SF 30 Continuation Sheet
A. This amendment hereby makes the following changes to the solicitation:
1. Incorporating the Pre-proposal conference slides.
2. Reference to Attachment 8 is hereby deleted in section E Solicitation Provisions, Paragraph 3, Proposal Submission Requirements, on Page 357 is hereby deleted in its entirety and replaced with the following: Page Limitation-Excluding the cover page, table of contents, past performance project forms (attachment 3), past performance questionnaires (attachment 4), and the teaming agreement or teaming narrative, the technical proposal (covering all non-price factors) is limited to six (6) pages at least 11pt. font and 1” margins. Pages in excess of this limitation will not be evaluated. The pages excluded from evaluation will be at the discretion of the Agency.
3. Section C-Contract Clauses-09B. PAYMENTS Paragraph 4., is hereby deleted in its entirety and replaced with the following which clarifies that the task order rate will be utilized for deductions not the contract rate:
To verify the monthly payment for productive man-hours, the Contracting Officer’s designated representative may compare the post hours required in the task order with the DHS Form 139, Record of Time of Arrival and Departure from Buildings, or other approved sign-in/sign-out form. The Government may perform a 100% comparison or sampled comparison to verify the accuracy of the Contractor’s invoice. The Government will only pay for services actually rendered by the Contractor and funded on the task order. If variances are noted between the invoice and the DHS Form 139, the Government will propose a price deduction. Please note that the hourly rate utilized for deductions will be the task order rate. For example, if the task order required that a post be manned for 12 hours, and the Contractor billed for 12 hours, but the DHS Form 139 shows that post was manned for 10 hours, the Government will deduct the difference.
4. The sample post exhibit in section E: Solicitation Provisions, Proposal Submission requirements section 2. Management Approach of the Staffing Plan of the staffing plan is hereby deleted and replaced with the following:

B. For informational purposes only, this amendment also issues responses to the questions submitted by industry as follows. Should there be a discrepancy between the requirements outlined in the Statement of Work and the responses provided in this amendment, offerors shall note that the Statement of Work prevails.
1. In the past 6 years that the MAC contract has been in use, what is the maximum # of hours procured and funded for the performance period of 1 year or less, including all options?
Answer: The requested information is not readily available. Since 2016, approximately 1 million hours have been ordered under this contract vehicle and $63,458,853.41 of task orders have been issued. Offerors are reminded any historical data provided here is strictly for informational purposes only. Please refer to the hours reflected on the schedule of the SF1449, which are the maximum total hours for this instant requirement.
2. In an effort to appreciate value of potential discount pricing, please provide how many large scale (over $5M/year) contracts are anticipated to be awarded on the MAC vehicle?
Answer: This is an Indefinite Delivery / Indefinite Quantity Contract and the number of contracts awarded will be determined by the Government. It is unknown how many large scale requirements will be competed under this contract vehicle. Some potential large scale requirements that are anticipated to be competed under the resultant MAC are listed on slide 3 of the slides from the pre-proposal conference.
3. Will the new MAC contract TOs continue to require start-ups of new work with no incumbent PSOs in less than 30 day transitions?
Answer: The solicitation is clear on its face. Transition time at the task order level will vary and may range from 12 hours to 120 days depending on the requirement. See page 4 of RFP
4. Will the new MAC contract continue to use less than 7 day transitions?
Answer: Please refer to the answer for question 3.
5. Will the funding of MAC TOs continue to impact transitions by happening concurrent to the transition where the vendor assumes the risk of starting the transition without funded TOs?
Answer: No service shall commence without appropriate authorization from a Contracting Officer (CO). A Task order will only be authorized by a CO after receipt of appropriate funding to cover the service being ordered. Task orders may be issued verbally by a CO under short time constraints; however the CO’s verbal authorization is a “funded” action.
6. Will all the existing contracts that will be replaced by either short or long term MAC TOs have a provision where incumbent vendors will provide accurate and timely data on their incumbent PSOs to the new vendor?
Answer: Unknown. That would depend on the phase out requirements of the existing contracts to include FAR 52.222-17 clause- Nondisplacement of Qualified Workers.
7. Will the new MAC contract continue to issue TOs for 1 month base periods with a single one month option where the awardee must onboard, train, qualify, etc. PSOs and transition them to a small or large business 60 days after start?
Answer: The period of performance and transition time for each task order will vary based on the specific requirement.
8. Will the Government allow tiered pricing for the MAC RFQ where if the Government procures only small, short term requirements the rate will be significantly higher than large long term TOs?
Answer: No, the Government will not allow tiered pricing.
9. Sec 12.1.2.1 Breaks – Would the Government consider eliminating the required break program and allow Vendors to develop one that works more efficiently for their program?
Answer: No, the Government will not consider eliminating breaks in order for the vendor to develop one that works more efficiently. See Statement of Work Section 12.1.2.1.
10. Sec 12.1.2.1 Breaks – Can the Government explain the logic of a 15 min break and a 30 minute lunch for 6 hour shifts. That suggests a 15 minute break after 2 hours, 45 min later a 30 minute break and then nothing for 3 hours? Would the Government consider dropping the requirement to provide lunch breaks to 6 hour shifts considering they will receive a break either at 2 hours or halfway through at three hours?
Answer: The solicitation is clear on its face. See section 12.1.2.1 of the Statement of Work. No, the Government will not consider dropping the requirement to provide the breaks as requested by the vendor.
11. Sec 12.1.2.1 Breaks – Will the Government take deductions against invoices for breaks not provided?
Answer: Yes, the Government has the ability to take deductions for non-conforming services in accordance with FAR 52.212-4. Please note that failure to provide breaks may also be annotated on the contractor's Contractor Performance Assessment Report.
12. In the instructions to Offerors, page 357, Section 3. Page limitations, the Government excludes attachment 8 Field Level Supervision from the page count. The Government provides a sample post exhibit that has proscribed supervision. Is the Government requiring/expecting an attachment 8? If so, should it be based on the sample post schedule?
Answer: See Paragraph A. 2 of this AMD which deletes the reference of Attachment 8, Field Level Supervision.
13. In the same section, in the Notice to Offerors the Government states: “Rather, the information provided in response to this factor should be detailed enough … to present the offeror’s strategy and/or innovative solutions to delivering the highest quality security services in full compliance with all contract requirements.” We recognize that the deliverables are due after post award but this statement suggests that a full proposal be condensed into 6 pages rather than the earlier statement that states: “In response to this [Management Approach] Factor, offerors shall address Staffing and participation in the DHS Mentor Protégé Program.” Can the Government please confirm that the 6 page limitation should be used to describe an offeror’s Staffing Plan and DHS MPP participation?
Answer: Yes, the Government confirms the 6 page limitation be used to describe an offeror’s Staffing Plan and DHS Mentor Protégé participation. Refer to page 229, Attachment 9, proposal checklist.
14. Will the Government identify which post(s) require NWDTP training and the level of training required?
Answer: Please see paragraph A.4 of this amendment. This updates the sample post exhibit contained within the staffing plan of the management approach with a column for the NWDTP requirements. In addition, the specific post exhibit requirements will be issued in the RFQs at the task order level, which will identify the posts that require the NWDTP training. Please also refer to Statement of Work section 6.7 for the NWDTP training requirements.
15. Will the Government provide the period of relief and frequency per day for the posts identified as requiring relief by a Relief PSO?
Answer: See section 12.1.2.1 for the break requirements, which addresses both the period and frequency of breaks.
C. All other solicitation provisions shall remain unchanged.

Multiple Award Contract (MAC)
Background
• Multiple Award Contract (MAC)-4th Iteration
• History of the MAC:
– Contract vehicle initially developed for new locations (without existing PSO workforce) in the National Capital Region (R11) o Requirements may afford very little transition time o New sites characterized by changing posts, start dates etc.
– Has been utilized for terminations, “delegated” locations and covers Washington DC as well as Virginia/Maryland
– FAR 16.505 Ordering
– Requirements range from a handful of hours to 100K plus hours
– Incumbents: American Security Programs/Paragon Systems
Expanded Scope
• Protective Security Officer (PSO) services for various locations primarily in Washington, D.C., Maryland and Virginia. May include other CONUS/OCONUS FPS protected locations.
• Contract will be used for requirements that lend themselves to unrestricted competition in Region 11 to include delegated locations.
Likely upcoming existing FPS/R11 requirements to be placed on this contract vehicle in FY19:
– HSHQEC-13-D-00017 (Centerra)-NRC Locations
– HSHQEC-13-D-00021 (Coastal International Security)-DC
Locations

• A number of existing requirements on the current MAC will remain on the contract vehicle
MAC

• Ordering Period II (FAR 52.217-8): October 1, 2023 – March 31, Evaluation Factors In addition to price, the following technical evaluation factors shall be used:

• Management Approach
• Staffing Plan
• DHS Mentor Protégé Program Participation (Large businesses only) The technical evaluation factors, when combined, are more important than price
Price Evaluation
• Using the sample post exhibit from the management approach, the sample wages/fringe benefits (no actual wage determination) and the SOW requirements, offerors will develop an hourly rate for PSO and Supervisory Services. Those hourly rates will then be multiplied out by the SF1449 hours.
– Breaks
• Price Realism o Measures the contractor’s understanding of the solicitation and assesses the performance risk inherent in the contractor’s price
Task Order Award Procedures
• Ordering Guidelines in RFP (Please read)
• An RFQ will be issued to ID/IQ holders (via email) for a specific requirement consisting of one or more sites o Task Orders will be solicited IAW FAR 16.505 (Fair Opportunity unless exception applies) o The ID/IQ holders will be permitted to quote rates lower than contract ceiling rates but cannot quote a rate higher than the applicable ceiling rate o RFQ will include applicable wage determination (s)
• Every ID/IQ holder must respond to every RFQ for Washington DC, Virginia
& Maryland requirements
• Submitting a quote on other requirements is optional based on licenses etc.
• Task orders will be awarded based on the stated evaluation criteria in the
RFQ (low price or best value)
• Contractors must have the requisite facility clearance as specified in the RFQ at the commencement of task order performance
Contractor Responsibility
• Adequate financial resources o Contractor has to be in good financial standing o Current assets cover current liabilities
• Ability to meet the delivery or performance schedule
• Satisfactory performance record
• Satisfactory record of integrity and business ethics
• Satisfactory operational controls, equipment, and facilities
• Qualified to receive an award
• No felony convictions
• Even where a contractor presents a proposal representing the best value to the government, award will not be made if the contractor is found to be non-responsible
