GEORGE C. MARSHALL SPACE FLIGHT CENTER

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

PURSUANT TO TITLE 10 U.S.C. 2304 (C) (1)

1. This document is a Justification for Other Than Full and Open Competition (JOFOC) prepared by the NASA Marshall Space Flight Center (MSFC) in accordance with Federal Acquisition Regulation (FAR) Part 6.3, Other Than Full and Open Competition, and NASA FAR Supplement (NFS) Part 1806.3, Other Than Full and Open Competition.

2. Nature and/or description of the action being approved: This procurement is to fulfill the requirement of a

Tungsten Module Package for the Electro Optical Systems (EOS) M290 3D printing machine currently installed at MSFC in Building 4707. This purchase will install the EOS software license for editable parameters for melting Tungsten material in the EOS M290 machine, as well as the EOSTATE Exposure and EOSTATE Meltpool Toolbox software and related hardware upgrades into the existing EOS M290 machine.

3. Description of the supplies or services required to meet the agency’s need, including estimated value: The Tungsten Module Package includes meltpool and exposure hardware and software to be installed on the existing M290 machine for monitoring and quality control and will be procured from EOS of North America, Inc. The total estimated cost of this effort is $257,698.00.

4. Statutory authority permitting other than full and open competition: This recommendation is made pursuant to FAR 6.302-1, which implements the authority for 10 U.S.C. 2304(C)(1) for acquisition of supplies or services from only one source and that no other supplies or services will satisfy agency requirements such that full and open competition need not be provided for.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires the authority cited: EOS of North America, Inc, has sole propriety rights to the technologies involved in the EOS 3D printing machines. No other vendor satisfies this requirement. EOS of North America, Inc, has the capability to perform the hardware and software maintenance, yet maintaining compatibility with peripheral hardware and software systems. The NASA EOS M290 machine is under a complete care extended warranty with EOS North America, Inc., which would be voided by attempts of other companies trying to make modifications to the machine. No other vendor could legally add material module licenses to the EOS software that is required, as each requires an encrypted key that comes only from EOS.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable: Pursuant to FAR 5.201, this proposed contract action will be synopsized on the Federal Business Opportunities (FBO). The results received in writing will be appropriately dispositioned and added to this document by addendum.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: Determination will be based upon past procurements.

8. Description of the market survey conducted, and the results, or a statement of the reasons a market survey was not conducted: No further market research has been conducted as this requirement is part of a proprietary system. Another vendor performing work on the machine would void the warranty by EOS.

9. Other facts supporting the use of other than full and open competition: Full and Open competition is not viable due to the proprietary nature of the EOS North America Inc.’s system. The EOS warranty will be void if any modifications are made to the M290 machine by anyone but EOS North America, Inc..

10. Sources, if any; that expressed an interest in writing in the acquisition: The proposed action will be synopsized on Federal Business Opportunities (FBO). The results received in writing will be appropriately dispositioned and added to this document by addendum.

11. The actions, if any, the Agency may take to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services required: There are no known actions that the agency may take to remove or overcome barriers to competition before any subsequent acquisition for the required Tungsten Module Package. For the above reasons, full and open competition is not feasible. Therefore, a sole source purchase from EOS North America, Inc for the Tungsten Module is the only practical approach.
