CACO – Cape Cod National Seashores, Hazardous Tree Removal Solicitation: 140P4323Q0057

Amendment 0004

Question 001: After reviewing the Nauset Ranger station and the work at Tin Pan Alley it would be safest to have the power disconnected during some of the tree removals. Would this be possible, assuming the ranger station and the maintenance garage have generators? The power disruption would be short term. To have the power shut off the Park Service would have to pay Eversource and Bartlett Tree Experts would handle the scheduling.

Government response: The contractor pays for any electrical outage work and coordination with the local utility. The contractor is responsible for the health and safety of its employees. Paragraph 3.3 of the SOW states, “The contractor is solely responsible for compliance with the Occupational Safety and Health Act (OSHA) (Public Law 91-596) and the resulting standards, OSHA Standard 29 CFR 1910, 1926, American National Standard ANSI Z133 (2017) – Safety Requirements for Arboricultural Operations and the protection of their employees. The contractor shall establish and maintain a Safety Plan that delineates the processes and procedures the contractor shall use to prevent accidents and preserve the life and health of contractor and Government personnel. This plan shall be delivered within 5 calendar days after contract award and shall be reviewed by the COR prior to the start of work at the site. The contractor shall report Contract employees’ accidents and injuries to the contractor’s Project Management Staff, the Contracting Officer, Chief of Facilities, and the COR. The contractor shall be responsible for all damages to persons or safety and health precautions to protect the work, the workers, the public, and the property of others.

The contractor’s Safety Plan shall include the following provisions: 1 The contractor safety inspection plan and investigation process; 2. The contractor plan for contractor personnel protective equipment and safety devices; 3. Equipment maintenance and certifications; 4. Records and certificates for contractor personnel required training; 5. The contractor procedures and practices that minimize accident risk; 6. The contractor hazard reporting procedures IAW 29 Code of Federal Regulations (CFR) 1910, and 1960, as applicable; 7. The contractor’s spill prevention program and plan; and 8. Designated competent person(s) with applicable training and certificates.”

Question 002: Is the prevailing rate wage based on the Government rate or our state rate?

Government response: The Wage Determination is based off the most recent rates posted in SAM.gov at the time of award.
