JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

Steam Tunnel Camera Project

Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification”

This document is a Brand-Name Justification prepared by National Aeronautics and Space

Administration (NASA) for the Langley Research Center (LARC).

The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is the NASA IT Procurement Office.

1. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This justification provides the rationale for contracting for a Brand Name Only Small-Business set-aside award under solicitation number 80TECH23Q0006. The total estimated price of the proposed order is and the estimated period of performance is six (6) months after award of the order.

2. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the

Agency’s needs (including the estimated value):

This action is a firm-fixed price purchase order for the purchase and installation of base infrastructure and fourteen (14) Brand Name only AXIS Q6135-LE Pan Tilt Zoom (PTZ) cameras and electrical accessories in the utility steam tunnels at NASA Langley Research Center (LARC). The cameras will be used to monitor the environmental conditions, detect incidents, and ensure worker safety.

FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302- (1) Only one responsible source and no other supplies or services will satisfy agency requirements.

3. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c) (1) is justified as the AXIS Brand Cameras are the only brand required for this project.

This new requirement is part of a larger program to upgrade and add to an existing video and camera system in the steam plant. The currently awarded projects are the Vistacom Camera Safety & Visualization System under 80NSSC22PC084 valued at $223,914.00. On 80NSSC22PC084, nine (9) new AXIS cameras will be purchased and installed to replace cameras in the steam plant at LARC. This new requirement will be for the purchase of fourteen

(14) AXIS cameras for the utility tunnels. The existing AXIS cameras are managed by a software product called Axis Camera Station. The Camera Station is a Video Management Software designed to improve incident response time, meets privacy requirements, supports analytics, and allows for remote monitoring. The software is only compatible with Axis products.

The Brand Name only AXIS cameras are required for the ease of integration and compatibility with the existing software. The acquisition of a different brand of camera will require the purchase of a separate managing software system which would cause an additional cost to the Government. Steam Plant Operators would also have to be trained on new software which will be time-consuming as they would have to divide their times on operating two systems and two products. This would cause significant downtime and incur additional costs as well. Finally, reconfiguration may be required if another brand name camera is procured and it does not make use of powered fiber. If this occurs, any cameras using traditional ethernet located more than three hundred (300) feet from the switch, would require one of more repeaters. In addition, if another brand camera does not use Power over Ethernet (PoE), additional electrical work would be required at each camera location. By adding additional equipment, it will increase the complexity of the system and the likelihood of failure.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

This action will be posted as a Brand-Name Only Request for Quotation (RFQ) to Sam.gov website.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

This action will be competed via SAM.gov. An opportunity will be provided to capable Small Businesses to provide the brand name product and complete the on-site installation.

Adequate competition is expected which will ensure the Government pays a fair and reasonable price. An award will be made to the Offeror based on Best Value.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

The Contract Specialist (CS) researched the GSA and NASA SEWP website to search for capable contractors to fulfill the requirement and the search yielded no results.

A Request for Information (RFI)/Sources Sought was posted to SAM.gov on February 8th, 2023 with responses due by February 15th, 2023. The intent of the posting was to determine the availability of capable contractors to fulfill the requirement. At the close of the posting the CS received two (2) responses. One (1) response was received from Saunders Contracting Services (WOSB) and one (1) response was received from Vision Technologies (LB).

The CS conducted additional market research via FPDS.gov with the search ‘AXIS Cameras” and the search yielded results of Small Businesses that were awarded similar contracts with NASA.

Based on the Market Research this will be solicited as a 100% Small Business Set-Aside.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

None

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

A notice of NASA’s intent to award this sole-source action is not applicable to this requirement. This is Brand Name Only Justification. The RFQ will be posted as a 100% Small-Business set-aside.

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

There are no barriers. Fair opportunity will be given to Small Business contract holders through Contract Opportunities/www.SAM.gov.
