SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS

1. Service Required:

The Natural Gas Week Data Source listed on Federal Energy Regulatory Commission (FERC) aka the Commission’s requisition number 39457 is available from only one source and competition is precluded for reasons indicated below. There are no substitutes available.

2. This acquisition is restricted to the following source:

3. Description of the service required, the estimated cost, and required delivery date.

Service: Natural Gas Week Data Source subscription for historical and daily/monthly data user licenses. Provides the latest natural gas market news, prices, data and trends.

PoP: Time of award (base plus 4 one-year options) IGCE: Under Simplified Acquisition Threshold

4. Specific characteristics of the service that limit the availability to a sole source e.g., unique features, function of the item, etc. Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources.

The Federal Energy Regulatory Commission (FERC) is an independent agency that regulates the interstate transmission of electricity, natural gas, and oil. FERC’s Mission is to ensure reliable, efficient, and sustainable energy for consumers. Fulfilling this mission involves pursuing two primary goals:

Ensure that rates, terms and conditions are just, reasonable and not unduly discriminatory or preferential.

Promote the development of safe, reliable and efficient energy infrastructure that serves the public interest.

In an effort to support the first goal, the Commission protects consumers through market oversight and surveillance; assuring compliance with tariffs, rules, regulations, and orders;

detecting, auditing, and investigating potential violations; and developing and formulating policies and regulations to address emerging issues. The Commission employs various methods in these activities, including:

Developing surveillance procedures to detect potential manipulation, anticompetitive behavior, and other anomalous activity.

Identifying potential subjects of nonpublic investigations.

Analyzing trading and other complex data related to manipulation or other improper conduct.

Analyzing long-term electric market trends.

Sole Source Justification for Simplified Acquisitions

Issuing, coordinating, and developing proposed policy reforms to address emerging issues affecting wholesale and interstate electric energy markets.

Reviewing index data used to set rates in jurisdictional tariffs.

In support of these objectives, the Commission is required to review indices referenced in proposed tariff filings are being supplied by Commission approved index developers and that the indices themselves meet minimum liquidity criteria set forth in the Commission’s Price Index Order. In order to do that, staff must have access to index data from all Commission approved index developers.

The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system:

These are “direct replacement” parts/components for existing equipment.

Other information to support a sole-source buy:

Natural Gas Week Data Source (of Energy Intelligence Group, Inc.) is a Commission approved index in which Commission staff must have access to. The Energy Intelligence Group is the only supplier of the required data.
