BRAND NAME JUSTIFICATION
RFQ A17PS00370
COMMVAULT LICENSES AND MAINTANICE
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for Other than Full and Open Competition”
This Purchase Order is being issued by the U.S. Department of the Interior, Bureau of Indian Affairs for the Office of Information Management Technology.
This document is a Justification for Other than Full and Open Competition (JOFOC) for the acquisition of CommVault Data Protection Advanced license and maintenance brand name only.
This JOFOC is executed for the Requiring Agency by the Contracting Activity, both identified below:

Period of Performance:
• Base Year: 02/27/2017 – 02/26/2018
• Option Year 1: 02/27/2018 – 02/26/2019
• Option Year 2: 02/27/2019 – 02/26/2020
• Option Year 3: 02/27/2020 – 02/26/2021
• Option Year 4: 02/27/2021 – 02/26/2022
2. Nature and/or description of the action being approved
This is a competitive acquisition for commercial Information Technology (IT) CommVault Data Protection Advanced license and maintenance.
As the CommVault licenses and maintenance is a brand name item manufactured by CommVault, only, a brand name justification is required in accordance with FAR 11.105 - Items peculiar to one manufacturer and FAR 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements. The period of performance for this requirement will be for a Base Year and four (4) Option Years. This brand name justification establishes the need for using CommVault licenses and maintenance brand name only for this requirement as described in the RFQ # A17PS00370.
3. A description of the supplies or services required to meet the agency’s needs
(including the estimated value)
CommVault licenses and maintenance are required in order to maintain compatibility with the existing information technology (IT) infrastructure currently installed and operating within the OIMT’s environment. CommVault’s maintenance includes 24x7x365 coverage plus holidays.
CommVault software is required to backup servers and retrival of MS-Exchange mail boxes and date in IE. CommVault improves data availability and meets compliance requirements while reducing the cost of protecting remote and mobile data. Data can be securely accessed through a web portal. This acquisition is for support only.
4. An identification of the statutory authority permitting other than full and open competition
The applicable statutory authority permitting other than full and open competition is FAR Subpart 6.302-1- Only one responsible source and no other supplies or services will satisfy agency requirements, and 16.505(a)(4) - Ordering. This justification is prepared using the format at 6.303-2 - Content.
5. A demonstration that the proposed Contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited
CommVault licenses and maintenance are required in order to maintain compatibility with the existing IT infrastructure currently installed and operating within the OIMT’s environment.
OIMT has a substantial investment in its current network and IT infrastructure. Purchase of different products or models of similar software products would cause both software and hardware incompatibility issues with the IT services. Subsequent changes to the IT infrastructure to resolve any of these incompatibilities would be financially detrimental to the OIMT and would overly complicate the network and IT infrastructure. A new software product would also mean additional cost for a new procurement and changing the backup system for OIMT and considerable downtime for deployment, configuration, and training to implement the new software development.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies
The procurement will be made in accordance with Buy Indian Act, 25.U.S.C 47 and therefore, 100% set-side for Indian Small Business Economic Enterprise (ISBEE). Only quotes received from ISBEE’s will be considered for award. Vendors who do not qualify under the ISBEE set-aside will be immediately removed from the competitive range. The solicitation will be posted on FedBizOpps for all ISBEE vendors to compete.
In accordance with FAR Subpart 5.102(a)(6) - Availability of Solicitations, the brand name justification will be made available with the solicitation to all contract holders with the solicitation.
7. A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable
In addition to the determination of the fair and reasonable price by SEWP, the BIA Contract Specialist and Contracting Officer will determine whether the price is fair and reasonable via the use of an in-depth price analysis by comparing the quoted prices against each other and with the Independent Government Cost Estimate (IGCE) which is based on commercial prices.
8. A description of the market research conducted and the results or a statement of the reason market research was not conducted
Market research included the following activities: reviewing acquisition history; interviewing technical experts and researching GSA schedules and companies through the Systems for Award Management (SAM). The Government will only be awarding one (1) Firm-Fixed-Price (FFP) Delivery Order for this requirement and the successful contractor must be able to provide CommVault licenses and maintenance to receive the award. The software is developed by CommVault and support will be provided directly by CommVault; it will be purchased through the reseller.
9. Any other facts supporting the use of other than full and open competition
No other facts supporting the use of other than full and open competition are necessary.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition
As this requirement has not yet been advertised on FedBizOpps, no contract holders are currently aware of the Government’s requirement. However, all ISBEE vendors will be provided the opportunity to quote on this requirement to ensure fair opportunity.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required
The current requirement is for the additional licenses and Support maintenance. The CommVault Software licenses were purchased by BIA previously. Any determination to change the type of software currently being used by the OIMT will be made at the time of the purchase of the new server. At that time the Government will determine if it is in the best interest to remove any brand name barriers to competition.
