Cape Cod National Seashore Performance Work Statement (PWS)
Tree/Woody Vegetation Removal
This contract shall remove hazardous and/or nuisance trees/woody vegetation at Cape Cod National Seashore facility locations. The locations are shown on paragraph 3.1 along one park roadway, three (3) facility location and at twenty-four (24) housing locations within the National Seashore. Removal includes cutting down the woody vegetation, cleanup, removal from the site and proper disposal of all debris generated under this contract.
PART 1: OVERVIEW
1.1 The Contractor shall furnish all necessary supervisor, equipment, labor, material, and plant for the tree/woody vegetation removal from the site, cleanup, proper disposal, and all related incidental work as in accordance with the bid schedule and specifications stated herein.
Therefore, any items not specifically noted, but necessary for performance in accordance with accepted industry standards, shall be furnished under this contract.
1.2 The contractor shall designate an OSHA competent person and OSHA qualified person(s) for each crew. The person(s) shall be on site while work is being performed.

PART 2: SCOPE
2.1. The Contractor is responsible for contract performance quality control and shall develop and maintain an effective Safety and Quality Control (QC) program to ensure services are performed in accordance with this PWS.
2.2. All equipment must meet all federal OSHA, state and local safety requirements and must be properly licensed, certified, and qualified. This includes equipment and hand tools such as chain saws, bucket trucks, aerial lifts, cranes, chipper trucks, wood trucks, etc. which may be needed to correctly perform woody vegetation removal in accordance with the specifications stated herein.
2.3. Contractor shall confine his work, the storage of materials and equipment, the parking of vehicles, and all other operations in connection with this contract to the specified hours and work areas approved by the Contracting Officer Representative (COR).
2.4. Responsibility Regarding Existing Structures, Utilities, Existing Plant Material and Other
Landscape Features:
2.4.1. The contractor shall be held responsible for any damages to, and for maintenance and protection of existing structures. Contractor shall patch, repair, or replace portions of sidewalks, curbs, gutters, streets, manholes, and the like that are damaged in connection with work under this contract or as a result of operations thereunder. Materials and methods shall conform to the current standards for the area damaged, match existing on-site materials, shall meet the approval of all cognizant officials and the COR. All damaged areas shall make smooth, satisfactory, and imperceptible transitions to existing adjacent work, and shall be performed without additional expense to the NPS.
2.4.2. The contractor will be held responsible for any damages to, and for maintenance and protection of existing utilities.
2.4.3. The contractor shall preserve and protect all existing vegetation such as trees, shrubs, and grass areas on or adjacent to trees being removed which do not reasonably interfere with work. The contractor shall be responsible for all unauthorized cutting or damage to trees and shrubs, including damage due to careless operation of equipment, stockpiling of materials, or tracking of grass and other surfaced areas by equipment. Such damaged areas or materials shall be restored, repaired, or replaced by the contractor, as directed by the Contracting Officer, at no additional cost to the Government.
2.5. The contractor will be required to furnish all labor, materials, equipment and plant for daily cleanup and restoration of all disturbed areas or features, which have been damaged during the course of this contract.
2.6. The Diameter at Breast Height (DBH) shall be the method to determine the tree size. The
DBH is measured on the trunk at a point 4.5 feet above the average ground level. Where the trunk divides into several smaller trunks at a point lower than 4.5 feet from the ground, the tree size shall be the diameter measured at the highest point on the single trunk. If a tree falls between sizes as listed in the bid schedule the tree shall be placed in the next larger size (i.e.:
a 17 1/2-inch diameter tree shall be documented in 18-inch diameter).
Note: All DBH measurements identified within this PWS are approximate measurements.
2.7. All woody vegetation removal under this contract shall comply with American National
Standard ANSI Z133 (2017) – Safety Requirements for Arboricultural Operations and requirements per Part 3: Safety.
PART 3: SAFETY
3.1 Accident Reporting
The Contractor shall report accidents and incidents incurred while performing work under this contract immediately by the most expeditious means possible, but not more than one hour following the accident or incident to the COR, Chief Facilities Management and Contracting Officer. Examples of accidents are as follows: One or more lives lost, one or more persons critically injured, one or more persons hospitalized due to one incident, property damage, fire causing damage to structures, equipment, or vehicles, and HAZMAT, hazardous substances, and HAZWASTE incidents.
Immediately after a job-connected injury, the Contractor shall prepare a record of the incident/accident and forward it by email to the COR. The COR will forward the incident/accident report to the facility safety specialist and the Chief Facility Management. If more information is required, the Safety specialist will coordinate with the COR for the required information. If the Contracting Officer notifies the Contractor of any noncompliance with foregoing provisions and the action to be taken, the Contractor shall, after receipt of notice, immediately correct the deficiencies. Such notice when delivered to the Contractor or his representative at the site of work will be deemed sufficient for this purpose. If the Contractor fails or refuses to comply promptly, the Contracting Officer may issue an order stopping payment on work performed under this contract until satisfactory corrective action has been taken.
3.2 Safety and Environmental Protection Requirement
Maintain contract area(s) in a neat, orderly, and safe condition at all times. All work areas shall be made secure and safe after hours, on weekends and holidays.
No smoking (including vaping) or use of tobacco products will be allowed on the government facilities.
Contractor personnel shall not enter the sites or perform work while in possession of, or while under the influence of, alcohol, tetrahydrocannabinol, or any controlled substance.
During the execution of this contract, the Contractor shall conform to the rules and regulations as set forth by OSHA Safety and Health Standards. The Contractor shall provide barriers, temporary fencing, locks, signage, etc. wherever work could cause injury to workers, visitors, CACO staff.
All workers shall wear OSHA required safety equipment and where applicable safety equipment required by American National Standard ANSI Z133 (2017) – Safety Requirements for Arboricultural Operations. When conducting operations near or adjacent to roadways, parking area, driveways or within the limits of work all employees shall wear reflective, bright orange or lime garment; ANSI/ISEA (International Safety Equipment Association) Class 3 Garment (AVY725SC2) with a minimum of 201 square inches of reflectorized or high-visibility material
The Contractor shall provide and maintain environmental protection during the life of the Contract to control pollution or to correct conditions that develop during this contract.
Equipment shall not be allowed to operate outside the limits of work or to disturb existing vegetation. Equipment shall be kept in good repair, without leaks of hydraulic, fuel or lubricating fluids. Contractor must visually inspect all equipment prior to commencing work every day. If such leaks or drips do occur, they shall be cleaned up immediately.
Confine equipment maintenance to one location. Control runoff in this area to prevent contamination of soils and water. No equipment repair will be allowed on the site.
It is the contractor’s responsibility to ensure that any disturbance or damage done during the course of this contract to the existing utilities, landscape, building or government materials, shall be repaired or restored to its original condition by the contractor at contractor’s expense prior to completion of the job.
3.3 Safety Plan
The contractor is solely responsible for compliance with the Occupational Safety and Health Act (OSHA) (Public Law 91-596) and the resulting standards, OSHA Standard 29 CFR 1910, 1926, American National Standard ANSI Z133 (2017) – Safety Requirements for Arboricultural Operations and the protection of their employees. The contractor shall establish and maintain a Safety Plan that delineates the processes and procedures the contractor shall use to prevent accidents and preserve the life and health of contractor and Government personnel. This plan shall be delivered within 5 calendar days after contract award and shall be reviewed by the COR prior to the start of work at the site. The contractor shall report Contract employees’ accidents and injuries to the contractor’s Project Management Staff, the Contracting Officer, Chief of Facilities, and the COR.
The contractor shall be responsible for all damages to persons or safety and health precautions to protect the work, the workers, the public, and the property of others.
The contractor’s Safety Plan shall include the following provisions: 1 The contractor safety inspection plan and investigation process; 2. The contractor plan for contractor personnel protective equipment and safety devices; 3. Equipment maintenance and certifications; 4. Records and certificates for contractor personnel required training; 5.
The contractor procedures and practices that minimize accident risk; 6. The contractor hazard reporting procedures IAW 29 Code of Federal Regulations (CFR) 1910, and 1960, as applicable; 7. The contractor’s spill prevention program and plan; and 8. Designated competent person(s) with applicable training and certificates.
3.4 Pollutant Spill Prevention, Notification, and Cleanup:
Provide measures to prevent spills of pollutants and respond appropriately if a spill occurs.
A pollutant includes any hazardous or non-hazardous substance that when spilled, will contaminate soil, surface water, or ground water. This includes any solvent, fuel, oil, paint, pesticide, and engine coolants, or similar products.
SPILL PREVENTION NOTIFICATION AND CLEANUP PLAN: This may be a tailgate session. The discussion is for the purpose of determining compliance with the specifications only and shall not relieve the Contractor of the responsibility for compliance with all Federal, State, and Local regulations. Include the following in the discussion:
1) Spill Prevention measures. Describe the work practices or precautions that will be used at the job site to prevent spills. This will include storage of fuels and other substances in spill proof containers; and management techniques such as requiring workers to handle material in certain ways.
2) Notification. Notify COR immediately. The State of Massachusetts and the Environmental Protection Agency require by regulation, that anyone who spills certain types of pollutants in certain quantities notify them of the spill within a specific period.
Some of these agencies require written follow up reports and cleanup reports. Include in the discussion, the types of spills for which notification would be made, the agencies notified, the information the agency requires during the notification, and the telephone numbers for notification.
3) Employee Awareness Training. Describe employee awareness training procedures that will be implemented to ensure personnel are knowledgeable about the contents of the discussion and the need for notification.
4) Commitment of Manpower, Equipment and Material. Identify the arrangements made to respond to spills, including the commitment of manpower, equipment, and material.
3.5 Permits and Approvals
The Contractor shall provide the COR with a copy of State and Federal licenses, operating permits, and certifications.
Contractor shall obtain all required permits for the performance of the work specified in Contract Documents at no additional cost to the contract. Please see attachment B, Deliverable Schedule.
Written approval from the park is required prior to blocking or obstructing parking areas, roadways, or egress routes.
3.6 Regulations

3.7 Utilities and Services
Many of the sites are residential leased properties, seasonal use properties and government administrative office facilities. The use of sanitary facilities for the contractor will not be available.
The Contractor shall drive on marked and established roadways and driveways.
Do not drive on or over sidewalks, curbs, lawns, etc. without approval from the COR.
The contractor shall locate and prevent damage to known utilities. If damage occurs, contractor shall repair utility at no additional expense to the Government. If damage occurs to an unknown utility, contractor shall repair the utility. An equitable adjustment will be made in accordance with the Changes clause of the contract.
PART 4: EXECUTION
4.1. General
4.1.1. Trees shall be felled only when there is an adequate felling area at least equal in radius to the height of the tree. Trees that cannot be felled due to adjacent trees, vegetation, roadways, buildings, structures, utilities, and/or lack of an adequate felling area shall be topped and/or sectioned.
4.1.2. The Contractor shall take all reasonable precautions to avoid damaging surrounding vegetation or lawn areas and prevent gouging and erosion of soils because of tree removal operations (i.e.: removal of stubs that might dig in and blanketing the area with brush and/or logs to cushion the fall).
4.1.3. The contractor shall chip all material and remove all remaining wood and debris from the park and dispose of legally off site.
4.1.4. All stumps shall be cut to a height not to exceed 2" from grade unless directed otherwise by the COR.
4.2. Location Details
4.2.1. Nauset Ranger Station:
3.2.1.1. Trees to be removed will be tagged by NPS personnel prior to contractor arrival. NOTE: Utility lines are present in this area.
4.2.2. Bio Lab:
3.2.2.1. Trees/woody vegetation shall be cleared 10 feet from the driveway’s edge.
3.2.2.2. Trees/woody vegetation shall be cleared 10 feet from the parking lot’s edge.
3.2.2.3. Trees/woody vegetation shall be cleared 10 feet from buildings/structures.
4.2.3. Tin Pan Alley (roadway):
3.2.3.1. Trees/woody vegetation shall be cleared 10 feet from the roadway’s edge. NOTE: Utility lines are present in this area.
4.2.4. North District Maintenance:
3.2.4.1. Trees/woody vegetation shall be cleared 10 feet from the fence line.
3.2.4.2. Trees/woody vegetation shall be cleared 10 feet from the parking lot’s edge.
3.2.4.3. Remove (1) tree leaning towards building corner - tagged by NPS personnel prior to contractor arrival.
4.2.5. Twenty-four (24) Housing Units
3.2.5.1. Trees to be removed will be tagged by NPS personnel prior to contractor arrival.
PART 5: SCHEDULE
5.1. Work is to be performed during the hours of 7am and 5pm, Monday through Friday. No work is to be performed on Saturday or Sunday or on federally recognized holidays unless authorized by the COR.
5.2. Work shall be scheduled and arranged so as not to interfere with normal activities of the park.
Advanced notice will be given to the contractor if a conflict is expected to divert from a prearranged schedule.
PART 6: DELIVERABLES
6.1. Within five days of award, the Contractor shall provide the following:
1) Safety and Accident Prevention Plan
2) Job or Activity Hazard Analysis
3) License, certification and permits
4) Spill Prevention Plan
5) Activity Hazardous Analysis (AHA)
PART 7: INSPECTION/ACCEPTANCE
7.1. The NPS reserves the right to conduct any inspection it may deem necessary prior to acceptance and approval of payment, to assure that all work conforms to the Performance Work Statement and any applicable standards, regulations, or laws.
