Immigration and Customs Enforcement (ICE) Courier Services
STATEMENT OF WORK
1. BACKROUND
The United States Department of Homeland Security (DHS), U.S. Immigration & Customs Enforcement (ICE) is responsible for the detention, health, welfare, transportation and deportation of illegal aliens in removal proceedings and aliens subject to final order of removal from the United States. ICE houses detainees in Contract Detention Facilities (CDF), Service Processing Centers (SPC), and other federal, state, local and private facilities.
The mission of the Enforcement and Removal Operations Program (ERO) is the planning, management, and direction of broad programs relating to the supervision, detention, removal, and transport of detainees who are in the United States illegally. These activities are chiefly concerned with the processing and enforcement of the administrative immigration process of detainees who have entered illegally or have become removable after admission.
The San Antonio Field Office, Enforcement and Removal Operations (ERO), a component of Immigration and Customs Enforcement has the requirement for Courier Services of sensitive documents and files to/from various locations daily as shown in the table below.
2. OBJECTIVE
The Contractor shall provide courier services to make daily pickups and deliveries to the facilities listed in Attachment A. The Contractor shall pick up and deliver documents, files or packages weighing less than forty pounds. This service shall be provided seven days a week. The courier shall retrieve A-files from the locations specified in Attachment A.
The Contractor shall provide all necessary materials, equipment, supplies, labor and transportation to perform the requirements of this contract. The Contractor shall manage the total work effort associated with the services required herein to assure adequate and timely completion of these services. Included in this function will be the full range of management duties including, but not limited to, planning, scheduling, and quality control. The Contractor shall maintain an adequate workforce to complete the work in accordance with the time and quality standards specified herein. All Contractor staff performing courier services shall be equipped with a working mobile phone at all times.
The Contractor shall obtain all licenses and permits required for the execution and completion of this work.
The Contractor shall comply will all applicable federal, state, and local laws. The Contractor shall provide a copy of their liability insurance certificate.
3. DAILY PICKUP/DELIVERY SCHEDULE
The Contractor shall provide courier services to make daily pickups and deliveries at times listed in Attachment A of this Statement of Work.
4. SECURITY REQUIREMENTS.
a. ICE Facilities are secure and entry is controlled and the security requirements for entering the facilities are as follows. These requirements are subject to change without notice and without change to the contract price.
i. All vehicles must have liability insurance and comply with all U.S. Department of Transportation Regulations.
ii. Driver of the vehicle must have valid driver's license.
iii. All other persons must have an official picture identification card.
iv. Weapons and/or alcoholic beverages are prohibited.
v. All vehicles and persons are subject to be searched.
vi. All persons entering the facility are subject to be questioned about their legal status.
vii. All Contractor employees must obtain a Contractor badge. Badges will be issued on an individual basis and may be kept until work is completed by that particular individual.
viii. All vehicles (including heavy machinery) must be secured when not in use.
ix. No vehicles with running engines will be left unattended.
x. Any type of contact with the detained population is strictly prohibited.
xi. All areas of the facility are subject to video surveillance.
b. The Contractor and all Contractor personnel shall become familiar with and comply with the entrance and exit regulations for each site location.
c. No materials shall be removed from the boxes and/or envelopes at any time. Contents of each box or envelope will be kept secure at all times and necessary precautions taken to protect against theft, loss, or damage.
d. The Government will hold the Contractor responsible for any damage to Government property due to his/her failure to comply with these specifications.
e. The Contractor shall have in place a program which assures the Government that there are adequate safeguards to protect the Government shipments from loss, damage, or theft.
f. The Contractor shall obtain the necessary building access clearances for those Contractor employees involved in picking up and delivering packages under this contract.
g. During the performance of this contract, the contractor employee is required to wear proper identification from the company contracted under this contract.
h. Contractor personnel shall be required to pass background checks as described below.
(i) GENERAL The United States Immigration and Customs Enforcement (ICE) has determined that performance of these tasks requires that the Contractor, subcontractor(s), vendor(s), etc. (herein known as Contractor) have access to sensitive DHS information, and that the Contractor will adhere to the following.
(ii) PRELIMINARY DETERMINATION ICE will exercise full control over granting; denying, withholding or terminating unescorted government facility and/or sensitive Government information access for Contractor employees, based upon the results of a background investigation. ICE may, as it deems appropriate, authorize and make a favorable expedited pre-employment determination based on preliminary security checks. The expedited pre-employment determination will allow the employees to commence work temporarily prior to the completion of the full investigation. The granting of a favorable pre-employment determination shall not be considered as assurance that a favorable full employment determination will follow as a result thereof. The granting of a favorable pre-employment determination or a full employment determination shall in no way prevent, preclude, or bar the withdrawal or termination of any such access by ICE, at any time during the term of the contract. No employee of the Contractor shall be allowed to enter on duty and/or access sensitive information or systems without a favorable preliminary fitness determination or final fitness determination by the Office of Professional Responsibility, Personnel Security Unit (OPR-PSU). No employee of the Contractor shall be allowed unescorted access to a Government facility without a favorable pre-employment determination or full employment determination by the OPR-PSU. Contract employees are processed under the DHS Management Directive 6-8.0. The contractor shall comply with the pre-screening requirements specified in the DHS Special Security Requirement – Contractor Pre-Screening paragraph located in this contract, if HSAR clauses 3052.204-70, Security Requirements for Unclassified Information Technology (IT) Resources; and/or 3052.204-71, Contractor Employee Access are included in the Clause section of this contract.
(iii) BACKGROUND INVESTIGATIONS Contract employees (to include applicants, temporaries, part-time and replacement employees) under the contract, needing access to sensitive information, shall undergo a position sensitivity analysis based on the duties each individual will perform on the contract. The results of the position sensitivity analysis shall identify the appropriate background investigation to be conducted. Background investigations will be processed through the Personnel Security Unit. Prospective Contractor employees shall submit the following completed forms to the Personnel Security Unit through the Contracting Offices Representative (COR), no less than 35 days before the starting date of the contract or 5 days prior to the expected entry on duty of any employees, whether a replacement, addition, subcontractor employee, or vendor:
1. Standard Form 85P “Questionnaire for Public Trust Positions” Form will be submitted via e-QIP (electronic Questionnaires for Investigation Processing) (Original and One Copy)
2. Three signed eQip Signature forms: Signature Page, Release of Information and Release of Medical Information (Originals and One Copy)
3. Two FD Form 258, “Fingerprint Card”
4. Foreign National Relatives or Associates Statement (Original and One Copy)
5. DHS 11000-9, “Disclosure and Authorization Pertaining to Consumer Reports Pursuant to the Fair Credit Reporting Act” (Original and One Copy)
6. Optional Form 306 Declaration for Federal Employment (applies to contractors as well) (Original and One Copy)
Prospective Contractor employees who currently have an adequate current investigation and security clearance issued by the Defense Industrial Security Clearance Office (DISCO) or by another Federal Agency may not be required to submit complete security packages, and the investigation will be accepted for adjudication under reciprocity.
An adequate and current investigation is one where the investigation is not more than five years old and the subject has not had a break in service of more than two years.
Required forms will be provided by ICE at the time of award of the contract. Only complete packages will be accepted by the OPR-PSU. Specific instructions on submission of packages will be provided upon award of the contract.
Be advised that unless an applicant requiring access to sensitive information has resided in the US for three of the past five years, the Government may not be able to complete a satisfactory background investigation. In such cases, DHS retains the right to deem an applicant as ineligible due to insufficient background information.
The use of Non-U.S. citizens, including Lawful Permanent Residents (LPRs), is not permitted in the performance of this contract for any position that involves access to DHS /ICE IT systems and the information contained therein, to include, the development and / or maintenance of DHS/ICE IT systems; or access to information contained in and / or derived from any DHS/ICE IT system.
5. PERIOD OF PERFORMANCE
The courier services shall commence on February 1, 2020 for one (1) year period of performance with four 1-year option periods.
6. INSPECTION
All services, workmanship, and material furnished or utilized in the performance of this contract shall be subject to inspection by the Government at any time during the term of the contract. All inspections by the Government shall be made in such a manner as not to unnecessarily delay the Contractor’s work.
The Contracting Officer’s representative is responsible for inspection of the Contractor’s work performance. If any service(s) performed are not in accordance with the contract requirements, the Government shall have the right to require the Contractor to correct the service(s) performed at no additional cost to the Government.
7. REPORTS
a. Daily Log. The Contractor shall keep a detailed daily log including number of A-files retrieved from each location, specific A-file numbers retrieved from each location, time of arrival and departure from each location, time of arrival at ICE ERO location, time the files turned over to ERO, and signature of ERO staff accepting the files to be submitted with the monthly report.
b. Monthly Report. The Contractor shall submit electronically to the COR by the 5th working day of the month following the month being reported a summary of the number of runs conducted in the prior month broken down by site number (location), number of files retrieved, and average number of files for the month along with copies of the daily logs for the month being reported.
8. NON-DISCLOSURE OF SENSITIVE INFORMATION
During the performance of the contract, the Contractor may have access to ‘sensitive information’ as defined in Homeland Security Acquisition Regulation (HSAR) 3052.204-71. The Contractor shall at all times protect such sensitive information. Before commencement of work under the contract, Contractor personnel shall be required to sign sensitive information non-disclosure agreements.
