About this file
This document is a justification and approval for other than full and open competition for simplified acquisitions over the micro-purchase threshold. The National Park Service Pacific West Region requires emergency heavy equipment rental from Cashman Equipment Rental in the amount of $156,150 to open park roads in Death Valley for administrative and emergency vehicle access following flood damage from Hurricane Hillary in August 2023. Brief market research found Cashman Equipment Rental is able to secure needed equipment while other businesses have already rented available inventory to other agencies and customers impacted by the storm. An urgent and compelling need exists to access critical infrastructure systems for operations and assess damage, as the park faces potential catastrophic impacts without access. The contracting officer and administrative officer approved the justification on September 1, 2023.

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Emergency Heavy Equipment Rental for opening park roads for administrative and emergency traffic after Hurricane Hillary Flood events August 2023.. Anticipated cost is $156,150K to a Large Business (Cashman Equipment Rental)
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
___X___ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: The DEVA roads were inundated with flood waters from the remanence of Hurricane Hillary.
Nearly all critical NPS systems such as Cow Creek Water System, Furnace Creek Water system, Stovepipe wells Sewer Treatment plan, Grapevine water system, Wild Rose Water System, etc. are not accessible on NPS roads. DEVA does not have enough functional heavy equipment to open these roads both for administrative access to maintain the systems and assess damage after the storm, but also for emergency vehicles to be able to leave the park.
Without urgent action, the park is at eminent risk of more catastrophic and unknown damages to critical infrastructure by not being able to access the areas; such as losing potable water to the housing areas and sewage overflows, which would pose a hazard to human health.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:
Brief market research was performed by performing searches on the SBA Dynamic Small Business Search engine, reviewing past contracts for emergency equipment rentals and identifying business within a 300 mile radius from the remote area of Death Valley that have access to this type of equipment. The storm has left many business with empty rental lots as other agencies and private businesses have rented what little equipment was in the area already.
Oral Quotes were received for limited inventory of required equipment. Cashman Equipment Rental (Las Vegas) is able to secure a PO for all equipment needed.
