor shall maintain such records as are necessary to indicate compliance with this paragraph.

(b) In connection with the Indian employment preference requirements of this clause, the Contractor shall also provide opportunities for training incident to such employment. Such training shall include on-the-job, classroom, or apprenticeship training which is designed to increase the vocational effectiveness of an Indian employee.

(c) If the Contractor is unable to fill its training and employment needs after giving full consideration to Indians as required by this clause, those needs may be satisfied by selection of persons other than Indians in accordance with the clause of this contract entitled “Equal Opportunity.”

(d) If no Indian organizations or Indian-owned economic enterprises are available for awarding of subcontracts in connection with the work performed under this contract, the Contractor agrees to comply with the provisions of this contract involving utilization of small business concerns, small business concerns owned and controlled by socially and economically disadvantaged individuals, or labor surplus area concerns.

(e) As used in this clause:

(1) “Indian” means a person who is a member of an Indian Tribe. If the Contractor has reason to doubt that a person seeking employment preference is an Indian, the contractor shall grant the preference but shall require the individual within thirty (30) days to provide evidence from the Tribe concerned that the person is a member of that Tribe.
