About this file

This Amendment 1 to Invitation for Bid 5400026807 is issued by the South Carolina Department of Health and Environmental Control (DHEC) for Analytical Laboratory Services for Petroleum Samples. The solicitation seeks qualified contractors to provide analytical laboratory services and was originally issued with an amendment effective April 5, 2024. Offers must be submitted online at http://www.procurement.sc.gov by April 30, 2024, at 2:30 PM ET. A non-mandatory pre-bid conference was scheduled for April 3, 2024, at 10:00 AM ET via Microsoft Teams, with attendees required to email Shannon C. Hicks (hickssc@dhec.sc.gov) by April 2, 2024, at 4:00 PM ET to request access. Award notification is scheduled for May 7, 2024. Offerors must hold their bids open for a minimum of thirty (30) calendar days after the opening date.

The amendment clarifies two key contractual points: (1) contractors are not required to submit a signed Quality Assurance Project Plan (QAPP) with their bid, as the QAPP is provided for reference only to understand contract requirements, and (2) pricing terms prohibit rate increases during the initial one-year term; however, justified price increases may be requested at the beginning of the first term renewal and again at the beginning of the second term renewal, with requests must be submitted to the Procurement Officer at least ninety (90) days prior to the applicable term expiration. Preferences do not apply to this solicitation under South Carolina Consolidated Procurement Code Section 11-35-1524, Part (E)(3). Offerors must register for a South Carolina Vendor Number and acknowledge receipt of all amendments by indicating the amendment number and issue date on Page Two of the bid form.

PREFERENCES - A NOTICE TO VENDORS (SEP. 2009): On June 16, 2009, the South Carolina General Assembly rewrote the law governing preferences available to in-state vendors, vendors using in-state subcontractors, and vendors selling in-state or US end products. This law appears in Section 11-35-1524 of the South Carolina Code of Laws. A summary of the new preferences is available at www.procurement.sc.gov/preferences .

Preferences do not apply to this solicitation per the South Carolina Consolidated Procurement Code Section 11-35-1524, Part (E)(3).

AMENDMENTS TO SOLICITION (JAN 2004)

(a) The Solicitation may be amended at any time prior to opening. All actual and prospective Offerors should monitor the following web site for the issuance of Amendments: www.procurement.sc.gov (b) Offerors shall acknowledge receipt of any amendment to this solicitation (1) by signing and returning the amendment, (2) by identifying the amendment number and date in the space provided for this purpose on Page Two, (3) by letter, or (4) by submitting a bid that indicates in some way that the bidder received the amendment. (c) If this solicitation is amended, then all terms and conditions which are not modified remain unchanged. [02-2A005-1]

QUESTIONS FROM OFFERORS – AMENDMENT (JUN 2017)

This solicitation is amended as provided herein, information or changes resulting from questions will be shown in a question–and-answer format. All questions received have been reprinted below. The “State’s Response” should be read without reference to the questions. The questions are included solely to provide a cross-reference to the potential offeror that submitted the question. Questions do not form a part of the contract; the “State’s Response” does. Any restatement of part or all of existing provision of the solicitation in an answer does not modify the original provision except as follows:

underlined text is added to the original provision. Stricken text is deleted. [02-2A097-1]

Changes to Solicitation: Award will be posted on May 7, 2024.

The following prospective offeror questions and agency responses are hereby incorporated into the solicitation:

1. Regarding the QAPP. Just wanted to clarify that it was provided as reference only and that we are not and do not need to sign it anywhere and submit with our bid?

State’s Response: Contractors are not required to submit a signed copy of the QAPP as an attachment to the solicitation, the QAPP was included as a reference to the requirements in the contract.

2. In the Standard Terms & Conditions there is a statement that prohibits any rate increases. Not within the term of the first award or subsequently during term renewals. However, in the Special Terms and Conditions there is language that allows justified rate increases at the beginning of the first and again at the beginning of the second term renewal. Seemed to contradict one another.

State’s Response: Price shall not be increased during the initial 1-year term; however, a price increase may be requested after the initial term and must be received by the Procurement Officer at least ninety (90) days prior to the expiration of the applicable term.
