Dear Contractor:
The purpose of this Request for Proposal (RFP) 9531CB20R0042 is to acquire a life insurance carrier to provide life insurance benefits to CFPB employees, as outlined in the Statement of Requirements provided herein. The resulting contract will be Fixed Unit Price with one (1) base year and four (4) one-year option years, not to exceed five (5) years, if all options are exercised.
The CFPB hereby issues a combined synopsis/solicitation for commercial items issued on Contract Opportunities (beta.sam.gov) using the policies contained in FAR Part 12 – Acquisition of Commercial Items and FAR Part 13.5 Test Program for Certain Commercial Items, to obtain contractor services in support of this requirement. CFPB intends to award a single contract as a result of this solicitation.
This solicitation is not issued as a small business set-aside. The NAICS code is 524113, Direct Life Insurance Carriers, and the business size standard is $41.5 Mil.
The Technical and Price Proposal must be received by 3pm ET October 13, 2020 and shall be emailed to both Jerry.Salinas@cfpb.gov and Vanessa.delToro@cfpb.gov.

SECTION 1
PRICING DESCRIPTION AND TABLES
1. FIXED UNIT PRICES FOR SERVICES
Offerors shall provide firm fixed unit prices for the Base Year and Option Years 1 through 4 as indicated in the Pricing Model (Attachment 1).
The fixed unit prices for servicing the Life Insurance policies shall apply for the duration of the contract.
The fixed unit prices are flat rate pricing and includes the cost of any claims, report preparation, salaries, overhead, other direct costs, general and administrative expenses, and profit.
The unit prices for the Base Year and Option Years 1-4 are fixed unit prices and shall not be subject to price adjustment. The Contractor shall be paid on a bi-weekly (i.e., every other week) basis for Operations (i.e., effective period of coverage which begins January 1, 2021) at the fixed prices set forth below (to be included upon award, and taken from the contractor’s completed Pricing Model (Attachment 1)).
Please note the estimated volumes provided in the Pricing Model (Attachment 1) are derived from existing CFPB limited and historical census data and are only for the purposes of arriving at a total price for evaluation purposes. The estimated volume data do not represent actual volumes for purposes of payment. CFPB has limited and historical information and makes no representations as to the accuracy of these estimates.
SECTION 2
STATEMENT OF REQUIREMENTS (SOR)
LIFE INSURANCE SERVICES PROGRAM
1.0 SCOPE
The Human Capital Division of Consumer Financial Protection Bureau (CFPB) requires a Life Insurance carrier to provide Life Insurance benefits for its active employees effective January 1, 2021.
This plan is offered in addition to Federal Employees Group Life Insurance (FEGLI). Employees can continue to be covered by FEGLI alone, both FEGLI and the CFPB plan, or the CFPB plan only.
CFPB will pay 100% of the cost of Basic Life if enrollee is not enrolled in FEGLI and 50% of the cost if enrolled in FEGLI.
Enrollment Eligibility The eligibility requirement is defined as a regular employee (full-time or part-time) or temporary employee with an appointment greater than one year; and actively at work at least 60 hours biweekly. Eligible dependents include lawful spouses, domestic partners and children up to age 22 or up to age 25 if a full-time student. Retirees are not eligible for the plan and will remain ineligible, despite being covered under FEGLI.
Enrollment and Effective Dates Initial enrollees will be effective January 1, 2021. New hires must meet the eligibility requirements.
New hires will have 60 days to elect coverage and elections will be effective the first pay period after receipt. The employee must be in a pay status. Open season elections will be effective the first pay period of the new year. Qualifying life events (QLEs) will be effective the first pay period after receipt and the employee must be in a pay status.
2.0 BACKGROUND
The Dodd-Frank Wall Street Reform and Consumer Protection Act requires that CFPB provide benefits to employees that are comparable to the benefits being provided by the Board of Governors of the Federal Reserve. In addition, employees who currently work at Office of Comptroller of Currency (OCC) and Federal Deposit Insurance Corporation (FDIC) are offered enhanced benefits in addition to the standard Title 5 Federal benefits. In order to achieve comparability and to attract talent and to make sure that there are little or no benefit gaps for transferring employees, the purpose of this solicitation is to maintain a life insurance plan for all active Bureau employees effective January 1, 2021. This plan is offered in addition to FEGLI. Employees can continue to be covered by FEGLI alone, both FEGLI and the CFPB plan, or the CFPB plan only. CFPB contributions towards the basic coverage in this plan are as follows:

3.0 REQUIREMENTS
3.1 Plan Design – The Life Insurance Plan is a contributory life insurance program that is available to eligible employees. The Life Insurance Plan offers basic life insurance, and the following four optional coverages for eligible employees only: Employee Life Insurance, Spouse/Domestic Partner Life Insurance (two levels: Option 1 and Option 2), Family Life Insurance, and 24-hour Personal Accident.
The contractor shall provide the following plan design and coverage, which is what CFPB currently provides employees. Please be advised that CFPB is not authorized at this time to consider coverage beyond that which is already provided to employees, so vendors receive no benefit (and may be negatively impacted in terms of price) by offering coverage beyond that which is specified herein.
Indeed, CFPB is not authorized to consider or accept any deviations. Any deviations offering coverage beyond that which is specified cannot be implemented by the agency. Any deviation, offering coverage considered less than that which is specified will render a proposal technically unacceptable.

3.2 Administrative and Enrollment Service Requirements - The Contractor shall provide the following administrative and enrollment services for the CFPB Life Insurance benefits:
a. Administer a life insurance plan that provides the benefits described in this Statement of
Requirements on a fully-insured non-participating basis.
b. Provide individual conversion policies for the two basic life insurance levels and the optional life insurances. Employees will have 31 days from date of termination to convert their policies.
c. Design, produce and distribute, subject to the approval of CFPB, CFPB-specific claim forms, enrollment forms, beneficiary forms, employee booklets, summary plan descriptions, Standard Operating Procedures, and all other forms and materials required to administer the plan.
d. Provide electronic files of forms and materials (booklets, summary plan descriptions (SPDs), etc.) in prescribed format to be uploaded to the CFPB Intranet.
e. Provide a seamless link to your firm’s website from the CFPB benefit website. Capability to accept online submission of a medical EOI application by the employee is preferred, but not required.
f. Provide a secured electronic site that CFPB benefits administrators can access to view the processing status of employees’ medical EOI applications. Ensure that EOI forms are reviewed and a determination made within 15 business days.
g. Provide a no-cost paramedical examination service at a time and location convenient to the proposed insured.
h. As requested by CFPB, assist in the communication to employees regarding life insurance benefits, including annual open enrollment meetings, if needed. Such meetings would be held at CFPB Headquarters in Washington, DC, and may also be held at up to three regional locations around the country.
i. Provide for direct communication between CFPB administrative staff and the assigned program administrator.
j. Provide service personnel who are accessible and knowledgeable in all aspects of the CFPB Plan.
k. The contractor will submit payment requests (i.e. invoices) bi-weekly (26 invoices per year) through the Internet Payment Platform (IPP). For payment and invoice questions, go to https://www.ipp.gov or contact the Accounting Services Division at (304) 480-8000 option 7 or via email at AccountsPayable@fiscal.treasury.gov.
l. Meet with CFPB on an as needed basis to review status of overall operation of the program.
m. Conduct an annual account management satisfaction survey.
n. Prepare a customized administrative manual to be used by CFPB.
o. Provide a toll-free information line for customer service questions.
p. The plan must be sitused in Washington, DC.
3.3 Claims Administration and Customer Service Requirements - The Contractor shall provide the following claims administration and customer service requirements.
a) Process death claims in accordance with the decedent’s validated beneficiary designations or the “Standard Order of Precedence”.
b) Provide CFPB with notification of the amount and date of the death claim paid to a decedent’s beneficiary(ies).
c) Maintain a death claims service unit with minimum office hours from 8:30 a.m. until 6:30 p.m., Eastern Time, Monday through Friday (except Federal holidays) and provide a message device to handle calls after business hours or on weekends.
d) Provide a toll-free telephone service that has the capability to place calls on hold and queue during peak calling hours. Provide adequate staffing so that all calls are answered on average in 30 seconds.

e) Provide legal defense on disputed claims or to determine eligible beneficiaries where there is ambiguity.
3.4 Management Information Systems (MIS)/Reporting and Monitoring Service Requirements
a) The Contractor shall provide monthly reports to include current and cumulative year-to-date information including paid and incurred claims by plan, covered volume and premium.
b) The Contractor shall be available to provide ad hoc reports such as but not limited to enrollment summary information, data reports on specific elements, and specific claims.
3.5 Transition Period
The Contractor shall provide a transition period which will begin at contract award and continue through December 31, 2020. During the transition period, the contractor shall be responsible for setting up the plan design in its system, assisting CFPB with establishing enrollment and billing processes, and providing materials and staffing to aid in the communication of the benefit plan to employees. The new contractor shall be responsible for all claims incurred beginning Jan 1, 2021.
In addition, during the final year of performance for this contract, the contractor will prepare for and assist with a seamless transition to the new contractor (if applicable) by transferring to CFPB and/or the new supplier, as determined by CFPB, within 30 days of notice of this requirement, all required data and records necessary to administer the plans subject to state and federal confidentiality considerations, without a break in service. The transfer may be made electronically, in a file format to be determined based on the mutual agreement between CFPB and the provider of services. The contractor may be asked to provide phase-in, phase out services for up to a one-year period, if necessary.
4.0 DELIVERABLES

INSTRUCTIONS TO OFFERORS
1.0 Submission of Proposals. Technical and Price Proposals are due electronically by 3pm ET October 13, 2020 to both Jerry.Salinas@cfpb.gov and Vanessa.DelToro@cfpb.gov.
All proposals shall have the subject line “RFP-9531CB20R0042.”
Proposals received after the deadline will not be considered.
Facsimile or physical mail transmissions will not be accepted.
2.0 Questions. Questions concerning this RFP shall be submitted in writing via email to both Jerry.Salinas@cfpb.gov and Vanessa.DelToro@cfpb.gov no later than 3pm ET October 2, 2020.
Questions will be answered in writing through an amendment to the solicitation at Contract Opportunities.
2.1 CFPB Census Data
If Offerors would like CFPB’s most recent available employee census data for life insurance services, please contact both Vanessa.delToro@cfpb.gov and Jerry.Salinas@cfpb.gov. In order to receive the census data for this requirement, the Offeror must submit, as part of its email request to both Vanessa.delToro@cfpb.gov and Jerry.Salinas@cfpb.gov, a signed Non- Disclosure Agreement (NDA) (Attachment 3), signed by an authorized representative of the Offeror.
3.0 Proposal Form and Content.
A. Proposals shall consist of two separate, written volumes, individually entitled as stated below.
1) Volume I – General/Price
2) Volume II – Technical
Volume I - General, shall include the following items:
a. Cover Letter - Provide a cover letter referencing the solicitation number and signed by an authorized official of the firm.
b. Summary Page or Table of Contents
c. Completed Standard Form 1449 - Complete blocks 12, 17 & 30 of the cover page of this
RFP (i.e., Standard Form 1449 “Solicitation/Contract/Order for Commercial Items”).
d. Acknowledgement of Amendments - Provide an acknowledgement of RFP amendments, if any. The acknowledgement must reference the amendment number(s).

i. Financial Rating of Company. Provide the Prime Contractor’s most recent financial rating or filing from each of the following rating agencies. This must be the rating of the prime contractor. If your company is not rated by any of the agencies listed below, please provide a copy of or a link to your most recent audited financial statement.

Volume I - Price, shall include the following items:

3. The Tax Identification Number (TIN) and DUNS Number of the Offeror.
4. A confirmation by the Offeror that its proposed prices are inclusive of the services outlined in the Statement of Requirements.
****In pricing the plan, Offerors are reminded that CFPB is seeking a plan that will be fully-insured and non-participating.
Volume II - Technical
1. The Technical Proposal shall be divided into the following sections and is limited to 25 Pages.
a. Plan Design – Plan Design. Offerors shall provide a copy of the Plan Design Chart in
Section 3.1 of the Statement of Requirements, and add a column to the Plan Design Chart, indicating with a “yes” if the proposed plan meets each particular Plan Design Requirements. Offerors shall confirm that they provide all required services and require no deviations from the Plan Design.
b. Firm Experience – The Offeror must have one (1) year of prior experience of providing life insurance services as a prime contractor within the last five (5) years. The Offeror must submit the following information to demonstrate the experience requirements above:
- Customer name and address.
- Contract number.
- Total dollar value of the contract. If performed as part of a team, provide the dollar value of your firm’s contribution.
- Period of contract performance.

SECTION 4
EVALUATION OF PROPOSALS FOR AWARD
1. The CFPB intends to award a single Fixed Price with Firm-Fixed Rates contract, to the responsible offeror on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors, which is known as the Low Price Technically Acceptable (LPTA) methodology. A decision on the technical acceptability of the lowest priced Offeror will be made. If the lowest priced Offeror’s proposal is determined to be technically acceptable, an award will be made to that Offeror and technical evaluations of other Offerors will not be conducted. If the lowest priced Offeror’s proposal is determined to be technically unacceptable, the next lowest priced Offeror’s proposal will be evaluated for technical acceptability, and so on.
2. To be accepted and eligible for technical evaluation, Proposals must be prepared in accordance with this solicitation and must comply with the instructions given in this solicitation document and must meet all the solicitation requirements. Proposals meeting the requirements of this solicitation and complying with other contract provisions will be evaluated and award made to the responsible Offeror whose proposal is deemed technically acceptable and offers the lowest total evaluated price.
3. The Proposals will be evaluated based on the following factors:
Factor 1: Financial Rating (Go / No Go Factor) Factor 2: Plan Design Factor 3: Firm Experience Factor 4: Price
Factor 1: Financial Rating (Go / No Go Factor) – Offerors must meet the following
Minimum Financial Rating(s) for at least one (1) of the Rating Agencies below in order to progress to the technical proposal evaluation stage. In lieu of being rated by one (1) or more of these Rating Agencies, the Offeror must have an annual premium volume of $1 billion or more as documented in the Offeror’s annual report. In lieu of providing evidence of its Minimum Financial Rating(s) (set forth below), the Offeror shall provide its annual report as part of its Proposal, in order to verify the Offeror’s annual premium volume.
Failure to meet the evaluation criteria for Financial Rating will deem the offeror’s proposal Unacceptable and Unresponsive and the Proposal will not be further evaluated.
Minimum Financial Ratings:
A.M. BEST: Rating of B+ Standard and Poor’s: Rating of BBB Fitch: Rating of BBB Moody’s: Rating of Baa2
Factor 2: Plan Design – CFPB will evaluate the offeror’s plan design and any plan design deviations (see Section 2, Paragraph 3.1). Offerors shall confirm that they provide all required services and require no deviations from the Plan Design.
Please note: Any deviations to the Plan Design requirements will render the offeror’s proposal technically unacceptable. Offerors must be able to meet all plan design requirements specified in the Statement of Requirements and will not be credited for providing deviations to the specified requirements.
Factor 3: Firm Experience – The Offeror must have one (1) year of prior experience providing life insurance benefit services as a prime contractor within the last five (5) years. The Offeror must submit the following information to demonstrate this minimum experience requirement:
Customer name and address.
Contract number.
Total dollar value of the contract. If performed as part of a team, provide the dollar value of your firm’s contribution.
Period of contract performance.
Description of services provided, including the specific services provided by your firm.
Factor 4: Price
The Government will determine which Offeror proposes the lowest evaluated price for the five
(5) year period (base year and four option years), using the following methodology and analysis of information supplied in the pricing tables of the Pricing Model (Attachment 1) of this solicitation.
For the Base Year and each of the four Option Years, the proposed biweekly premium rates by line of coverage (Basic Life, Basic AD&D, Optional Life, Optional Spouse Life, Optional Family Life, 24-hour Personal Accident Self and 24-hour Personal Accident Family) will be multiplied by the applicable volume divided by $1,000 or by the estimated number of units, to develop a biweekly premium. The biweekly premium will then be multiplied by 26 to calculate the annual premium by line of coverage or age band. The sub-total by line of coverage or age band will be totaled to determine the total annual premium for the Base Year and each of the four Option Years.
