I hereby certify that this sole source justification for an item peculiar to one manufacturer is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify this request is not the result of a desire to expend funds while those funds are still available.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A "SOLE SOURCE JUSTIFICATION."

1. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

The National Archives and Records Administration NARA intents to award an Other Then Full and Open Competition (Brand Name), one base year and one option year Purchase Order for NetIQ Primary Support Engineer-US Renewal.

III. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE).

The MicroFocus suite of software applications is an integral part of the IT Operations environment of the National Archives. These enterprise applications are the Network Operating System for the File and Print environment, the Directory Services for the Enterprise, Identity Management software and Configuration Management software for the enterprise. These different products, referred to as Novell, NetIQ and MicroFocus, are all mission critical software applications supporting the National Archives enterprise infrastructure.

The Primary Support Engineer-(PSE) – US solves problems and provides proactive maintenance on NARA’s systems. This service enables NARA to have personalized and escalated response times from the software engineers, enabling fast resolution of the mission critical services this software provides. Failure to have this service will adversely impact critical mission applications placing our information system at risk.

The estimate cost is projected to be $248,270.00. Services Period of Performance are from May 22, 2018 to May 21, 2019 for the Base Year and May 22, 2019 to May 21, 2020 Option Year I, if Option is exercised.

IV. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITING OTHER THAN FULL AND OPEN COMPETITION.

41 U.S.C. 3304 (a)(1) – Title III of the Federal Property and Administrative Services Act of 1949 and Title 40 U.S.C. 501 - Services for Executive Agencies as implemented by FAR 6.302-1 (c) "The item is peculiar to one manufacturer."

V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.

The NetIQ/Novell Primary Support Engineer-US services requirement can only be provided by MicroFocus, the owner/developer of these software applications. Multiple MicroFocus authorized resellers of this service are available.

VI. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXECPTION UNDER

5.202 APPLIES.

A Request for Quote (RFQ) will be posted in the Federal Business Opportunity (FEDBIZOPS) website for all interested Micro Focus authorized resellers to respond with their quotes.

VII A DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

These services are commercially available through Micro Focus Resellers. The Contracting Officer will determine price fair and reasonableness based, on historical data, and competition. Award will be made to the vendor who is found to be Low Priced Technically Acceptable

VIII. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT COMPLETED.

Market Research was done and it was determined that several Micro Focus partners/authorized resellers can provide NETIQ Primary Engineer Services Support.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION.

Awarding a contract to a vendor who can provide a different solution to what NARA currently uses, would be to undertake a complete revamping of the operating system, the email system, the file servers and the print servers at NARA. This will come at an estimated cost of more than three million dollar, which include purchase of new licenses, the cost of installing and configuring the operating system, email, and printing servers.

X. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.

As technology changes, NARA will monitor the marketplace and complete market research to seek alternate solutions that either advance the capabilities of the status quo or achieve better overall, value and review its options for future consideration from both a budget and compatibility perspective

XII. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S KNOWLEDGE AND BELIEF.
