PERFORMANCE WORK STATEMENT

National Park Service

Dinosaur National Monument Jensen, UT

CONSTRUCTION INSPECTOR (CI) SERVICES-

Rehabilitate Mechanical Systems in the Quarry Visitor Center

I. GENERAL INFORMATION

Confidentiality: The information developed from a contract resulting from this solicitation is the property of the U. S. Government and shall be kept in strict confidence.

Performance Period: The construction period is approximately October 30th, 2023 through March 22nd, 2024 (end date TBD based on construction schedule).

Sub task 1 Construction Inspection

Approximately 6-7 hours per day onsite and 1 hour per day performing administrative work emailing daily photos and Construction Dailies to the COR

700 hours onsite, 100 hours drivetime (5 days per week, 14 weeks, 30 min. each way, 2.5 hours average visit)

Monday- Friday, some Saturdays, 7am to 5pm during on site construction phase

Sub task 2 Construction Meetings

0.5-1 hour per week weekly progress meeting (MS teams or conference call) plus one 1hour preconstruction meeting.

II. GENERAL DESCRIPTION OF WORK

The work in this task order consists of one major Task.

Task 1 is inspection and oversight of U.S. government managed contract construction projects. This component shall consist of on-site inspection, special inspections, meetings, office services, and site visits. The Construction Inspector (CI) is responsible for coordinating the government-contracted construction efforts with the park staff's daily operations.

Contractor will be required to provide any automation (computer, printer, monitor, etc).

III. GOVERNMENT PROVIDED MATERIALS

IV. EQUIPMENT REQUIRED

a. The Construction Inspector shall provide the following equipment:

i. Communication Equipment:

1. Provide a cell phone for use in the project vicinity capable of voice mail, sending and receiving calls, local and long distance.

ii. All safety equipment (hard hats, orange safety vest, work boots, safety glasses, dust masks, etc.) for exclusive use of the CI’s. Equipment must be provided as required by applicable Federal and State law.

iii. Each CI shall be equipped adequately to perform tasks necessary as part of general construction.

iv. Each CI shall have available for their use:

1. Hand level

2. 25’ metal tape (retractable)

3. 100’ cloth tape

4. Digital camera

5. Hand calculator, or equivalent

6. Clip board

7. Appropriate clothing and personal protective equipment

8. Infrared thermometer

v. Each CI shall have appropriate means of transportation.

V. TASK 1: INSPECTION AND OVERSIGHT OF U.S. GOVERNMENT MANAGED

CONTRACT CONSTRUCTION PROJECTS

TASK 1 BACKGROUND:

The projects required for oversight and inspection services include the following

• PMIS 239105: The project consists of 1) the removal of the existing building HVAC system and controls and a full replacement with a new HVAC system and the associated updates to the roof and ceiling systems, 2) selective demolition of existing suspended ceiling systems for existing duct and equipment removal and ductwork and equipment installation, 3) patching and repairing of existing single ply roofing system as required for infilling existing roof deck openings after existing rooftop equipment demolition, and installation of new rooftop equipment, curbs and roofing penetrations, and 4) installation of new finishes after new mechanical system installation.

• Contractor shall review plans, drawings and specifications prior to construction start. Contractor will conduct an interview with the COR and visit the site to ensure a full understanding of the project scope and details. Contractor shall also review and be familiar with submittals already approved.

SubTask 1. On-Site Construction Inspection

General: The CM firm shall provide an on-site inspector – Construction Inspector (CI) -with extensive expertise in mechanical (HVAC) and building rehab construction for the time period that work is in progress. The primary role of the CI is to inspect the work of the construction contractor for progress, workmanship and conformance with the contract documents and existing codes.

a. The COR/CO will provide all necessary written notification and/or direction to the contractor. The CI will have no authority to accept or reject work, or to authorize changes to the terms and conditions of the contracts, or obligate the NPS to time or money.

b. The CI shall make recommendations to the COR only, and shall under no circumstances instruct or make recommendations to the construction contractor.

The limits of contractual authority of the Construction Inspector (CI) shall be designated in writing by the CO only.

c. The Construction Inspector shall provide inspection services, and specifically inspect work performed by the construction contractor in accordance with the plan and specifications to verify conformity with requirements of the construction contract.

d. Report to Government regarding the status of the work, problems, disputes, etc.

The CI shall promptly notify the Contracting Officer’s Representative (COR) of any problems or issues observed.

i. Notify the CO/COR of work that is not in compliance with the contract requirements.

ii. Recommend the correction or replacement of non-complying work.

iii. Recommend that the Construction Contractor proceed with work that is in apparent compliance with the construction contract.

iv. Identify plan errors or required field adjustments. Recommend necessary changes to the plans or contract.

v. Recommend suspension of work which is not being performed in compliance with the construction contract or which is causing damage and/or liability to the Government.

vi. Notify the COR of safety deficiencies and if a deficiency is life threatening, he/she may request that the work be stopped.

e. Coordinate inspections around planned construction activities.

Contractor’s schedule may change with short notice, CI will be required to adjust accordingly and may not cause the contractor to incur delays.

i. Plan and coordinate inspections with the construction contractor to minimize impacts on construction operations, and confirm that critical inspections occur as required. CI must be onsite for all testing activities (see sub task 6). Critical inspections include key activities such as install of new mechanical equipment, testing and balancing of new mechanical work, modification of structural steel framing, new electrical panel work, membrane roof repair, and other inside architectural finishes.

ii. Verify that workmanship, materials and equipment installed by the construction contractor meet or exceed the requirements of the contract drawings and specifications.

iii. Perform overall inspection of construction activities. Perform random inspections at key points on construction on a regular bases (e.g. come to the site unexpected and at different times of the day).

iv. Monitor overall project work methods for substantial compliance with permits and environmental requirements.

v. Inspect the work for substantial compliance with the construction contract requirements and industry standards for construction related work.

vi. Monitor the construction contractor’s quality control operations to determine substantial compliance with contract requirements and the approved contractor quality control/quality assurance plan.

vii. Review all deliveries or items for compliance with their respective submittals. Notify the COR when discrepancies arise.

f. Provide engineering support services which may include:

i. Assisting in the review of the Construction Contractor's shop drawings, schedules, and other submissions.

ii. Reviewing as-built drawings provided by the Construction Contractor to verify that as-built conditions have been marked on the plans.

iii. Reviewing and checking progress estimates.

iv. Perform field measurement and verification for pay requests and verify amount of work completed corresponds to pay request amounts.

g. Monitor the adequacy of Construction Contractor material inspection and testing systems.

h. Provide detailed written documentation if disputes with the Construction

Contractor arise or if events indicate the possibility of a contract modification.

This documentation shall include specific recommendations for the resolution of the problem.

i. Ensure construction safety: Review the Accident Prevention Plan developed by the construction contractor. During construction, monitor compliance by the contractor with contractual safety requirements and make periodic reports on contractor’s compliance with its safety plan. Notify the construction contractor of safety deficiencies and report them to the COR/CO.

viii. Cooperate to the extent necessary with officials of other agencies who are vested with authority to enforce OSHA & other safety requirements.

ix. Advise the construction contractor immediately of any safety hazards observed. (The CO issues ALL stop work orders, except for issues involving safety. If the CI observes a safety condition that appears life threatening, he/she may request the work to be stopped. This person shall then immediately advise the CO.)

x. Prepare Accident Report. In the event of an accident or fire, the construction contractor, the CI, and others familiar with the circumstances will be required to prepare, coordinate and submit an accident report for accidents occurring on the construction project. Maintain a file of all accident reports.

xi. None of the requirements in this section intends to relieve the construction contractor of its responsibility for the safety of the workplace or for the method or manner of construction, or to infer any liability onto the CI for the construction contractor’s failure to ensure a safe workplace.

j. Work is intended to occur from 7:00am to 5:00pm, Monday through Friday. Some work may occur outside of this schedule, but will be irregular and require discussions prior to the work occurring.

k. The construction contractor is required to provide a Quality Control Manager (QCM) who will be responsible for writing a Quality Control Plan (QCP) for various construction items and overseeing and ensuring quality control on the project. The CI shall be aware of all of the QCM activities and be responsible for periodically independently verifying any testing the QCM performs. The CI shall be onsite for all QCM testing activities. If the CI observes that the contractor’s testing may not be in compliance, the CI shall promptly notify the CO and COR.

l. Daily Log of Construction Report are to be completed onsite during the inspection daily and emailed to the COR including photos by the end of each day. See the attached format.

a. Daily narratives of all Construction Contractor activities including number of hours worked by Construction Contractor employees and equipment. A Construction Contractor's daily record of operations may be used as the basis for these narratives, verified on a sampling basis approved by the

COR.

b. Measurement checks, computations, and other activities supporting payment for all items in the contract.

c. Test results, measurements, and other documentation verifying the adequacy of the Construction Contractor's quality control system(s) and compliance with the terms of the contract.

d. Digital, .jpg format, labeled photographs of the different construction operations providing a pictorial record of the project's construction stages.

Cameras should be digital, five megapixel minimum.

SubTask 5. Attend Construction Progress Meetings

a. The CI shall participate in weekly half-hour to one hour progress meetings with the COR, Contracting Officer, and the contractor. The purpose of these meetings are to discuss scheduling of weekly activities, status of work, submittals status, RFI’s, QC review, and etc. The Contractor and/or COR leads these meetings and provides minutes.

i. Expect approximately 14 progress meetings during the period of performance.

b. The CI shall participate in the approximately one hour pre-construction meeting with the COR, Contracting Officer, and the contractor. The purpose of this meeting is to discuss mobilization, scheduling, workflow, park rules and regulations, safety, quality control, submittals, and etc. The Contracting Officer and/or COR leads this meeting and provides minutes. Expect the pre-construction meeting to take place approximately 1-2 weeks before the construction start date.

VI. QUALIFICATIONS OF CONSTRUCTION INSPECTOR

Construction Inspector- Shall have the following minimum knowledge, skills, abilities and experience:

a. Shall possess one of the following minimum qualifications:

1. Registered Professional Engineer; or Bachelor Degree in Mechanical

Engineering or Construction Management with 3 years on-site project administration; or minimum of 5 years of progressively responsible experience in exterior construction projects including at least 3 years as a Project or Resident Engineer on State or Federal construction or equivalent projects.

2. Ten years increasingly responsible experience as Inspector, Project Engineer, or the equivalent, on city, county, state or federal or similar construction, with specific experience in mechanical (HVAC) and building rehab construction.

VII. PROTECTION OF INFORMATION & CONFLICT OF INTEREST

a. Performance under this contract may require contractor access to data and information proprietary to the National Park Service, another government contractor, concessioner, or of such nature that its dissemination or use, other than as specified in this contract, would be adverse to the interests of the Government and/or others. Employees shall not divulge or release data or information developed or obtained under performance of this contract, except to authorize government personnel or upon written approval of the CO. Employees shall not use, disclose or reproduce proprietary data other than as specified in each task order.

c. Inquiries received by the Contractor for work performed under this contract shall be referred to the COR for evaluation under the Freedom of Information Act. The Contractor is responsible for search and submission of records upon request by the COR.

d. The CI may not work on any project where a spouse, minor child, or member of the CI’s household is employed by, on the board of, is an officer of, or has an ownership interest in the construction contractor, a first or second tier subcontractor, or supplier to the construction contractor or subcontractor.

e. The CI, during the time they are contracted to provide services to the Government, may not seek employment with any contractor or subcontractor working on the same Construction Contract.

VIII. REPLACEMENT OF PERSONNEL

All changes in assigned personnel will be subject to approval by the CO.

a. The CO shall have the authority to require the replacement of any Contractor personnel not exhibiting integrity, capability, responsibility, or reasonable safety in their job performance. For the purposes of this contract, on-site CI employees have the same restrictions as Federal Employees in regards to 5 U.S.C. 7321- 7326, the Hatch Act. Unsuitable job performance includes but is not limited to the following:

i. The CI does not report to their assignment for the scheduled work hours.

ii. The CI employee is late by ½ hour or more two times in any four-week period.

iii. The CI causes a safety hazard at the work site.

iv. The CI deliverables consistently contain errors, are incomplete, or services provided are below the required standard of performance.

v. The CI does not exhibit adequate capability in performing the work.

vi. On-site CI employees do not follow the restrictions of the Hatch Act.

vii. Improper use of Government property, including items such as the telephone, computer, facsimile, and copier.

b. A CI removed due to Government determination of unsuitability shall be replaced within 5 calendar days.

IX. PERSONNEL REQUIREMENTS

PERSONNEL

The Contractor shall employ personnel qualified and capable to perform these services as required under this scope of work. All personnel providing services inside the buildings shall be permitted to work in the United States and shall be able to read, speak, write, and understand the English language. The Contractor shall ensure that all employees are legal residents of the United States. Personnel providing services under this contract shall not be considered employees of the Government. All employees assigned by the Contractor to perform work under this contract shall be physically able to do the assigned work during the entire period of the contract.

All contract personnel attending meetings, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

CONDUCT OF PERSONNEL

Contractor personnel's conduct shall not reflect discredit upon the federal government. The Contractor shall remove any employee for any violations of law or Park Service regulation from the jobsite as determined by the Contracting Officer or Park law enforcement. The removal from the job site of such a person shall not relieve the Contractor of the requirement to provide sufficient personnel to perform adequate and timely service.

THE CONTRACTOR SHALL NOT

Employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest.

X. FEE AND PAYMENT

a. Request for progress payment shall be made on the basis of monthly-itemized invoices submitted for completed work in accordance with the purchase order.

b. Invoices shall include a description of the work task, personnel involved, the dates and hours worked based on hours on site, the cost for the month and the cost to date for each item of service performed. Itemized receipts shall support travel expenses.

c. Travel time to and from the site shall not be included in the hours charged for payment. Overtime will not be paid unless authorized in advance by the COR.

d. Payment shall not be made in excess of the ceiling price unless the CO authorizes a revision to the ceiling price in writing.

e. (Invoices shall be submitted electronically through the U.S. Department of the Treasury’s Invoice Payment Platform (IPP) (https://www.ipp.gov/), after review of the draft invoice by the COR .

f. The following supporting documentation is required as an attachment for backup with each IPP invoice:

i. Payment for On-Site Construction Inspection and Site Visits: For performance of on-site inspection as defined in Section G of the base contract, payments will be made to the CM firm on the basis of direct hours incurred at fixed hourly rates as provided under the terms of the contract and direct expenses as indicated and approved above. Travel time to and from the site shall not be included in the hours charged for payment. Travel and per diem expenses shall be paid in accordance with Federal Travel Regulations and Section G, DSC-14 TRAVEL. Itemized receipts shall support travel and field office expenses. Payment shall not be made in excess of the ceiling price unless the CO authorizes a revision in writing. Overtime will not be paid unless authorized in advance by the COR.

ii. Payment for Office Services: : For performance of approved office services as defined in Section G of the base contract, the CM firm shall be paid on the basis of direct hours incurred at the fixed hourly rates as provided in the contract. Invoices shall include a description of the services and shall identify the personnel performing the services. Payment shall not be made in excess of the ceiling price unless the Contracting Office authorizes revision in writing.

iii. Summary of Negotiated Price. In accordance with the terms of the IDIQ https://www.ipp.gov/ contract, the CM firm shall be paid on a not-to-exceed basis.

g. CM registration is required to access the IPP. The CM Government Business Point-of-Contact (as listed in the System for Award Management (SAM) System (formally the Central Contractor Registration (CCR) System)) will receive enrollment instruction via email from the Federal Reserve Bank of Boston (FRBB) within 3-5 business days after contract award. CM assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

h. If the CM is unable to comply with the requirement to use IPP for submitting invoices for payment, the CM must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

i. A Release of Claims is required for all Call Orders totaling $150,000 or greater. The CM firm shall submit a signed Release of Claims to the Contracting Office after completion of the work and as a prerequisite to final payment. When no claim is being declared by the CM, place the word “None” in the Release of Claims” form under the word “except”. Correspondence, identifying data and other pertinent documentation shall accompany the Release of Claims. All other terms and conditions remain unchanged.

j. Summary of Negotiated Price: The sum of $ is obligated as the maximum total Call Order amount to furnish all supplies and services required to accomplish all work required under this Call Order.
