Justification for Other than Full and Open Competition Project #: 3PA0249

Federal Public Defender, Department of Labor, U.S. Courts – Magistrate/District/Bankruptcy, U.S. Marshals Service, U.S. Attorneys, U.S. Probation Office Johnstown, PA

1. Nature and/or description of the action being approved.

To extend the current lease agreement LPA09082, by means of a Lease Amendment, for nine (9) months, from June 1, 2013, through March 1, 2014, at the current rental rate.

2. Description of the supplies or services required to meet the agency’s needs (including estimated value).

The current agencies under this lease are in need of 24,675 ABOA square feet (28,377 rentable square feet) in Johnstown, PA. Their current lease expires May 31, 2013. <redacted>

The current lessor has agreed to extend the lease for nine (9) months at the current rate and terms.

The estimated value of this action is as follows:

Soft Term: <redacted> x 28,377 rsf = $579,686.76 (Annual Rent) x 9 months = $434,765.07

Total Contract Value

3. Identification of the statutory authority

41 U.S.C. 253 (c) (1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.

4. Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires use of the authority cited

GSA is currently working on the long term requirement for this lease. The project to do so is in progress but requires additional time because there has been a delay in determining the security requirements in conjunction with FPS. An extension is necessary to avoid holdover and will be provided at the current rental rate and terms.

5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable

In order to maximize competition <redacted> was searched for available properties and <redacted> market data was used for price comparison purposes.

The market research identified <redacted> potential buildings within the delineated area that could satisfy the requirement. Relocation of these agencies would not be practical in this situation.

6. Determination by the contracting officer that the anticipated cost to the government will be fair and reasonable

The anticipated cost of performing an extension lease action is fair and reasonable. Please see attached cost-benefit analysis for an outline of this anticipated cost.

The current rental rate at this location is within market comparisons.

7. Description of the market research conducted

See attached market research and cost-benefit analysis.

8. Other facts supporting the use of other than full and open competition

All agencies within this current lease have stated that the current location is satisfactory and that they wish to remain. The tenant satisfaction survey results from 2009 were 85% overall satisfaction. The GSA field office has indicated that this lessor is responsive to requests and has an overall satisfactory history of past performance. Remaining in the current location will allow the agency to continue their mission without any disruption.

9. List of any sources that expressed in writing an interest in the acquisition

No source has expressed, in writing, an interest in the acquisition.

10. Statement of actions the agency may take to remove or overcome any barriers to competition

At the end of the proposed lease term, a fully competitive leasing action, if appropriate, will be initiated.
