IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A “JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION”
See Page 1
I. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED
The National Archives and Records Administration (NARA) request approval to use Other than Full and Open Competition procedure to limit competition to authorized BMC vendors who are able to provide BMC Remedy Force Service Desk Software Annual Maintenance Support Renewal.
A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE)
The BMC Remedy Force application is a cloud based Software as a Service (SaaS) and is an integral part of the ERA Service Desk, providing a means to record and track user calls, incidents and requests for service. Remedy Force includes proprietary configurations and software that cannot be supported by anyone other than the owner/developer or its authorized vendors. Our current set-up is the Remedy software installed onsite with licenses and maintenance provided by BMC. As a cost savings measure, NARA has decided to forgo the traditional onsite installation and support of the Remedy software and go with a cloud based SaaS agreement with BMC which is Remedy Force. This agreement ensures that the Electronic Records Archives (ERA) Service Desk continues to function properly on a day-to-day basis with little to no training required. The period of performance: September 28, 2018 through September 27, 2019.
The estimated cost is as follows:
Base Year $ Option Year I $ Option Year II $ Option Year III $ Option Year IV $
TOTAL COST $
1. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION.
41 U.S.C. 3304(a) (1) – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED
NARA relies on BMC Remedy software product’s functionality such as service level management, self-services, and discovery and asset management. NARA purchase the licenses through BMC directly because they are the propriety manufacturers and sole source providers.
1. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES.
Market research shows that this requirement is for services that are commercially available through BCM authorized resellers. Quotes will be solicited on Fedbizops for competition among BCM authorized resellers. The requirement will be awarded to the vendor offering the lowest price technically acceptable.
1. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.
In order to determine price fair and reasonable fair competition quotes will be solicited from BMC authorize vendors with the award going to the vendor offering the lowest cost technically acceptable, historical data will also be a factor to determine price reasonableness.
1. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS CONDUCTED.
Market research shows that this requirement is for services that are commercially available through open market.
IX. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION.
Replacing the Remedy brand with another vendor’s product will affect the capability of the overall system. BMC owns all the manufacturing and technology affiliated with their products and is best suited to ensure that compatibility challenges and or constraints are eliminated. Costs associated with implementing compatibility for universal Remedy products outweigh any cost or schedule savings that might be recouped via unrestricted full and open competition.
X. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION.
N/A
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT PRECLUDE THE AGENCY FROM MEETING THE REQUIREMENTS OF 6.302-1 BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE.
This procurement is except of any action or berries that leads to the restricted consideration in accordance to FAR 6.302-1 (c ) where only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
When Remedy Force reaches end-of-life, NARA will evaluate the possibility of another Service Desk in a cloud solution that can work within the ERA framework. In the meantime, it is the most cost effective solution to buy annual support for devices that we already own.
XII. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S KNOWLEDGE AND BELIEF
